Abstract

The advanced developments in technology, information, and knowledge, especially in the fields of health and law, will have a negative impact on the mindset of society, especially in health services. This is proven by the wide variety of demands on medical personnel, the doctors who practice medicine. Cases of suspected malpractice are often over-reported by the mass media and social media. Doctors are seen to have no responsibility or making mistakes in their profession. In fact, all the news that is delivered or written does not necessarily reflect reality. The actions were taken by the doctor corresponds with professional standards and standard for operating procedures. This study aims to explore the analysis of legal protection implementation and its weaknesses in a medical dispute between doctors and patients. This study employed a normative juridical approach by library research. The primary and secondary legal material sources were taken from laws, books, and scientific journals. The findings revealed that in doing medical practice, doctors must fulfill informed consent and medical records. This is to serve as evidence that can exempt the doctors from all lawsuits if malpractice allegations arise. There are many reasons for the repeal of the doctors’ sentences to free them from lawsuits. This includes the risk of medication and medical accidents. In conclusion, a doctor who has carried out his duties based on professional standards, service standards, and standard operating procedures is entitled to proper legal protection based on the value of justice

Abstract

Justice is one of the main basic ideas in a rule or law. A rule is not considered as a law if it does not provide a sense of justice to the subject it governs. The aim of this article is to analyze the context of social justice on the effectiveness of  urban drainage construction facilities system in the cities. This study used an empirical-juridical method based on the Minister of Public Works Regulation Number 12 of 2014, the implementation of Urban Drainage. The result of data analysis showed since the planning stage, the implementation of each infrastructure development in the city of Gorontalo continually refers to the spatial planning map and collaborates with the associations engaged in the environmental sector so that it reaches the development and control processes. In this case, an infrastructure of the drainage facility does not violate its designated zone. Yet, there are several zones whose utilization is not in accordance with their designation. Thus, the problem collides with the fulfillment of social justice which affects the implementation of drainage facilities construction.Keadilan merupakan salah satu ide dasar pokok dalam sebuah peraturan atau hukum. Sebuah peraturan bukanlah hukum jika tidak memberi rasa keadilan terhadap subjek yang diaturnya. Tujuan artikel ini untuk menganalisis konteks keadilan sosial pada efektivitas pembangunan fasilitas sistem drainase perkotaan di kota dengan menggunakan metode yuridis empiris berdasarkan Peraturan Menteri Pekerjaan Umum Nomor 12 Tahun 2014 tentang Penyelenggaraan Drainase Perkotaan. Hasil penelitian Analisis data menunjukkan bahwa setiap pelaksanaan pembangunan infrastruktur di kota Gorontalo sejak perencanaannya selalu mengacu pada peta penataan ruang wilayah dan melakukan kerjasama dengan asosiasi yang bergerak di bidang lingkungan hidup sehingga sampai pada proses pembangunan dan pengendalian, sebuah infrastruktur dalam hal ini fasilitas drainase tidak menyalahi zona peruntukkannya. Meskipun masih terdapat beberapa zona yang pemanfaatannya tidak sesuai peruntukkannya sehingga permasalahan terbentur pada pemenuhan keadilan sosial yang mempengaruhi pelaksanaan pembangunan fasilitas

Abstract

This paper compares the policy formulation/legislation of criminal acts of religion, religious life, and worship facilities based on the new draft of Indonesian Criminal Code (RKUHP) and the Penal Code United Kingdom of 2008. This study was conducted using normative juridical methods and comparative law. The type of data employed in this study focuses on secondary data namely primary legal materials, secondary legal materials and tertiary legal materials. The data were collected through documentation and literary studies. Meanwhile, the data analysis method used in this study is qualitative and descriptive. The findings revealed the religion is fundamental and important in all aspects of human life in Indonesia. The result also showed the policy formulation/legislation of criminal acts of religion, religious life, and worship facilities stipulated on the draft of national criminal code (RKUHP) July 2018 refer to the development of policy formulation/legislation called blasphemy in England. Tulisan ini membandingkan kebijakan formulasi/legislasi mengenai tindak pidana terhadap agama, kehidupan beragama dan sarana ibadah dalam Rancangan Kitab Undang-Undang Hukum Pidana Indonesia (RKUHP) yang baru dengan Kitab Undang-Undang Hukum Pidana Inggris (The Penal Code United Kingdom) tahun 2008. Penelitian ini ditempuh melalui metode penelitian yuridis normatif dan perbandingan hukum. Jenis data yang dipergunakan pada penelitian ini dititkberatkan pada data sekunder yang terbagi dalam bahan hukum primer, bahan hukum sekunder dan bahan hukum tertier. Adapun pengumpulan data pada penelitian ini dilakukan dengan studi dokumentasi dan studi kepustakaan sedangkan metode analisa data yang dilakukan pada penelitian ini bersifat kualitatif dan deskriptif. Hasil penelitian menunjukan bahwa agama merupakan hal mendasar atau hal yang fundamental dan bersifat penting dalam seluruh aspek kehidupan manusia di Indonesia. Hasil penelitian juga menunjukan bahwa kebijakan formulasi/legislasi mengenai tindak pidana terhadap agama, kehidupan beragama dan sarana ibadah sebagaimana diatur dalam Rancangan Kitab Undang-Undang Hukum Pidana (RKUHP) nasional versi bulan Juli tahun 2018 dapat dikatakan mengacu kepada perkembangan kebijakan formulasi/legislasi mengenai “blasphemy” di Inggris

Abstract

This study aims to determine the position and function of the Regional Representative Council (DPRD) in the constitutional system of Indonesia. The study employed a normative legal approach and was analyzed qualitatively using secondary data. The finding revealed the position and function of the DPRD, an element of regional government administration, is currently regulated in one law, Law no. 23 of 2014 concerning Regional Government which previously regulated in the Law on the MPR, DPR, DPD, and DPRD. The DPRD has been regarded as a regional legislative council. In fact, a country adheres to the Unitary State concept do not familiar with regional legislatures. Even though, there is only one legislative council at the regional center, the DPR RI. In the previous law, Law no. 32/2004 states that DPRD has legislative, budgeting, and supervisory functions. The legislative function of the DPRD has resulted in ambiguity on the DPRD's position, a legislative council or part of the executive branch. This is because the function of legislative is to create laws owned by the legislative council. In this case, the DPR. Meanwhile, the DPRD only has the authority to formulate Perda. Based on Law no. 23 of 2014, the DPRD no longer has a legislative function. It is replaced by the function of forming a regional regulation. The DPRD which has been regarded as a regional legislative council, has begun to shift towards the regional executive

Abstract

The management of natural and biological resources must be carried out by the central and regional governments to seek financing for development. The management of natural and biological resources should synergize with its preservation and the environment. The common problem encountered when managing natural and biological resources lies in its improper management that caused damage to the environment such as doing disharmonize exploitation with environmental interest. Accordingly, This study employed a sociological juridical study to capture the implications of authority reformulation management of natural and biological resources of the conservation district in Probolinggo. The findings revealed that the management reformulation of Natural and biological resources Management results in the limitation of regional authority in managing their natural resources. This was certainly different from the concept mandated by regional autonomy. Thus, It is feared that this will affect the development plans carried out in the area, affecting the welfare of the community. As a conservation district, Probolinggo Regency has tried to optimize the regional potential in the development of conservation-minded areas. This commitment is written in regional regulations, regulating not only the use of natural and biological resources but the clarity of regional authority in managing these resources as well

Abstract

The village is a place where people can live side by side in harmony and peace. This what actually has been aspired by our national law long time ago, that is a society which live in equity and prosperous . Laws are made to regulate and bring justice for all elements of the society. This justice should be able to presented by the policy maker and should be realized because it is awaited by all of elements. Especially in the current situation where the COVID-19 pandemic is occuring across the world which is Indonesia state is also affected. Many people, especially the grassroots got the impact of the COVID-19 pandemic, they lost their jobs, that is very meaningful for them to fullfill their daily needs. The Government through the Ministry of Villages, Development of Rural Regions, and Transmigration in the midst of this situation released a program as one of the solution, that is direct grant (Banyuan Langsung Tunai) arranged through the regulation of the Ministry of PDTT  Number 6 Year 2020. The research methodology used the qualitative methods which produced descriptive data. The results of this study indicated the BLT policy in the midst of the COVID-19 pandemic is an appropriate solution from the government to help alleviate citizen's living cost especially the burden of rural societies who are affected by COVID-19. The BLT policy in the midst of the 19th pandemic has reflected the sense of justice aspired by the law, because actually a law/regulation/policy was made to create justice for humans, and even that policy became a priority in the context of overcoming the COVID-19 pandemic.ame a priority in the context of overcoming the COVID-19 pandemic.

Abstract

The global Covid-19 pandemic has made Indonesia do various ways to reduce the spread of covid-19. Through Government Regulation Number 21 of 2020, the Large-Scale Social Restrictions. The aim of this study is to know the relationship pattern of central and local governments in handling public health emergencies and harmonizing any related laws and regulations. This study used juridical normative method with the statutory approach. The study used the Large-Scale Selection of Social Restrictions policy. The findings revealed the central government as the main policy at the regional level, as a party to determine the type of steps that will be taken in handling public health emergency of Covid-19. The selection of Large-Scale Social Restrictions known as PSBB as the main way to suppress the spread of Covid-19 is based on the Regional Government flexibility. In other words, the local government can immediately oblige to apply PSBB in their regions to see the progression and to act quickly upon it. Thus, the synergy between central and local governments in handling covid-19 is indispensable. In conclusion, the implementation of PSBB in Banten Province, especially in Tangerang Raya, successfully reduce the number of positive cases of Covid-19. However, the delay in the implementation of PSBB in Banten Province makes the spread of covid-19 reach to other areas apart from Tangerang Raya.Pandemi global Covid-19 telah membuat Indonesia melakukan berbagai macam cara untuk menekan angka penyebaran Covid-19. Melalui Peraturan Pemerintah Nomor 21 Tahun 2020 tentang Pembatasan Sosial Berskala Besar, pemerintah pusat memilih untuk menggunakan. Tujuan penelitian ini untuk melihat bagaimana pola hubungan antara pemerintah pusat dan pemerintah daerah dalam hal penanganan kedaruratan kesehatan masyarakat dan mengharmoniskan peraturan perundang-undangan yang berkaitan dengan hal tersebut. Metode penelitian ini yang digunakan yaitu yuridis normatif dengan pendekatan peraturan perundang-undangan, studi kebijakan yang dikaji adalah Pemilihan Pembatasan Sosial Berskala Besar. Hasil penelitian didapatkan bahwa, Pemerintah Pusat sebagai haluan utama kebijakan di tingkat daerah menjadi pihak yang dapat menentukan langkah apa yang akan diambil dalam pengananan kedaruratan kesehatan masyarakat Covid-19. Pemilihan Pembatasan Sosial Berskala Besar (PSBB) sebagai cara utama sebagai penekan penyebaran Covid-19 didasarkan pada keleluasaan Pemerintah Daerah yang dapat langsung berkewajiban melaksanakan PSBB di daerahnya sehingga bisa melihat perkembangan sekaligus bertindak cepat dan sinergitas antara pemerintah pusat dan pemerintah daerah dalam penanganan Covid-19 sangat diperlukan. Penerapan PSBB di Provinsi Banten terutama di Tangerang Raya dapat menekan angka kasus positif Covid-19, namun keterlambatan untuk membuat keseluruhan wilayah di Provinsi Banten melaksanakan PSBB membuat penyebaran Covid-19 di Provinsi Banten mulai merambah ke deaerah-daerah yang lain selain Tangerang Raya.

Abstract

This paper aims to analyze the importance of supervisory function in ensuring the government effectiveness and efficiency in the realization of good governance principles. The government internal supervisory apparatus is an authorized institution or agency. In the application of supervisory function in regional government, they must be able to carry out its duty properly based on the prevailing laws and regulations. This study employed juridical-empirical method. The results showed the duties and the function are stipulated on the Government Regulation Number 60 of 2008, the government internal control system which includes the audits, reviews, evaluation, monitoring, and other supervisory activities. In addition, it is also stated in the Regulation of the Ministry of Home Affairs Number 64 of 2007, the technical guidelines and the working procedures of the provincial and regency/city inspectorate. The conclusion is the role of the government internal supervisory apparatus often faces some problems in doing their duties and functions. For instances, rampant corruption cases committed by regional officials making the effectiveness of the role of the government internal supervisory apparatus being questioned. Furthermore, their low capability and the independence issues encountered by regional government hampers the performance of the Government Internal Supervisory Apparatus which is directly responsible to regional head. This practice also seems to be able to reduce the objectivity and the independence of the regional government of internal supervisory apparatus in doing their supervisory dutiesTujuan dari penulisan ini yaitu untuk menganalisis fungsi pengawasan menjadi sangat penting dalam menjamin penyelenggaraan pemerintah yang efektif dan efisien untuk mewujudkan asas tata pemerintah yang baik (good governance).  Aparat Pengawas Intern Pemerintah  sebagai institusi atau lembaga yang berwenang dalam menjalankan fungsi pengawasan di pemerintahan daerah harus mampu melaksanakan fungsi pengawasan tersebut dengan baik sesuai dengan peraturan perundang-undangan yang berlaku . Metode penelitian yang digunakan yaitu yuridis empiris. Hasil penelitian menunjukan bahwa tugas dan fungsi diatir oleh Peraturan Pemerintah Nomor 60 Tahun 2008 tentang Sistem Pengendalian Intern Pemerintah, melalui audit, reviu, evaluasi, pemantauan, dan kegiatan pengawasan lainnya dan Peraturan Menteri Dalam Negeri Nomor 64 Tahun 2007 tentang Pedoman Teknis Organisasi dan Tata Kerja Inspektorat Provinsi dan Kabupaten/Kota. Simpulan bahwa Peran Aparat Pengawas Intern Pemerintah kerap kali menghadapi kendala-kendala dalam melaksanakan tugas dan fungsinya. Salah satunya adalah mengenai kasus korupsi yang marak dilakukan oleh pejabat daerah, menyebabkan dipertanyakannya efektivitas peran pengawasan Aparat Pengawas Intern Pemerintah Daerah. Selain itu, kapabilitas Aparat Pengawas Intern Pemerintah yang rendah dan masalah independensi yang dihadapi oleh Aparat Pengawas Intern Pemerintah Daerah menghambat kinerja Aparat Pengawas Intern Pemerintah yang secara langsung bertanggung jawab kepada kepala daerah. Praktik tersebut juga dianggap memungkinkan mengurangi objektivitas dan independensi Aparat Pengawas Intern Pemerintah Daerah dalam menjalankan tugas pengawasannya

Abstract

This study aims to describe tourism governance development policies in Karanganyar Regency and the concept of sustainable development-based tourism policy and governance. The research employed empirical juridical approach. Therefore, this research focused on primary data collected from the interview and observation. In addition, this research was also supported by secondary data collected from literature study. Finally, the data were analyzed qualitatively. The findings revealed that the tourism governance development policies in Karanganyar regency which stated in the laws and regulations are adequate. However, its implementation is not yet running well. Furthermore, the sustainable development-based tourism governance development policy is the state's responsibility. The state acts as the holder of natural resource power and strengthens the community rights as the holders of state sovereignty. In conclusion, the tourism governance development policies in Karanganyar Regency cover environmental-friendly tourism development. However, its implementation has not yet been realized by the government of the Karanganyar regency. Moreover, the concept of sustainable development-based tourism governance development policy is based on the following basic principles, the state’s responsibility as the holder of natural resource power and strengthens the community right as the holders of state sovereignty

Abstract

State-owned enterprises have a strategic position in realizing the mandate of the 4th paragraph of the Preamble of the 1945 Constitution. However, the absence of synchronization of laws and regulations in interpreting the  State-Owned Enterprises fund as separated state assets, creates legal uncertainty for the Board of Directors when losses arise due to business risks. This condition raises the issue of the board of directors' responsibilities in managing State-Owned Enterprise's finances. Thus, there is the need to apply the Principles of Business Judgment Rule in protecting the Directors from State-Owned Enterprises losses. The approach employed in this study was juridical normative research. Specifically, this study used descriptive analysis. The data were analyzed qualitatively. The findings revealed: (1) State-owned enterprises have played a role in realizing Indonesian Economic Democracy with their distinctive business characteristics, a profit-seeking company and social services provider to the community; (2) State-owned enterprise's losses are not related to state finances. This is because state equity participation has been transformed into state shares/funds to State-owned Enterprises whose management is based on the provisions of Limited Liability Companies; and (3) The principle of the Business Judgment Rule provides protection for the Board of Directors. It states that they can not be held accountable for the losses in state-owned Enterprises if the management of State Owned Enterprises is based on the following principles: (a) due of care; (b) due of skill; (c) good faith, and (d) for the best interest of the company. In conclusion, BUMN Persero that experiences losses due to business risks cannot be categorized as state financial losses. In addition, according to the principles of business judgment rule, Directors cannot be held accountable
