Abstract

Legal and political system is a subsystem in the community. Each perform a specific function to movethe social system as a whole. A rill, a national banking law norms contained in Law no. 7/1992concerning Banking as amended by Law no. 10/1998 provide less public protection arrangements(social protection) than in community settings (social deregulation). The Law. 7/1992 on banking, asamended by Law No. 10/1998 which does not restrict the ownership of commercial banks. In acompany where there are differences in ownership of company shares a number of very big difference,it will be found the majority shareholder in one hand and minority shareholders, on the other bydifferences in the number of voting rights is striking. Lessons of the past shows that the majorityprinciple causes ¬'s minority shareholders are in a position of powerlessness and disadvantage inenforcing their interests. Legal position of minority shareholders who number more weak and unableto deal with actions that harm the directors or commissioners of the company, it is caused by theposition of the majority shareholder of which is identical with the company's second organ, bothphysically and interests.

Abstract

Well before the election schedule of India's 17th Lok Sabha to be held ahead of mid 2019 we can not pass any judgement but its coalitional history with varied trends right from the year 1977 and thereafter showed that it is not the cultural homogeneity which is a requisite for political stability and integration, the chances of stable democracy are enhanced to the extent that the group has a number of cross-cutting, politically relevant affiliations. It involves : 1. application of power, in the sense of joint use of resources to determine outcomes'; 2.  a ‘mixed motive situation' means the existence of both conflict and cooperation; and 3.  this is a collective activity, which involves interaction of more than two units. In Indian context it can be safely argued that coalition politics has come to settle at the Indian federal level and that it cannot be viewed as a sudden and unexpected development but on a deeper analysis, it is reflective of a societal metamorphosis: wherein day by day larger number of hitherto latent groups of Indian society are getting mobilised and politicised. Evaluation of coalition politics in India will definitely help many alike countries to set coalitional patterns in the present and the future as well.

Abstract

Abstract

Various concepts, models or theoretical frameworksare on offer, to frame the public in fighting againstcorruption in Indonesia. They include: bureaucraticreform, good governance, civil society engagementetc. In response to the failure to bring corruptionfreestatus, experts unnoticeably tend to blame publicofficers instead of ensuring the accuracy and thereliability of the framework. This reflective literaturereview reveals such tendency. To begin with, it mapsout the logical basis of each approach, particularlyin conceptualizing the ‘public’, the ‘private’, andtheir relationship. The reliability of the approacheswill emerge as we link the conceptualization withreal life the public or socio-cultural context. The reviewreveals that analysis on corruption and its imperativeare ideologically driven, and hence, suffersfrom ideological bias. It obsesses with altering thebehaviour of public officers, which inevitably entrappedwith particular set-up. As liberal discoursetake place in non-liberal institutional set-up, thepublic fail to comprehend the nature of the problemsand the solution on offer. Instead of setting upcontext-specific agenda, public a dragged on variousforms of reform such as granting political rights, enhancing civil society, articulate more autonomyand alike. As overwhelming individual within thebattles against corruption overloaded with assertingof more public role, they encountered with difficultyin setting the boundary between the public and theprivate. As Indonesia has been endowed with differentinstitutional set-up in governing public affairs,corruption-free public governance remains elusive. This is because the reforms dismantle the existing powerbase, which actually is vital for winning the fight against corruptivesystemKEYWORDS: public, private, corruption

Abstract

As an urban area, Malang City has waste management problems, with causes ranging from governance to the lack of supporting facilities. Therefore, this article aims to discuss waste management using a dynamic governance approach. A qualitative approach was employed and aimed at providing a more nuanced narrative of how and why urban waste management is performed, alongside the involved social phenomena. The result was a dynamic governance framework in waste management practices in Malang City, including waste facilities, the development of sanitary landfill methods, and partnerships with international organizations. Although facilities, such as waste banks and Final Disposal Place (FDS), are still needed, efforts to apply agile principles with a citizen-centric approach in the development have not received great attention from the municipality. Meanwhile, household groups produce more waste due to the current condition of the city

Abstract

Internet can develop the communication and information freedom on society but unfortunately in some nations, especially in Asia, it cannot be fully accessed because of government censorship. This report explains the relationship between the practice of Internet censorship imposed by the Chinese government and the freedom of its citizens (in the internet surfing experience) as the realization of human rights in the freedom of expression and opinion (seek, receive-use, and communicate information) which is traced through the relevant literature study. China is a unique case since the internet censorship regulation contributes to its status as the country with the least internet freedom yet at the same time it is credited as having the most internet users globally. In addition, China known as the communist country that began opening up to globalization and information of technology, but the government’s control over it is still so tight and binding, not only in the press, or the traditional media, but also in new media with the internet censorship. The control over this information may have a clear objective to maintain a climate of information in the community, but on the other hand, such control is tantamount to restricting the right of citizens to make, use, and distribute information, and more fatal as a violation of human rights. Keywords: Internet, ICT, Censorship, China, Asia

Abstract

The study establishes the individual of kiai as a determinant autonomous actor of shifting roles and political support ‘ assume ‘ that the problem of shifting roles and political support of kiai are problems related to the quality of the individual ( individual quality) kiai alone. While studies that put the structure as an autonomous actor explaining that problem of shift in the role and political support of kiai turns laced with systems or structures that surround the life of kiai. Kiai is no longer a mere accused or suspect. Compared with the two previous perspectives, the study which makes a link of kiai and structure as a determinant actor of crisis of political agency of kiai or shifting political roles of kiai from cultural broker to political broker either to political player in the reform era is look more able to explain the problem in a comprehensive manner. The explanation which is given is also open awareness that the problem of shifting political roles or crisis of political agency of kiai in the reform era was not only related to the quality of the kiai alone, but also by the growing structure and surrounding kiai life.
