Abstract

Each formation of local regulations must meet philosophical, sociological, and juridical elements. This aims to form local regulations that can keep up with the community developments and can be applied effectively. The problems under the study were the requirements and efforts related to responsive local regulations. The study employed a normative-juridical approach. Specifically, This study used descriptive-analytical research. The findings revealed the local regulations must have clear philosophical, sociological, and juridical values to create a responsive regulation to community development. In addition, this study also concluded that this matter also gave the community an opportunity to take part in forming local regulations. Meanwhile, the efforts can also be done by establishing local regulations based on applicable laws and regulations. Besides, this should also be accompanied by academic texts and public hearing to gather public opinion on the discussion of draft local regulations

Abstract

Citarum river, located in West Java, is the longest and the largest river in Indonesia. Nevertheless, it is also noted as the most polluted rivers in the world. The aims of this research are to know the steps and the efforts taken by the government in the manifestation of Citarum Harum program, to understand the legal basis or the legal form or legislation with the involvement of the Indonesian National Army, and to see the social impact of this program for the local community. The juridical-empirical research methodology in this study refers to a research method in the literature study and an interview to sources by asking several questions face to face. The findings showed the Government involvement in handling Citarum River is stipullated in the Presidential Regulation Number 15 of 2018, the acceleration of pollution control and damage of watershed. To tackle with the problem, the government hold a program called Citarum Harum. In addition, the involvement and the various efforts done by Indonesian National army members in the program is in accordance with the mandatory laws. It has a significant impact on the ecosystem and the local community.Sungai Citarum yang terletak di Jawa Barat merupakan sungai yang paling panjang dan paling besar di Indonesia. Namun sayangnya, Sungai Citarum tercatat sebagai salah satu dari sungai yang paling tercemar di dunia.. Tujuan penelitian ini untuk mengetahui langkah-langkah pemerintah dalam upaya mewujudkan program Citarum Harum, mengetahui dasar hukum dan kaitan hukum atau undang-undang dengan keterlibatan Tentara Nasional Indonesia dalam program Citarum Harum, dan mengetahui dampak sosial program Citarum Harum bagi masyarakat setempat. Metode penelitian hukum yuridis empiris  yaitu metode penelitian studi kepustakaan dan wawancara yang dilakukan dengan mengajukan beberapa pertanyaan kepada narasumber secara langsung dengan bertatap muka. Hasil penelitian menunjukkan bahwa penanganan Sungai Citarum yang melibatkan pemerintah, yaitu Peraturan Presiden Nomor 15 Tahun 2018 tentang Percepatan Pengendalian Pencemaran dan Kerusakan Daerah Aliran Sungai Citarum dengan pemerintah juga mengadakan sebuah program untuk menanggulangi pencemaran dalam Sungai Citarum ini, yang diberi nama Citarum Harum dan keterlibatan anggota Tentara Nasional Indonesia dalam program Citarum Harum dalam melakukan berbagai upaya yang sesuai dengan amanah Undang-undang ini memberikan dampak yang cukup signifikan terhadap ekosistem dan juga sosial masyarakat setempat.

Abstract

Article 28D paragraph (2) of the 1945 Constitution states everyone has the right to work and to receive fair and proper compensation and treatment in a working relationship. It is emphasized in Article 151 (1) of Law no. 13/2003 concerning Manpower. The entrepreneurs, workers/laborers, trade/labor unions, and the government must make every effort to prevent an employment termination. In fact, many workers have been terminated and some even did not receive any severance pay at all. Accordingly, the researchers formulated the following research questions: how to terminate employment in the midst of the Covid-19 pandemic, and how is the government’s responsibility for the welfare guarantees for workers. This research employed a normative juridical approach by collecting data from literature studies. The data obtained were analyzed qualitatively. The findings revealed the layoffs in the midst of the Covid-19 pandemic were a breach of contract by entrepreneurs.  The entrepreneurs were still obliged to provide severance pay, reward money, and compensation money. In addition, the government has also provided accountability in the form of an economy, the Pre-Work Card. With this card, workers can develop workforce competence, increase productivity and competitiveness of the workforce, and develop entrepreneurship. The Manpower Office responsible for this program also participated in the workforce supervising and guiding

Abstract

The duties implementation of the Election Supervisory Board in the prevention and prosecution against violations and process disputes requires qualified resources for producing higher quality elections. The aims of this paper are to: 1) See the construction of membership elements of the Election Supervisory Board based on the Law number 7 of 2017; 2) Reveal the need of reconstructing the Election Supervisory Board membership elements; 3) Find the concepts related to the reconstruction of the Election Supervisory Board membership elements in realizing higher quality elections. This study used normative legal research method and conceptual approach with a constructive design paradigm. The data was taken from secondary data, a documentary study, then was analyzed qualitatively. The findings showed the Article 92 paragraph (1) of Law Number 7 of 2017 only regulates an individual the Election Supervisory Board membership. Thus, it is necessary to reconstruct the Election Supervisory Board for philosophical, sociological and juridical reasons. For instances, the reconstruction can be done by adding a paragraph to the Law of Article 92. For the reccomendation, the Election Supervisory Board should be supported by members who have an understanding of material and formal laws of the election. Besides, in the membership, there should be a member from law enforcers. Thus, it is necessary to reconstruct the Law Articles governing the Election Supervisory Board membership.Pelaksanaan tugas Badan Pengawas Pemilihan Umum (Bawaslu) dalam upaya pencegahan dan penindakan terhadap pelanggaran dan sengketa proses agar menghasilkan Pemilu yang lebih berkualitas, dibutuhkan sumber daya yang mumpuni. Tujuan penulisan ini untuk 1) melihat konstruksi unsur keanggotaan Bawaslu menurut Undang-Undang Nomor 7 Tahun 2017; 2) Mengungkap perlunya dilakukan rekonstruksi unsur keanggotaan Bawaslu; 3) Menemukan konsep terkait rekonstruksi unsur keanggotaan Bawaslu dalam mewujudkan Pemilu yang lebih berkualitas. Metode penelitian ini mengunakan penelitian hukum yuridis normatif melalui pendekatan konseptual, dengan paradigma design konstruktif. Data  digunakan adalah data sekunder yang diperoleh melalui studi dokumenter. Selanjutnya dianalisa secara kualitatif. Hasil penelitian ditemukan bahwa Pasal 92 ayat (1) Undang-Undang Nomor 7 Tahun 2017 hanya mengatur keanggotaan Bawaslu terdiri dari individu. Perlu dilakukan rekonstruksi keanggotaan Bawaslu dengan alasan filosofis, sosiologis, dan yuridis. Dapat dilakukan rekonstruksi dengan menambah ayat pada Pasal 92 UU. Saran, Bawaslu hendaknya didukung dengan keanggotaan yang memiliki pemahaman hukum materil dan hukum formil tentang kepemiluan. Sebaiknya dalam keanggotaannya terdapat anggota yang berasal dari unsur penegak hukum, dan untuk itu perlu dilakukan rekonstruksi terhadap pasal undang-undang yang mengatur tentang keanggotaan Bawaslu

Abstract

The judicial system in Indonesia has now begun to adapt to the developments in information and technology to improve court case administration services which are realized through the digitization of court cases or known as the electronic justice system (e-court). E-court is a case processing service. It involves registration, payment of fees, and court summons via electronic media and online. The implementation of e-court in Indonesia is based on supreme court regulation No.1 of 2019 on Electronic case and trial administration in courts. This e-court system is designed to create an effective, efficient, and cost-effective Indonesian justice system for justice seekers. However, the lack of public understanding of the e-court system becomes an obstacle to implementing an e-court system in Indonesia. This research aims to analyze how the role of the court in socializing the e-court system to the public as an effort to improve case administration services in court. The research employed normative legal research and a literature study approach with the secondary assessment of legal materials and juridical data analysis. The findings revealed that the current courts are still working to improve technology-based court administration services (e-court) to the public by providing explanations and education through the official website of state court accounts spread throughout Indonesia. In addition, the court has also massively socialized the implementation of the e-court system to the public, advocates/lawyers, and court officials via online and offline. Unfortunately, for people who wish to litigate electronically at this time, it can only be done by cooperating with advocates/lawyers who have e-court access.

Abstract

The purpose of this study is to analyze the arrangement and the application of House Ownership Credits known as KPR based on the prevailing laws and regulations. This study employed a juridical-empirical approach. The juridical approach was used to analyze various laws and regulations. Meanwhile, the empirical approach was used to analyze the law which was viewed as a patterned community behavior in people’s lives that continually interacts and relates to social aspects. Reffering to the state regulation of public housing number 6 of 2011, the findings revealed the procurement of housing and settlements was supported by housing and financial aid in the form of housing subsidies through credits/home ownership financing. In addition, it is also required to submit a collateral in each application of a mortgage agreement with the bank. This collateral provides an assurance to the bank that the credit granted to the customers returns according to mutually agreed terms and minimizes the possible risk involved and arise in any credit disbursement. Meanwhile, in terms of providing credits to prospective debtors, the bank must have a confidence in the debtors’ ability or capability to repay the loan. In conclusion, credit is a loan-borrowing agreement between the bank and the other party that requires the borrower to pay off his debt with the amount of interest, compensation or profit sharing within a certain period of time. Besides, in the implementation of legal aspects for credit applicants, a general home ownership credit applicant is an individual or human who is not a legal entity. Humans who are not legally incorporated are legal subjects. Thus, a credit analyst and an authorized officer who work in a credit unit must be able to fully understand the ins and outs of the credit applicant’s legal aspects.Tujuan penelitian yaitu menganalisis Pengaturan dan Pelaksanaan Perjanjian Kredit Pemilikan Rumah (KPR) Berdasarkan Peraturan Perundang-Undangan. Metode Penelitian yang digunakan dalam penelitian ini adalah Pendekatan Yuridis Empiris. Pendekatan Yuridis digunakan untuk menganalisis berbagai peraturan perundang-undangan. Sedangkan pendekatan empiris digunakan untuk menganalisis hukum yang dilihat sebagai perilaku masyarakat yang berpola dalam kehidupan masyarakat yang selalu berinteraksi dan berhubungan dalam aspek kemasyarakat. Hasil penelitian yaitu peraturan menteri negara perumahan rakyat nomor 6 tahun 2011 tentang perumahan rakyat menyebutkan bahwa pengadaan perumahan dan pemukiman dengan dukungan bantuan pembiayaan perumahan dalam bentuk subsidi perumahan melalui kredit/pembiayaan pemilikan rumah. Setiap pelaksanaan perjanjian kredit pemilikan rumah pada bank, disyaratkan untuk menyerahkan jaminan. Fungsi jaminan ini adalah untuk memberikan keyakinan kepada bank bahwa kredit yang diberikan kepada nasabah dapat diterima kembali sesuai dengan syarat-syarat yang telah disepakati bersama, dan itu juga untuk meminimalisir resiko yang terkandung dan senantiasa dimungkinan dapat timbul dalam setiap pelepasan kredit.Berkaitan dengan pemberian kredit kepada calon debitur, maka pihak bank harus mempunyai keyakinan atas kemampuan atau kesanggupan pengembalian pinjaman kredit oleh debitur. Simpulan bahwa kredit adalah persetujuan atau kesepakatan pinjam-meminjam antara bank dan pihak lain yang mewajibkan peminjam untuk melunasi utangnya setelah jangka waktu tertentu dengan jumlah bunga, imbalan atau pembagian hasil keuntungan. Pelaksanaannya aspek hukum bagi pemohon-pemohon kredit. Pada umumnya pemohon kredit pemilikan rumah adalah perorangan atau manusia dan tidak berbadan hukum. Manusia yang tidak berbadan hukum adalah subyek hukum. Seorang analisis kredit dan pejabat yang bertugas di unit kerja perkreditan harus mampu memahami seluk beluk aspek-aspek hukum pemohon kredit

Abstract

During the pandemic of Covid-19, cases of domestic violence (KDRT) in Indonesia increased. This is because the people experience stress during the pandemic. The stress arises due to the implementation of Large-Scale Social Restrictions (PSBB) set by the Government.  In the PSBB period, all normal activities were disrupted, and even affected the economic situation of the community. Accordingly, the researcher discusses the following research problem: The form of legal protection for victims of domestic violence during the Covid-19 pandemic and the factors influence the increase in domestic violence during the pandemic of covid-19. This study employed normative juridical approach. The legal materials in this study were derived from statutory regulations, books, other scientific works, or dictionaries. In conclusion, to impose Large-Scale Social Restrictions (PSBB), the Regional Government needs to review the impact of PSBB on the family. Accordingly, this research is expected to provide an understanding to the public relates to the form of legal protection for everyone who experiences domestic violence during the pandemic. This is stipulated in Law No.23 of 2004 concerning the elimination of domestic violence and the factors influence the domestic violance

Abstract

Marriage Age Maturity, PUP is a BKKBN program which regulates the age maturity limit for marriage, a minimum of 20 years for women and a minimum of of 25 years for men. This provision differs from the minimum marriageable age stated in the marriage act. The importance of PUP program is to prepare the adolescents entering the ideal age of marriage in the context of creating a quality family and controlling the population. In this case, Purbalingga Regency has a high level of early marriage. Thus, the PUP program is highly needed to realize the ideal age of marriage. Accordingly, the purpose of this study is to know the implementation of PUP in realizing the population control and developing family in Purbalingga Regency as well as revealing the factors that influence its implementation. This study employed juridical-empirical and qualitative approaches. The findings revealed the implementation of PUP program in Purbalingga Regency was realized in the form of KIE (Information and Education Communication). This was carried out by Dinsos Dalduk KB P3A in collaboration with PIK-R/M, Duta Genre, government agencies such as the health office, KUA, Ministry of Religious Affairs, Rural areas community development, and the participation of PLKB. However, this program was not fully implemented. Meanwhile, regarding the factors that influence its implementation, a supporting factors covered the partnership cooperation and support from religious leader and the community. The inhibiting factors, on the other hand, covered legal factors, law enforcement, means and facilities, personal factors, and social factors.Pendewasaan Usia Perkawinan (PUP)  merupakan program BKKBN yang mengatur tentang  pendewasaan batas usia  perkawinan yaitu minimal 20 tahun bagi perempuan dan laki-laki minimal berusia 25 tahun, yang mana ketentuan tersebut berbeda dengan aturan batas usia perkawinan dalam Undang-Undang Perkawinan.  Pentingnya program PUP adalah untuk mempersiapkan remaja memasuki usia  perkawinan yang ideal dalam rangka membentuk keluarga berkualitas dan sarana sarana pengendalian penduduk. Kabupaten Purbalingga mempunyai tingkat perkawinan muda nya tinggi sehingga program PUP sangat dibutuhkan untuk mewujudkan usia perkawinan yang ideal. Penelitian ini bertujuan mengetahui implementasi Program PUP guna mewujudkan pengendalian penduduk dan pembangunan keluarga di Kabupaten Purbalingga dan faktor yang mempengaruhi implementasi dengan menggunakan metode penelitian yuridis empiris dan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa implementasi program PUP di Kabupaten Purbalingga dilakukan dalam bentuk KIE (Komunikasi Informasi dan Edukasi) oleh Dinsos Dalduk KB P3A bekerja sama dengan PIK-R/M, Duta Gendre, instansi pemerintah seperti Dinas Kesehatan, KUA, Kementerian Agama, pembinaan institusi masyarakat pedesaan, peran serta PLKB. Namun program PUP tersebut masih belum  terlaksana  secara menyeluruh. Adapun faktor –faktor yang mempengaruhi implementasi berupa faktor pendukung yaitu kerja sama kemitraan dan dukungan para tokoh agama dan masyarakat sedangkan faktor menghambatnya berupa  faktor hukum, penegak hukum, sarana dan fasilitas,  faktor  personal, faktor sosial

Abstract

In general, legal discovery refers to conducting legal searches when the statutory regulations are not regulated and are unclear. Legal discovery is not only based on the concept of positive law, but it also refers to Islamic concepts. This aims to find the law on an issue where the regulation is not yet regulated. Thus, inexistence and unclear issues in law become present and apparent. Legal discovery in Islamic concept is known as Ijtihad, an act and an effort to find, understand, and formulate Islamic Shari’ah ruling. Legal discovery in Islam is conducted using several methods including istinbat, interpretation, literal/linguistic, causation (ta’lili), and synchronization methodologies. Other methods of legal discovery are qiyas, istihsan, maslahah mursalah, istishhab, urf, mazhab shahabi which cannot be separated from the main sources of Islamic law, the Qur’an and hadith. Meanwhile, ra'yu and ijtihad are ways of thinking in understanding the Qur’an and hadith. These are to determine a problem where its nash has not been determined. The researchers employed library research in this study. The study examined the documents using secondary data and analyzed it using a qualitative method where the data are described in words, not numbers. In addition, the data collection is based on literature studies taken from books, journals, and internet sources related to legal discovery in the Islamic concept.

Abstract

Law and economic are the pillars of development. They must be compatible and aligned in the interests of the people. Accordingly, the policy direction of political and economic laws must have value. Thus, the objective of the law can be achieved. In addition, laws are made and built to regulate the business behavior done by investors. These are to protect their economic activities with laws. For these reasons, this research is formulated. This research focused on the following problems: First, how is the concept of law as the basis of economic development? Second, how is the policy direction of political law in National Economic Development? This research employed a normative method and conceptual and historical approach. The findings revealed two ideas: First, five elements such as stability, predictability, fairness, education, and the special development abilities of the lawyer must be developed so that law does not hamper the economy. Second, the policy direction of political law in national economic development is a reflection of the objectives of Indonesian development. Therefore, the development of economic law needs integrated and interdisciplinary skills that require tolerance.
