Abstract

Act number 13 of 2003 on State Owned Enterprise obligate State Owned Enterprise to pay attention on social issues through Partnership and Community Development Program (PKBL). Meanwhile Act number 40 of 2007 on the Limited Liability Company instruct Limited Liability Company to implement Social and Environmental Responsibility which often called as Corporate Social Responsibility (CSR). These two programs are practically have almost the same form, thus assign a double burden for SOEs on its implementation. This study aims  are to find out the mechanism of implementation and reporting of PKBL and CSR from SOEs which are both regulated in different legal regimes. This research is conducted normatively by reviewing various rules and legal documents and empirically by assessing various implementation of PKBL and CSR by SOEs. The result of this study indicate that SOEs must perform PKBL if they have profits, while SOEs related to natural resources industry have to implement CSR which obtained from company’s budget. Both programs are implemented in the same form in providing social assistance and community business. The CSR report is only reported in the Company's annual report to be accounted in front of General Meeting of Shareholders. While the aims of Partnership and Community Development Program financial reporting is to provide information on financial position, activity and cash flow statement and records, for stakeholder’s decision making.

Abstract

Law No. 11, 2006 concerning Aceh Government determines the existence of decentralization of authority in the land sector to the Aceh Government. However, in reality, the decentralization of authority could not be accomplished.  Therefore, this research aims at studying the authorities which have been decentralized and factors that led to the failure in implementing these authorities. The data were collected through literature research and field research. The literature research was conducted by reviewing the Law No. 11, 2006 and other statutory provisions as well as the views of relevant experts. Field research was conducted by interviewing officials of technical institutions and other relevant stakeholders. The results of the research show that the authorities in the land sector that are especially decentralized to the Government of Aceh through Law No. 11, 2006 are the autorithies to grand The Right to Cultivate and The Building Rights on Land. However, these rights have not been implemented due to the inavailability of more concrete rules and local officials whose fundamental duties and functions are specifically in the land sector.Key words: decentralization, authority, the land sector

Abstract

The intensity of fishing activity around West Coast Area of Sumatra increased along with the decrease of the fish amount in marine area in other countries. This condition urged foreign fisherman boats to search for a new fishing area including the West Coast Area of Sumatra. This Area was the strategic part of marine area of Indonesia, it directly faced the high seas, Indian Ocean. Based on the data from Department of Maritime Affairs and Fisheries, marine fishery source of Indonesia was estimated to reach 6.167.940 tons per year. This illegal fishing was certainly detrimental for the country since it threatened the fishery potentials and the fish stock was decreasing. The line of West Coast Area of Sumatra was prone with illegal fishing, which included West Sumatera, Nanggroe Aceh Darussalam, and North Sumatera. The illegal fishing activities in the West Coast of Sumatra had been apprehensive, because the waters around this area were the open sea easily entered by foreign boats. Therefore, “Fishery Court” (in Medan) was formed to investigate, adjudicate, and decide criminal offense in fishery. The fishermen caught and arrested were then processed further based on the law referring to the Act No. 8 of 1981 on KUHP. Key Words: The Tackling, Illegal Fishing, West Coast Area of Sumatra

Abstract

Penelitian ini bertujuan menguraikan konstruksi norma  pencegahan dan penanggulangi plagiarisme dalam peraturan perundang-undangan  Indonesia, mendeskripsikan penerapan atau implementasi norma pencegahan dan penanggulangan plagiarisme pada beberapa  Perguruan Tinggi serta merekonstruksi norma pencegahan dan penanggulangan plagiarisme berdasarkan berdasarkan analisi peraturan perundang-undangan serta implementasinya.Untuk menjawab ketiga permasalahan tersebut,  peneliitan menggunakan pendekatan hukum non doktrinal yakni dengan melakukan inventarisasi seluruh peraturan perundang-undangan terkait pencegahan dan penanggulangan plagiarisme kemudian diikuti dengan  penelitian atas praktek pelaksanaannya pada  beberapa Perguruan Tinggi yang menjadi unit sampel dalam penelitian ini. Pengumpulan data primer dilakukan dengan cara wawancara mendalam terhadap responden di Perguruan Tinggi. Analisis dilakukan melalui 3 (tiga) tahap berdasarkan Miles dan Huberman yang mencakup reduksi data, display data serta verifikasi/penarikan kesimpulan.Penelitian menghasilkan : Pertama, terdapat inkonsistensi antarperaturan perundang-undangan, baik dalam taraf vertikal maupun horisontal. Kedua,ditemukan 2 (dua) pola dalam  implementasi penanggulangan plagiarisme pada perguruan tinggi yang menjadi sampel dalam penelitian ini. Untuk kasus plagiarisme yang menimpa langsung dosen internal perguruan tinggi yang bersangkutan,maka penanggulangannya menggunakan pendekatan perundang-undangan secara ketat dengan sanksi yang pasti. Sebaliknya, untuk penanggulanga plagiarisme yang terjadi pada perguruan tinggi yang bersangkutan tetapi  terduga plagiatornya berasal dari luar perguruan tinggi tersebut, penyelesaiaannya diserahkan sepenuhnya pemilik karya ilmiah yang dikutip, kepada pihak plagiator,   serta asal perguruan tinggi plagiator tersebut sudah menggunakan pendekatan norma perundangan-undangan untuk . Ketiga, rekonstruksi norma dilakukan dalam bentuk usulan perbaikan peraturan perundang-undangan (sinkronisasi) serta perbaikan cara penanggulangan plagiarisme yang ditemukan dalam penelitian ini. Keywords : Rekonstruksi Norma, Plagiarism, karya ilmiah, penulis akademik, plagiator.

Abstract

Act number 28 of 2014 on Copyright regulates that the Copyright as a movable intangible objects can be used as fiduciary transfer of ownership. Provisions regarding Copyright as the object of fiduciary transfer of oiwnership will be implemented in accordance with the provisions of the legislation applied. But practically, it is still being debated, both from the holders of copyright, as well as banks and Notaries as the official maker of the Deed of Fiduciary because there is no implementing regulations are clear, so recently there is no party that provides credit with collateral in the form Copyright. This research aims to study the binding mechanism of Copyright as fiduciary transfer of ownership’s object in lending in terms of readiness of the Appraisal authority to determine the economic value of the collateral. This type of research is normative juridical research.

Abstract

Area  of  Indonesia  consists of  80% water, which  contains  abundance  of  potential  fish  resources,  Those  fish resources  should  be  utilized  for  as much  as  prosperity  and welfare  for  Indonesian.  In  fact,  fish  resourceshaven’t enhanced the  living  standard, which  is  sustainable and equitable.  Issues on fisheries come up such as exaggeration  of  fishing,  theft  fish,  illegal  fishing  activities  and  the  use  of  fish  resources  that  exceeding  thegeneration of fish  itself. That  circumstance will  cause harm  for  the state,  the fishermen, as well as people  in general.  The  use  of  tools  that  harm  the  nature will  cause  the  decrease  of  fish  resources  and  threat  thesustainability  of  fish  resources.  The  aim  of  writing  this  article  is  to  analyze  law  enforcement  related  to  the sustainability of fish  resources and the sustainability of  fish  resources, viewed from  the perspective of  justice.As the result of  the study,  law enforcement to protect the  fish resources generally has not given attention  to the  sustainability of  fish  resources,  therefore  fishermen  still  use  unfriendly  tools  to  catch  the  fishes.  Thoseunfriendly  tools will  cause  the  occurrence  of  over-fishing  and will  impact  to  the  environmental  damages. Those  kinds of  things will destruct  the  fishes,  therefore  the  quantity  of  fish will  have deteriorated and evencould  be  extinct.  Those  environmental  damages would  suffer  the  present generation  as well  as  the  next generation  since  they  couldn’t  consume  fish which  is  very  essential  for  the  growth  of  the human body  anderadicate  the job for the people as the fishermen. The present generation will be sinful if the next generation will get  the  impact of what  the present generation done.  In order  to  reduce more over-fishing activities and the  distrust  of  the  fish habitat  it  needs  the  law  enforcement, which  is oriented  to  the  sustainability of  fish resources.  The  sustainability  of  fishery  resources  couldn’t maintain  its  existence,  this  could  be  seen  as  the symbol  of  environmental  damages.  In  this  case,  the  law  also  needs  to make  integration  of  fish  resources sustainability to be processed so that  it will  result output  law enforcement which is oriented to  fish resourcessustainability.  As  a  conclusion,  in  law  enforcement  oriented  to  fish  resources  sustainability,  it  needs  to  be thought by the lawmaker to embed that the law should contain  idea or concept about justice,  legal certainty,the significance of fish resources and the implementation of the law itself. In the fish resources utilization and law enforcements, it needs to pay attention to the justice principle; intergenerational equity; intergenerational equity;  precautionary;  conservation  of  biological  diversity;  conservation  of  biological  diversity.

Abstract

To provide legal protection and legal certainty for service users and Appraisers, the Government, in this case, the Ministry of Finance requires the Public Appraisal profession to obtain a permit in supporting financial service sector. The research describes the position and responsibility of Appraisers in assessing collateral for loan and  finance, that in practice, often requires Appraisers’ administrative, civil, and criminal responsibilities. The article uses a multi-interdisciplinary approach by applying status, comparative, and case study. The results show that a key for legal protection for appraiser comes from a legal relationship between an Appraiser and a Bank. The assessment of collateral for bank loan and financing, arises from collateral appraisal cooperation agreements; and from the legal provisions, including Regulation of the Ministry of Finance on Public Appraisal and the other related Laws. Furthermore, Legal responsibility of Appraiser's mistakes in appraising will be an administrative and civil sanctions. To provide legal certainty and legal protection for the Appraisal profession requires a strengthening of regulations by the issuance of Law on Public Appraisers such as other supporting professions, namely Public Notary, Legal Consultant, and Public Accountant.

Abstract

The Communal Right to Land (Hak Ulayat), both as the economic source and communal identity, should be empowered and be protected. This research studies the regulation of the utilization of Tanah Ulayat for the interest of investment and finds the root of its conflict in West Sumatera.  The result of the research concludes that there is no both horizontal and vertical synchronization in regulating of Tanah Ulayat. The regulations that have been enacted by DPRD and governor of West Sumatera are not in line with the Adat and Custom of Adat Community. Those regulations are also far from an ideal regulation and Syariah (Islamic Law), while the root of the conflict is the inconsistence between the regulation of Tanah Ulayat and its implementation which ignore the contract

Abstract

The Indonesia Competition Commission (the ICC) often faces difficulties to find evidence in the form of agreement made by business actors in determining prices. The agreement is the main element to prove the price-fixing which is prohibited under Article 5 of Law No. 5 of 1999. The legal issue discussed in this research is whether the use of per se illegal approach in proving the price-fixing agreement requires direct evidence or it is sufficient with an indirect evidence. This normative study found that the competition authorities still impose sanctions to business actors even though the (legitimate) agreement does not exist. The examination requires an in-depth understanding of economic theories and should prioritize the principle of prudence due to its vulnerability to manipulation. The analysis of Decision No. 08/KPPU-I/2014 and 04/KPPU-I/2016 found that the ICC proved the price-fixing case using indirect evidence and included an analysis of the impact on competition. Both cases indicate that the ICC applied the rule of reason approach because of the difficulties in finding the evidence of the agreement. On the other hand, the ICC applied per se illegal approach in the Decision No. 10/KPPU-L/2009 and 14/KPPU-I/2014 due to the existence of direct evidence.

Abstract

Cyber technology gives birth to criminal activities carried out inside the cyberspace which is technically referred to as cybercrimes. Cybercrime appears in various forms including the so-called cyberterrorism.  The purpose of this research is to discuss the development of cyberterrorism and to explore the efforts made by the Government in controlling cyberterrorism in Indonesia. This normative legal research examines the application of the relevant legislation, especially Law No. 19 of 2016 regarding the Amendment to Law No. 11 of 2008 on Information and Electronic Transaction and Law No. 5 Year 2018 regarding the Amendment of the Law No. 15 of 2003 on the Eradication of Crime of Terrorism. It is found that the development of cyberterrorism can be prevented through both technological and legal approach.
