Abstract

The emergence of Artificial Intelligence (AI) technology has brought significant changes to corporate governance, presenting various opportunities and challenges. The implementation of AI in corporate governance can have a significant impact on the level of governance and create conditions that support better decision-making. However, the use of AI also has negative impacts such as data privacy violations, gender discrimination, reputational loss, and compliance issues. Additionally, there are legal challenges in the application of AI, including the legality of data utilization, accountability, fairness, transparency, security, and data privacy. Through a systematic literature review, including the analysis of articles, legal documents, and relevant regulations, this study aims to analyze the impact of Generative AI on corporate governance, identify potential legal challenges, and investigate relevant legal perspectives in addressing these challenges

Abstract

The purpose of this study is to see how the development of Islamic community empowerment is linked through social media. The link between community empowerment and social media can be seen from the influence of social media which is quite complex in empowering the community, due to the rapid development of the media, everything can be known through the media. Because of that, many people use it in all ways, including empowering their lives to be more worthy and also upgrading skills and knowledge through social media. The research method used in this research is descriptive qualitative research. The data collection technique used in this research is to use library research, namely by collecting data through journals, scientific articles and other literature related to community empowerment. In empowering the community itself, social media plays a role in education, information, information and also as a social liaison between the community and the government as well as other communities. The media also functioned as a vessel in obtaining various knowledge in the form of values, prevailing norms. The media plays a role in empowering by becoming an intermediary in conveying information to the public. So far, the media can help increase the success of the empowerment process and support community capacity building practices. In the context of empowering the Islamic community, the majority of people who are Muslim in Tanjungbalai City with a ratio of 3:4 of the total population make the Islamic community in Tanjungbalai the right object of empowerment. Moreover, as a religion that is the majority, it would be better if it is able to show the quality to become a superior society.

Abstract

This study aims to analyze the role of the Indonesian Constitutional Court in carrying out its function as a stronghold of law enforcement in Indonesia after the reform era, as well as evaluate the extent to which this institution has succeeded in protecting human rights through its decisions. Methods: This research is categorized as normative legal research with a philosophical and analytical approach. The focus is on rational, critical, and philosophical analysis of the legal issues raised. The analytical descriptive method is used to describe the applicable legislation, legal theory, and positive law enforcement practices related to the problem under study. Results: The results show that the Indonesian Constitutional Court plays an important role in upholding the Constitution and social justice with a careful and balanced approach. Key decisions such as No. 18/PUU-V/2007, No. 75/PUU-XIII/2015, and No. 102/PUU-XXI/2023 highlight the importance of legislative autonomy, legal clarity, and certainty, as well as the presumption of innocence and prudence in political intervention. The application of Aharon Barak's theory of "proportionality," Lon Fuller's "legal certainty," and Alexander Bickel's "judicial restraint" provides insight into ensuring a balance between human rights, legal certainty, and the integrity of due process.

Abstract

This research focuses on the role and responsibility of the state in controlling and regulating electronic information resources, especially in the scope of e-commerce in Indonesia. In the digital era, the rapid development of e-commerce requires effective and comprehensive regulation to ensure the integrity, security, and growth of this industry. This research discusses several necessary regulations adopted by the Indonesian government, including Law Number 11 of 2008, which was changed to Law Number 19 of 2016 concerning Information and Electronic Transactions, Government Regulation No. 82 of 2012 concerning the Implementation of Electronic Systems and Transactions, Law Number 7 of 2016 concerning Trade, and Bank Indonesia Regulation No.11/12/PBI/2009 concerning Electronic Money. This research shows that these regulations and policies have established a Solid legal framework for e-commerce in Indonesia. However, given the rapidly changing technology and industry dynamics, these regulations and policies must be continuously updated and adapted to new needs. Therefore, the state's role in monitoring industrial developments, adjusting regulations, and educating the public is essential in establishing a fair, safe, and sustainable e-commerce ecosystem. Overall, this research shows that balancing consumer protection and industry growth is critical for the future of e-commerce in Indonesia.

Abstract

This research is a qualitative research that looks at and explores how economic violence perpetrated by the state impacts women. The research was conducted in Bangkalan Madura using a descriptive qualitative approach. The results of the research show that the state policy to increase the price of fuel oil (BBM) is considered as state economic violence. As a result, this country's economic violence has an impact on the lives of Bangkalan Madura women. To get out of this problem, the state should be wiser in raising fuel prices.

Abstract

Used cellphones are cellular telecommunications devices that have been previously used by other people and resold. Not a few people prefer to buy used cellphones rather than new cellphones. This research aims to analyze the factors that influence consumers' decisions in buying used cellphones in Dairi Regency. The subjects in this research were people from Dairi Regency who had bought used cellphones. The research method used is quantitative by obtaining data through questionnaires distributed to respondents. The data analysis technique used is multiple linear regression analysis. The research results showed that partially the price and quality of the product did not influence consumers' decisions to buy used cellphones in Dairi Regency. Partially, brand and physical condition have a positive influence on consumers' decisions to buy used cellphones in Dairi Regency. Meanwhile, simultaneously price and product quality have a positive influence on consumers' decisions to buy used cellphones in Dairi Regency.

Abstract

The low participation of Micro, Small, and Medium Enterprises (MSMEs) in export activities remains a major challenge in developing sustainable coastal economies. This study examines the effect of digital marketing literacy on export readiness among shell-craft MSMEs in the coastal area of Sanur, Bali, with strategic agility as a mediating variable, and identifies improvement priorities using Importance-Performance Map Analysis (IPMA). A quantitative approach was employed through a survey of 62 shell-craft MSMEs selected using accidental sampling. Data were analyzed using Structural Equation Modeling–Partial Least Squares (SEM-PLS) and IPMA. The results reveal that digital marketing literacy significantly influences strategic agility (β = 0.616; p less than 0.001) and export readiness (β = 0.293; p = 0.016). Strategic agility positively affects export readiness (β = 0.500; p less than 0.001) and partially mediates the relationship between digital marketing literacy and export readiness (β = 0.308; p less than 0.001). IPMA findings indicate that social media promotion, digital payment use, digital catalog management, customer data analysis, and market-driven product innovation are high-importance but low-performance attributes. This study proposes the “Shore to Store” model as a strategic framework to accelerate the transformation of coastal MSMEs into export-ready enterprises.

Abstract

This study aims to identify the causes of conflict between PT. Pagilaran and the community in Batang Regency over land owned by PT. Pagilaran comes from the concession with revealing theories that support the causes of conflict and studies how the dispute is resolved. This research is normative juridical research with a descriptive-analytical approach. The research results obtained: First, the cause of the emergence of Cultivation Right disputes is the claims from farmers that they once controlled part of the Cultivation Right land, the absence of compensation at the time of land acquisition, and the negative view of the community towards PT. Pagilaran and some parties facilitate claims efforts, as well as repressive actions from the company through security forces. Second, efforts to resolve the dispute are carried out both through channels outside the court, through efforts to seek support from policy-making institutions, and through re-data collection of biological data on PT. Pagilaran looked for opportunities to strengthen the position of farmers who once controlled the land and settlement through the courts in the form of legal action for the perpetrators of marking, plotting, and damage to land and plants in the Cultivation Rights area but did not resolve the core issues of the dispute. This study suggests that rural conflict resolution requires a holistic approach by paying attention to regulatory, human rights, contractual, and environmental aspects of resolving conflicts.

Abstract

Peraturan daerah merupakan instrument hukum yang dibuat oleh pemerintahan daerah dalam menyelenggarakan kewenangannya untuk mewujudkan otonomi yang dimiliki. Pemerintah Kabupaten Nagan Raya sebagai pelaksana otonomi daerah  telah mengeluarkan Peraturan Daerah Nomor 5 Tahun 2007 tentang penertiban hewan ternak. Penelitian ini bertujuan untuk mengetahui terkait implementasi peraturan daerah Kabupaten Nagan Raya tentang penertiban hewan ternak khususnya di Desa Purwosari, karena berdasarkan penelitian regulasi penerapan peraturan daerah tersebut masih lemah dalam pengimplementasiannya. Dimana masih terdapat ketidaksesuaian terhadap peraturan daerah Kabupaten Nagan Raya dengan realita yang terjadi dilapangan, khususnya di Desa Purwosari.  Penelitian ini menggunakan metode kualitatif dengan pendekatan deskriptif. Data yang digunakan yaitu data penelitian primer  yang diperoleh peneliti melalui pengamatan dan wawancara dengan perangkat Desa, terutama kaur keuangan Desa Purwosari. Sementara data sekunder dikumpulkan melalui berbagai literatur, seperti jurnal, buku-buku, dokumen yang dianggap tepat dan mampu memperkaya wawasan peneliti tentang masalah yang sedang diteliti. Hasil penelitian menunjukkan bahwa implementasi peraturan daerah Kabupaten nagan raya tentang penertiban hewan ternak  khususnya di Desa Purwosari belum maksimal, karena masih terdapat program-program terkait penertiban hewan ternak yang belum dijalankan dan masih terdapat ketidaksesuaian terhadap peraturan daerah Kabupaten Nagan Raya dengan realita yang terjadi dilapangan, seperti penerapan sanksi terhadap para peternak yang melepas ternaknya di fasilitas publik, hal ini dikarenakan Desa Purwosari masih mengedepankan rasa kekeluargaan sehingga dalam pemberian sanksi belum sesuai dengan kebijakan yang telah ditetapkan.

Abstract

From the results of research on the Lower-Level Bureaucratic Capacity Building Network Model in Community Empowerment Policy: Case Study of Implementation of Limam Foot Vendor (PKL) Policy in South Sulawesi Province. Aims to find out effective implementation strategies so that street vendors can participate in world development, especially specifically in the province of South Sulawesi, precisely in the city of Makassar, the focus in this study includes (a). integrated human resource development in implementing street vendor empowerment policies, (b). partial strengthening of the organization in implementing PKL empowerment policies (c).institutions that are integrated in the collaborative implementation of street vendor empowerment policies. The method of the research results is to use qualitative methods that are case study strategic surveys. The data collection techniques used are in-depth interviews, observation, and documentation. The results of the study show that the development of empowerment coaching.
