Abstract

Partisipasi masyarakat adalah perwujudan dari masyarakat di dalam negara demokrasi, dimana pemerintahan yang di dasarkan kepada rakyat merupakan tujuan utama kehidupan berpolitik, baik dalam kebijakan maupun dalam tujuan pemerintahan. Perda Label Batik Pekalongan merupakan peraturan daerah yang mengatur tentang suatu tanda yang menunjukkan identitas dan ciri batik buatan Pekalongan yang terdiri dari tiga jenis yaitu batik tulis, batik cap atau batik kombinasi tulis dan cap. Tujuan dibentuknya Perda tersebut adalah agar masyarakat dan konsumen Batik Pekalongan tidak dirugikan akibat dari salah dalam membedakan jenis batik. Hasil penelitian ini menunjukan bahwa partisipasi masyarakat dalam pembentukan Perda tentang penggunaan label batik Pekalongan masih bersifat elitis, karena yang mendominasi mengikuti public hearing hanya pengusaha kelas atas yaitu seseorang atau kelompok orang yang memproduksi seni batik dalam bentuk tulis, cap dan kombinasi dalam jumlah besar, sudah mempunyai nama merek yang terkenal, dan pemasarannya sudah sangat luas baik di dalam negeri maupun di luar negeri. Partisipasi masyarakat dalam pembentukan perda tentang label batik pekalongan yang masih bersifat elitis dapat berpengaruh karakteristik produk hukum yang di hasilkan yaitu lebih menguntungkan pengusaha batik kelas atas, karena dalam pembuatan label batik Pekalongan merugikan dalam segi ekonomis bagi  pengusaha kelas menengah dan bawah.Community participation is the embodiment of the people in a democracy, where the government is based on the people as the ultimate goal of political life, both in policy and administration purposes. Label the Perda Batik Pekalongan local regulation of Batik Pekalongan Label is a sign which indicates the identity and characteristics of batik from Pekalongan which consists of three types of batik, batik or batik and stamp combination. Purpose of the establishment of the regulation is that the public and consumers are not harmed Batik Pekalongan result of incorrect in distinguishing the types of batik. The result of this research indicates that participation in the formation of legislation on the use of Pekalongan batik label still elitist, because that dominate following the public hearing only top-class entrepreneurs is a person or group of people who produce batik art in written form, stamp and combinations in bulk, already has a well-known brand names, and marketing has been very widely both domestically and abroad. Public participation in the formation of regulations about labeling Pekalongan batik is still elitist may influence the characteristics of a legal product that produced batik entrepreneurs are more favorable upper classes, as in the manufacture of Pekalongan batik label in terms of economic harm to employers middle and lower classes.

Abstract

Hak asasi adalah Hak yang melekat secara kodrati pada setiap mahluk yang dilahirkan dengan sosok biologis manusia. Salah satu hak asasi sipil dan politik  adalah  hak untuk memeluk dan melaksanakan ibadah dari agamanya tersebut. Di Indonesia, kebebasan untuk beragama dan berkeyakinan diatur dalam Pasal 28 E angka 1 dan 2 Undang-undang Dasar 1945. Penelitia ini bertujuan untuk menganalisis kebijakan kriminalisasi delik penodaan agama dalam  KUHP  dan UU No. 1/PNPS/1965?. Hasil penelitian ini menunjukkan bahwa delik penodaan agama diatur dalam Pasal 156a KUHP dan Pasal 1 UU No. 1/PNPS/1965. Pasal 156a KUHP pada pokoknya mengatur tentang tindak pidana penodaan agama yang  dengan maksud agar supaya orang tidak menganut agama apapun juga, yang bersendikan Ketuhanan Yang Maha Esa, sedangkan ketentuan Pasal 1 UU No. 1/PNPS/1965 mengatur mengenai penafsiran agama/kegiatan keagamaan yang menyimpang dari pokok-pokok ajaran agama itu. Selain KUHP Indonesia. Pasal 156a KUHP Indonesia yaitu melindungi perasaan masing-masing warga negara /penduduk yang memeluk suatu agama atau keyakinan tertentu. Perbedaannya terletak pada perumusannya. Konsep KUHP telah menyempurnakan rumusan Pasal 156a KUHP dengan merumuskan tindak pidana-tindak pidana yang tergolong dalam tindak pidana penodaaan agama dan kehidupan beragama. Namun mengingat Pasal 1 UU No. 1/PNPS/1965 yang mengatur mengenai penafsiran agama/kegiatan keagamaan yang menyimpang dari pokok-pokok ajaran agama itu, dipertahankan oleh putusan Mahkamah konstitusi, sebaiknya ketentuan pasal ini juga diintegralkan dalam tindak pidana penodaaan agama dan kehidupan beragama yang dirumuskan di dalam Konsep KUHP. Human rights is rights inherent by nature in every being is born with a biological human figure. One of the civil and political rights is the right to profess and practice their religion from the religion. In Indonesia, freedom of religion under Article 28 E numbers 1 and 2 of Act of 1945. This research is intended to analyze the policy of criminalization of blasphemy offense in the Criminal Code and Law No. 1/PNPS/1965? 2) . The result of this study reveals that the offense of blasphemy under Article 156a of the Penal Code and Article 1 of Law no. 1/PNPS/1965. Article 156a of the Criminal Code in principle regulate crime of blasphemy in order so that people do not adhere to any religion, who jointed Belief in God Almighty, while the provisions of Article 1 of Law no. 1/PNPS/1965 governs the interpretation of religion / religious activities that deviate from the main points of religious doctrine. In addition to Indonesia’s Criminal Code. Article 156a of the Criminal Code Indonesia which protect each other’s feelings citizens / residents who embrace a particular religion or belief. The difference lies in the formulation. The concept of the Criminal Code has been perfecting the formulation of Article 156a of the Criminal Code to formulate crime-crime offenses classified in penodaaan religion and religious life. But considering Article 1 of Law no. 1/PNPS/1965 which governs the interpretation of religion / religious activities that deviate from the main points of religious doctrine, the Court’s decision is maintained by the constitution, this section should also integrable in criminal penodaaan religion and religious life were formulated in the concept of the Criminal Code.

Abstract

The purpose this research were to find out and analyze the form of the State of Ukraina accountability in shooting MH17 Malaysia Air Lines aircraft and knowing and analyzing the accountability of MH17 Malaysia Air Lines airliners to passengers. The type of research used is a type of normative legal research, the approach in this study is the law approach, case approach, and historical approach, the sources of legal material used are primary, secondary and tertiary legal materials. Legal material collection techniques used with document study techniques and legal materials are evaluated, interpreted, argued and discussed descriptively. The results of the study show (1) the responsibility of the Ukraina for Malaysia Air Lines MH17 Aircraft Shooting that the State of Ukraina must be responsible for providing safety and security services for the sovereignty of the air space over its territory by Malaysia Air Lines MH17 in the form of flight navigation services, (2) The Malaysia Airlines airline must be limited to 100,000 SDR for each passenger and Malaysia Airlines. The airline cannot be subject to unlimited liability or exceed 100,000 SDR. Every country is expected to always supervise the airspace which is the sovereignty of the airspace above which becomes the international civil aviation route and to coordinate well with the ICAO (International Civil Aviation Organozation) to maintain the security of international civil aviation.

Abstract

This research is intended to determine the authority possessed by the forestry police related to the crime of forest occupation and how far the implementation of the authority in the process of settling the case of the crime of forest occupation. This research is an empirical law study, by conducting interviews, direct observation, and literature study. The problem of forest occupation in the area of Alas Purwo National Park is a long-standing problem that can not be solved sooner which can lead to reduced protected areas and disrupt natural ecosystems that already exist around the site of the forest occupation. The existence of citizens who have been found guilty by the court violated Article 78 paragraph (2) jo. Article 50 paragraph 3 sub-paragraph of Law Number 41 of 1999 on Forestry jo. Article 55 paragraph (1) of the Criminal Code (KUHP) related to illegal criminal acts of forest occupation but until this day they still occupy the jungle zone of Alas Purwo National Park area also can disrupt the duties of the forestry police in its efforts to secure the forest. Besides due to the lack of public awareness of the importance of forest existence, the settlement process of forest occupation is also constrained by internal factors of forestry police, namely the understanding of the forestry police on the extent of their authority.

Abstract

Tourism is one of the sources of Original Regional Revenue that is quite promising, when it is managed professionally. With regard to funds, the presence of foreign investment is a very possible solution. From the collected data, in the Regency of Magelang, the presence of foreign investors in tourism is still very little, while such potential is wide open for development. For this reason, this research is entitled "The Policy of the Regional Government of Magelang Regency towards Foreign Investment in Tourism". This study aims to find out how the Regional Government Policy of Magelang Regency in regulating foreign investment in the tourism sector as well as knowing its implementation and also the driving factors and obstacles in the implementation of foreign investment cooperation in tourism.This study is a normative juridical study that uses primary data, secondary data and tertiary data. Data collection is done using library research techniques, observation, interviews and online data search.Based on the results of this study indicate that the Regional Government Policy of Magelang Regency to increase foreign investment, especially in the tourism sector, is still very lacking because there are few foreign investors who invest in Magelang Regency. Based on the driving factors and constraints that exist, the prospect of foreign investment manifested by Magelang Regency Tourism towards the labor sector is very promising because it can open opportunities for employment opportunities for the people of Magelang Regency, and improve the economy in Magelang Regency. Abstract

This paper focuses on the sovereignty of the state and its influence on the implementation of ASEAN cooperation mechanisms in combating terrorism.State sovereignty tends to obstruct the counter-terrorism effort. The difficulty of gaining consensus has temporarily encouraged member countries to enable bilateral or trilateral framework options, which are less productive of regional insight development efforts. The consensus mechanism causes in any degree the handling of terrorism issues in ASEAN will only be possible if the parties agree. This is what then makes the implementation of the agreement in ASEAN to be slow and even not run.

Abstract

Artikel ini membahas masalah pengelolaan keuangan desa terpadu yang harus dilaksanakan oleh pemerintah desa untuk menghindari terjadinya korupsi. Hal tersebut penting untuk memahami permasalahan pengelolaan keuangan desa yang terjadi. Metode penelitian yang digunakan yakni  metode penelitian yang bersifat yuridis-normatif dengan mengambil contoh kasus korupsi pengelolaan dana desa di Simalungun, Mojokerto, Magetan, dan Ciamis. Hasil penelitian menunjukkan bahwa keuangan desa adalah termasuk keuangan negara. Pasal 93 ayat (1) PP No. 43 Tahun 2014 tentang Peraturan Pelaksana UU No. 6 Tahun 2014 tentang Desa menentukan Perencanaan, Pelaksanaan, Penatausahaan, Pelaporan dan Pertanggungjawaban harus dilakukan dalam mengelola keuangan desa terpadu. Pengelolaan keuangan desa terpadu menurut Kerugian keuangan negara yang terjadi di empat desa tersebut merupakan kesalahan pengelolaan keuangan negara. Asas pengelolaan keuangan desa yaitu transparansi, akuntabilitas dan partisipatif harus diterapkan oleh pemerintahan desa dalam pengelolaan keuangan desa untuk mencegah terjadinya kerugian keuangan negara. Risiko keuangan desa yang diprediksikan oleh BPKP berpotensi mengakibatkan kerugian keuangan negara. Prediksi tersebut seharusnya ditindaklanjuti dengan memperketat sistem pengawasan kepada kepala desa serta perangkatnya dalam mengelola keuangan desa, kerja sama beberapa kementerian diantaranya Kementerian Keuangan, Kementerian Desa dan Transmigrasi, Kementerian Dalam Negeri, dan perlu dilakukan untuk mencegah terjadinya kerugian keuangan negara.This article discusses the problem of integrated village financial management that must be carried out by the village government to avoid corruption. This is important to understand the problems of village financial management that occur. The research method used is a juridical-normative research method by taking examples of corruption cases of village fund management in Simalungun, Mojokerto, Magetan and Ciamis. The results of the study show that village finance is part of state finance. Because regional finance is a part of state finance. Integrated village financial management based on Article 93 paragraph (1) of Government Regulation Number 43 of 2014 concerning Implementing Regulations Law Number 6 Year 2014 concerning Villages includes Planning, Implementation, Administration, Reporting and Accountability. The state financial losses that occurred in the four villages constituted a mistake in managing state finances. The principle of village financial management, namely transparency, accountability and participatory must be applied by the village government in managing village finance to prevent the loss of state finances. Village financial risks predicted by the BPKP have the potential to result in state financial losses. The prediction should be followed up by tightening the supervision system to the village head and its instruments in managing village finance, coordination between the finance ministries, the interior ministry and village ministries & transmigration needs to be done to prevent the loss of state finances.

Abstract

Artikel ini memiliki fokus terhadap studi David S. Powers tentang hukum kewarisan Islam dan implementasinya di dunia muslim. Sebagai studi kasus, penulis mengangkat topik materi hukum kewarisan Islam yang terhimpun dalam Kompilasi Hukum Islam (KHI). Salah satu tesis yang dihasilkan Powers dari studinya mengatakan bahwa masyarakat muslim saat ini sebenarnya tidak memiliki pembacaan dan pemahaman yang tepat atas beberapa ayat al-Qur’an dan hadis atau sistem waris yang diterima oleh Nabi Muhammad. Apa yang dikonsepsikan dan dilakukan oleh masyarakat muslim berkaitan dengan kewarisan pada dasarnya merupakan buah dari dialektika antara aturan kewarisan dalam al-Qur’an dan hadis dengan realitas sejarah itu sendiri yang disebut farā’iḍ. Demikian halnya dengan KHI, materi-materi hukum yang termaktub dalam pasal per pasalnya jamak yang tidak sejalan dengan realitas redaksional teks al-Qur’an maupun hadis. Materi-materi hukum dalam KHI jamak didasarkan pada farā’iḍ, yang sudah barang tentu syarat dengan dinamika kesejarahan. Oleh sebab itu, KHI tidak lagi dapat menjawab problem-problem kontemporer yang terus berkembang.

Abstract

Konsep keseimbangan menjadi ide pembaharuan dalam hukum pidana saat ini. KUHP yang berlaku selama ini masih belum mampu memberikan keadilan dikarenakan masih berorientasi pada nilai-nilai hukum kolonial, belum bersumber pada Pancasila. Penelitian ini adalah penelitian hukum dengan menggunakan tipe penelitian doktrinal dengan pendekatan perundangan serta pendekatan konsep. Pada akhirnya, dalam memaknai hukum yang berkeadilan harus memiliki konsep keseimbangan yang diharapkan mampu menjadi solusi. Asas keseimbangan dalam tujuan pemidanaan adalah untuk membina pelaku dan membebaskan rasa bersalah pelaku, disamping itu juga bertujuan untuk mencegah dilakukan tindak pidana dengan menegakkan hukum, menyelesaikan konflik yang ditimbulkan oleh tindak pidana, memulihkan keseimbangan dan mendatangkan rasa damai dalam masyarakat.The concept of balance is a renewal idea in the current criminal law. The Criminal Code that has been in force so far has not been able to provide justice because it is still oriented to the values of colonial law, not yet based on Pancasila. This research is legal research using the type of doctrinal research with the legislative approach and the conceptual approach. In the end, in interpreting the law with justice, it must have a concept of balance that expected to be a solution. The principle of balance in the goal of punishment is to foster the perpetrators and free the guilty while also aiming to prevent criminal offenses by enforcing the law, resolving conflicts caused by criminal acts, restoring balance, and bringing a sense of peace in society.

Abstract

Menghindari terjadinya putusan kepailitan oleh pengadilan dengan suatu putusan hakim yang berkekuatan hukum tetap, maka akan dilakukan suatu upaya hukum yang dapat menyeimbangi keberadaan dan fungsi kepailitan itu sendiri, yaitu dengan dilakukannya Penundaan Kewajiban Pembayaran Utang (PKPU).  Debitor yang tidak dapat  melanjutkan membayar utang-utangnya yang sudah jatuh waktu dan dapat ditagih, dapat mengajukan permohonan  PKPU dengan maksud untuk mengajukan rencana pembayaran utang    yang selanjutnya mengajukan rencana perdamaian yang meliputi tawaran pembayaran seluruhnya atau sebagian utang kepada para kreditor. Metode penelitian yang digunakan adalah metode penelitian hukum yuridis normatif,  pendekatan yang digunakan di dalam penelitian hukum adalah pendekatan undang-undang (statute approach), dan pedekatan kasus (case approach). Hasil dan Pembahasan adalah PKPU yang diajukan oleh Pemohon PKPU dikabulkan dan telah berada dalam PKPU Sementara selama 45 hari, dan rencana perdamaian dan PKPU Tetap disetujui oleh kreditor maka pengadilan niaga menetapkan PKPU Tetap selama 30 hari. Rencana perdamaian disetujui akibat hukum yang ditimbulkan adalah mengesahkan perjanjian perdamaian dan PKPU demi hukum berakhir dan debitor atau pemohon PKPU untuk membayar biaya perkara sebesar Rp 1.427.000 (satu juta empat ratus dua puluh tujuh ribu rupiah).Prevent the incidence of bankruptcy decisions by a court of a judicial decisions to be fixed set of laws , it will be done a legal remedy that can be menyeimbangi the availability and function of bankruptcy it self , namely by doing suspension of debt payment obligation (PKPU). In which cannot estimate that he did not be able to continue their pay its debts they fall time and can charged , any PKPU with a view to propose plans payment of a debt with a view to propose plans peace which includes bid payment wholly or in part debt to creditors. Research methods that were used of these tests are research methodology of juridical law normative , the approach that was used with our research law is the statute approach , and  case approach  .The results and of discussion to be addressed is pkpu that had been requested by the applicant for pkpu granted to you has been in pkpu in it 45 the day , and the plan of just and peaceful society and that it should remain consistent pkpu firm assets as agreed on by a creditor so the commercial court shall at reach an agreement on fixing pkpu a perpetual 30 the day .The home grown peace plan accepted by the bank if as a result of law that were brought about is legalize the peace agreement and pkpu for the sake of law had ended and debitor or an applicant pkpu to pay the legal costs as much as Rp 1.427.000 ( one million four hundred twenty seven rupiah thousands to ) .
