Abstract

Overlap the land permit granted by the Government of Pelalawan result of indigenous people communal land taken without regard to the rights of the local population. In issuing licenses, many customary rights of indigenous peoples are disadvantaged. Because in practice the country has not fully provide legal protection of the rights of indigenous peoples, as in the case of customary land disputes and conflicts/communal, indigenous peoples still in a weak position associated with the policies issued by the state. Need for Local Regulation in Pelalawan governing the legal protection of the rights of indigenous peoples, so that indigenous land disputes and conflicts/customary in Pelalawan can be minimized.

Abstract

This research has 3 aims, the first is to examines the consideration of the Supreme Court in deciding the cancellation of arbitration decision under Article 70 and beyond Article 70 of Arbitration Act, the second is to review and analyze theories used in the consideration of the Supreme Court to cancel the Arbitration Decision. The third is to formulate concept in deciding the cancellation of Arbitration based on the principle of justice. This type of research is normative judicial research. Approach used in this research is case study approach. In more detail of the data obtained, processed and analyzed and presented in descriptive qualitative. The result of the research is divided into several parts, the first shows that according to the consideration of Deision of Supreme Court No.729/K/Pdt.Sus/2008 see Article 70 of the Arbitrase Act is limitative, different with Supreme Court Decision No.03/Arb/BTU of 2005 interpeting Article is enunciatif. The second, the Great Judge who cancel the arbitrase decision according to Article 70 Arbitration Act which is limitative by using Analytical theory. the Great Judge cancel the arbitrase decision refers to reasons beyond Article 70 of Rbitrase Act using Progressive Law theory. The third, according to procedural fairness the reason for cancellation is based on decision Article No.70 Arbitrase Act is too limitative comparing to Article 34 of the UNICITRAL Model Law. This substantive justice should be limited to the signs, so that arbitrators use it arbitrarily.

Abstract

Tujuan penelitian ini adalah untuk mengidentifikasi dan mengevaluasi berbagai bentuk kebijakan pemerintah daerah serta mengevaluasi kondisi eksisting berbagai  program TJSP di DIY dan Provinsi Jawa Tengah yang telah dilaksanakan. Untuk menjawab tujuan tersebut, maka metode yang digunakan adalah Pada tahun pertama, penelitian ini dilakukan dengan metode penelitian yuridis normatif dengan pendekatan perundang undangan (statute approach) (Marzuki, 2005: 137-139); dan penelitian yuridis empiris (sosiologis). yaitu mengkaji dan mengevaluasiberbagai bentuk kebijakan daerah serta program pelaksanaan TJSP di Daerah Istimewa Yogyakarta dan Provinsi Jawa Tengah. Berdasarkan hasil dan pembahasan dapat disimpulkan bahwa: Pertama, Kebijakan TJSP oleh pemerintah daerah terutama di DIY dan Jatenag secara umum masih sangat lemah,  dimana untuk DIY dalam bentuk Peraturan Gubernur sedangkan Jawa Tengah menggunakan Surat Keputusan Gubernur.  Kedua, untuk Program TJSP yang dilakukan oleh perusahaan selama ini belum mengetahui kalau pemerintah telah mengeluarkan kebijakan TJSP. Sehingga perusahaan dalam melakukan TJSP selama ini hanya sebatas inisiatif sendiri dan walapun secara tidak langsung sudah bekerjasama dengan pemerintah dalam melaksanakan TJSP. Perusahaan secara umum akan mendukung kebijakan Daerah mengenai TJSP dalam bentuk Perda. Namun ketentuannya harus mempertimbangkan kepentingan situasi dan kondisi yang dihadapai perusahaan.

Abstract

One of means to eradicate corruption is preventing corruptors to go abroad. Prevention is basically an instrumentof limiting of indivudual rights and therefore it is considered againts human rights. However, prevention conduetedby the corruption Eradication Commision on the corruptors is not considered as againts human rights since it ispart of restriction on human rights in the light of law enforcement. It does not also violate the presumption ofinnocence as part of criminal procedure. the authority of the Corruption Eradiction Commission is legitimateand in accordance with legal principle that state may have right to restrain the rights of citizens for the sake ofstate interests and society.

Abstract

Procurement of goods and services for the benefit of the government is one tool to drive the wheels of the economy, in order to improve the national economy to the welfare of Indonesian life, for the procurement of goods and services, especially in the public sector is closely linked to the use of the state budget. Through normative juridical research, this study found the legal aspects of government procurement of goods and services, especially in terms of a review of the juridical rules of government procurement. Arrangements regarding the procedures for the procurement of government goods and services in Presidential Decree No. 54 Year 2010 jouncto Presidential Decree No. 70 The year 2012 is expected to increase conducive investment climate, efficiency of public spending, and accelerating the implementation of APBN/APBD. Government procurement of goods and services currently on aspects of administrative law, civil law and criminal law. In the procurement of goods and services should apply the general principles, good principles that have long been known in state financial management, such as the principle annual, the principle of universality, the principle of unity, and the principle of specialty as well as the principles of the new as reflecting best practices (application of the rules good) in the management of state finances.

Abstract

This research entitled: Study Focus of Provincial Autonomy In the constitutional system of the Republic of Indonesia. The result of the research can be concluded that the First, the 1945 Constitution does not give a clear regulation about the options in the unit of local authority where the policy emphasis autonomy placed. The Second, in the history of the accomplishment regional administration, the policy emphasis on the autonomy at the regional Level II/regency/City normatively used to be implemented at the time of the validity of Law Number. 5 of 1974 and Law Number. 22 of 2004. The third, in the normative perspective chances of emphasis on provincial autonomy in the future is very open, it is because at the Article 18 of the 1945 amendments to the results of an open policy (open legal policy) about regional autonomy and regional autonomy center of gravity. In these provisions, do not regulate in which the emphasis regional autonomy placed. Thus the focus wisdom of regional autonomy is highly dependent on the political will of the legislators with regard to the situation of country, such as politics, security, economy and society when the law was made and the policy of the center gravity of regional autonomy in the Provincial or the Regency/City is not contradictory with the Constitution of Republic of Indonesia Year 1945.

Abstract

The State Civil Apparatus has a very important role in the implementation of the tasks of government and nation-building. Therefore, the State Civil Apparatus is an apparatus free from political intervention. In other words, as stated in the legislation, the State Civil Apparatus must be neutral. The neutrality of the State Civil Apparatus is a prohibition for the State Civil Apparatus to become a member or manager of a political party, so that the Civil State Apparatus is free from the influence and intervention of political parties in the performance of their duties and obligations. The regulation of the neutrality of the new State Civil Apparatus began in the New Order period with the issuance of Law No. 8 of 1974, and so on in Law 43 of 1999 and Law No. 5 of 2014 on State Civil Apparatus and its implementing regulations. In practice, the implementation of neutrality of the State Civil Apparatus has many obstacles and constraints. At the time of enactment of Law No. 8 of 1974 and Law No. 43 of 1999, the principle of State Civil State’s neutrality of neutrality is often violated, this is due to the strong influence of political parties in bureaucratic relations in government agencies. Therefore, in the period of Law No. 5 of 2014, efforts are made to minimize and even eliminate the influence of political parties on the State Civil Apparatus, one way is to establish the State Civil Apparatus Commission.

Abstract

Perwujudan hukum yang benar harus saling melengkapi dan tidak saling mengecualikan hakikat dari hukum terletak pada karakteristik dari hukumnya sebagai institusi yang menunjang dan melindungi nilai-nilai, hingga eksistensi hukum harus mampu memberikan perwujudan nilai-nilai menjadi kenyataan dan perwujudan tersebut teraplikasikan dalam proses bekerjanya hukum. Norma hukum yang mengatur dokter yaitu Undang-Undang No.29 tahun 2004 tentang Praktek Kedokteran memberikan suatu pendefinisian secara tegas mengenai standar profesi, yaitu batasan kemampuan (knowledge, sklill and profesional attitude) minimal yang harus dikuasai oleh seorang individu untuk dapat melakukan kegiatan profesionalnya pada masyarakat secara mandiri yang dibuat oleh organisasi profesi. Untuk itu, dalam menjalankan profesi dokter harus berdasarkan pada ketentuan norma tersebut sebab dokter dituntut pertanggungjawaban dalam menjalankan profesinya, bilamana terjadi hal-hal yang disebabkan oleh kelalaian dan kesalahannya dapat menimbulkan pertanggungjawaban hukum sehingga dituntut adanya proses hukum yang dapat berakibat administratif, perdata atau pidana, putusan pengadilan yang dapat menentukan hal ini. Putusan Mahkamah Agung Nomor 365 K/Pid 2012, salah satu bentuk pertanggungjawaban hukum yang harus dibebankan sebagai bentuk perwujudan dokter dalam menjalan profesinya, sekalipun pada akhirnya dengan putusan tersebut dapat berdampak pada kinerja dokter.

Abstract

Presecution system is one of the criminal justice system’s elements. In Indonesia, the presecution system does not clearly state whether it follows legality principle or opportunity principle. A strict regulation regarding to the presecution system influences the criminal justice system. Re-evaluation of the presecution system through the opportunity principle as stated in the Draft of Criminal Code Procedure of 2008 does not only bring impacts towards the Indonesian criminal justice system but also balance the victims position which has got less attention during these years.

Abstract

This  study is discussed about the mediation mechanism based on the local wisdom in Banyumas and factors inhibiting in the implementation. This study used a qualitative sociological juridical approach. The results showed that the mechanism for the resolution of criminal cases through mediation based on the value of local wisdom in Banyumas can be done outside and within the criminal justice, while still empowering the use of social network mediator. The mediation mechanism outside the criminal justice is done when the criminal case has not been reported or filed to the police, while the mechanism in the criminal court is done when a criminal case has been reported or filed with the police, and each of these mechanism has a sequence of stages. Meanwhile, the voluntary mediation became the first and man choices of Banyumas people. Inhibiting factors in the implementation of the mediation is primarily related to substantial and cultural components.
