Abstract

AbstractThe objective of research was to find out the existing condition of spatial layout the Kutai Kartanegara Regency’s Government used and to find out the policy of Kutai Kartanegara Regency’s Government in spatial layout. In this research, Empirical research on Law (ELr) was used. ELr seeks to understand and explain how law works in the real world. This study was a descriptive developmental one providing a systematical description on the object to be studied, and then a model was developed to address the problems in the field. The research approach used was qualitative approach. The research was taken place in Kutai Kartanegara regency. From the result of research and discussion, two conclusions could be drawn. Firstly, the existing condition of land use in Kutai Kartanegara regency showed the land use for various activities such as: mining, forestry, gardening, and farming. The shift of land function increased over years. Secondly, the government of Kutai Kartanegara regency had developed draft Local regulation of regency about rTrW or Zoning for Kutai Kartanegara regency, but it had not been proposed to the Local Legislative Assembly’s (dprd’s) discussion because there had been no provincial regulation about rTrW or Zoning of East Kalimantan provinceKey words : policy, Special layout, ValorisationAbstrakTujuan penelitian adalah untuk mengetahui existing condition tata ruang yang digunakan Kabupaten Kutai Kartanegara, untuk mengetahui kebijakan Pemerintah Kabupaten Kutai Negara dalam penataan ruang. Dari Hasil penelitian dan pembahasan dihasilkan dua kesimpulan, yaitu : pertama, Kondisi existing Penggunaan tanah di Kabupaten Kutai Kartanegara untuk bermacam – macam kegiatan diantaranya yaitu : . Kegiatan  pertambangan  , Kegiatan Kehutanan , Kegiatan Perkebunan, kegiatan pertanian. Terjadi pengalihan fungsi lahan yang meningkat dari tahun ketahun Kedua, Pemerintah Kabupaten Kutai Kartanegara telah membuat Draft Rancangan Peraturan Daerah Kabupaten Tentang RTRW maupun Zonasi Kabupaten Kutai Kertanegara, hanya saja belum bisa diajukan dalam pembahasan dengan DPRD karena Peraturan Daerah Propinsi tentang RTRW maupun zonasi Provinsi Kalimantan Timur belum ada.Kata kunci : Kebijakan, tata ruang, valorisasi

Abstract

AbstractThe probation is an alternative conditional independence revocation entity that is intended to avoid some negative impact from the implementation of the criminal in prison. Implementation of probation committed outside the correctional institution with provisions for prisoners on probation must abide by conditions set by the judge requirements to be supervised by a supervisory officer. The purpose of this study is to investigate the implementation of the supervision of general and specific requirements by the supervisory officer in this case conducted by the supervisory judge observer (kimwasmat), prosecutors and Correctional Center (BAPAS). This research was conducted with library research to obtain secondary data and field research to obtain primary data. In conducting surveillance, kimwasmat never touched prisoner probation supervision, citing a judge's limited ability to perform tasks supervisory oversight of all court decisions, in addition to the obstruction of funding is not budgeted specifically for the task. Supervision conducted by the prosecutor is also not running, because prosecutors had handed over control to BAPAS. The supervision by BAPAS is precisely the effective control, because it is done with two-way method, which offenders are required to report to the office of BAPAS for any particular period and given guidance in the form of mental training and skills. Supervising social each month, also visited a client's home with intent to know the development of coaching. Based on data obtained from BAPAS Yogyakarta during the last year and a half, never breach the terms of which the judge determined, so it can be said implementation of the supervision and coaching successful.

AbstractIslam basically does not stipulate that a male may only be married to woman whose common thing, both in position, wealth, ethnicity ,etc. Islam doesn’t make rules concerning kafa'ah, but it is people who set them. Islam considers that humans are created equal. No set of people who can not afford not be able to marry, the Arabs should not marry non-Arab people. (Al-Hamdani, 1989: 98)In order to establish and create a family that sakinah mawaddah and rahmah, ulama suggest that there is a balance of harmony, correspondence (there is an element kafa'ah) between the prospective spouses Pasal 2 ayat 1 of Act No. 1 of 1974 when viewed from the principle of equality Kafa'ah concept in religious matters embraced by each bride should be the same even if not explicitly prohibit the State of different religious intermarriage Compilation of Islamic Law Article 61 states that "no sekufu not be used as an excuse to prevent the marriage, except no sekufu (kafa'ah) because of religious differences or ikhtilaafualdeen." Islam, pada dasarnya tidak menetapkan bahwa seorang laki laki hanya boleh menikah dengan perempuan yang sama kedudukanya, baik dalam kedudukan,  harta,  suku dan sebagainya. Islam tidak membuat aturan mengenai kafa’ah, tetapi manusialah yang menetapkannya. Islam memandang bahwa manusia diciptakan sama. Tidak menetapkan orang yang tidak mampu tidak boleh menikah dengan orang mampu, orang arab tidak boleh menikah dengan orang non arab dan sebagainya. Untuk dapat membentuk dan menciptakan suatu keluarga yang sakinah mawaddah dan rahmah, para ulama menganjurkan agar ada keseimbanga, keserasian, kesepadanan (ada unsur kafa’ah) antara calon suami isteri. Pasal 2 ayat 1 Undang undang Nomor 1 Tahun 1974 kalau ditinjau dari konsep Kafa’ah maka prinsip kesejajaran dalam masalah agama yang dianut oleh masing-masing mempelai harus sama meskipun tidak secara tegas Negara melarang terjadinya perkawinan antar agama yang berbeda. Pasal 61 Kompilasi Hukum Islam menyebutkan bahwa “ tidak sekufu tidak dapat dijadikan alasan untuk mencegah perkawinan, kecuali tidak sekufu (kafa’ah)karena perbedaan agama atau ikhtilaafu al dien.”Kata Kunci, Islam, Perkawinan,Kafa’ah, Indonesia

Abstract

The contract generally means the consent of two wills to make a particular legal effect of giving or doing work or abstaining from work in return for material or in-kind compensation. As for the commercial nature of the contract, in the Jordanian civil law, the contract is considered commercial if it is included in the business stipulated in Article 6 of the Jordanian Trade Law. A contract is commercial if its subject matter is one of the acts provided for in article 6 of the Trade Law, as is the case with the purchase of movables for the purpose of selling them, and the agency commission and brokerage. On the international level, the commercial character of the contract comes closest to the extent to which the contract relates to international trade as the export or import of goods that regulate the movement of goods across the borders of one State. After the good study of the subject, we find that there are a number of questions or problems that accompany the determination of the internationality of the contract, including the extant of adequacy of the personal internationality, in addition to, whether the introduction of the purely national relationship to the jurisdiction of the foreign country lead to the internationalization of the relationship. The study will deal with international standards of the contract in different international theories and conventions. I will discuss the legal and economic standard in section I, the mixed standard in section II and the standards of the internationality of the contract in accordance to international conventions, especially the Vienna Conventions, The Hague Convention, the Rome Convention and the International Convention on International Arbitration in Section III.

Abstract

The development of the concept of state law is a product of history. Formulation of understanding continues to evolve to follow the historical development of society in the state, although in practice the discussion refers to the concept of the modern state of the mainstream since the 19th century; Continental European Rechtstaats concept, and Anglo-Saxon with the concept of Rule of Law. Each country has its own style. The concept of state law in one country can not be forced into other countries. Indonesia has the Pancasila ideology that by applying them consistently, so it can become law states that happy people.

Abstract

A dispute between two or more countries involved in a foreign investment may arises from investment agreement agreed upon by the parties. If one of the parties breaches the agreement, the parties will automatically agree to resolve the dispute to the agreed arbitration forum based on the dispute settlement clause on the agreement, those forum such as the ICSID arbitration. Therefore, the existence of dispute settlement clause on an investment agreement (Bilateral Investment Treaty) is very necessary. The result of the above-mentioned arbitration proceeding is a binding and final decision for the parties. An arbitral award, should contain relief or compensation set by the arbitrator as the result of the proceeding. The reliefs are given as orders to indemnify the damages obtained by Claimant. Issues arises when Respondent has been proven to have done detrimental damage to the Claimant yet Respondent deliberately neglected his/her obligation to compensate Claimant accordingly based on the relief/ compensation specified in the award. The non-compliance of the Respondent to fulfill the compensation obligation is due to the fact that the party habitually assume that the arbitration award does not have the legal force equivalent to the decision of general court, even though the nature of the award is final and binding. Thus the interests and rights of the Applicant who has been declared entitled to compensation based on the arbitration award must be protected so that their rights can be fulfilled according to the law.

Abstract

This study issue was the credit card crime (carding) in Indonesia conductedin Bank Indonesia and Indonesian National Police Headquarters. Carding is international cyber crime causing society restively particularly the credit card users, due to the computer technology of carding beyond the national boundary. The coordinated, inter-state cooperation and understanding of science and mastery of computer and related products are mandatory to the necessity of facing the cyber crime carding. The primary data obtained by direct interviews with the police (Police Headquarters) and Bank Indonesia meanwhile the secondary data attained from books, magazines, internet and research. This study indicated that the handling of carding preventively conducted by the Police in coordination with Bank Indonesia to supervised/ restricted the circulation / issuance of credit cards, issuing red book on carding prevention guideline and actively informed the banking about carding issues. Meanwhile, Bank Indonesia are obliged to form theregulation draftin credit cards utilization Carding.countermeasuresreperesively performed using mediation between the bank that issued the credit card, the credit card holder and carding actors with Bank Indonesia as the mediator. If mediation did not reach an agreement, the cases would be handed over to the police, treated as a crime in general.

Abstract

This article examines efforts to protect and deal with government, law enforcement agencies and assistants or NGOs in preventing and eradicating commercial sexual exploitation of children (CSEC). In Indonesia there are many child trafficking in border areas and cities like Surabaya, which are identified as sending, transit and destination cities. The research type used is  the juridical empirical study namely the effectiveness research of regulations enforcement on child protection. Primary data obtained from experience experienced by children and the family, law enforcement, government and companion Non Governmental Organization (NGO). Data collection techniques carried out by the interview method and FGD. The results showed that the commercial sexual exploitation of children is an act of human trafficking because the purpose of sexual action is to obtain money or other goods with the children, sex service users, liaison and related parties. The highest educated victims of Commercial Sexual Exploitation of Children (CSEC) are high school and are in an economically inadequate condition, broken home, and the influence of uncontrolled social media.

Abstract

Conspiracy in the tender including auction collusive tenders occuring through a deal between businessmen, between the owner of the work as well as between the two parties. The tender conspiracy case that happened in Indonesia is a case involving the Pte Ltd. Industri Kereta Api (Pte Ltd. INKA) in the procurement of Transjakarta fiscal of 2013. From the results of this research noted that enforcement of the law against the procurement of Transjakarta yet running optimally, where knowing the verdict matter passengers number: 15/KPPU-I/2014 in unfair business competition elements Law number 5 of 1999 can't show anyone others who benefited by Pte Ltd. INKA and profitable, as well as in the By Law 16 of Number 2018 on The President of Government procurement of goods/service stating Pte Ltd. INKA is not proven procurement tenders because collusion Pte Ltd. INKA do not know reasons of Pte Ltd. Mayapada Auto Sempurna resign therefore the Pte Ltd. INKA as winner in the tender Package I repeated Single Bus.

Abstract

This research uses Socio Juridical approach by reviewing the pandects prevailing in the society, analyzing the implementation of Restorative Justice in settling and minimizing the cases of School Bullying, acquiring data related to the factors of school bullying, the characteristics of the bullies and the bullying facts, and digging up the efforts to overcome bullying , either for the victims, the witnesses, the school or the parents. This research uses in depth interview, observation and documentation. In depth interview is conducted on a number of respondents, namely the students of SMPN 3 Boja and the teachers on Guidance and Counseling. The result of the research shows that in the teaching and learning process and the extracurricular activities in SMPN 3 Boja, the forms of bullying including direct physical contact such as beating and pushing, direct verbal contact such as the acts of disgracing, name-calling, and mocking, direct non-verbal behaviors by sticking the tongue out, mocking, or threatening which are usually followed by physical or verbal bullying, and indirect nonverbal behaviors such as expelling someone from the group, manipulating friendship, and sending anonymous letter. According to the result of the research, the writer recommends the restorative justice approach as the solution in settling the school bullying in order to make the students be responsible for their actions. This approach should be applied by involving the victims and the relevant parties especially the family and the society to take role in mending the suspected children’s morality so that they will not feel as if they are prisoners who should be expelled from their environment and will have the motivation to improve themselves and not to repeat their mistakes. Lastly, the law upholder should adjust the Law No. 11/2012 on Juvenile Criminal Justice System in settling children as the criminal offenders.
