Abstract

Al-Qur’ân  al-Karîm  di  turunkan  bertahap,  mulai  dari  satu  hingga  sepuluh  ayat, berfungsi sebagai jawaban terhadap permasalahan yang muncul ke permukaan, sekaligus memenuhi  keinginan  ummat.  Ketika  turun  ayat,  sahabat  segera  menghafal,  memahami sekaligus mengamalkan. Tujuan al-Qur’ân di turunkan bertahap adalah menetapkan hati sekaligus mengawal missi Nabi SAW dan juga sahabatnya, sekaligus mempelajari hukum,mengenal sistem serta bersikap dengan akhlaq al-Qur’ân. Selain itu, tujuan yang paling urgen adalah bertahap dalam penerapan hukum. pengertian at-Tadarruj “melalui suatu tempat  setahap  demi  setahap”,  yang  kemudian  lebih  familiar  dipakai  dalam  kaitannya dengan hukum-hukum Allah SWT, berupa perintah dan larangan serta halal dan haram. Hal itu terangkum dalam beberapa hal, seperti kaitannya dengan Iman yang di haramkan bercengkerama  dengan  orang  yang  belum  beriman,  berkenaan  dengan  ibadah  seperti Shalat dan Puasa, mu’amalat seperti pengharaman riba, jinayat seperti qhishas dan juga hukuman bagi pelaku zina, larangan seperti mengkonsumsi khamar, perintahNya seperti Jihad. at-Tadarruj telah berdampak terhadap kehidupan ummat dari berbagai sisi, seperti edukasi, psikologi dan juga sosial. Hal itu terangkum dalam rahmat Allah terhadap ummat ini yang mengayomi kondisional dan adat istiadat saat itu sehingga mereka tidak lari dari Islam, akan tetapi mencintainya sehingga termasuk dalam keluarga besar Islam.نزل القرآن الكريم آية آية مفرقا حتى عشر آيات على الأكثر إجابة على الوقائع والقضايا والطلب التي تقع على المسلمين. وإذا نزلت الآيات فسارع الصحابة على حفظها وفهم معانيها والعمل على حكمها. والقصد من إنزاله منجما تثبيت فؤاد النبي ( ص ) وأصحابه، كما كان التعليم من أحكامه والتنظم بأحواله والتخلق بأخلاقه، وأبرزه هو التدرج في التشريع. والتدرج هو المواضع التي يمر عليها السيل شيئا فشيئا. ثم عرف مصطلاح التدرج على التشريع من أوامره ونواهيه والحلال والحرام التي تطبق الله تعالى على الأمة تدريجيا. وأجمالا، منها: تتعلق في شؤون الإيمان مثل تحريم موالاة المسلمين للكافرين، وفي شؤون العبادات مثل الصلاة والصوم، المعاملات مثل تحريم الربا، الجنايات مثل القصاص في القتلى وعقوبة الزنا، وفي نواهيه مثل تحريم الخمر، وبأوامره مثل الجهاد. تنجيم القرآن الكريم وتدريج تشريعه قد تؤثر على قلوب الأمة على صعيد التربوية، وناحية الاجتماعية، وناحية النفسية، وخلاصة هذا الأثار ما هي إلا بيان رحمة الله بهذه الأمة، حيث أن الله سبحانه وتعالى يراعي أحوال الناس وعاداتهم ويتدرج معهم رحمة بهم حتى لا ينفروا من الإسلام، بل يحببهم به حتى يكونوا من أهله.

Abstract

Islam memperhatikan dan memelihara lima hak dasar dalam syari’atnya. Yaitu: memelihara agama, jiwa, akal, keturunan dan harta. Pelanggaran terhadap lima hak dasar ini akan dianggap sebagai tindak pidana dan kriminal yang layak untuk mendapatkan hukuman yang setimpal. Sebagian Organisasi Ilmiah, Sosial, yayasan asing, dan lembaga non pemerintah (NGO), salah satunya Yayasan Amnesty International melihat, bahwa Hukum-hukum syara’ bertentangan dengan Hak Azazi Manusia serta menuntut membatalkan hukum pancung (Qishas). Sumber tuntutan yang mencurigakan ini hanya satu, yaitu intoleransi dan resistance terhadap islam yang disebabkan ketidak tahuan yang jelas terhadap hukum syara’, justifikasi dan realitasnya. اعتىن اإلسالم حبفظ الضروريات اخلمس اليت اتفقت الشرائع اإلهلية على حفظها، وهي: حفظ الدين والنفس والعقل واألنساب واملال، واعترب التعدي عليها جناية وجرمية تستحق عقابا مناسبا. وترى بعض اجلهات العلميات واالجتماعيات واملؤسسات األجنبيات، واملنظمة غري احلكومي، أحدها منظمة العفو الدولية، أن احلدود الشرعية تتناىف مع حقوق اإلنسان، وتطالب بإلغاء عقوبة اإلعدام. ومصدر هذه املطالبات املشبوهة شيء واحد وهو التعصب ضد اإلسالم ومقاومة االجتاه اإلسالمي، بسبب اجلهل البني باحلكم الشرعي ومسوغاته وحقيقته.

Abstract

كان القرآن الكريم مليء بالأخبار الموضوعي مثل قصص الأنبياء والأمم بصورة مجملة ومقتصرة، عظة واعتبارة للأمة الإسلامية، ومن بينها قصص بني إسرائيل واليهود. وقصص الأنبياء والأمم التي تناولتها القرآن الكريم قد تناولتها أيضا التوراة. وبعد دخول كثير من الرهبان اليهودي إلى الإسلام، ميل نفوس بعض الصحابة تفاصيل القصة في القرآن وسألوهم ذلك. وكذلك التابعون من أصلهم رهبان اليهود والنصارى دخلوا إلى الإسلام وتحدثوا إلى الناس تفاصيل القصص في القرآن معتمدا ومستندا على التوراة والإنجيل حتى نقل أقوالهم وسجل في الكتب المتنوع وتدخلت في كتب التفسير. أسماء أصحاب الكهف، واسم كلبهم، واسم الملك الظالم في زمنهم، وطول نومهم من الأمثال الرواية التي تجد في التورة والإنجيل ولم يذكر في القرآن الكريم أو الحديث النبوي صلى الله عليه وسلم. وتقسيم روايات إسرائيليات باعتبار حكم إسلامي إلى ثلاثة أقسام، وهي ما وافق، وما خالف، وما سكت عنه الشرع. فعلى كل الباحث أن يحققها حتى لا تحتلط بالرواية الصحيحة التي كانت مصدرها القرآن الكريم والسنة رسول الله صلى الله عليه وسلم.

Abstract

This article aimed to map the literature of Quran exegesis prevailing for Sunni.There are seven literatures classified as a tafsir bi al matsur, and four of themelaborated as comparison, namely Adhwa al Bayan fi Iydhah al Quran bi alQuran of asy Syinqithi, Jami al Bayan fi Tawil al Quran of Ibnu Jarir alThabari, Tafsir al Quran al Adzhim of Ibnu Katsir and al Dar al Mantsur fiat Tafsir bi al Matsur of Imam Suyuthi. The historical study and methodologyare the main subject of this literatures research using library approach. Theresearch show that there are some excellence and weakness of each literatures ifthey are viewed by methodology aspect. But according definition of al Matsur,the most valid (mutamad) literature is Adhwa al Bayan fi Iydhah al Quran bial Quran. Whereas according to turats and seniority of writer, the most validliterature is Jami al Bayan fi Tawil al Quran. The third position is Tafsir alQuran al Adzhim, as a resume of Jami al Bayan fi Tawil al Quran. And thelast position is al Dar al Mantsur fi at Tafsir bi al Matsur, because its sanadvalidation only pin up the closest of rawi.

Abstract

The existence of sharia cooperatives (kopsyah) in Indonesia is relatively new. There are two main pillars of sharia cooperative management, namely social functions (baitulmaal) and business functions (baitut tamwil). The problem that arises in kopsyah in Surabaya is that there is an imbalance in the management of profit-oriented business functions that tend to be dominant compared to their social functions. The factors that caused the weakness of the Baitulmmaal function in Surabaya, the first factor was dominated by management factors, the second factor was more influenced by manpower  and environment, while the environmental factors were influenced by the variables the existing muzakki in the kopsyah environment and the unavailability of a juridical basis for kopsyah to manage ZIS funds. Mentoring that the author did on Kopsyah Benefits of Surabaya is conducting training and assistance in the collection and utilization of ZIS and endowments of money to the management staff of Baitulmaal. Keberadaan koperasi syariah (kopsyah) di Indonesia relatif masih baru. Terdapat dua pilar utama pengelolaan koperasi syariah yaitu fungsi sosial (baitulmaal) dan fungsi bisnis (baitut tamwil). Masalah yang muncul pada kopsyah di Surabaya adalah adanya ketimpangan pengelolaan fungsi bisnis yang berorientasi laba cenderung dominan dibandingkan dengan fungsi sosialnya. Faktor-faktor yang menyebabkan lemahnya fungsi baitulmaal di Surabaya, faktor pertama didominasi oleh faktor manajemen, faktor kedua lebih banyak dipengaruhi oleh manpower (SDM) dan environment (lingkungan), sedangkan faktor lingkungan dipengaruhi oleh variabel tidak dilakukannya penggalangan dana dari para muzakki yang ada dilingkungan kopsyah serta belum tersedianya landasan yuridis bagi kopsyah untuk mengelola dana ZIS. Pendampingan yang penulis lakukan pada Kopsyah Manfaat Surabaya adalah melakukan training dan pendampingan pemghimpunan dan pendayagunaan ZIS dan wakaf uang terhadap SDM pengelola baitulmaal.

Abstract

A discourse on justification of radical act faked as jihad based on Fakhr al-Dîn al-Râzî’s perspective is the cause of this study. The question is “How is al-Râzî’s opinion on verses used to justify radical acts which are faked as jihad?” This study uses the perspective of Fakhr al-Dîn al-Râzî’s Tafsîr bi al-Ra’yi. This is a library research employing qualitative explorative paradigm. All data are in the form of documentation; primary data are from Mafâtîḥ al-Ghayb and book entitled Aku Melawan Teroris as well as other secondary data. The study shows, first: jihad and its meaning are relevant with the period of Quran revelation to date and theologically they will also be relevant in the future; nothing changes from jihad’s concept and substance except the situation and condition. Second, there are five verses in Quran becoming the justification basis of radical acts in the name of jihad i.e. Q.S. al-Tawbah [9]: 5, Q.S. al-Tawbah [9]: 14, QS al-Tawbah [9]: 36, Q.S. Anfâl [8]: 39, and  Q.S. al-Baqarah [2]: 191; yet it is contra productive for al-Râzî. Through this study, al-Râzî’s tafsîr model is expected to be a formula and new opinion to deeply comprehend, contextual wise, the meaning of those verses.

Abstract

The community is all actors in the institutional context referred to as potential stakeholders. That is the group that has the decisions to be made regarding the educational agenda and the organizations that participate in the educational decision process. The school's relationship with the community aims to : 1) Advancing the quality of learning and children's growth, 2) Strengthening goals and improving the quality of life and livelihoods of the community, and 3) Encouraging the community in establishing relationships with schools. The function of the community in education is as a source that provides students, teachers, facilities and infrastructure in school administration. In addition, the community is also a consumer of the results of school education, who receives back and provides employment for school graduates, then as participants in the education process at school, who continuously follows and influences the education process in schools. Some of the surahs in the Qur'an that allude to society and educational institutions or world developments are: 1) QS. al Fath : 48:8, 2) QS. al Maidah: 5:2 dan 67, 3) QS. adz Dzariyat: 51:55.

Abstract

Mediation as an alternative dispute resolution has its advantages. However, behind the advantages of dispute resolution, it is inversely proportional to the data on the success of mediation in Indonesia which is very low. Based on statistical data from the Semarang Religious Court during 2015-2019, less than 3% of mediations were successful. However, the data on the success of mediation in Indonesia contradicts that of Turkey. During 2017, more than 80% of cases were successfully resolved through mediation. Based on this data, it is necessary to compare the implementation of mediation between Indonesia and Turkey. This research is included in normative juridical research with a qualitative comparative approach. The results of this study indicate that there are similarities and differences in the implementation of mediation between Indonesia and Turkey. The equation lies in the terms of the mediator, the number of mediators and the place. The difference lies in regulation, mediation time, disputes that must be mediated, mediation implementation, mediator title, mediation fees, mediator audit, mediator membership fees and the strength of the peace deed

Abstract

As a result of not implementing the voluntary child custody decision, the next legal remedy is the execution of child custody which can have a negative impact on the child's psyche. As a solution to this problem, the judge can decide on the dwangsom in the child custody decision. However, dwangsom becomes a legal problem when it is not contained in the petitum but appears in the ruling as stated in the decision Number 8/Pdt.G/2020/MS-BNa. The focus of this research is a juridical review and analysis of Aristotle's theory of justice on the application of dwangsom to the decision. This research is a normative juridical research using a law approach and a case approach. The primary legal source is decision Number 8/Pdt.G/2020/MS-BNa. and secondary sources of law, namely laws relating to the procedural law of the Religious Courts, books and journals related to Aristotelian justice, child custody, ultra petita and dwangsom principles. The data of this study were obtained through documentation and analyzed by Aristotle's theory of justice. The results of the juridical review on the decision contradict Article 178 paragraph (3) HIR / Article 189 paragraph (3) RBg, Article 50 Rv, SEMA Decision Number 3 of 2018, and Jurisprudence number 1001 K/Sip/1972. The judge's considerations in deciding the case Number 8/Pdt.G/2020/MS-BNa have met the criteria of Aristotle's corrective justice, namely there is a violation of rights that should be obtained, there are efforts to correct (return) rights, losses can be measured, corrections can be measured, and on a proportional basis.

Abstract

Muhammad bin Abdul Wahhab created a da'wah movement to purify Islamic doctrines. With this movement, he invited all Muslims to return to the Qur'an and Sunnah by the understanding of the Sahabah. This research is qualitative, using an analytical descriptive method and a normative juridical approach. This study aims to find out who Muhammad bin Abdul Wahhab was, how his doctrines, epistemology, and thoughts were in Islamic law, and how the term "Wahhabi" developed. and the results, Muhammad bin Abdul Wahhab was a very influential scholar in Saudi Arabia, especially in da'wah and Islamic law. Until now, his doctrines and thoughts have spread to various countries including Indonesia. He came from the tripe of sahabah who one of the beloved sahabah's of the messenger. His full name is Muhammad bin Abdul Wahhab bin Sulaiman bin 'Ali bin Muhammad bin Ahmad bin Rashid Al Wuhaibi At Tamimi. In the field of Islamic law, especially in the chapter on worshiping Allah, according to him, Islamic law can only be implemented and obeyed if there is a clear legal basis from the Qur'an and Sunnah by the understanding of the Companions. The term "Wahhabi" was assigned to him and his followers because of the similarity in his method of preaching with the real Wahhabi, Abdul Wahhab bin Abdurrahman bin Rustum, a Khowarij Ibadhiyah figure who lived in Morocco.
