Abstract

If there is any notion in which Islam is seriously concerned with more than anything else, it is the notion of freedom of expression. No doubt, Islam has recognized this and has even institutionalized it in the form of what popularly known as ijtihad. Rational exercise is the main trait of this institution, in which a mujtahid would employ a certain method to come up with whatever result he/she has discovered on certain legal issues. In the meantime, the science in which ijtihad is commonly used is called the science of Usûl al-Fiqh. This science also provides the guidelines on how intellectual exercise should be carried out. This paper is interested in exploring further this notion of ijtihad within the framework of evolutionist thinking. It assumes that the product of ijtihad, commonly called fiqh, has evolved from being an individual opinion, to become a collective discourse then to a religious dogma. Hence, the paper argues that while ijtihad is a precious gift, it is wrongly misappropriated by certain religious authorities to produce dogmas that can jeopardize the opposing views.

Abstract

Model construction of curriculum and integrated learning between the Islamic Religious Education (PAI) and Civic Education (PKn) in elementary schools oriented to synergize the PAI and Civics teachers in designing integrated learning a more comprehensive and effective while improving the personality of students for the future be able to reflect the intellectual potential and the potential for in attitude. Basically, in the process of education and learning , teachers are required to conduct a comprehensive innovations and effective to prevent saturation, both teachers and students. Concerned it, this research produces research that has been tested in three elementary schools (SD) in Surabaya in the form of construction of an integrated curriculum in a way to bring some basic competence of these two subjects, then packaged in an integrated learning syllabus equipped, Learning Implementation Plan, Instructional Materials / Module Simple, and the Learning Guide.

Abstract

Dangding as a literary work is only meaningful when chanted. When one just reads in his/her mind silently, dangding becomes dry and lacks of meaning. This paper discusses the position of Mustapa’s dangding in literary context and their relevance to contemporary Sundanese discourse. The main focus of this study is the character of his mystical verses, structural aspects of dangding as a Sufism vessel, and to examine any discrepancy of meaning in reading process on his dangding for Sundanese literary today. Cultural studies approach is used to analyze the meaningfulness of his works in the current widespread popular cultural challenges. The study finds that with the decline of dangding tradition, Mustapa’s works receive a great deal of challenges seen from the development of modern literary: the influence of Indonesian literature (short stories, novels, etc.) to the Sundanese literary; dangding becomes marginalized along with the loss of many cultural institutions where it is appreciated; and the problem of meaning discrepancies on reading it in popular culture, which is dominated by massively printed works that lost the meaning behind words and melody. It is difficult for it to compete in popular cultural hegemony that relies on uniformity, profit-oriented and passive consumer.

Abstract

Similar to any theological sect, the Kharijite has split into many smaller groups. Usually all these groups were characterized as extreme factions who used violence in the pursuit of their purposes. However, the factual evidence proved that there was Ibadite which was considered as the most moderate group. The Ibadites tend to avoid  extreme behaviour. Due to their moderation, they successively ascended to power. The example of their remarkable achievement was the Rustamid Dynasty in Maghreb from 160-296H (776-909AD). As far as the research is concerned, unfortunately, there is no comprehensive records on the Rustamid accomplishment. The Rustamids reigned their plural society with different backgrounds in ethnicity, nationality, and religion. By doing so, the Rustamids could generate harmonious life in the entire territory under their government. Besides, the Rustamids have achieved an extraordinary civilization. The Rustamid tolerance was based on their ideology. The moderate Ibadite doctrine inspired the Rustamids to become tolerant to their various people. Actually, Indonesians with their diversity could also achieve high civilization such as what the Rustamid has achieved in terms of religious tolerance.

Abstract

This article discusses the reconstruction of fiqh (Islamic jurisprudence) with regard to vaginal bleeding using a medical approach. The fiqh of vaginal bleeding discusses menstruation, postpartum, and istiḥâḍah. The discussion of fiqh is normative in nature, as it is based on the Qur’ân and Hadîth. Technological developments in medical science affect the deconstruction of fiqh pertaining to vaginal bleeding. As a resut, the opinions of previous jurists become less relevant, and the fiqh of vaginal bleeding needs to be reconstructed accordingly. This reconstruction can be conducted by using the empirical-normative approach to the study of fiqh with regard tovaginal bleeding, redefining the fiqh of vaginal bleeding, reinterpreting the argument of fiqh concerning vaginal bleeding, and making medical experts as partners in determining vaginal bleeding.

Abstract

The diversity of legal opinions in the Shâfi‘î school of thought (madhhab), in the form of old opinion (qawl qadîm) and new opinion (qawl jadîd) and the ijtihâd activities that pertained  to some centuries after the passing away of al-Shâfi‘î, has brought this madhhab into encounter with serious problems in selecting the law. In such a situation, al-Râfi‘î and al-Nawawî came into the fore as muharrir (selector) to cope with this uncertainty. This research tries to analyze all scientific activities of the two scholars using the theory of tarjîh. This research found out that they attempted to establish a legal certainty in the Shâfi‘î school of law through the making of new mixed system of tarjîh to ensure which opinions deserve to be regarded as valid from the viewpoint of Shâfi‘î madhhab. This achievement contributes to the enrichment of Shâfi‘î madhhab as a legal school consisting of a great variety of legal opinions that equips itself with procedures of selection used as norms of everyday life.

Abstract

Difference of opinion is highly respected in Islam. The Prophet of Islam is even reported to have said that, “difference of opinion is divine providence”. This paper tackles this issue particularly within the science of prophetic tradition, and relates it to the way Muslim legalists develop the logics of law. The paper first argues that difference of opinion is not only natural but also needed in legal and social life. It is also—viewed in terms of social conflict—a requirement for a social integration. The paper speaks of the two sources of Islam—the Qur’ân and the prophetic tradition—as supportive of this difference of opinion and shows that the prophet, his companions, and closest followers are all involved in debate stemmed from their difference of opinion. This difference is the natural consequence of the difference in the level of understanding, different language, culture, way of thinking, custom, and the extent to which the companions are in engaged in the activities of the prophet.

Abstract

This article deals with the issue of religious pluralism in the view of the leading authorities within Muhammadiyah. The paper argues that the scholars of the organization develop a unique view of religious pluralism in line with the vision of the founding fathers. Apart from some “discursive distortion” that these scholars might have undergone in the process of developing the discourse, their view deserves some appreciation for its depth and originality. The paper tries to show that there is indeed a tension between the cadres of the organization on the problem at hand. To dwell into this tension, the paper distinguishes between two major groups within the organization, namely that which accepts the notion of religious pluralism, and that which rejects it. The former includes such well-known scholars as Syafii Maarif, Amin Abdullah, Abdul Munir Mulkhan, and Moeslim Abdurrahman, whereas the latter includes the preachers and mosque-activists. Apart from these two groups, the paper will also look at the particular role that the Muhammadiyah’s Youth Movement has played in discourse-development among the members of the organization. Hence, the areas that the paper will cover include those that have been well-represented by the most admitted elements of the organization.

Abstract

The object of this study is Islam in Dayak communities; a subject that is rarely being studied. It tries to expose some interesting facts about Islam in these isolated communities. Many have hitherto thought that the Dayak communities are primitive with no particular affiliation to any formal religion. This paper tries to show the reverse. The truth is that these communities do even have reasonably developed view of Islam especially that which has to do the problem of tolerance and social life. The basic premise that this paper adopts is that a practice is form of paradigm; the way a particular society performs social life reflects their orientation of religious understanding. Hence, although the Dayak communities do not have paradigmatic understanding of Islam—in the strictest sense of the word—they do nonetheless have a practical discourse that emerge out of their unique and perhaps simple understanding of their religion. Relevant to the study of this object is the issue of community identity and how this issue is related to the religious identity. Hence, the paper is interested in exposing the tension between the two identities in the context of the Dayak communities in West Kalimantan.

Abstract

Samâ‘ in Tasawuf has been a very important element in the dissemination of this spiritual dimension of Islam. Yet, it has received very little both from the practitioners of Tasawuf and its intellectuals. This paper tries to expose this simply in a hope to make it heard in the academic and popular circle. Here, samâ‘ is not only understood as a form of music, as many would do, but also as an art of listening of which music is certainly part. The paper will explore the meaning and definition of this term, putting emphasis on its many-faceted function in the formation and development of one’s soul and spirituality. It is argued that soul is musical and artistic. Using art and music to talk to soul is therefore the proper way and means. The paper will also try to show that samâ‘ is also an indispensable part of spiritual method to reach and know God. Knowledge of God in other words, can be gained through this practice. Hence, samâ‘ is treated not only as a form of entertainment, but also a kind of practical epistemology.
