Abstract

AbstractRape crime is a form of crime against women. In its development, this crime can no longer be seen as merely moral offence, however it had touched the problem of anger and violence considered as violation and denial against human rights. Considering this development, the Drafting Team of KUHP Barn should change the formulation of rape crime law, the definition of which no longer exists in the article 285 of KUHP (penal code) but it should be extended in order to be consistent with development and future condition. Through policy or penal code politics, the more adequate law formulation about rape crime would be achieved, consistent with the time condition. AbstrakTindak pidana perkosaan merapakan salah satu bcntuk kejahatan kekerasan terhadap wanita. Dalam perkembangannya tindak pidana ini tidak lagi dilihat sebagai persoalan moral semata-mata (moral offence), namun di dalamnya sudah menyentuh pada masalah anger and violence yang dianggap merupakan pelanggaran dan pengingkaran HAM. Mendasarkan perkembangan ini Tim Perancang KUHP Baru memandang perlu untuk mengubah rumusan tindak pidana perkosaan, yaitu tidak lagi pengertiannya seperti yang ada dalam rumusan Pasal 285 KUHP tetapi diperluas sesuai dengan perkembangan dan keadaan di masa mendatang,. Melalui kebijakan atau politik hukum pidana dapat dicapai rumusan tindak pidana perkosaan yang lebih memadai dengan keadaan zaman.

Abstract

AbstrakPenelitian ini bertujuan untuk mengetahui berbagai masalah yang timbul dalam penyelesaian kasus pidana, dan bagaimana pandangan penegakan hukum terhadap hukum acara pidana di Indonesia dalam memberikan keadilan. Penelitian ini adalah penelitian hukum empiris dengan menggunakan metode kualitatif yang menekankan pada observasi lapangan, dan data dianalisis dengan cara non-statistik. Teknik pengumpulan data dilakukan dengan studi pustaka, observasi, wawancara, dan focus group discussions (FGD). Informan dipilih berdasarkan tujuan penelitian. Data yang terkumpul kemudian divalidasi dengan triangulasi data dan dianalisis menggunakan model analisis interaktif. Hasil penelitian menunjukkan bahwa 1) Sistem peradilan pidana belum mampu memberikan keadilan bagi korban dan pelaku 2) penegakan hukum masih terlalu kaku dalam menerapkan secara penuh aturan normatif, termasuk dalam kasus-kasus tertentu, bahkan yang kerugian sangat kecil.Kata Kunci : Pidana, Keadilan, Restorative JusticeAbstractThe purposes of this research are to find out many kinds of problems that arise in the resolution of criminal case, and how the views of law enforcement against criminal procedural law in Indonesia in order to provide justice.This research is an empirical law by using a qualitative method that emphasizes on the field obser- vations, and the data were analyzed by non-statistical means. Data collecting technique performs by literature studies, observations, interviews, and focus group discussions (FGD). The informants were se- lected refer to its each purposes. The data validation was based on triangulation and it was analyzed using interactive analysis model.The results of this research indicate: 1) Criminal Justice System is less able to achieve substantial justice for both victims and perpetrators, 2) This study also concluded that law enforce- ment is still too rigid to fully implement the normative rules, including in certain cases, even the loss is very small.Keywords: Criminal, Justice, Restorative Justice

Abstract

AbstractThis empirical legal research aims to describe reality factors that caused not established BPSK (Consumer Disputes Resolution Board) in Madura area. Characteristics of Consumer Disputes in Madura  used as early Informed to mapping the factors inhibited BPSK in Madura. In-depth interviews and Focus Group Discussion (FGD) was conducted to mapping of  consumer cases characteristic that happened in Madura, furthermore, this research classified factors that caused not established BPSK in Madura. Results of this study mapping the structural and cultural problems is a major cause for the establishment of BPSK. AbstrakPenelitian hukum empiris ini bertujuan untuk menggambarkan realitas faktor-faktor yang menyebabkan tidak berdirinya  BPSK (Badan Penyelesaian Sengketa Konsumen) di wilayah Madura. Karakteristik sengketa konsumen di wilayah Madura dijadikan informasi awal untuk melakukan pemetaan terhadap faktor-faktor yang menghambat adanya BPSK di Madura. Interview mendalam dan Focus Group Discussion (FGD) digunakan untuk memetakan karakteristik kasus konsumen yang terjadi di Madura, selanjutnya akan di klasifikasikan faktor-faktor apa saja yang menghambat berdirinya BPSK di Madura. Hasil penelitian ini memetakan problem struktural dan budaya menjadi penyebab utama bagi pendirian BPSK.

Abstract

Under the WTO, Indonesia is obliged to liberalize its markets through establishing the schedule that comprise a list of services that can be either opened or closed to foreign suppliers.  However, Indonesia’s schedule is vague as to whether gambling services are closed to foreign suppliers. Through this loophole, the practice of cross-border gambling services has been rampant, resulting in some consequences, especially those related to money laundering and underage gambling. Tackling this problem, Indonesia could apply public morals exception that allows member states to impose trade prohibition. By using public morals exception that was applied in some WTO cases, this article explores the way in which Indonesia could justify prohibiting cross-border gambling services. This article claims that Indonesia has a justification to impose public morals exception under the WTO to prohibit cross-border gambling services within its territory because the prohibition would be designed to protect public morals; it would be necessary to protect public morals; and the prohibition would equally apply  to both foreign and local suppliers in cross-border gambling services in Indonesia.

Abstract

AbstractArticle 18B (2) of the Constitution 1945 normatively recognizes and respects the unities of society with customary law with its traditional rights. However, in the context of emerging empirical question which is based on a number of issues regarding the presence or absence of the role of customary law in the administration of the village administration. This article aims to identify and analyze the existence of the application of customary law through synoptic policy in the administration of the village administration as an effort to strengthen participatory democracy. Approach selected was socio-legal research with qualitative data analysis (qualitative research) that is descriptive. Techniques in collecting the data are interview, documentation and observation. The study concludes that the involvement of customary law, citizens feel partially responsible for the implementation of village governance system. But along with the development policy of national law customary law sometimes neglected. Recommendations of this study can be used as a basis for developing policies synoptic application of customary law in the administration of the village administration.Keywords: Synoptic Policy, Village Government.AbstrakPasal 18B ayat (2) UUD 1945 secara normatif mengakui dan menghormati kesatuan-kesatuan masyarakat hukum adat beserta hak-hak tradisionalnya. Namun dalam konteks empiris muncul sejumlah pertanyaan yang bersumber pada permasalahan perihal ada tidaknya peran hukum adat dalam penyelenggaraan pemerintahan desa tersebut. Artikel ini bertujuan untuk mengetahui dan menganalisis eksistensi penerapan hukum adat melalui kebijakan sinoptik dalam penyelenggaraan pemerintahan desa sebagai upaya imemperkuat demokrasi partisipatoris. Pendekatan socio-legal research dipilih dalam penelitian kebijakan hukum ini menggunakan analisis data kualitatif (qualitative research) yang bersifat deskriptif. Teknik pengumpulan data dengan metode wawancara, dokumentasi dan observasi. Hasil penelitian menyimpulkan, dengan berperannya hukum adat, warga masyarakat merasa ikut bertanggungjawab terhadap terselenggaranya sistem pemerintahan Desa. Namun seiring dengan kebijakan pembangunan hukum nasional terkadang hukum adat terabaikan. Rekomendasi penelitian ini dapat digunakan sebagai dasar membangun kebijakan sinoptik penerapan hukum adat dalam penyelenggaraan pemerintahan desa.Kata Kunci : Kebijakan Sinoptik, Pemerintahan Desa.

AbstractThis article will describe how the legal protection of the notary who indicated a criminal offense in connection with the authentic deed made. To implement articles of the Criminal Code by Prosecutors and judges in order to drag notary into criminal case because Indonesia’s Law Number 2 of 2014 does not contain the who was appointed and dismissed by the public authority (government) and was given the authority and the obligation to serve the public, and therefore he participate to implement a government authority. the research conclusion describe that the legal protection of the Notaries in performing his respective which include right of refusal, liabilities broken and exclusive rights when summoned for questioning by investigators, prosecutors or judges, which is subject to approval of the Honorary Council of Regional Notary AbstrakArtikel ini akan mendeskripsikan bagaimana perlindungan hukum terhadap notaris yang terindikasi tindak pidana sehubungan dengan akta otentik yang dibuatnya. Penuntut umum dan hakim pada umumnya menerapkan pasal-pasal tertentu dalam Kitab Undang-undang Hukum Pidana (KUHP) untuk menyeret notaris ke dalam perkara pidana karena Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris (UUJN) sama sekali tidak memuat konsep dan sistem pertanggungjawaban pidana notaris.Jabatan notaris adalah jabatan publik karena notaris diangkat dan diberhentikan oleh pemerintah. Notaris menjalankan tugas negara dan akta yang dibuatnya, yaitu minuta (asli akta), merupakan dokumen negara. Di Indonesia, notaris disebut sebagai Pejabat Umum karena diangkat dan diberhentikan oleh kekuasaan umum (pemerintah) dan diberi wewenang serta kewajiban untuk melayani publik dalam hal-hal tertentu, dan oleh karena itu ia ikut melaksanakan kewibawaan pemerintah. kesimpulan bahwa perlindungan hukum terhadap Notaris dalam menjalankan tugas jabatannya selaku Pejabat Umum dapat dilihat dalam beberapa instrumen yang mencerminkan hak-hak istimewa notaris, antara lain berupa hak ingkar, kewajiban ingkar dan hak ekslusif ketika dipanggil untuk dimintai keterangan oleh penyidik, penuntut umum atau hakim, yakni harus dengan persetujuan Majelis Kehormatan Notaris Daerah.

Abstract

The purpose of this study is to examine further regarding the legal accountability of the public accountants on financial statements in the Indonesian legal system. This research is important to conduct due to the public accounting profession that has a significant role to express opinions about fairness in all material matters, financial position, results of operations, changes in equity, and cash flows in accordance with general accounting principles accepted in Indonesia. In other words, the responsibility of public accountants is to express opinions on financial statements. Public accountants are responsible for planning and carrying out audits in order to obtain adequate assurance about whether the financial statements are free from material misstatement, whether caused by errors or fraud. Financial statements are the responsibility of management, and the public accounting profession cannot just be punished. This research is a normative legal research. The data used is secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. The data collection techniques use literature study, while data validation techniques use source criticism. The data is analyzed by using legal interpretation methods to obtain answers to the questions examined. The results show that a public accountant can have criminal and civil liability in carrying out the duties when publishing a company's financial statements.

Abstract

 This research aimed to examine to what extent the role of the State participation in applying the principles of democracy and human right in Indonesia. This research is normative legal research (library research). There are two obligations of state toward human rights namely, protection and realization. Protection requires  the role’s state to  guarantee and to protect human rights. Meanwhile, realization is obligation demanded  State to act actively  in keeping human rights.  Human Right violations aren’t only done by State, but also non-State actors covering either individual or corporation. The obligation and responsibility to keep  human rights are important because we are not only face human crimes, genocide or war crimes but also poverty and undeveloped. The obligation and reponsibility of corporation are realized in the form of   Corporate Social Responsibility , especially in community development.

Abstract

Abstract            In order to provide the protection to the “traditional batik art knowledge” in Tirtomoyo, Wonogiri, the local government policy rests on the potensial of art, commerce, services, education, tourism and sports.Here, it can be drawn the real purpose, that is to develop, to conserve, and to protect the traditional knowledge as the heritage and cultural expression, especially the traditional knowledge. In this case, the Intellectual Property Right protection and its all varieties should be applied on the traditional intellectual art. However, it has not yet manifested the regional regulation on the Intellectual Property Right, especially the protection to the traditional knowledge.         There has not been confirmation about what institutions will be responsible or what kind of agencies will be involved in providing the protection to the traditional knowledge, like the batik art, dance art, and others, so that they don’t seem loose accountability in handling it. The policy on the Intellectual Property Right, especially the one related to the traditional knowledge, is still partial or supplement. The Industry and Trade Department of Wonogiri regency, which handles the micro and medium industry field and is not related directly to the batik handicraft industry, has planned to make a program of batik handicraft industry as the regional superior.

Abstract

The enactment of Law Number 23 Year 2014 on Regional Government has implications for setting local owned enterprises (BUMD) in Indonesia. Law No. 23 Year 2014, revoke Law Number 5 of 1962 and Law Number 32 Year 2004, the previous both are the legal basis for setting local owned enterprises in Indonesia. In Law No. 23 Year 2014, specifically regulates the local owned enterprise, namely in Chapter XII, consisting of 12 Articles, starting from Article 331 to Article 343 and scattered in several chapters, Article 1 paragraph 40, Article 134 paragraph (1) letter c, 188 paragraph (1) c, subsection 298 (5) c,subsection 304 (1) and (2), 320 (2) g, 402 paragraph (2), 405 and Article 409.
