Blurred village boundaries can cause confusion in the implementation of village services, pawedalan, punia funds, kasucianism and non-compliance for local residents. This condition is believed by Hindus to cause disruption of social balance (sekala) and magic (niskala). As a result of the unclear territorial boundaries of the Pakraman village, there was a customary reaction in Pakraman Penatih Puri Village with Pakraman Peguyangan Village. This research will discuss 2 (two) main points, namely: (1) How is the settlement of customary disputes regarding the boundaries between Pakraman Penatih Puri Village and Pakraman Peguyangan Village? (2) What are the factors that hinder the settlement of customary disputes regarding the boundary between Pakraman Penatih Puri and Pakraman Peguyangan villages? This type of research is qualitative research that is descriptive and analytical in nature. Settlement of customary disputes regarding the boundaries between Pakraman Penatih Puri Village and Pakraman Peguyangan Village which are resolved by means of mediation by making a collective agreement or pararem which is used as the legal basis in the Pakraman village. Awig-awig is made in order to create harmony and security in society.

Bengkok land is village property in the form of village land. This bent land is widely known as village treasury land or village property. The definition of bent land itself is not explicitly regulated in statutory regulations. The definition of crooked land is implicitly regulated by statutory regulations. Based on the explanation of Article 72 of Law Number 6 of 2014 concerning Villages (hereinafter referred to as the Village Law), it is stated that bent land is the result of business. The provisions in Law Number 6 of 2014 concerning Villages indicate that Village Treasury Land or village assets which include bent land are certified in the name of the Village Government. In addition, the Regulation of the Minister of Home Affairs of the Republic of Indonesia Number 1 of 2016 concerning Village Asset Management, regulates the same thing as Law Number 6 of 2014 concerning Villages. This research approach uses a statutory approach (statute approach) and a conceptual approach (conceptual approach). Based on the research results, which crooked land that is starting to lose its existence is certified in the name of the Village Government

The designation of armed criminal groups (KKB) in Papua as a terrorist group/organization raises pros and cons because the KKB has so far been identified with the West Papua National Liberation Army (TPNPB-OPM), which is one of the armed separatist movements in Papua. The determination is motivated by violence and or armed violence carried out by the KKB which has political, ideological, and security motives, where these three motives are elements in criminal acts of terrorism. Meanwhile, according to the author, the policy carried out by the Government of Indonesia is a re-criminalization. By using the normative juridical method, the authors conclude that the determination of the KKB as a terrorist group/organization is the right policy of the Indonesian government. Based on the three motives above, the KKB can be categorized as an ethno/nationalist separatist terrorism.

Violations occur because motorists do not obey road signs and markings, which results in congestion and is more at risk of leading to an accident. The government, in this case the city government of Denpasar, has issued Regional Regulation for the City of Denpasar Number 13 of 2016 concerning the implementation of transportation. The research method is empirical legal research. From the results of research on the Effectiveness of Illegal Parking Regulations Related to the Regional Regulation of the City of Denpasar Number 13 of 2016 concerning the Implementation of Transportation, the Denpasar City Transportation Agency takes action in accordance with Article 142 paragraph (4) to take action against violations against vehicle owners and / or drivers as referred to in paragraph (3) done by: affixing stickers; locking and / or fixing the chain on the wheels of a motorized vehicle, tire grinding (removing the valve); and towing with this rule reduces illegal offenses by the side of the road, so that it can be said to be effective.

This essay discusses the legal protection for mobile banking custumers, because the mobile banking product as one of the delivery many benefits but contain many risk on the other side that could cause losses for the custumers. Therefore, the protection for mobile banking custumers is requiered in order to protect the rights of the custumers banking servise. The study was conducted to determine how the indonesian low and regulations that protect mobile banking custumers in banking transaction in case of the error transaction electronic in review of low number 11 of 2008 on information and electronic transactionsas well as the bank’s responsibility for the mobile banking custumers in case of a transaction error. This study is a normative study with the literature research method to analyze the book of legal literature and the low number 8 of 1999 about the custumers protection, low number 10 of 1998 about the indonesia banking sistem, low number 11 of 2008 about the transaction and electronic information. The result showed that although there is no customers legislation that specificaly regulates mobile banking, but in indonesia positive legal order there are laws and regulation which has provided legal protection for mobile banking custumers. There are law number 11 of 2008 about information and electronic transaction as contained in article 1.2 and 3. The bank’s responsibility to the custumer in case of error transaction. The loss is a proxy of fullfillment of one custumers protection law. Right to copensation in accordance with the treaty law in article 1313 civil law. Then the current legislation already includes aspects of legal protection for mobile banking custumers.

Regional regulations (Perda) have a very strategic role in the implementation of regional governance. Various efforts to improve the quality of the Perda continue, including through Law Number 12 of 2011 concerning the Formation of Laws and Regulations which require the preparation of Academic Texts (NA). This study aims to identify and analyze the urgency and implementation of NA drafting in the formation of regional regulations based on legislation. The research method used is normative juridical research, by examining the prevailing norms in the preparation of a guideline in the form of a text with a statutory and historical approach. The results showed that NA has a very important urgency to create a good and quality regional regulation. NA is very important in the process of forming laws and regulations when faced with statutory problems that are considered unresponsive, egalitarian, futuristic, and unqualified. Through NA, each Raperda that gets a scientific touch can produce a higher quality Regional Regulation and can be categorized as good legislation. Given its very vital urgency, it is hoped that the drafters of Perda (Regional Government and DPRD) formulate NA first before compiling the Regional Regulation Draft and provide legal standing for NA compilers in the formation of Perda which need to be regulated in Legislation.

The justice of in absentia got a serious issues that concered to the pros and cons defendant of corruption criminal act, which is the good impact of in absentia implementation can advanced the justice process in recovering the costs state offered another impact to the defendant who has took an advantages of in absentia to run away abroad (DPO) and wasn’t attend the court, so that the defendant can’t be fulfilled his rights for the self- defense. The studies has made for (1) the authority of the public prosecutor in absentia implementation and (2) the criminal procedural of law mechanism (KUHAP) related by in absentia and the relevance of the Rights defidant that seen by HAM point of view in Indonesia. By using the research methods of sosio- legal, based on law comprehensive and connected with the implications for legal fact in society. The result of the study has proved that in the in absentia implementation wasn’t violated the rights of corruption defendant based on law criminal procedure (KUHAP) which is the defendant has called legally by the public prosecutor but it wasn’t attended court so that the restrictiory on civil can be imposed (Derogble Rights). In the law of human rights which based on siracusa principle in international convention of civil rights and politics that in state of emergency can be made the restictions under certain conditions. But in the restrictions of Rights it supposed to pay attention of in absentia implementation so that the processed can be done by the procedure.

In ASEAN and the EU, there is a social problem that underlies a similar problem that occurred in ASEAN and the EU regarding the authority of regional human rights institutions in deciding a case of human rights violations. ASEAN also does not have an independent judicial institution that functions to enforce human rights law independently. These factors are certainly an obstacle in the enforcement and protection of human rights in ASEAN in particular. This is different from the EU which has a more integrative law enforcement mechanism. In terms of upholding and protecting human rights, the EU has the European Court of Human Rights (ECHR). The judicial institution has a function to ensure that the human rights of the EU people are not violated and give the EU community the right to be heard in court for cases of human rights violations experienced.

Tindak pidana kelalaian merupakan kasus yang banyak menimbulkan pro dan kontra. Hal ini dikarenakan tindak pidana kelalaian adalah tindak pidana yang terjadi karena suatu perbuatan yang tidak dikehendaki oleh pelakunya melainkan dikarenakan oleh kecerobohon dari pelaku sehingga kecerobohan tersebut merugikan orang lain. Namun, dari kelalaian tersebut tetap saja menimbulkan sebuah akibat. Salah satu contoh kelalaian adalah kelalaian dalam mengaliri pagar rumah dengan arus listrik yang menyebabkan kematian pada orang lain. Pengaturan mengenai akibat “kelalaianâ€yang menyebabkan matinya orang lain di dalam KUHP. Yakni pasal 359 KUHP yang berbunyi “Barang siapa karena salahnya menyebabkan matinya orang, dihukum penjara selama lamanya lima tahun atau kurungan selama lamanya satu tahunâ€. Tujuan dari penelitian ini adalah untuk, pertama: untuk mengetahui apakah pemasangan arus listrik yang mengakibatkan hilangnya nyawa orang lain termasuk suatu tindak pidana kelalaian; dan kedua untuk mengetahui bagaimana pertanggungjawaban pidana bagi pelaku tindak pidana kelalaian di indonesia. Penelitian ini peneliti lakukan dengan menggunakan metode yuridis normatif, yakni dengan studi kepustakaan. Dari hasil penelitian ini dapat disimpulkan bahwa pertama: pemasangan arus listrik yang menyebabkan hilangnya nyawa orang lain termasuk ke dalam tindak pidana kelalaian; dan kedua: syarat untuk adanya pertanggungjawaban pidana bagi pelaku tindak pidana kelalaian adalah harus adanya kemampuan bertanggung jawab dari pelaku.

Apart from being intended to establish friendly relations, diplomatic relations are also carried out to improve cooperative relations in various fields. The objectives of this study include: 1) to find out whether the diplomatic representatives of Afghanistan in Indonesia are also responsible for handling Afghan refugees in Indonesia based on the 1961 Vienna Convention, 2) to find out how Indonesia's role as a receiving country in efforts to handle refugees from Afghanistan in Indonesia is based on the Convention. Wina 1961. This legal research uses the normative juridical legal method. Secondary data obtained through literature study is used as the main data. The findings of this study indicate that Afghan diplomatic representatives have no responsibility towards refugees from Afghanistan because they have abandoned their citizenship when they left their country. As a receiving country based on the 1961 Vienna Convention, Indonesia has played a role in handling refugees from Afghanistan by issuing Presidential Regulation no. 125/2016 concerning the Handling of Refugees from Abroad which is used as a normative and coordinative basis for Ministries / Agencies and in handling refugees from abroad by involving the role of the Regional Government.
