Abstract

ABSTRACTThis research studies and answers the problem concerning with regulating of holding debit-credit cooperation activity in laws. And also to know potential criminal acts which can be happened in holding debit-credit cooperation activity.This research is a kind of normative and empirical research which is descriptive and observation. The kind of data which is used is secondary data that consist of primary law material, secondary law material and tertiary law material. Data collecting technique used is document study with content analysis technique and data observation.Based on the research and the analyze, it showed that holding the activity of debit-credit cooperation refers to regulation no. 525 1992 about cooperation; Government regulation no. 9 1995 about carrying out of debit credit activity business by cooperation, and the decision of minister of cooperation, little and middle entrepreneur minister of Republic Indonesia no: 351 /KEP/M/XII 1998 about guidance of implementation debit credit activity business by cooperation. From the three regulations which regulate of holding debit credit cooperation activity can be known that debit credit cooperation activity is to unite and to make flow the fund which directed only to the members of cooperation, candidate of member, cooperation and/or its member.Actually at recent time, a lot of debit credit cooperation which unite fund from a broad society beyond members of cooperation. The weak control and even no control against debit-credit cooperation give chance for deviations against regulation regarding with debit credit cooperation. The deviation is directed to criminal acts which make the caretaker and manager of cooperation to be suspected and criminal acts which have potency to be happened in debit-credit cooperation activity are criminal act of embezzlement and fraud. Keywords: Debit-Credit Cooperation, Criminal act.

Abstract

ABSTRACT That the modus operandi of theft above really makes it difficult for polhut officers to perform their duties, well, especially to face the risk of "life" that is likely to exist. So Modus Operandi of illegal logging in review by article 362 of the Criminal Code jo Inpres no. 4 Year 2005, has fulfilled the element of theft act and it must be done investigation or legal process and the act has also damaged the environment and will automatically bring the impact of the loss of the nation and the State. In this case through Presidential Instruction Number 4 Year 2005 on the criminal act of illegal logging, must be dealt with firmly do not recognize compromise and the action is a priority mandated through Inpres no. 4 Year 2005. In the framework of eradicating illegal logging in forest areas and its circulation throughout the territory of the Republic of Indonesia, it is instructed to all state apparatuses to take unequivocal action against illegal logging perpetrators. The legal process must be carried out consistently for the sake of law in this country. ( Law enforcement ) should be put forward.Factors causing criminal acts of illegal logging of timber products are: Economic population is relatively weak; Ironwood has high economic value; Ironwood theft is easy to do. The modus operandi of illegal timber theft in KPH East Kalimantan; Enter the forest area in the evening or evening; The perpetrators of timber theft are not just one night in the forest, but stay up for days; Conducted in groups. Efforts to control criminal acts of illegal logging. Prevention efforts in a preventive way. The counseling materials include: Environment, Transmigration, Job Skills, Legal Knowledge, Religious Lectures. Repetitive countermeasures In addition to prevention efforts above, the Perum Perhutani and the relevant agencies also perform repressive actions when the perpetrators of criminal acts of illegal logging are caught by investigating and investigating in the end Until sentenced from the district court.

Abstract

ABSTRAK         Dalam  kehidupan  masyarakat  sebagai  subjek  hukum  yang  paling  sering  dilakukan  oleh  orang  maupun  badan  adalah  melakukan  suatu  perjanjian  dalam  rangka  memenuhi  kebutuhan  hidup  atau  dalam  rangka  memperoleh  keuntungan  terlebih  lagi  dalam  buku  III  KUH  Perdata  menganut  sistem  terbuka, artinya  para  pihak  bebas  mengadakan  perjanjian yang  berisi  dan mencari  apapun  asal  tidak  bertentangan dengan Undang-Undang  dan  ketertiban  umum. Buku III KUH Perdata tersebut menganut sistem terbuka (open system), artinya setiap orang bebas mengadakan perjanjian yang berisi apa saja, baik perjanjian bernama (nominaat) maupun perjanjian tidak bernama (innominaat), asalkan tidak melanggar ketertiban umum dan kesusilaan.  Mengenai orang yang belum dewasa diatur dalam Pasal 330 KUH Perdata, dinyatakan bahwa belum dewasa adalah mereka yang belum mencapai umur genap 21 (dua puluh satu) tahun dan sebelumnya belum kawin. Apabila perkawinan itu dibubarkannya sebelum umur mereka genap 21 (dua puluh satu) tahun,  maka  mereka  tidak  kembali  lagi  dalam  kedudukan  belum  dewasa        Tujuan  dari  penelitian  ini  adalah  Hendaknya  masyarakat  dalam  membuat perjanjian atau melakukan perbuatan hukum memperhatikan syarat sahnya perjanjian  khususnya   mengenai   syarat   kedewasaan. Kata Kunci: Masalah Kedewasaan Sebagai Syarat Sahnya Perjanjian KUH Perdata Pasal 1330

Abstract

ABSTRACTThe disclosure of cases relating to a lawsuit against the holder of the certificate by the original land holder has raised the insecurity of the certificate holder. In the city of Samarinda precisely in Jalan Ir. H. Juanda RT 02 Sidodadi Urban Village, Samarinda Ulu Sub-district, Samarinda City, land dispute occurred in civil case at Samarinda District Court Number. 93 / Pdt.G / 2000 / PN.Smda Juncto Number 48 / Pdt / 2004 / PT.KT. Smda Juncto Number. 74 / Pdt / 2005, used as the basis for the cancellation of Certificate of Property Number 2853 / Kelurahan Sidodadi, 2856 / Kelurahan Sidodadi, 2857 / Kelurahan Sidodadi, 2858 / Sidodadi Urban Village, 2859 / Sidodadi Urban Village, 2860 / Sidodadi Urban Village, 2862 / Kelurahan Sidodadi The Land Office of Samarinda City is forwarded to the Regional Office of the National Land Agency of East Kalimantan Province to subsequently issue a Decree of the Head of Regional Office of the National Land Agency of East Kalimantan Province regarding the cancellation of the Certificate as the execution of the decision of the Courts which has obtained permanent legal force.Under this circumstance, the writer encourages the writer to know what the legal considerations of the Court of Samarinda are in Decision Number 93 / Pdt.G / 2000 / PN.Smda that cancels the Certificate of Property Number 2853 / Kelurahan Sidodadi, 2856 / Kelurahan Sidodadi, 2857 / Kelurahan Sidodadi, 2858 / Sidodadi urban village, 2859 / Sidodadi urban village, 2860 / Sidodadi urban village, 2862 / Kelurahan Sidodadi and to find out what effect the law has on the Certificate of Property Owned by the Court and permanent law force. This research uses a normative sociological approach, referring to the truth obtained from a reality in the field that is linked to the legal aspect.From the research result it can be seen that the legal considerations of the Samarinda Court strengthen to grant the request for the cancellation of the Certificate of the Property and the legal consequences to the Certificate which have been subsequently terminated. The court which has obtained permanent legal force (Inkracht Van Gewijsde) is null and void by the Head of Office The territory of the National Land Agency of East Kalimantan Province Number 38 / KEP-64 / IV / 2016 which is further processed by the Land Office of Samarinda City, and to avoid land disputes such as this case case, / public complaints as an effort to protect the law of Land Rights.Keywords: Cancellation of Certificate of Property.

Abstract

ABSTRACT That the technical execution of the ex-wife's right to the salary of her ex-husband, the division of salary if the divorce occurs because of the wishes of the Civil Servant of man then his salary is divided as follows: If no child, then ½ for the Civil Servant concerned; For ½ part wife; If having children and children join the Civil Servant concerned, then 2/3 for the Civil Servant concerned and his / her child and 1/3 for the wife.That the legal consequences of divorce are as follows: At the level of talaq ba'in, is a divorce that has entered the level of talaq three where the married couple is forbidden to reconcile before the former wife marries first with another person then the person divorces her; Divorce due to li'an, then marriage can no longer be done forever; Collective property is shared between husband and wife while the cost of maintenance and education is the responsibility of the father; The more entitled to take care of his children is his mother, as long as the mother is married to someone else.

Abstract

ABSTRACTThe title of this paper is the role of the court in resolving the divorce petition tholak according to Law No. 1 of 1974 on marriage .The formulation of the problem of how to reconcile the efforts of religious courts in the party who filed for divorce in a religious court tholaksamarinda and what the legal consequences of divorce tholak according to Law No. 1 of 1974. The purpose for doing this study to obtain information about the role of religious courts in resolving divorce petition tholak according to Law No. 1 of 1974 on marriage . Writing this thesis using empirical juridical library with study analysis and interview sources.Divorce in certain circumstances be considered the ultimate solution remains to drown out the bickering and discord in the household of husband and wife therefore be of a husband and wife running a live household carefully so that marriage really achieve the purpose of marriage itself , that forms the family the eternal happy and prosperous in the world and the hereafter . Abstract

ABSTRACTLaw No. 22 Year 2009 section 134 explains the primary rights of road users who prioritize or have the primary right to take precedence and must be escorted by the Indonesian National Police officers. Escort is done to reduce the potential for traffic accidents which are of course very dangerous to the convoy itself as well as other road users. But still many people who do not want to give way to vehicles that have the right of priority.This research uses research method with sociological juridical approach which is implemented in POLRESTA Samarinda city by using interview technique, and interviewing the community around writer area itself. The data obtained are primary and secondary data, and library research. Darta obtained kemudiaan analyzed descriptively.The results showed that many causes why people misuse the main right of the road is the lack of knowledge about the regulations. And how efforts and steps undertaken by the police officers of the Police RI to safeguard and guard against community and government activities as needed.  Key Words : misuse of the main right of the road

Abstract

ABSTRAKSIPenelitian hukum ini bertujuan untuk mengetahui apakah SEMA RI Nomor 7 Tahun 2014 dapat mengesampingkan putusan Mahkamah Konstitusi Nomor 34/PUU-XI/2013, dan untuk mengetahui dasar maupun pertimbangan hukum penerbitan SEMA RI Nomor 7 Tahun 2014, sejalan ataukah tidak dengan rasa keadilan yang hidup dalam masyarakat, serta bagaimana seharusnya upaya Peninjauan Kembali diterapkan dalam hal perkembangan zaman yang terus berkembang khususnya ilmu pengetahuan dan teknologi. Penelitian ini dilakukan dengan menggunakan metode penelitian yuridis normatif sehingga data yang dikumpulkan hanya sesuai dengan studi kepustakaan saja. Data yang diperoleh kemudian disusun dan dianalisa setelah itu menghubungkannya dengan teori, asas, dan kaidah hukum untuk dapat menjawab permasalahan yang diangkat dalam penelitian ini. Berdasarkan hasil penelitian dan pembahasan dihasilkan simpulan bahwa SEMA RI Nomor 7 Tahun 2014 hanya merupakan peraturan kebijakan yang tidak harus mengikat jajaran dibawah Mahkamah Agung. Surat Edaran ini juga tidak ditemukan dalam hierarki Pembentukan Peraturan Perundang-Undangan. Sedangkan putusan Mahkamah Konstitusi merupakan produk hukum yang setara dengan Undang-Undang, bersifat final dan Mengikat yang wajib ditaati oleh semua lembaga negara di Indonesia. Serta masuk dalam hierarki Pembentukan Peraturan Perundang-Undangan. Kontroversi terbitnya SEMA RI Nomor 7 Tahun 2014 semestinya dievaluasi oleh Mahkamah Agung.Kata kunci: Keadilan dan Kepastian Hukum, Norma Peninjauan Kembali (PK)

Abstract

AbstractThis study examines how the arrangement of abortion according to the Criminal Code (KUHP) and Law Number 36 Year 2009 on Health. This research is a scientific research to find the truth based on scientific logic from side of law by using legislation. Types of legal materials that the author uses are primary legal materials, secondary legal materials, as well as tertiary legal material. In the formulation of the Criminal Code (KUHP) does not give any room at all to the implementation of the act of abortion. The rules are set forth in articles 299, 346,347,348 and 349. Mean while, according to Law Number 36 Year 2009 on Health is regulated in Articles 75-77 and 194. Slightly different from the abortion arrangements in the Criminal Code, the abortion arrangements in the Health Act provide the space for the occurrence of abortion for some reason. Articles 75 the law provides two reasons for the abortion, which is a medical indication of a congenital / genetic defect or saves the lives of mother and rape victims that many affect the psychological victims. KEYWORDS  :  ACT OF ABORTION

Abstract

ABSTRAK Tujuan penelitian ini adalah untuk mengetahui bagaimana nilai-nilai hak asasi manusia untuk hidup diatur dalam sistem hukum di Indonesia dan bagaimana tinjauan Hak Asasi Manusia terhadap eksistensi hukuman mati di Indonesia. Berdasarkan penggunaan metode penelitian hukum normatif dapat disimpulkan bahwa: 1. Nilai-Nilai Hak Asasi Manusia di Indonesia bersumber dan bermuara pada Pancasila. Hak Asasi Manusia mendapat jaminan yang kuat dari falsafah bangsa, yaitu Pancasila. Selain itu Konstitusi yang ada di Indonesia pada dasarnya mengatur hak asasi manusia yang bersumber pada Pancasila dan perkembangan pengaturan secara umum. 2. Penerapan Hukuman Mati dalam sistem hukum di Indonesia bertentangan dengan hak asasi manusia yaitu hak untuk hidup yang tercantum dalam nilai-nilai pancasila dan dijamin oleh Undang-Undang Dasar 1945.Kata kunci: hukuman mati, hak asasi manusia
