Abstract

This study aims to find out the considerations of the Constitutional Court Judge in issuing Constitutional Court Decision No. 36/PUU-XV/2017 as well as to identify the implications of the Decision on the Independence of Corruption Eradication Commission. The method used in this study was normative juridical method. The data collected through library research were then analyzed analytic-descriptive. The formulations of the problem are; 1) What are the considerations of the Constitutional Court Judge in issuing Constitutional Court Decision No. 36/PUU-XV/2017 against judicial review of Law No. 17 of 2017 concerning MD3? and 2) What are the implications of the Constitutional Court Decision No. 36/PUU-XV/2017 against judicial review of Law No. 17 of 2017 concerning MD3 on the independence of Corruption Eradication Commission? As results, it was found that; 1) in Constitutional Court Decision No. 36/PUU-XV/2017, the Constitutional Court states that the inquiry right owned by the House of Representatives over the Corruption Eradication Commission is constitutional as long as it does not relate to the authority of investigation and prosecution owned by the Corruption Eradication Commission with the consideration that the Corruption Eradication Commission is a state institution that includes to the realm of executives; and 2) The House of Representatives will give a strong influence on the Corruption Eradication Commission even though the inquiry right owned by the House of Representatives cannot touch the authority of the Corruption Eradication Commission in conducting investigations and prosecutions. However, there is an indication that the effort to provide inquiry right is not a legal effort but rather a political effort which is widely applied in countries adhering to a parliamentary system where the parliament tends to be more dominant than the executive. Hence, it can be concluded that; 1) in this Decision, the Constitutional Court Judge did not use a stronger grammatical and systematic interpretation based on the original intense. Besides, this Decision is ambiguous and potentially contradicts with the previous Decision, namely Constitutional Court Decision No.012-016-019/PUU-IV/2006; and 2)  there will be consequences for the Corruption Eradication Commission in the future, especially in terms of independence, since it can be used as an object of inquiry right by the House of Representatives. Implikasi Putusan Mahkamah Konstitusi No. 36/Puu-Xv/2017 Terhadap Independensi Komisi Pemberantasan KorupsiTujuan dari pennelitian ini adalah untuk mengetahui pertimbangan Hakim Konstitusi dalam memutus perkara No. 36/PUU-XV/2017 dan Implikasi dari putusan tersebut terhadap Independensi Komisi Pemberantasan Korupsi. Metode penelitian yang digunakan yaitu  hukum normatif dengan cara studikepustakaan,data yang digunakan  adalah data sekunder dananalisis data dilakukan secara deskriptis analitis. Rumusan masalahnya  adalah (1). Bagaimanakah pertimbangan Hakim  Konstitusi dalam memutus perkara No. 36/PUU-XV/2017 terhadap pengujian UU No. 17 Tahun 2017 Tentang MD3 dan (2). Bagaimanakah implikasi putusan Mahkamah Konstitusi  No.36/PUU-XV/2017 terhadap pengujian UU No. 17 Tahun 2017 Tentang MD3 terhadap independensi Komisi Pemberantasan Korupsi. Berdasarkan penelitian diperoleh hasil (1) MK dalam putusan No. 36/PUU-XV/2017 menyatakan  bahwa kewenangan hak angket yang dilakukan  Dewan Perwakilan Rakyat  terhadap Komisi Pemberantasan Korupsi adalah konstitusional sepanjang tidak menyangkut kewenangan penyidikan, penyelidikan, dan penuntutan yang dimiliki oleh Komisi Pemberantasan Korupsi, dengan pertimbangan  Komisi Pemberantasan Korupsi adalah lembaga negara yang termasuk ranah eksekutif. (2). Pengaruh tekanan yang diberikan Dewan Perwakilan Rakyat  kepada Komisi Pemberantasan Korupsi akan amat kuat walaupun hak angket tersebut tidak dapat menyentuh kewenangan Komisi Pemberantasan Korupsi dalam melakukan penyidikan, penyelidikan, dan penuntutan. Namun ada indikasi bahwa upaya angket pada dasarnya bukanlah upaya hukum melainkan upaya yang bersifat politis yang banyak dipraktekkan dalam negara penganut sistem parlementer yang cenderung dominan parlemen dibanding pihak eksekutif.Kesimpulan dari penelitian ini adalah (1).  Dalam putusan ini Hakim Konstitusi tidak  menggunakan penafsiran gramatikal dan sistematis yang lebih kuat dengan berlandaskan pada original intens. Selain ituPutusan Mahkamah Konstitusi ini adalah ambigu dan  berpotensi bertentangan dengan putusan sebelumnya yaitu putusan  Mahkamah Konstitusi  No.012-016-019/PUU-IV/2006.(2)  Adanya konsekuensi bagi Komisi Pemberantasan Korupsi dimasa mendatang khususnya dalam hal independensi  akibatdari dapat dijadikannya objek hak angket oleh Dewan Perwakilan Rakyat

Abstract

The doctor and patient relationship is a pattern that is born among the doctor and the patient before continuing to the act of health care. And health services, is a concept used in providing health services to the community. Health services is a sub-system of health services whose main purpose is health services in terms of Preventive (preventive), Promotive (improving health,) Curative (healing health) and Rehabilitative (recovery) are all efforts mobilized by the government in improving the quality of health services prime and in accordance with standard operating procedures and health service standards. This study uses a method of approach to the community so that the public knows in more detail about the juridical analysis of the legal relationship among doctors and patients in health services. The results of this study are in terms of the legal aspects of health, the relationship among doctors and patients cannot decide what is called health services by doctors who have a direct role in improving tasks for the community in order to realize a good and quality society. Analisis Yuridis Hubungan Hukum Antara Dokter Dan Pasien Dalam Layanan Kesehatan Hubungan dokter dan pasien merupakan pola yang lahir antara dokter dan pasien sebelum berlanjut pada tindakan pelayanan kesehatan. Dan pelayanan kesehatan,merupakan sebuah konsep yang digunakan dalam memberikan layanan kesehatan kepada masyarakat. Pelayanan kesehatan adalah sebuah sub sistem pelayanan kesehatan yang ditujuan utamanya adalah pelayanan kesehatan dalam hal Preventif (pencegahan), Promotif (peningkatan kesehatan,) Kuratif (penyembuhan kesehatan) dan Rehabilitatif (pemulihan) merupakan segala upaya yang dikerahkan oleh pemerintah dalam peningkatan mutu pelayanan kesehatan yang prima dan sesuai dengan standar prosedur dan standar operasional prosedur pelayanan kesehatan. Penelitian ini menggunakan metode pendekatan kepada masyarakat sehingga masyarakat tahu lebih detail tentang analisis yuridis hubungan hukum antara dokter dan pasien dalam peyanan kesehatan. Hasil penelitian ini yaitu Dalam hal aspek hukum kesehatan, hubungan antara dokter dan pasien tidak dapat memutuskan apa yang disebut layanan kesehatan oleh dokter yang memiliki peran langsung dalam tugas-tugas perbaikan untuk masyarakat dalam rangka mewujudkan masyarakat yang baik dan berkualitas.

Abstract

The process of transferring bengkok land ownership rights through land swap agreements is frequently done, but due to lack of understanding of the legislations, the transfer of land rights often experiences various problems. This study aims to find out the mechanism of transferring bengkok land ownership rights through land swap agreements based on the legislations as well as the process of certifying bengkok land into proprietary land. This descriptive-analytic study applied an empirical juridical approach. The results showed that the mechanism of transferring bengkok land ownership rights through land swap agreements in Kuningan District is regulated in Kuningan District Regulation No. 44 of 2017 concerning Management of Village Assets. Meanwhile, the process of certifying bengkok land into proprietary land is regulated in Article 17 of Government Regulation No. 27 of 2014 concerning Management of State/Regional Property. In conclusion, the process of transferring land ownership rights, especially state-owned land, shall to be done in a written form and is based on the applicable legislation. Peralihan Hak Milik Tanah Bengkok Melalui Perjanjian Tukar Guling Proses peralihan hak milik tanah bengkok melalui perjanjian tukar guling sering dilakukan namun karena ketidak pahaman terhadap peraturan perundang-undangan, peralihan hak milik atas tanah tersebut mengalami berbagai permasalahan. Tujuan penelitian adalah untuk mengetahui mekanisme peralihan tanah bengkok melalui perjanjian tukar guling menurut perundang-undangan dan proses pensertifikatan tanah bengkok menjadi tanah hak milik. Jenis penelitian deskriptif-analistis dengan pendekatan yuridis empiris. Hasil penelitian mengemukakan bahwa Mekanisme peralihan tanah bengkok melalui perjanjian tukar guling di Kabupaten Kuningan diatur dalam Peraturan Bupati Kuningan Nomor 44 Tahun 2017 tentang Pengelolaan Aset Desa dan Proses pensertifikatan tanah bengkok menjadi tanah hak milik diatur dalam Pasal 17 Peraturan Pemerintah Nomor 27 Tahun 2014 adalah pengalihan kepemilikan barang negara/daerah. Kesimpulannya Dalam proses perjanjian tukar menukar tanah terutama tanah milik negara perlunya dilakukan secara tertulis dan sesuai dengan peraturan perundangan yang berlaku.

Abstract

The number of recidivist cases found in the society shows that the prisoner guidance system in correctional institutions is still not meeting its goals, especially as mandated in Article 2 of Law No. 12 of 1995 concerning Corrections. The problem discussed in this study was: how effective imprisonment is if it is related to the prisoner guidance system in correctional institutions, especially towards recidivists, so as to reduce the number of recidivists in Class II A of Correctional Institution, Kuningan District, West Java. This study applied a descriptive analytical method and a normative juridical approach. As results, it was found that the prisoner guidance system, especially for recidivists, was not yet fully implemented so that the goals of the Penal System, held in the context of establishing correctional prisoners to become fully human, be aware of their mistakes, improve themselves, and not repeat the crimes so that they can return to the society, can actively play a role in development, and can live reasonably as good and responsible citizens, have not been fulfilled. The goals of the penal system cannot be achieved yet especially because there is no separation of blocks between recidivist and non-recidivist prisoners, lack of correctional officers who have special skills needed in the field, negative views from the society, and limited facilities and infrastructure. Efektifitas  Pidana Penjara terhadap Residivis dihubungkan dengan Peranan Lembaga  Pemasyarakatan  dalam Sistem Pembinaan Narapidana  Perspektif  Undang Undang Pemasyarakatan   Banyaknya kasus residivis yang terdapat dalam masyarakat, menunjukan bahwa pembinaan terhadap Warga Binaan Pemasyarakatan masih belum memenuhi harapan kita semua. Khususnya sebagaimana yang diamanatkan dalam Pasal 2 Undang-Undang Nomor 12 Tahun 1995 tentang Pemasyarakatan. permasalahan adalah: seberapa efektifnya penjatuhan pidana penjara jika dikaitkan dengan sistem pembinaan terpidana di lembaga pemasyarakatan khususnya terhadap residivis sehingga dapat mengurangi jumlah residivis di Lembaga Pemasyarakatan Kelas II A Kuningan Jawa Barat. Metode penelitian ini menggunakan metode Deskriptif Analitis dan pendekatan yang dilakukan adalah Yuridis Normatif, dengan teknik pengumpulan data dilakukan dengan studi dokumen. Berdasarkan penelitian diperoleh hasil bahwa ternyata pembinaan terhadap narapidana khususnya residivis belum sepenuhnya dapat dilaksanakan sehingga tujuan dari Sistem Pemasyarakatan yang diselenggarakan dalam rangka membentuk warga binaan pemasyarakatan agar menjadi manusia seutuhnya, menyadari kesalahan, memperbaiki diri dan tidak mengulangi tindak pidana sehingga dapat diterima kembali dalam lingkungan masyarakat, dapat aktif berperan dalam pembangunan dan dapat hidup secara wajar sebagai warga yang baik dan bertanggung jawab belum terpenuhi. Khususnya yang menyangkut tentang pemisahan blok antara napi residivis dan non residivis, kurangnya petugas lembaga pemasyarakatan yang memiliki keterampilan khusus yang sesuai dengan kebutuhan lapangan kerja, pandangan negatif dari masyarakat serta keterbatasan sarana dan prasarana.

Abstract

This study aims to identify the legal analysis of the burning of a Sector Police Office by the community from a criminological perspective as well as to analyze the level of community trust in police after the burning of the Sector Police Office based on criminological theories. This descriptive-analytical study applied a normative juridical approach. The results of the legal analysis of the burning of a Sector Police Office by the community from a criminological perspective showed that, according to the anomic theory, the burning is due to the influence of social structure as a correlative factor in the burning of the Sector Police Office of Bendahara. This influence can be seen from the disparity between the goals to be achieved and the means used in achieving these goals. Hence, the community took steps to burn down the Sector Police Office to achieve its goals. Further, the level of community trust in police after the burning of the Sector Police Office was demonstrated through association theory, social control theory, and neutralization theory. Based on the description of the criminological theories and its relation to the phenomenon of the burning of the Sector Police Office of Bendahara, there needs to be an evaluation of the application of the law as the harmonization of the law in the context of criminal provisions is needed. Pembakaran Kepolisian Sektor oleh Masyarakat dalam Perspektif Kriminologi Tujuan penelitian ini yaitu untuk mengetahui analisis hukum terhadap pembakaran Kepolisian Sektor oleh masyarakat dalam perspektif kriminologi, untuk mengetahui kepercayaan masyarakat terhadap kepolisian pasca pembakaran Kepolisian Sektor menurut teori-teori kriminologi. Spesifikasi penelitian yang digunakan adalah penelitian bersifat deskriptif-analitis dengan pendekatan yuridis normatif. Hasil penelitian dari analisis hukum terhadap pembakaran Kepolisian Sektor oleh masyarakat dalam kriminologi bahwa menurut teori anomi menekankan pengaruh struktur sosial sebagai faktor korelatif terjadinya pembakaran Kepolisian Sektor Bendahara. Pengaruh ini terlihat dari adanya disparitas antara tujuan yang hendak dicapai dengan sarana yang digunakan dalam mencapai tujuan tersebut. Hal ini akhirnya mengambil langkah-langkah pembakaran Kepolisian Sektor Bendahara untuk mencapai tujuannya. Selanjutnya tingkat kepercayaan masyarakat terhadap kepolisian pasca pembakaran Kepolisian Sektor menunjukkan melalui teori asosiasi; teori kontrol social dan teori netralisasi. Berdasarkan uraian teori-teori kriminologi tersebut dihubungkan fenomena pembakaran Kepolisian Sektor Bendahara saat ini sangatlah dibutuhkan sebagai evaluasi terhadap penerapan hukum sehingga diperlukan harmonisasi hukum dalam konteks ketentuan pidana

Abstract

The purpose of this study is to analyze the law authority through criminal law politics states in the law concerning corruption. This study employed a normative juridical method with conceptual and statue approaches. This research collected the data from primary and secondary legal materials. These are to obtain a critical study of legal issues happening in society. The findings revealed that the criminal act of corruption does not provide a deterrent effect and is actually detrimental to the state. In addition, this study also found that the law concerning corruption increases the state’s burden. This is because the prison sentence for corruptors is too light. The amount of money proceeds from corruption is not comparable to state spending in supporting the life of corrupt convicts in prison. The standard of penalty state in the law is too light compare to the result of corruption. Thus, it is necessary to reform the law on corruption due to the absence of proportionality in law and large losses to the state when dealing with corruption. The highest standard penalty for corruption only amounts to one billion Rupiah. In fact, many corruption cases reach to tens billions and even trillions rupiahs.

Abstract

Banks are financial institutions to collect and distribute funds to the public. As a public trust institution, the banks must maintain the public trust. In doing so, it is needed a supervision agency called Bank Indonesia. The purpose of this study is to see and to analyze the roles and the responsibilities of Bank Indonesia as rural banks’ supervisory agency based on law No. 3 of 2004, Bank Indonesia and Act No. 21 of 2011, financial services authority. The writer employed a normative juridical approach by understanding, testing, and reviewing the secondary data. This research was a descriptive analysis describing the prevailing laws and regulations related to the authority of Bank Indonesia as a rural bank’s supervision agency. The result of the research showed the roles of of Bank Indonesia and Financial Services Authority as rural bank supervisors were not aligned with the law provisions stipulated in Bank Indonesia article 27, a direct and indirect supervisions. Meanwhile, based on Article 28 of Law No. 21 of 2011, Financial Services Authority. The role of the Financial Services Authority in the legal protection of the consumer was not limited to facilitating the consumer protection. For instances, it is not only to accomodating and becoming a mediation institution but also becoming an institution that sides the consumers and society in the legal defense activities. As the central bank, bank indonesia is responsible for the case happening in Rural banks by putting it under a special supervision bank. In addition, if the rural bank is unable to improve its financial condition within a specified time, it will be declared as a failed bank and its business license will be revoked. The forms of protection, on the other hand, undertaken by the Financial Services Authority covers the prevention protection of violation and restoration of consumer rights if for instance the consumers suffer losses.Bank merupakan lembaga keuangan yang menghimpun dan menyalurkan dana ke masyarakat. Sebagai lembaga kepercayaan masyarakat, bank harus dapat menjaga kepercayaan masyarakat, untuk menjaganya maka diperlukan badan pengawasan yaitu Bank Indonesia. Tujuan penelitian ini untuk mengetahui dan menganalisis peranan dan tanggung jawab Bank Indonesia sebagai badan pengawas terhadap Bank Perkreditan Rakyat berdasarkan Undang-Undang No 3 Tahun 2004 Tentang Bank Indonesia dan Undang-undang no 21 Tahun 2011 tentang Otoritas Jasa Keuangan. Metode pendekatan yang digunakan oleh penulis adalah metode pendekatan yuridis normatif dengan memahami, menguji, dan mengkaji data sekunder. Penelitian ini bersifat deskritif analisis, menggambarkan peraturan perundang-undangan yang berlaku dan berkaitan dengan Bank Indonesia terhadap kewenangannya sebagai badan pengawas kepada Bank Perkreditan Rakyat. Hasil penelitian adalah Peranan Bank Indonesia dan Otoritas Jasa Keuangan sebagai pengawas dan pembina terhadap Bank Perkreditan  Rakyat  belum  sesuai dengan yang ditetapakan Undang-Undang Bank Indonesia Pasal 27 yaitu mengenai  pengawasan   langsung    dan   pengawasn   tidak langsung. Sementara berdasarkan Pasal 28 Undang-Undang No. 21 Tahun 2011 tentang Otoritas Jasa Keuangan, Otoritas Jasa Keuangan peran Otoritas Jasa Keuangan dalam sistem hukum perlindungan konsumen tidak terbatas hanya dengan memfasilitasi perlindungan konsumen yakni menampung dan menjadi lembaga mediasi tetapi juga menjadi lembaga yang berpihak kepada konsumen dan masyarakat dalam bentuk kegiatan pembelaan hukum.  Bank  Indonesia  sebgai  Bank  sentral  bertanggung  jawab  terhadap kasus  Bank Perkreditan Rakyat  dengan  memasukkan  bank tersebut   ke dalam Bank Dalam Pengawasan Khusus. Pada waktu yang   telah  ditentukan   Bank Perkreditan Rakyat   tidak  dapat   memperbaiki  kondisi keuangannya.  Bank Perkreditan Rakyat  dinyatakan  sebagai bank   gagal   dan    dicabut   ijin   usahanya. Sementara Bentuk-bentuk perlindungan yang dilakukan oleh Otoritas Jasa Keuangan meliputi perlindungan dalam upaya pencegahan terjadinya pelanggaran dan pemulihan hak-hak konsumen apabila konsumen mengalami kerugian.

Abstract

Nowadays, technology is getting more advanced.  For example, IVF or "In Vitro Fertilization (IVF)" with a surrogate mother. A surrogate mother is a woman who has no relationship at all with a spouse who owns the seed then makes an agreement with them to rent out her uterus in exchange for material things. This study aims to determine the Surrogate Mother validity in Indonesia and in Ukraine on born children's civil status. This study employed normative juridical methods. The findings revealed Surrogate mothers is not allowed as it against the existing law in Indonesia. This is stated in Article 127 of Law Number 36 the Year 2009, the prohibition of the surrogate mother agreement. However, if a child is born from a Surrogate Mother, his civil status will be of surrogate mother's child. In Ukraine, on the other hand, the surrogate mother is legal.  This is stated in Article 123 of the Family Code of Ukraine 2002, the children’s civil status is a genetic child of a spouse who owns the seed

Abstract

This paper aims to determine to what extent Garuda totem is faced with covid-19 totem in the constitution of Indonesia. It begins with the pandemic hit a worldwide including Indonesia, all countries are busily making effective policies. Reviewing the existing policies, the president and the regional heads have an extraordinary role. A well-saying that the king can do no wrong while carrying out his policies. Many issues concerning the existence of Garuda totem are currently being in the spot light. Thus, this study focuses on the discussion upon the struggle of Garuda totem over the new totem that has changed the policy arrangement in Indonesia. A normative legal research method sets as a basis for conducting an analysis. The struggle made the existence of Garuda totem hits a polemic in the indonesian constitution. This so-called totem does not just apply on religious values. The state even has its respective totem as a form of sacredness for its people. The research result on the consenquences of Garuda totem, holding the shield of Pancasila and setting its feet on Indonesia’s diversity, are indicating an inseparable bondage for the king of the country and the king of the region during 2019-nCoV which befell the worldwide, particularly Indonesia. In addition, the national emblem, Garuda Pancasila, is not just an ordinary image. It has a meaning that is coming from Indonesian cultures. It has a sacred value (holy) that must be protected and maintained its dignity by everyone who claims to be the citizens of Indonesia. This is to signify an ethic of showing the love for the country. Lastly, in order to avoid the threats to Garuda totem, the state is required to be more careful in making policiesTujuan dari penulisan ini yaitu untuk mengetahui sejauh mana totem Garuda dihadapkan pada totem Covid-19 dalam ketatanegaraan Indonesia. Berawal dari adanya pandemik yang melanda dunia termasuk Indonesia, semua negara disibukan untuk segera mengambil kebijakan-kebijakan yang efektif. Melihat kebijakan-kebijakan yang ada menempatkan Presiden dan Kepala Daerah memiliki peran yang sangat luar biasa dan dapat dikatakan sebagai the king can not do wrong dalam menjalankan kebijakannya. Permasalahan-Permasalahan yang berkenaan dengan keberadaan totem Garuda saat sekarang banyak disoroti, fokus pembahasan mencoba mengkaji pergumulan totem garuda atas totem baru yang merubah tatanan kebijakan di Indonesia. Metode penelitian hukum yang bersifat normatif sebagai pijakan dalam melakukan analisis. Adanya pergumulan atau pertarungan yang menjadikan keberadaan totem Garuda mengalami polemik dalam ketatanegaraan Indonesia. Apa yang dinamakan sebagai totem sendiri rupanya bukan hanya berlaku pada nilai-nilai keagamaan saja, bahkan sekelas negara memiliki totem masing-masing sebagai bentuk kesakralan bagi masyarakatnya. Hasil penelitian Konsekuensi totem Garuda yang memegang perisai Pancasila dan menapakan kakinya pada kebhinekaan Indonesia, sebagai bentuk ikatan yang tidak terpisahkan bagi raja negara maupun raja daerah pada saat adanya 2019-nCoV yang menimpa dunia dan Indonesia khususnya. Labang Negara yaitu Garuda Pancasila bukan hanya sebuah gambar yang biasa saja, mempunyai makna yang lahir dari budaya-budaya Indonesia, memiliki nilai sakralitas (suci) yang wajib di lindungi yang harus dipertahankan martabatnya oleh setiap orang yang mengaku sebagai warga Indonesia untuk menandakan sebuah etika yang menunjukan rasa kecintaan terhadap tanah air. Dalam rangka menghindari ancaman terhadap totem Garuda, negara harus berhati-hati dalam mengambil kebijakan

Abstract

This study aims to determine the regulation of converting agricultural land into housing and the suitability of its implementations. This study employed a juridical empirical approach which is a research done by looking at and paying attention to applicable legal norms associated with existing facts from the problems encountered. In this case,  the local government policies on converting agricultural land into housing. The findings revealed the perpetrators of the land conversion process that occur in Kuningan Regency are the landowners. Some of the causes are: social, economic, population density, and the lack of socialization of Law Number 41 of 2009. Efforts made by local government officials and related agency officials to realize sustainable food land protection are still limited to carrying out their main duties and functions. The guideline in controlling the use of space, licensing and controlling mechanisms for the implementation of development, stated in the Regional Regulation of Kuningan Regency Number 26 of 2011 on regional Spatial Planning and Regulation of the Head of the National Land Agency Number 2 of 2011 concerning guidelines for technical land considerations in controlling location permits and determining locations and permits for changes in land use. The study concluded that converting the function of agricultural land to non-agriculture in Kuningan Regency is carried out by the landowner. In addition, efforts made by local government officials and related agency officials to realize sustainable food land protection are still limited to carrying out their main duties and functions. Accordingly, it is necessary to socialize Law Number 41 of 2009 on Protection of Sustainable Food Agricultural Land and Regional Regulation of Kuningan Regency Number 26 of 2011 concerning Regional Spatial Planning continuously to the community level. Furthermore, local governments need to coordinate with the village officials to monitor the use of agricultural land and the development of housing areas. This can be done by providing socialization to village officials.
