Abstract

This study aims to analyze the relevance of the ‘health emergency’ status to the existing legal theory and condition as well as to identify the validity of the Circular Letter of the Rector of State Universities. To this end, this study applied the statute and conceptual approach. The study was conducted by inventorying primary and secondary legal materials to obtain a proper and critical review of the legal issues under study. The results showed that the determination of the ‘health emergency’ status by the government was inappropriate due to the uncertainty of the regulations issued by the government to determine the current condition. Thus, the status of the COVID-19 pandemic is a ‘legal emergency’ status. Further, the Rector’s policy through the Circular Letter is valid judicially, sociologically, and philosophically. The determination of the ‘legal emergency’ status can be done by issuing a Perppu without a ‘state of emergency’ from the President. Finally, it is suggested to firstly get an approval from the Ministry of Education and Culture regarding the issuance of the Rector’s Circular Letter. Besides, further study is needed as this study was conducted during the COVID-19 pandemic. Keabsahan Surat Edaran Rektor Perguruan Tinggi dalam Pandemi Covid-19Tujuan dari penelitian ini adalah untuk menganalisa relevansi status ‘darurat kesehatan’ dengan teori hukum dan kondisi yang ada dan keabsahan atas Surat Edaran Rektor Perguruan Tinggi Negeri. Metode yang digunakan dalam penelitian ini adalah statute approach dan conseptual approach. Penelitian dilakukan dengan menginventarisasi bahan hukum primer dan sekunder, guna mendapatkan kajian yang seyogianya dan telaah kritis terkait isu hukum. Hasil penelitian menyatakan penetapan status darurat kesehatan oleh pemerintah kurang tepat, dikarenakan tidak menentu-nya peraturan yang dikeluarkan oleh pemerintah untuk menetapkan kondisi saat ini. Sehingga, status pandemi COVID-19 merupakan status darurat hukum. Kebijakan rektor melalui Surat Edaran adalah absah secara aspek yuridis, sosiologis, dan filosofis. Penetapan darurat hukum cukup dilakukan dengan menerbitkan Perppu tanpa pernyataan darurat dari Presiden. Saran peneliti adalah di perlukan persetujuan pada Kementerian Pendidikan dan Kebudayaan terkait terbitnya Surat Edaran Rektor, dan dibutuhkan penelitian lebih lanjut dikarenakan penelitian ini dilakukan pada masa COVID-19 yang bersifat temporal.

Abstract

This article discusses the issue about collective wealth sharing. In principle of Islam does not regulate the detail of collective wealth sharing except according to syirkah, but in the Marriage Law that any wealth is obtained during the marriage period becomes joint wealth, regardless of who works or obtains the assets and in whose name, as long as the wealth is not an inheritance, gift or inheritance, and there is not marriage agreement in terms of joint ownership. With the problem of how the ideal construction of distribution wealth sharing for wife who has income. The research method uses normative juridical research with case and approach regulations . The results of this research proves that distribution wealth sharing for wife who works and does not forget the responsibilities and duties as a wife, then when a divorce occurs, the distribution of joint wealth can deviate from the law (Article 97 KHI) this is in accordance with the Supreme Court decision MA No. 266K / AG / 2010 with the wife's acquisition of 3/4 share, while the husband's remaining is 1/4 share. Meanwhile, in the decision of the Banjarnegara Religious Court Number 1372 / Pdt.G / 2011 / PA.Ba. In this verdict, a wife gets more share than the husband gets, with the husband's share being 2/5 and the wife 3/5 of the share. This decision provides a sense of justice, and this is an ideal construction in the distribution of collective wealth by considering the principle of balance.Keywords: Ideal Construction, Distribution, Joint Wealth,

Abstract

Law 32 of 2004, regional autonomy, mandates the improvement of community services and regional equity by encouraging community participation. Meanwhile, Law 22 of 2009 on road traffic and transportation mandates the maintenance of traffic infrastructure, particularly The Road Traffic Signaling Devices (APILL) on National Roads, National with Provincial Roads intersection, and National with Regency/City Roads intersection to BPTD–The representative of the Ministry of Transportation. In practice, all maintenances are by Regency/City Transportation Service, including the maintenance of the Traffic Signaling Device (APILL) at National and Provincial Roads intersection with Regency/City Roads. The study aims to evaluate Law 22/2009 and its implementing regulations. Besides, This study also attempts to determine the implementation of Traffic Signaling Devices (APILL), including its procurement and maintenance. The research method was legal research. It involved investigating related regulations to the problem under study. The study concludes the maintenance implementation of traffic signaling devices (APILL) is the best fit for the Regency/City Transportation Service. In addition, it is necessary to revise the governing rules for maintaining traffic infrastructure, the traffic signaling devices (APILL).

Abstract

Marriage is seen as a bridge to a long journey that has shared visions and missions. We can not recklessly hold a wedding. There are a few things to be considered. Umumnya adalah budaya dan agama yang menjadi sorot utama ketika pemuda pemudi atau calon mempelai pria dan wanita akan melangsungkan pernikahan. Budaya merupakan hal yang juga akan dibawa ketika acara pernikahan akan dilangsungkan. Generally, culture and religion become the highlight once man and woman or prospective brides and grooms plan to get married. Culture is presented on the wedding day. However, a different culture is not allowed or prohibited. This also applies to religion. It becomes an important matter to consider before marriage. Marriage must be carried out according to each partner's religion. Thus, it is considered valid. In general, marriages are held in the same religion. However, this study will discuss massive interfaith marriages done by young people in Indonesia. The study employed a literature approach. This approach requires more reading and collecting library data. The findings generated new ideas in civil matters, the registration of interfaith marriages and the challenges of holding such marriage. In conclusion, interfaith marriages bring countless problems if they insist.

Abstract

Indonesia sebagai negara dengan banyak pulau mempunyai beragam kesenian dan kebudayaan, salah satunya adalah batik yang sudah dikenal dunia internasional. Batik telah diakui sebagai warisan budaya manusia, verbal, dan takbenda oleh UNESCO (United Nations Educational, Scientific and Cultural Organization)  sejak tahun 2009. Batik Tulis Paseban merupakan perwujudan simbol artefak budaya Sunda yang muncul secara alami dari nilai-nilai budaya lingkungan, termasuk ide-ide arkeologi pemikiran lokal. Dalam menjaga kelestariannya, hak atas kekayaan intelektual (HAKI) sangat krusial dalam mendorong peningkatan ekonomi global yang tujuan akhirnya adalah kemakmuran bagi bangsa Indonesia. Hal ini yang kemudian menjadikan Indonesia sebagai negara dengan keanekaragaman hayati yang yang tertinggi di dunia. Penelitian ini bertujuan untuk menganalisis Batik Paseban, Kuningan Jawa Barat sebagai Ekspresi Budaya Tradisional ditinjau dari UU Hak Cipta. Artikel ini mengunakan metode penelitian hukum normatif. Hasil kajian menunjukkan bahwa dalam rangka mempertahankan kelestarian budaya dan kekayaan intelektual, maka diperlukan teknologi tepat guna melalui literasi visual dapat memberikan nilai tambah untuk mengembangkan seni budaya sehingga makna dan filosofi Batik Tulis Paseban. Selain itu, pemerintah juga harus terus mendukung dengan melakukan berbagai usaha dalam rangka menjaga dan melestarikan pengetahuan tradisional dan ekspresi budaya tradisional.

Abstract

This study aims to find how women workers' protection is linked to a feminist legal approach, referring to the job creation law. The study revealed there was no improvement in the law. It tended to be detrimental, especially the discussion of three articles: 59, 79, and 81. Feminist Legal Theory sees the need for a breakthrough, the making and enacting laws against women. This is to eliminate discrimination, marginalization, and subordination by law against women. The study employed normative juridical research, involving the statute and conceptual approaches. The data were collected by a literature study involving descriptive data analysis techniques. The study showed women workers' protection, the Job Creation Law has not improved. It is even more destructive, especially the regulation of limitation periods in employment contracts, weekly rest, and contract labour abolition.

Abstract

Abstract: Indonesia has experienced millions of cyber attacks but it has never been able to be handled properly and completely, partly because of weak policies and conventional perspectives in understanding cyber threats. A country's vital infrastructure is related to a country's national interests, so threats to vital infrastructure are tantamount to threatening Indonesia's national interests. The level of use and dependence of a country on information and communication technology is directly proportional to the level of security and defense vulnerability in a country. Communication network connectivity and information technology cause security in this domain to become a separate issue in itself. This study aims to outline the importance of Indonesia to establish a national vital infrastructure in Indonesia in order to prepare Indonesia to face threats in the fifth domain. Determination of national vital infrastructure is urgent because it is closely related to the determination of jurisdiction, national defense and security policies in the cyber domain. This research is a normative study using a comparative approach. The results showed that Indonesia still uses a conventional perspective in seeing the form of threats and determining national vital objects as stipulated in Presidential Regulation No. 63 year 2014. Therefore, in order to face the threats of defense, security as well as national interests of Indonesia in the cyber domain, government needs to evaluate existing policies in accordance with the modern threats, as well as to establish and define Indonesia's vital national infrastructure.Keywords: national interest, security, defense, critical infrastructure, cyber threat.Urgensi Penetapan Infrastruktur Vital Nasional Indonesia Abstrak: Indonesia mengalami jutaan serangan cyber namun tidak pernah dapat ditangani dengan baik dan tuntas, hal ini diantaranya disebabkan karena lemahnya kebijakan dan perspektif konvensional dalam memahami ancaman cyber. Infrastruktur vital suatu Negara sangat terkait dengan kepentingan nasional suatu Negara, sehingga ancaman terhadap infrastruktur ini sama artinya dengan mengancam kepentingan nasional Indonesia. Tingginya penggunaan dan ketergantungan suatu Negara terhadap teknologi informasi dan komunikasi berbanding lurus dengan tingkat kerentanan keamanan dan pertahanan disuatu Negara. Konektifitas jaringan komunikasi dan teknologi informasi menyebabkan keamanan di domain ini menjadi masalah tersendiri yang kompleks. Penelitian ini bertujuan untuk menguraikan pentingnya Indonesia untuk menetapkan dan mendefinisikan infratruktur vital nasional di Indonesia dalam rangka mempersiapkan Indonesia menghadapi ancaman pertahanan dan keamanan di domain kelima. Upaya penentuan infrastruktur vital nasional ini penting segera dilakukan karena berkaitan erat dengan upaya penentuan yurisdiksi, kebijakan pertahanan dan keamanan nasional Indonesia di domain. Penelitian ini merupakan penelitian normatif dengan menggunakan pendekatan komparatif. Hasil penelitian menunjukkan bahwa Indonesia masih menggunakan perspektif konvensional dalam melihat bentuk Ancaman dan menentukan objek vital nasional sebagaimana diatur dalam Peraturan Presiden No. 63 tahun 2014. Oleh karena itu, dalam rangka menghadapi ancaman pertahanan dan keamanan serta kepentingan nasional indonesia di domain cyber maka pemerintah perlu mengkaji kembali kebijakan yang ada sesuai bentuk ancaman modern dan menetapkan infrastruktur vital nasional milik Indonesia.Kata kunci: national interest, security, defense, critical infrastructure, cyber threat.

Abstract

This research aims to address the following research questions:  Why is kratom plant considered illegal in Indonesia? Is there any legal protection for Indonesian farmers who cultivate kratom plants? This study employed normative legal method combining with a qualitative approach. This method relied on secondary data gathered from books, journals, laws, court decisions, and the internet. The information gathered was about kratom plants in Indonesia. In addition, a legal approach was also involved to review selected kratom plant regulation in Indonesia. The study revealed that the legality use of kratom is governed by the circular letter of the Head of the POM No: HK.04.4.42.421.09.16.1740 of 2016, the prohibition on the use of Mitragyna Speciosa (Kratom) in traditional medicines and health supplements. There are numerous side effects for those who consume the kratom plant, according to its content. Since 2013, it has been classified as an NPS (New Psychoactive Substance) and the National Narcotics Agency in an effort to prevent the spread of Kratom plants in Indonesia. Starting with the issuance of a policy, a total ban effective as of 2022. Farmers who cultivate Kratom Plants must switch crops because kratom is classified as Narcotics─ it cannot be cultivated or traded freely.

Abstract

The study was conducted in the villages, Bencah Kelubi and Subarak. Both villages have oil palm plantation companies. The study aims to scrutinize the influence of oil palm plantations, particularly the development and efforts in resolving land disputes─ the indigenous people and the so-called company in Kampar Regency. This study employed descriptive analysis involving qualitative patterns. The study revealed some points. In Subarak village, the investor of an oil palm plantation built a garden for indigenous people. In addition, prior to the investment, they apply the principle of Free, Prior, and Informed Consent (known as PADIATAPA). On the other hand, the investors (oil palm plantation companies) did not fulfill the commitment to build gardens for the community. Also, they disregarded the principle of PADIATAPA. In conclusion, employing the PADIATAPA principle at the initial stage could significantly lessen the conflicts between oil palm plantation companies and indigenous people.

Abstract

This study aims to discover the legal protection of trademark rights from its law and geographical indications. In addition, this study also determines the implementation of the trademark law on Jeniper products. This study employed empirical legal approach involving interviews, observations, and literature studies. This study revealed that the legal protection regulation of trademark right is governed by several laws and regulations. This includes trademark and geographical indications Act, Government Regulation of the Republic of Indonesia Number 22 of 2018─International trademark Registration─Protocols Related to the Madrid Agreement on International trademark Registration, and Ministry of Law and Human Rights Regulation Number 67 of 2016─Trademark Registration and Regional Regulation of West Java Province Number 10 of 2018─Intellectual Property Management. Furthermore, the implementation of legal protection, trademark rights of Jeniper products, have been registered at the Directorate General of Intellectual Property Rights of the Republic of Indonesia. Thus, they are legally by the State. In conclusion, the Regional Government of Kuningan Regency lacks a specific Regional Regulation, governing Trademark Rights in Kuningan RegencyÂ
