Abstract

This study aims to determine the form of dispute resolution between the Buleleng Regency Government and the private sector PT. Candra Dwipa regarding the construction of RTH Bung Karno Park, Singaraja city. The data collection technique used purposive sampling through interviews, observation, documentation and literature study. The subjects in this study were the Regional Government, especially the Commitment Making Official (PPK) of the Disperkimta, Buleleng Regency. Data processing and analysis techniques in this study will be carried out qualitatively. After the qualitative analysis process is carried out, then the data will be presented in a descriptive qualitative manner and systematically. The results showed that (1) a contract clause / agreement letter between the Buleleng Regency Government and PT. Chandra Dwipa is in accordance with the pacta sunt servanda principle and has implications for the rights and obligations of the parties, namely the DISPERKIMTA party can supervise the work of the provider and the provider must carry out the work according to the applicable contract; (2) the dispute settlement mechanism for the development of RTH Taman Bung Karno in which the provider (contractor) does not fulfill the work as planned, namely the realization is only 74,932% while the deviation is -25,068%, the government will stop work, impose fines, and put the provider into in the Black List.

Abstract

The growth of coal mining business in the last ten years in The Indoensia region must certainly be balanced with the fulfillment of the prevailing laws and regulations. So in this article will be discussed about the legislation that specifically regulates the restriction of expansion of group companies, especially in the coal mining sector in Indonesia. The result of this study is Law No. 4 of 2009 on Mineral and Coal Mining provides restriction arrangements for group companies, namely IUP or IUPK holders are prohibited from involving subsidiaries and/or affiliates in the field of mining services in the mining business area they are working in, except with the permission of the Minister. The maximum area ownership of IUP in group companies is not limited.

Abstract

The procedure of law enforcement against international crime includes the problem of developing bilateral and multilateral cooperation in preventing and combating international criminal acts. For example, by entering into an extradition agreement or by entering into a Mutual Legal Assistance (MLA) agreement. Both have different understandings where extradition can be interpreted as a formal surrender made either on the basis of a pre-existing extradition treaty or based on the principle of reciprocity or good relations, for someone accused of a crime (suspect, accused, accused) or someone who have been sentenced to criminal penalties that have definite binding powers (convicted and convicted), whereas Mutual Legal Assistance are agreements between two foreign countries for information purposes and information exchange in an effort to enforce criminal law. Very interesting from this research will be discussed later about the Practice of Cross-border Arrest in the International World, and the Practice of Cross-border Arrest in its Relationship with Indonesia using the Descriptive Normative research method, with legislation and historical approaches.

Abstract

In the global era with all demands and expectations for a better economic condition in a country that an international trade is needed. Fair competition can be carried out in competition between business actors and commodity (goods or services) in overseas with business actors and commodity (goods or services) in country. One form of creating justice in international trade competition is by providing subsidies. The issue of subsidies created the problems and disputes. The problem formulations of this research were: (1) how are the effects of subsidies and countervailing in international trade regulations? (2) how is the case analysis related to subsidies and countervailing measures according to the provisions of the GATT 1994, The SCM Agreement and other legal provisions? The results showed that (1) the effect of subsidies and countervailing measures based on their types (red light, yellow light, green light) in international trade regulations had provided clear provisions as well as the impact and limitations in implementing these provisions in accordance with the provisions. GATT 1994 and The SCM Agreement. (2) The several cases described regarding subsidies that were not allowed because they created injustice that the subsidies were only carried out in an emergency situation and their nature rescued them from an economic crisis.

Abstract

Disaster management is the obligation of the state in carrying out constitutional duties, namely protecting all spilled Indonesian blood. Disasters have the potential to cause casualties and property. Laws are needed as the basis for government decision making in disaster management. The effectiveness of implementing law number 24 of 2007 can be a benchmark for disaster management. The participation of civil society such as Muhammadiyah mass organizations is a supporting capacity in disaster management. This research is a normative study of the effectiveness of the law on disaster management and Muhammadiyah disaster management case study of Covid 19. The results of the research show that there are many things that need to be evaluated in the implementation of the implementation of the law.

Abstract

Introduction to the Problem: Substitute heirs have problems in the form of their implementation in Islamic Law which is rooted in the unclear existing rules, this is based on the status of the successor heirs in obtaining inheritance rights from heirs who have died are not known in the type of inheritance distribution. In Islam, as the successor heir still has direct blood ties (nasab), siblings, and partners in the marriage bond (husband / wife) of the deceased heirs. know clearly and completely, regarding the position of a substitute heir fundamentally in obtaining the inheritance obtained from the rights of a person who has died. Design / Methodology / Approach: Through KHI as tangible as Presidential Instruction No.1 of 1991 contains provisions regarding the position of the successor heirs, so that it becomes the basic instrument for the author in determining legal rules and forms of legal rules for replacement heirs in terms of distribution of appropriate inheritance with Islamic law. Findings: In their existence incapable of not being able to provide a more detailed form of clarity regarding the position of the successor heir which has the character of "Uncertainty" because it contains Tentantive elements and does not provide an absolute position for the successor heirs. Abstract

The development of information technology resulted in the industrial revolution 4 times. Starting from the 1.0 industrial revolution that occurred in the 18th century until now in the 4.0 industrial revolution that occurred in 2010. The 4.0 Industrial Revolution introduced innovative technology in the industrial world so that the world became acquainted with Artificial Intelligent. The application of Artificial Intelligent in banking activities provides convenience and efficiency to all customers and also the bank. However, technological progress will not be defeated by human greatness. Where hackers can still leak and steal customer data, so regulations related to the application of Artificial Intelligence in banking activities are considered very important. The rise of leaks carried out by hackers is known as cyber crime which can destroy the application of the principle of secrecy in the banking system. This is what then inspires the urgency to protect bank consumers data. This research was conducted using normative Legal research and is intended to provide the benefits derived from the application of AI in banking activities, negative impacts and ways to avoid negative impacts through the formation of new regulations related to the application of Artificial Intelligence in banking activities in Indonesia.

Abstract

The problem of international migration at this time has become a problem for every country, be it country of origin, country of destination or country of transit. Several government policies related to granting visas to foreign nationals are expected to encourage the number of foreign arrivals to Indonesia. However, the existence of these policies has resulted in an increase in the number of immigration violations in Indonesia. The main problems in research on Immigration administrative sanctions against foreigners in Indonesia in terms of Law Number 6 of 2011 concerning Immigration are: How effective is the implementation of administrative sanctions against visa violators by foreign nationals and How are the efforts of immigration officers in preventing visa violations by foreign nationals? foreign nationals in Bali. The research method that the author uses is an empirical type with the aim of the studybeing to see the effectiveness of administrative sanctions against foreign nationals who violate visas in Bali. The theories used are Legal Certainty Theory, Legal Effectiveness Theory, Law Enforcement Theory, Authority Theory, Justice Theory and Benefit Theory. The results of the study indicate that application administrative sanctions for violations of visas inthe  Bali Region have not been effective, it can be seen from the data obtained in the field during the last five years there are still many foreign nationals who have been caught in violation casesand during the last five years the number of cases violations in Bali continue to increase. This shows that administrative sanctions do not provide a deterrent effect for perpetrators and other foreigners. Therefore, the immigration authorities should be firm in bringing cases of violations and misuse of visas to court. Immigration officers' efforts to prevent visa violations in Bali are in the form of preventive and repressive measures, the Immigration Office in Bali coordinates withrelevant agencies or agencies, receives reports and follows up on any reports, takes action against foreign nationals who violate. Obstacles faced by the Immigration Office in preventing the abuse of visa-free visits for foreigners in Bali are internal factors including limited human resources, limited operational budget for immigration control, low expertise of immigration officers in supervising foreigners, and external factors, namely the role of the community that has not been supportive immigration officers in providing correct information regarding the presence and activities of foreign nationals.

Abstract

The unlimited use of Information Technology (IT) has made cybercrime accessible to everyone. Technology can be very useful for daily needs, but on the other hand it can also be used irresponsibly by certain parties such as the distribution of pornographic content. The purpose of this article is to find out the regulations regarding pornography in Indonesia, to analyze the spreaders of pornographic content based on Indonesian positive law and to analyze the penalties for spreading pornographic content based on positive law in Indonesia. This research uses ‘doctrinal legal research’. Sources of legal information use primary legal materials (regulations and relevant documents) for further qualitative analysis. The approach used is ‘statutory and conceptual’ to help solve the problem in this research. The results showed that law enforcement officials such as the police and prosecutors prefer to use Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions and Law Number 44 of 2008 concerning Pornography to ensnare perpetrators. spreading pornographic content on the Internet which is considered more obvious and appropriate to be used as a legal basis to ensnare  spreaders of pornographic content on the internet. Perpetrators can be sentenced to punishment is imprisonment and/or a fine as regulated in the law.

Abstract

Keberagaman budaya dan latar belakang masyarakat Republik Indonesia menciptakan suatu perkumpulan adat dimana masyarakatnya hidup dengan kebiasaan – kebiasaan tertentu yang berlaku di wilayah masyarakatnya masing – masing. Perkumpulan ini disebut sebagai masyarakat adat yang tunduk kepada aturan yang kebanyakan non tertulis disebut sebagai “hukum adat” . Biarpun dengan keadaan tanpa “kenormatifan” dari Negara, hukum adat sampai saat ini hidup dan tumbuh bersama masyarakat adatnya ( living law ). Undang – undang Dasar Negara Kesatuan Republik Indonesia 1945 telah dengan jelas mengatur mengenai pengakuan dan eksistensi masyarakat Hukum Adat dalam Pasal 18b, Pasal 28i Ayat (3) dan Pasal 32 Ayat (1) dan (2). Menandakan bahwa biarpun sudah melewati proses justifikasi oleh pemerintah, tidak mengubah kekuatan maupun pengaruh hukum adat itu untuk tetap diakui oleh masyarakat. Sifat fleksibel dan bertujuan untuk kesejahteraan masyarakat hukum adatnya tersebutlah yang menjadikan hukum adat dapat mengambil tindakan menghukum / mengadili masyarakat adatnya tanpa adanya hukum tertulis dari pemerintah, padahal dalam Kitab Undang – undang Hukum Pidana Pasal 1 ayat (1) menyatakan bahwa : “Tiada suatu perbuatan yang dapat dipidana selain berdasarkan kekuatan ketentuan perundang-undangan pidana yang mendahuluinya. Andi Hamzah dalam bukunya memberikan beberapa kesimpulan yang dapat ditarik dari pasal tersebut. Pertama, jika suatu perintah maupun larangan ingin dibuat menjadi sesuatu yang dapat dipaksakan dan dapat diancam dengan pidana, maka larangan atau perintah tersebut harus dicantumkan dalam undang-undang pidana. Kedua, hukum tersebut tidak boleh berlaku surut (Hamzah, 2008: 40). Lalu bagaimana keadaannya dengan hukum adat ? apakah masyarakat diberikan pilihan untuk menggunakan hukum adat atau hukum pidana ? atau apakah terdapat eksklusifitas dalam hal penerapan antara hukum pidana dengan hukum adat ?
