Abstract

Many contemporary Muslim scholars argue that Islamic jurisprudence (fiqh) is not ready to face the demands of the modern era. Modernity is so powerful that it weakens the foundation of fiqh on the one hand, and opens up new opportunities that cannot be reached by fiqh on the other. The method that fiqh has introduced is in itself incapable of adapting to new situation and also incapable of addressing new issues such as the issue of human right, constitusionalism and the like. It is in this context that the contemporary Muslim scholars speak out for reform in the methodology of fiqh as well the application of thismethodology in addressing new issues. This paper is concerned with discussing this problem by referring to the thought of some leading authority in this regard such as Abdullahi Ahmed an-Na‘im, Aboe el-Fadl and Nas}r H{âmid Abû Zayd. The paper argues that for these scholars, fiqh has lost its role and power in the modern society because of its discriminative trait. Fiqh must therefore deal with this negative image if it is to restore its influence in the modern civilization.

Abstract

There are two conceptual terms that this paper will try to expose. The first is analogy (qiyâs) and the second is istihsân, an analogy—like method of extrapolating jurisprudential rules. The paper will try to speak of their relationship in the light of al-Sarakhsî’s rationality. In the field of Islamic jurisprudence, the two concepts are often seen as contradicting to one another. The Shafi’ite jurists are even of belief that using istihsân is legally forbidden for that would contradict the general rules of Islamic law. The paper assumes that despite general view of the jurists that istihsân is an equivocal method it can nonetheless be fitted into qiyâs. To show that however, the paper would inevitably re-define both qiyâs and istihsân as proposed by al-Sarakhsî. By exploiting the ideas of al-Sarakhsî, the paper hopes that new lights may be shed as far as the richness of Islamic method injurisprudence is concerned.

Abstract

The role and contribution of Islam as a religion in the process of education in this country is both clear and remarkable. The contribution is so significant that many have believed that the Islamic system of education in the country has become what can be called a sub-culture within the national system of education. This paper tries to expose this in the context of the goal, the development and the core of education in Islam. The paper argues that the Islamic system of education is based on the vision of the Qur`an concerning man, his knowledge and attitude. For Islam, education is about sharpening man’s mind and softening his heart. It is this premise that underlines the whole argument of the paper. The paper further shows that this vision is in a total line with the objectives and goals of our national education. The paper then speaks of what it calls the “new nationalistic form of Islamic education” in which the religious and national values are integrated. This new model of education is not only idealistic but also transformative and innovative in the context of Indonesia and is relevant vis-à-vis the demands of modernity.

Abstract

This article tries to analyze the revival of mystical order (tarekat) in urban areas. Experiences reveal that the development of mystical orders in the Muslim world is not free from criticism, either from the insiders or the outsiders. However, mystical orders still exist, and this fact is characterized by the development of different mystical groups in various cities. Political, social and economic factors influence the fluctuation of mystical orders. This article argues that in a number of countries and in Indonesia, the mystical orders have contributed significantly to the socio-religious life of Muslims. The mystical orders become stronger as they are supported by the involvement of middle class group, media publication, and internal strength embedded in the very tradition of mystical orders. The influx of middle class Muslims to the networks of tarekat brings the fresh wind of change since their engagement provides the internal dynamic of tarekat which encounters external influences on the one hand, and the continuing drive to develop on the other.

Abstract

In principle, the Salafi-Islam attempts to call for genuine Islamic teaching as practiced during the period of the Prophet. Salafi-Islam came to Indonesia in the late nineteenth and early twentieth centuries, then spread to different places in the Archipelago. In Larangan, Pamekasan, the spread of Salafi-Islam is still in its nascent stage, from person-to-person, and appears as a small phenomenon in the midst of predominantly mainstream Islam. Salafi teachings spread through different forms of communication media (radios, televisions, magazines, and books) and religious practices of its  proponents. The movement manifests itself in the pratices of rituals, not in politics. The implication of encounter between salafi-Islam and NU as the mainstream religious group in Pamekasan is as follows: (1) religous life in Pamekasan becomes more dynamic; (2) there emerges inward-looking attitude at their own religous practices as well as outward-looking attitude to the others. This phenomenon can be observed among more educated members of the society. Among the common people, however, there are two types of attitude: ignorance and negative reaction; and (3) an attempt to search for the common ground and dialogue among different religious communities is being conducted.

Abstract

This article analyzes the epistemology of healing developed by kiai-traditional healer. In the Indonesian-Islamic tradition of healing, the kiai-traditional healer develops his own epistemological construct of healing, based on: (1) textual basis (bayânî) referring to classical Islamic references, such as al-Awfâq and Shams al-Ma‘ârif; (2) intuitive power (‘irfânî) in the form of mystical practices, such as spiritual endeavor (mujâhadah), tawajjuh, self-cleansing (tazkîyat al-nafs), wara‘, consistency (istiqâmah), and forbearance (ṣabr); and (3) pragmatic basis of the truth, particularly its utility value for the society. Normatively, the kiai-traditional healer uses different media of healing in terms of its easiness, belief or charm. Accordingly, it results in an impression that there are many modes of healing, i.e., medical, magical, mystical, and cosmic. The meaning of healing by the kiai-traditional healer constitutes a placebo effect of well-being, that is, an attempt of the kiai to implant evocation to recover the condition of human being.

Abstract

This paper is interested in exploring the most recent current of thought belonging to the younger generation of Indonesian intelligentsia. This current of thought is known by many as post-traditionalism. While discussing some of its most notable traits, this paper tries to show that the school of thought –while being intellectual and discursive- is also concerned with the state of education in the country. The paper argues first and foremost that the advent of this school was due to the poor quality of religious discourse in the country. By means of critical approach and “leftist” epistemology, this group tries to subvert the existing discourses, which it considers irrelevant. Since these irrelevant doctrines were encapsulated in the educational institutions, the practical and strategic way to dismantle these doctrines is by deconstructing their educational system on the one hand, and by reconstructing the new one; the one that reflects the universal and humanitarian values of Islam such tolerance and understanding.

Abstract

NU, the largest social and religious organization in Indonesia, has undergone many changes since its very inception decades ago. But the essence of the organization remains the same, namely its theological doctrine and “ideological” inclination toward the Sunna. This paper tries to speak of the struggle of NU in this changing era to remain as it is. It traces the theological genealogy of the organization, and how this theology has been transformed from time to time to meet the demands of Indonesian setting. Here NU is understood as a dynamic religious organization capable of translating certain theology and ideology into a totally different look. Hence, although it was originated in the theology of al-Asy’ariyyah and al-Maturidiyah, NU was not at all representing any of these two Middle Eastern theologies. Unlike the two, NU emphasizes theoretically the idea of justice, moderation, and tolerance while practically upholding the adaptive and adoptive attitude toward local customs and traditions.

Abstract

This paper is aimed at discussing the critical view of Abdullah Saeed as far as murabahah is concerned. For Saeed, this banking practice, which is adapted and adopted from Syari’ah has caused a lot of controversies. The basic question that a man like him asks is, does this Syari’ah banking system really make a difference? Nonetheless, it is this Syari’ah-based banking product that dominated the whole Islamic banking system in the great majority of Islamic countries. Investigating the nature of this product becomes therefore both strategic and important so as to have a better and proper understanding of it. This proper understanding will in turn influence the way this product is promoted and sold to the public in line with the values of Syari’ah. The paper will also compare murabahah with the similar banking practices in the conventional banks.

Abstract

Energy is one of the most important factors to global prosperity. The dependence on fossil fuels as primary energy source has led to global climate change, environmental degradation, and human health problems. In order to reduce dependence on commercial energy, steps have been taken to develop an alternative source, such as biogas. Biogas was a gas produced from biological activities in anaerobic fermentation processes and as a renewable energy. Biogas is one form of the alternative energy. It is environmentally friendly. However, biogas and its utilization still pose a serious problem within Muslim community, especially the pesantren. It is not easy for the pesantren to accept it on jurisprudential grounds. This paper attempts to examine the nature of biogas by looking at it as a human waste, and how does Islamic jurisprudence (fiqh) treat human waste particularly in terms of its use for human purpose. The paper also compares fiqh perspective with that of chemistry. The underlining argument that the paper tries to build is that legal compound component of human waste biogas (methane, carbon dioxide, hydrogen sulfide) is sacred, and must therefore be treated accordingly
