Abstract

This research aims to discuss democratic values and democratic interactions in customary law in Wajo Regency. This research uses a qualitative approach with normative juridical methods as stated in the constitution of the Republic of Indonesia. The results and discussion of this research show that democratic values cannot be separated from positive law, including customary law. As part of the Unitary State of the Republic of Indonesia, Wajo Regency also applies democratic values both in leadership in the district area and in customary areas. This can also be seen in the realization of the protection of people's constitutional rights in the field of customary law. This research tries to conclude that in Wajo Regency, the government of the Republic of Indonesia guarantees constitutional rights which originate from basic norms such as democratic values which are also implemented in local customary law. This research recommends that healthy democracy can occur in Wajo Regency regardless of collaboration between government and community elements.Keywords: Democracy; Customary Law; Wajo RegencyAbstrakPenelitian ini bertujuan untuk membahas nilai-nilai demokrasi dan interaksi demokrasi dalam hukum adat di Kabupaten Wajo. Penelitian ini menggunakan pendekatan kualitatif dengan metode yuridis normatif yang tertera dalam konstitusi Negara Republik Indonesia. Hasil dan pembahasan penelitian ini menunjukan bahwa nilai demokrasi tidak dapat dipisahkan dari hukum positif termasuk juga hukum adat. Sebagai bagian dari Negara Kesatuan Republik Indonesia, Kabupaten Wajo juga menerapkan nilai-nilai demokrasi baik dalam kepemimpinan di wilayah kabupaten dan juga di wilayah adat. Hal ini juga dapat dilihat dalam perwujudan perlindungan hak-hak konstitusional masyarakat di bidang hukum adat. Penelitian ini mencoba menyimpulkan bahwa di Kabupaten Wajo, pemerintah Republik Indonesia menjamin hak konstitusi yang bersumber dari norma-norma dasar seperti nilai-nilai demokrasi juga diterapkan dalam hukum adat setempat. Penelitian ini merekomendasikan agar terjadi demokrasi yang sehat di Kabupaten Wajo terlepas dari kolaborasi elemen pemerintah maupun masyarakat.Kata Kunci: Demokrasi; Hukum Adat; Kabupaten Wajo

Abstract

The Government of Indonesia (GoI) recently enacted Government Regulation Number 72/2016 concerning Shares Subscription and Arrangement of State Capitals in State-Owned Enterprises (BUMN) (hereinafter referred to as “PP Holding BUMN”). The Indonesian Ministry for BUMN (“Meneg BUMN”) proposes, that the Holding of BUMN will cover six core economic sectors: (1) Energy, (2) Mineral extraction, (3) Financial service, (4) Highway infrastructure/construction, (5) Property (real estate), (6) Food. BUMN is principally regulated in Article 33 paragraphs 1, 2, and 3 of the Indonesian Constitution 1945, which provides a legal basis for the state-owned monopolies by BUMN. On one hand, the GoI argues that Holding of BUMN is necessary because it would bring beneficial impacts, such as the strengthening of corporate performance by creating synergies and economies of scale and reducing inefficiencies in operations and financing; professionalizing the management system by distancing BUMN from unreasonable politics; and relieving the Government of its direct responsibilities of overseeing all the BUMN dispersed across various industries. On the other hand, there are public pervasive concerns that PP Holding BUMN would lead to unlawful privatization of BUMN, and this led to the public filing an appeal for a Judicial Review from the Indonesian Constitutional Court. Accordingly, this research attempts to analyze the Holding of BUMN under PP Holding BUMN, the Constitutional Law Analysis of Judicial Review over the Government Regulation Number 47/2017, as well as Law Number 19 year 2003 on BUMN.Keywords: Holding of Indonesian State-Owned Company (BUMN); Government Regulation Number 72/2016; Judicial Review; Indonesian Constitutional Court (MKRI)  AbstrakPemerintah Indonesia baru-baru ini menetapkan Peraturan Pemerintah Nomor 72 Tahun 2016 tentang Langganan Saham dan Penyelenggaraan Modal Negara pada Badan Usaha Milik Negara (BUMN) (selanjutnya disebut "PP Holding BUMN"). Kementerian BUMN mengusulkan bahwa Holding BUMN akan mencakup enam sektor ekonomi inti: (1) Energi, (2) Ekstraksi Mineral, (3) Layanan Keuangan, (4) Infrastruktur/Jalan Raya, (5) Properti (real estat), (6) Pangan. BUMN pada dasarnya diatur dalam Pasal 33 ayat 1, 2, dan 3 Undang-Undang Dasar 1945 Indonesia, yang memberikan dasar hukum bagi monopoli milik negara oleh BUMN. Di satu sisi bahwa Holding BUMN diperlukan karena akan membawa dampak positif, seperti penguatan kinerja perusahaan dengan menciptakan sinergi dan ekonomi skala serta mengurangi ketidakefisienan dalam operasi dan pendanaan; profesionalisasi sistem manajemen dengan menjauhkan BUMN dari politik yang tidak masuk akal; dan meringankan Pemerintah dari tanggung jawab langsung pengawasan terhadap semua BUMN yang tersebar di berbagai industri. Di sisi lain, ada kekhawatiran masyarakat yang meluas bahwa PP Holding BUMN akan mengarah pada privatisasi yang tidak sah dari BUMN, dan hal ini menyebabkan masyarakat mengajukan permohonan Judicial Review ke Mahkamah Konstitusi Indonesia. Abstract

The domain of higher education plays a crucial role in cultivating exceptional human resources. The primary emphasis of education reform in Indonesia is the implementation of the Independent Curriculum. This article examines the execution of the Merdeka Curriculum at higher education institutions to evaluate its influence on learning and the attainment of learning objectives. The objective of this study is to determine the most effective methods for implementing the Merdeka Curriculum in higher education, assess the opinions of both lecturers and students regarding the Merdeka Curriculum, and evaluate its influence on the attainment of learning objectives. This study employs a mixed strategy, integrating both qualitative and quantitative methodologies. The qualitative technique entails conducting comprehensive interviews with instructors and analyzing policy papers. Concurrently, the quantitative approach entails conducting surveys among students to gauge their impressions of the Merdeka Curriculum, as well as employing statistical analysis to assess the attainment of learning objectives. The research findings indicate that there are differences in the approaches used to apply the Independent Curriculum, which involve modifications to resources, teaching techniques, and evaluation systems. The lecturers and students had favorable reactions to this strategy, perceiving it as a pioneering measure in enhancing the curriculum's alignment with the demands of the job market. The data analysis indicates that students who participate in the Merdeka Curriculum exhibit a greater degree of pleasure and attain superior learning outcomes in comparison to the control group. In addition, it was mentioned that the introduction of the Independent Curriculum in higher education had a beneficial effect on learning and the attainment of learning objectives. By employing an appropriate methodology, a combination of qualitative and quantitative approaches offers a comprehensive comprehension of the execution of the Merdeka Curriculum and furnishes valuable direction for subsequent curriculum enhancement.Keywords: Independent Curriculum; Education units; CollegeAbstrak:Ranah pendidikan tinggi memegang peranan penting dalam menumbuhkan sumber daya manusia yang unggul. Penekanan utama reformasi pendidikan di Indonesia adalah penerapan Kurikulum Mandiri. Artikel ini mengkaji penerapan Kurikulum Merdeka di perguruan tinggi untuk mengevaluasi pengaruhnya terhadap pembelajaran dan pencapaian tujuan pembelajaran. Tujuan penelitian ini adalah untuk mengetahui metode penerapan Kurikulum Merdeka yang paling efektif di perguruan tinggi, menilai pendapat dosen dan mahasiswa mengenai Kurikulum Merdeka, dan mengevaluasi pengaruhnya terhadap pencapaian tujuan pembelajaran. Penelitian ini menggunakan strategi campuran, yang mengintegrasikan metodologi kualitatif dan kuantitatif. Teknik kualitatif mencakup melakukan wawancara komprehensif dengan instruktur dan menganalisis makalah kebijakan. Sementara itu, pendekatan kuantitatif mencakup pelaksanaan survei di kalangan siswa untuk mengukur kesan mereka terhadap Kurikulum Merdeka, serta menggunakan analisis statistik untuk menilai pencapaian tujuan pembelajaran. Temuan penelitian menunjukkan bahwa terdapat perbedaan pendekatan yang digunakan untuk menerapkan Kurikulum Mandiri, yang melibatkan modifikasi sumber daya, teknik pengajaran, dan sistem evaluasi. Para dosen dan mahasiswa mempunyai reaksi positif terhadap strategi ini, dan menganggapnya sebagai langkah perintis dalam meningkatkan keselarasan kurikulum dengan tuntutan pasar kerja. Analisis data menunjukkan bahwa siswa yang mengikuti Kurikulum Merdeka menunjukkan tingkat kesenangan yang lebih besar dan memperoleh hasil belajar yang lebih unggul dibandingkan dengan kelompok kontrol. Selain itu disebutkan bahwa pemberlakuan Kurikulum Mandiri pada perguruan tinggi memberikan pengaruh yang menguntungkan terhadap pembelajaran dan pencapaian tujuan pembelajaran. Dengan menggunakan metodologi yang tepat, kombinasi pendekatan kualitatif dan kuantitatif memberikan pemahaman komprehensif tentang pelaksanaan Kurikulum Merdeka dan memberikan arahan yang berharga untuk penyempurnaan kurikulum selanjutnya.Kata Kunci: Kurikulum Merdeka; Satuan Pendidikan; Perguruan Tinggi

Abstract

Government Employees with Employment Agreements (PPPK) are required to comply with regulations relating to employment and are required to have good behavior such as being loyal and obedient to the stateIn siyasa fiqh it is referred to as tabi'in (followers). Where tabi'in are required to obey and obey the orders and rules made by ulil amri (Leader). The purpose of this study is to find out the application of government employee discipline with work agreements (PPPK) according to PP no. 49 of 2018 concerning Management of Government Employees with Work Agreements (PPPK). Knowing the Application of Discipline for Government Employees with Employment Agreements (PPPK) According to Fiqh Siyasah. The results of the study show that the application of disciplinary regulations for Government Employees with Employment Agreements (PPPK) is confirmed in Government Regulation No. 49 of 2018 article 51 and article 52 but in these articles, it is explained that the imposition of disciplinary sanctions is carried out by government agencies that have the authority to impose sanctions on employees. In adhering to the Siyasah Fiqh principles in the application of employee discipline, employees must have the principles of sovereignty, the principles of justice, the principles of deliberation and Ijma', the principles of equality, the principles of the obligations of the state and the people and the principle of amar ma'ruf nahi munkar. Dalam fiqh siyasah disebut sebagai tabi’in (pengikut). Dimana tabi’in diwajibkan untuk patuh dan taat terhadap perintah dan aturan yang dibuat oleh ulil amri (Pemimpin). Tujuan dari penelitian ini adalah Untuk Mengetahui Penerapan Disiplin Pegawai Pemerintah Dengan Perjanjian Kerja (PPPK) Menurut PP No. 49 Tahun 2018 tentang Manajemen Pegawai Pemerintah dengan Perjanjian Kerja (PPPK). Mengetahui Penerapan Disiplin Pegawai Pemerintah Dengan Perjanjian Kerja (PPPK) Menurut Fiqih Siyasah. Hasil penelitian menunjukkan bahwa Penerapan peraturan disiplin bagi Pegawai Pemerintah dengan Perjanjian Kerja (PPPK) ditegaskan pada Peraturan Pemerintah No. 49 Tahun 2018 pasal 51 maupun pasal 52 namun didalam pasal tersebut dijelaskan bahwa pemberian sanksi disiplin dilakukan oleh instansi pemerintah yang memiliki kewenangan untuk memberikan sanksi kepada Pegawai Pemerintah. Dalam menegakan prinsip Fiqih Siyasah pada penerapan disiplin pegawai harus memiliki prinsip kedaulatan, prinsip keadilan, prinsip musyawarah dan Ijma’, prinsip persamaan, prinsip hak kewajiban negara dan rakyat serta prinsip amar ma’ruf nahi munkar. Abstract

This research aims to investigate the impact of financial distress on predicting the potential for bankruptcy and investigate the influence of financial ratios in predicting profit growth in cosmetic companies listed on the Indonesia Stock Exchange during the period 2020-2022. This research uses a quantitative analysis approach to evaluate the level of financial health of companies, with a focus on identifying indicators of financial distress  that may affect the financial conditions of cosmetic companies listed on the Indonesia Stock Exchange. Researchers use bankruptcy models and financial ratio analysis to measure the level of financial distress and predict company profit growth of the companies. This research uses data obtained from the financial reports of each company during the specified period from 2020 to 2022.

Abstract

This study aims to determine the effect of Working Capital, Total Asset turnover, and Debt Equity Ratio on the Profitability of food companies listed on the Indonesia Stock Exchange for the period 2018-2020. Profitability in this study uses the ROA ratio. This research uses a quantitative method. The sampling used is purposive. Thus, the conclusion is to look for the influence of Working Capital, DER, and TATO, together (simultaneously) on profitability in food and beverage companies listed on the Indonesia Stock Exchange for the 2020-2022 period. Abstract

Juridically Indonesia has owned a set of law regulations to guarantee children’s rights and decrease the impact of working from children, one of which is law Number 13 Year 2003 about Employment. In Islam, children are a blessing from Allah God Almighty for parents to take care of and nurture well. This paper provides an understanding of the legal protection find out the legal protection towards minor workers according to Law Number 13 Year 2003 and find out the legal protection towards minor workers according to Islamic law. The author employed a library research type with a normative juridical approach. The data sources used in this research were primary data amely The Law Number 13 the Year 2003 and the book entitled Al-Qur’an and Social Prosperity. The secondary data were books, journals, documents, law regulations, and so on. The research results showed that the regulation in Article 68 until Article 75 Law Number 13 the Year 2003 gives the guarantee of legal protection to minor workers to gain their rights and obligation facility as workers. Islamic law gives legal protection to minor workers. Islamic law gives protection for underage child workers from a maslahah perspective. Legal protection for working children seen from their interests is included in the maslahah al-dharuriyah category because it concerns the basic needs of humanity in this world and the hereafter, namely maintaining religion, soul, mind, lineage, and property.Keywords: Legal protection, Worker, Minor, Islamic Law AbstrakSecara yuridis Indonesia telah mempunyai seperangkat peraturan perundang-undangan untuk menjamin hak-hak anak dan mengurangi dampak bekerja dari anak, salah satunya yaitu UU nomor 13 tahun 2003 tentang Ketenagakerjaan. Sedangkan dalam Islam, anak adalah sebuah titipan Allah SWT kepada orang tua untuk merawat, menjaga, dan memeliharanya dengan baik. Tulisan ini memberikan pemahaman mengenai perlindungan hukum terhadap pekerja anak di bawah umur menurut Undang-Undang nomor 13 tahun 2003 dan untuk mengetahui perlindungan hukum terhadap pekerja anak di bawah umur menurut hukum Islam. Penelitian ini merupakan penelitian kualitatif kepustakaan (Library Research) dengan pendekatan yuridis normatif. Sumber data yang digunakan adalah sumber data primer yaitu Undang-Undang nomor 13 tahun 2003 dan buku yang berjudul Al-Qur’an dan kesejahteraan sosial. Sumber data sekunder yaitu, buku, jurnal, dokumen, peraturan perundangan, dan sebagainya. Hasil penelitian ini  menunjukkan melalui peraturan pada Pasal 68 sampai dengan Pasal 75 Undang-Undang Nomor 13 Tahun 2003 memberikan jaminan perlindungan hukum bagi pekerja anak di bawah umur untuk mendapatkan fasilitas hak-hak dan kewajibannya sebagai pekerja. Hukum Islam memberikan perlindungan terhadap pekerja anak di bawah umur dalam perspektif maslahah. Perlindungan hukum bagi anak yang bekerja dilihat dari kepentingannya termasuk kategori maslahah al-dharuriyah, karena menyangkut kebutuhan pokok umat manusia di dunia dan di akhirat, yakni memelihara agama, jiwa, akal, keturunan, dan harta.Kata Kunci: Perlindungan Hukum Pekerja, Anak di Bawah Umur, Hukum Islam

Abstract

The goal of national development is the creation of a just and prosperous society based on Pancasila and the 1945 Constitution. One of the activities that can support national development is the Capital Market. After the issuance of Law Number 4 of 2023 concerning Development and Strengthening of the Financial Sector, the functions, duties and authority over regulation and supervision were given to the Financial Services Authority. One of the authorities given to the Financial Services Authority is to grant business permits to Mutual Funds as a forum used to collect funds from the investing public or investors to then be invested in Securities Portfolios, collective investment portfolios, and/or other financial instruments by the Investment Manager. The person entitled to represent the interests of the Investment Manager in carrying out Securities Portfolio management activities is the Deputy Investment Manager. However, unfortunately, the clear regulations given to the Financial Services Authority based on Law Number 4 of 2023 concerning the Development and Strengthening of the Financial Sector are for the supervision of Investment Managers and do not provide clear regulations for supervising the activities of Deputy Investment Managers.Keywords: Financial Services Authority; Capital Markets; Investment; Mutual Funds Abstrak Tujuan pembangunan nasional adalah terciptanya masyarakat adil dan makmur berdasarkan Pancasila dan UUD 1945. Salah satu kegiatan yang dapat menunjang pembangunan nasional adalah Pasar Modal. Pasca terbitnya Undang-Undang Nomor 4 Tahun 2023 tentang Pembinaan dan Penguatan Sektor Keuangan, fungsi, tugas, dan wewenang pengaturan dan pengawasan diserahkan kepada Otoritas Jasa Keuangan. Salah satu kewenangan yang diberikan kepada Otoritas Jasa Keuangan adalah memberikan izin usaha kepada Reksa Dana sebagai wadah yang digunakan untuk menghimpun dana dari masyarakat investor atau pemodal untuk kemudian diinvestasikan pada Portofolio Efek, portofolio investasi kolektif, dan/atau instrumen keuangan lainnya dengan cara: Manajer Investasi. Yang berhak mewakili kepentingan Manajer Investasi dalam melaksanakan kegiatan pengelolaan Portofolio Efek adalah Wakil Manajer Investasi. Namun sayangnya, pengaturan yang jelas yang diberikan kepada Otoritas Jasa Keuangan berdasarkan Undang-Undang Nomor 4 Tahun 2023 tentang Pembinaan dan Penguatan Sektor Keuangan hanya untuk pengawasan terhadap Manajer Investasi dan tidak memberikan pengaturan yang jelas untuk pengawasan terhadap kegiatan Deputi Manajer Investasi.  Kata Kunci: Otoritas Jasa Keuangan, Pasar Modal, Investasi, Reksa Dana

Abstract

The high number of narcotics abuse in Indonesia cannot be denied because of the minimum assistance or report from the community related to the presence of narcotics crime existing around them. In the perspective of Islamic Law, narcotics is like khamr in which if it is consumed then it will cause mind lost. Therefore, khamr is forbidden in Islam. This paper provides an understanding of legal protection towards the informant of narcotics crime allegation according to The Law Number 35 Year 2009 and to find out the legal protection towards the informant of narcotics crime allegation according to Islamic law. The author employed library research type with normative juridical approach. The research results showed that The Law Number 35 Year 2009 about narcotics gives legal protection towards the informant of narcotics crime allegation systematically. Started from the protection aspect towards the physique, protection towards the psychic, and legal assistance during the process of justice and right reinforcement, and obtain an award. Islamic law gives legal protection to the informant of khamr drinker. Islamic law gives the opportunity by giving the protection towards the informant of khamr drinker not to be punished and the khamr drinker must be punished to implement the punishment and had in line with Islamic teaching namely the execution of whiplash for 40 times.Keywords: Informant Legal Protection, Narcotics, Islamic Law.  AbstrakTingginya angka penyalahgunaan narkotika di Indonesia tidak bisa di pungkiri, karena minimnya bantuan atau laporan dari masyarakat terkait adanya tindak pidana narkotika yang ada di sekitar mereka. Dalam perspektif hukum Islam, narkotika diqiyaskan dengan khamr, yang apabila diminum akan mengakibatkan hilangnya akal. Oleh karena itu khamr diharamkan dalam Islam. Tulisan ini memberikan pemahaman mengenai perlindungan hukum terhadap pelapor dugaan tindak pidana narkotika menurut Undang-Undang nomor 35 tahun 2009 dan perlindungan hukum terhadap pelapor dugaan tindak pidana narkotika menurut hukum Islam. Hasil penelitian menunjukkan Undang-Undang Nomor 35 tahun 2009 tentang narkotika memberikan perlindungan hukum terhadap pelapor dugaan tindak pidana narkotika secara sistematik. Mulai dari aspek Perlindungan terhadap fisik, perlindungan terhadap psikis, dan pendampingan hukum selama proses penegakkan hak dan keadilan, serta mendapatkan penghargaan. Hukum Islam memberikan perlindungan hukum terhadap pelapor peminum khamr. Hukum Islam memberikan kesempatan dengan memberikan perlindungan terhadap pelapor peminum khamr agar tidak dihukum dan wajib bagi seorang peminum khamr untuk melaksanakan hukuman atau had sesuai ajaran Islam, yaitu dengan terlaksananya dera sebanyak 40 kali.Kata Kunci: Perlindungan Hukum Pelapor, Narkotika, Hukum Islam

Abstract

This study aims to analyze the effect of mergers and religiosity on switching behaviour of customers BSI users who live in DKI Jakarta Province. This study is quantitative research using Multiple Linear Regression via Microsoft Excel 2010 and SPSS version 26. The population of this research, customers BSI users, was sampled as many as 100 respondents using the Purposive Sampling technique. Data was collected using a questionnaire on google form. The research results show that mergers and religiosity simultaneously have a significant effect on Switching Behaviour. Partially, the merger has a positive and significant effect on Switching Behaviour, so that you have a good opportunity to move now or in the future. Likewise, religiosity has a positive and significant effect on switching behaviour. It is important for management to pay attention to customer switching behavior, because this will affect the target number of customer increases that the bank wants to achieve.  Keywords : Effect of Merger, Influence of Religiosity, Switching Behaviour, Indonesian Bank Syariah (BSI) Customers
