Abstract

Wannacry Ransomware epidemics have attacked several high-profile companies in European Union creating an EU-wide cybersecurity crisis in the digital economy and social order. In response, European Union established an appropriate regulation in cybercrime namely The Cybersecurity Act. The Act as an international regime does not only gives a permanent mandate that strengthens European Union Agency for Network and Information Security (ENISA) but also establishes The EU Cybersecurity Certification Scheme in order to increase cybersecurity and build cyber resilience in the European Union Digital Single Market. This paper investigates how does the Cybersecurity Act as a business law in maintaining cybersecurity aspect on the European Union Digital Single Market through the theory of neoliberal institutionalism as a framework of thinking. After a series of conduction of literature reviews, this research argues that The Cybersecurity Act would be an appropriate regulation in dealing with the cybersecurity crisis in the digitalized market order. The standardization in The EU Cybersecurity Certification Scheme regulated by The Cybersecurity Act would improve cybersecurity and build cyber resilience in the European Union Digital Single Market.

Abstract

This study aims to determine the accountability of financial institutions to employees who have been negligent in providing services to customers and examines the triangular relationship between financial institutions, employees, and customers. This normative juridical research is combined with empirical data. The results indicate that if the negligence of an employee is per the standard operating procedures (SOP) set by the authorities in the financial institution, the financial institution must be responsible for the loss of the customer. This responsibility is based on Articles 1365, 1366, and 1367 of the Civil Code. If the employee's negligence is not according to the SOP, then the employee must be personally responsible. A single legal event may result in different ways of settling in the relationship of these three parties.

Abstract

Dalam praktik, penerapan prinsip state’s primary responsibility seringkali dihadapkan pada sebuah tantangan berupa kondisi kemampuan dan kemauan suatu negara dalam menghadapi bencana yang terjadi secara tiba-tiba, besar, dan bersifat meluas seperti adanya pandemi Covid-19. Tulisan ini menganalisis pentingnya rekonseptualisasi prinsip kedaulatan negara dalam penanggulangan bencana khususnya di Indonesia dengan belajar dari penanggulangan Covid-19. Penelitian ini merupakan penelitian yuridis normative. Hasilnya bahwa kedaulatan negara dalam kondisi bencana hendaknya dipahami juga sebagai bentuk tanggung jawab negara untuk melindungi rakyatnya dengan membuka kerja sama internasional dalam bentuk bantuan kemanusiaan, ketika negaranya tidak mampu atau tidak mau menanggulanginya. Kondisi pemerintahan yang kuat atau lemah dapat menjadi tolak ukur terpenting untuk menentukan penerimaan bantuan internasional. Hal ini tentunya dapat menjadi rekomendasi bagi pemerintah Indonesia untuk menghentikan polemik penerimaan atau pencarian bantuan internasional terkait implikasi hukum dari penetapan status bencana nasional di Indonesia.

Abstract

Artikel ini menganalisis konsep Perseroan Terbatas pasca diundangkannya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja. Penelitian hukum normatif ini dengan menggunakan pendekatan perundang-undangan, pendekatan analisis konsep hukum dan pendekatan perbandingan. Hasilnya bahwa pasca diundangkannya UU Cipta Kerja terdapat bentuk badan hukum baru yaitu Perseroan Perorangan yang dikhususkan bagi pelaku UMK dengan tujuan untuk memudahkan pengembangan usaha bagi pelaku UMK dengan dapat membentuk badan usaha berbadan hukum hanya dengan satu orang pendiri/pemegang saham. Perubahan tersebut telah mengindikasikan terjadinya perubahan paradigma Perseroan Terbatas sebagai asosiasi modal. Hal ini berupa perluasan konsep Perseroan Terbatas dimana pendirian Perseroan Perorangan bagi UMK didirikan oleh 1 (satu) orang. Konsep tersebut bukan merupakan hal yang baru mengingat pada Pasal 7 ayat 5 dan ayat (7) UUPT bahwa perseroan dapat didirikan hanya oleh satu pemegang saham sebagaimana pada pendirian BUMN dan BUMD yang diatur juga di dalam UU BUMN dan PP No. 45 Tahun 2005 yang memungkinkan saham Persero seluruhnya dimiliki negara. Konsep tersebut dapat dipahami sebagai rujukan dalam mendirikan Perseroan Perorangan untuk pelaku UMK.

Abstract

Political corruption is a form of violation of people's human rights and is a worrying phenomenon because it is dominated by state officials who have superior positions. This article aims to find out how the reality of law enforcement against corruption is carried out by state officials and how the criminal responsibility of state officials who commit political corruption in Indonesia. This article uses a normative juridical method. The results shows that law enforcement against state officials who commit political corruption has not been carried out optimally. The low demands of prosecutors followed by judges' verdicts against state officials who commit corruption are the cause of the difficulty of eradicating this crime. The imposition of a maximum criminal threat or life imprisonment for perpetrators of political corruption is something that should be done to create a deterrent effect for the perpetrators or the public who see it. In this case, law enforcement officers must have the courage, integrity, and high morale to be indiscriminate in eradicating political crimes in Indonesia.

Abstract

Abstract

Dalam amar putusannya, Mahkamah Konstitusi dengan putusan Nomor 22/PUU-XV/2017 memerintahkan pembentuk Undang Undang dalam jangka waktu paling lama 3 tahun sejak putusan tersebut ditetapkan untuk melakukan perubahan terhadap Undang Undang Nomor 1 Tahun 1974 tentang Perkawinan. Tulisan ini mengkaji ratio legis pengaturan batas minimal usia perkawinan menurut Undang Undang nomor 16 tahun 2019 tentang Perubahan Undang Undang nomor 1 tahun 1974 tentang perkawinan. Penelitian hukum ini menggunaka pendekatan filsafati, perundang-undangan, dan pendekatan konseptual. Hasil penelitian ini menyimpulkan bahwa bahwa ratio legis pengaturan batas minimal usia perkawinan menurut Undang Undang Nomor 16 Tahun 2019 tentang perubahan atas Undang Undang Nomor 1 Tahun 1974 tentang Perkawinan adalah pengakuan hak anak, jaminan, perlindungan dan kepastian hukum yang adil serta perlakuan yang sama atas hukum sehingga tidak ada diskriminasi.

Abstract

In Indonesia, there have been numerous cases of people escaping from prison including the Muara Labuh Prison. This research analyze the prison conditions, the cases that occurred there, the motives behind the escape, the responsibility of the warden, and how Islamic law views escape. Data were collected through observation of prison conditions and interviews. Data analysis was performed in several stages, including data reduction, display, and verification techniques, then, narrated using a qualitative approach and Islamic law. The results revealed three cases of inmates escaping from this prison. They have a variety of reasons for this, including an inability to restrain sexual desires, being unable to serve very long sentences, depression, and poor prison security, which is the warden's responsibility. Prison escape is not justified in Islamic law due to the necessity to obey state rules that are not specifically regulated in the Qur'an and Sunnah.

Abstract

Legal protection of human rights defenders in Indonesia is at an alarming point. This sociolegal study focused on the objective conditions of legal protection for human rights defenders and the legal protection for human rights defenders from a theoretical perspective on the reasons for erasers punishment. The results are human rights defenders still experience arrests, shootings, clashes and torture. There are also several criminal law policies that have the potential to violate the rights and guarantees of legal protection for human rights defenders. Second, "the theory of lesser evils" can be used as a basis for providing legal protection to human rights defenders. As long as the actions of human rights defenders are to implement Article 67 of Law No. 32 of 2009, for example, human rights defenders can be seen as "implementing the laws and regulations" and protected by Article 66 of Law No. 32 of 2009, so that Article 50 of the Criminal Code can be applied as an excuse to eradicate crimes. In the future, guidelines for the criminalization of human rights defenders when dealing with criminal case settlement processes are also needed.

Abstract

Settlement of disputes in civil cases is not only resolved by the Court, but also through arbitration and alternative dispute resolution if the disputing parties agreed. The selection of this arbitration must be stated in the clause of the agreement which expressly chooses the arbitration. Civil cases that become the authority of this arbitration are only within the scope of the trade sector. The procedure for settlement through arbitration is different from the court, among others, the trial is closed and flexible, the decision is final and binding, the arbitrator is chosen by the parties and the decision is carried out by the court.
