Abstract

Violence and abuse against Indonesian unskilled labourers and migrant workers has become prolific and is a serious breach of human rights. This research will provide a basis to understanding physical violence and abuse against Indonesian migrant workers overseas from a policy and government perspective. This issue will be analyzed with four different perspectives including; non-government organizations working in the field, governments and legislation which are obliged to protect migrant workers against abuse, agents who send Indonesian migrant workers overseas and victims who have returned following employment overseas. Both quantitative and qualitative research methods will be applied through the compilation and analysis of statistics by government and non-government organizations, assessing trends, demographics and social factors that increase the risk of exploitation and also providing an overview of relevant legislation. Victims, witnesses, agents and other concerned parties will give testimony to provide primary data and greater insight into the issue. Understanding the causes and trends behind these phenomena will provide a sturdy foundation on which to build long term policy solutions and cooperation among nations.

Abstract

How does the Office of the United Nations High Commissioner for Refugees (UNHCR) respond to a sudden influx of a large number of refugees in a state rejecting the international legal standards on refugee protection? By applying a qualitative case study method, this article seeks to shed light on that question by focusing on the UNHCR’s response in the context of the Rohingya refugee influx to Bangladesh, a non-signatory state to the 1951 Refugee Convention and its 1967. This article recognizes the existence regime complexity involving the international refugee regime and argues that Bangladesh has tried to challenge UNHCR’s involvement through authorizing the International Organization for Migration (IOM) to lead the international humanitarian response in the early days of the 2017-18 Rohingya refugee crisis. Furthermore, this article adopts challenged institutions as a framework to explore how the UNHCR responded to the challenge through a series of strategic maneuvers to uphold its mandate of providing “international protection” to the Rohingya refugees in Bangladesh. The main findings suggested that although UNHCR has been able to emerge as a leading stakeholder of the humanitarian response to the Rohingya refugee crisis, the existing operational context in Bangladesh still challenges the agency to uphold its mandate fully. Other findings include the fragmentation of authority in the international response coordination, increasing institutional competition, and lack of coordination between UNHCR and other major humanitarian agencies.

Abstract

This article elaborates that a pluralist English School perspective offers a number of possibilities that are useful in analysing SEA. Its prime contribution is to help locate the middle ground that is often missing from theoretical debates. Thus, it can bridge parallel discourses, whether they be realist and constructivist, or realist and liberal. It can also provide a socially oriented understanding of the role of great powers – an understanding that provides a much more subtle interpretation of what Indonesia offers the region, and the challenges it faces there.

Abstract

In 2020, the Coordinating Minister for Political, Legal, and Security Affairs of Indonesia, Mahfud MD, affirmed that any Indonesian citizen affiliated with ISIS would not be repatriated. However, Article 28D of the 1945 Constitution ensures that a person’s citizenship status is guaranteed as one of the human rights, as guaranteed in Article 15 of the Universal Declaration of Human Rights. For this reason, this research used a normative legal research method using statute and case approaches through literature review. The research raises the question of how is the protection of the rights to nationality for ex-ISIS based on international law? The research aims to discuss and analyze the rights to the nationality of ex-ISIS combatants under the implementation of international law, such as Article 1 (1) of the 1954 Convention Relating to the Status of Stateless Persons. The research results explain that the state’s discretion regarding nationality is particularly limited to conditions such as the prohibition of arbitrary deprivation, the duty to avoid statelessness, and the principle of discrimination, and everyone has a right to a nationality.

Abstract

This paper analyses ASEAN’s diplomatic style using Hofstede’s theory of Cultural Dilemma Indicators and uses it to explain why the organization has failed to stop on-going cultural conflicts such as the PreahVihear temple dispute. There are 13 cultural dilemma indicators discussed in the paper, each is backed with an example which in the end leads to the conclusion that the government of each ASEAN member state must invest in longterm yet effective solutions. These solutions are necessary since ASEAN is embarking on ASEAN Community (AC), which is slated to take place in 2015, and since this paper is about the organization’s diplomatic style in light of continuing cultural conflicts, the focus is on AC’s Socio-Cultural Community pillar. The recommendations offered in this paper are necessary not only to prepare ASEAN people for major changes AC will bring in the context of culture, but also to rectify ASEAN’s image in the eyes of observers outside Southeast Asia who view the organization as nothing more than a “talk shop.” As a whole, they contribute to a successful ASEAN Community.

Abstract

This paper discusses Indonesian food agricultural policy, particularly since the Susilo Bambang Yudhoyono (SBY) administration. Influenced by the powers of global political economy, Indonesia has been dictated to practice neoliberal policies, including those in agricultural sector. The government had launched a policy of agricultural revitalization to encourage agricultural productivity through a private involvement. This study concludes that the agricultural revitalization is just a short-term pragmatic policy and serves the neoliberal ideology. It is not solve the major problems of food security and of rural life. What has to be done by the government is a long-term attempt and planning to strengthen the productivity and production of food agriculture and to improve the life of poor peasants in rural areas—the majority of Indonesian population. Essentially, the attempt and planning has to be directed into two basic problems on food security in Indonesia, which are the problem of ‘food access’ and ‘peasant vulnerability’.

Abstract

This study is trying to project some trends of U.S. foreign policy based on the results of presidential election in 2016. The United States had recently held presidential election on November 8, 2016. The victory of Republican candidate Donald Trump shocked the world that he defeated Democratic Hillary Clinton, who had excelled in some polls before the election. Various controversies raised by Trump did not prevent him from becoming the president-elect, as the global community soon became concerned with the possibility of the unstable international politics. After describing Clinton and Trump’s stand on foreign policy during their campaign, the study will present the results of the presidential election. Trump’s foreign policy is expected to show “the great American power,” but at the same time his favor of protectionism could threaten international economic cooperations involving the United States. The U.S. could see its image of “world police” reduced, but this would not automatically make the world safer. Under the leadership of Trump, American foreign policy will face many problems and challenges that are not easy to solve. Tulisan ini mencoba untuk memproyeksikan beberapa kecenderungan kebijakan luar negeri Amerika Serikat berdasarkan hasil pemilihan presiden tahun 2016. Amerika Serikat baru saja menyelenggarakan pemilihan presiden pada tanggal 8 November 2016. Kemenangan kandidat Partai Republik, Donald Trump, mengejutkan dunia. Ia mengalahkan kanditat partai Demokrat Hillary Clinton, yang unggul dalam beberapa jajak pendapat sebelum pemilu. Berbagai kontroversi yang disampaikan oleh Trump tidak mencegahnya memenangkan pemilihan, membuat masyarakat dunia segera menjadi khawatir dengan kemungkinan politik internasional yang kacau. Setelah menggambarkan posisi Clinton dan Trump pada isu luar negeri selama kampanye mereka, studi ini akan menyajikan hasil pemilihan presiden tahun 2016. Kebijakan luar negeri Trump diharapkan menunjukkan “kekuatan besar Amerika,” tetapi pada saat yang sama kecenderungan proteksionismenya bisa mengancam kerja sama ekonomi internasional yang melibatkan Amerika Serikat. AS akan melihat bahwa citra “polisi dunia”-nya bisa berkurang, tapi ini tidak akan otomatis membuat dunia lebih aman. Di bawah kepemimpinan Trump, kebijakan luar negeri Amerika akan menghadapi banyak masalah dan tantangan yang tidak mudah untuk dipecahkan.

Abstract

Isu limbah elektronik (e-waste), sebagai akibat pesatnya perkembangan teknologi elektronik dan sering melihat produk-produk elektronik dari sisi komersial yang terlepas dari siklus akhirnya, mendorong revolusi keberadaan limbah ini sebagai masalah global karena praktik pembuangan dan penggunaan ulang yang diterapkan seringkali tidak mengindahkan bahaya yang mungkin terjadi. Hal ini terutama menjadi perhatian di dunia bagian selatan karena adanya perspektif umum bahwa polusi dan limbah dipandang sebagai “harga” dari proses pembangunan, serta terkait juga dengan pandangan bahwa pengelolaan limbah elektronik adalah praktik yang mahal, sulit, dan tidak praktis serta asumsi bahwa lingkungan dan masyarakat dapat dipertahankan di masa depan, yang dengan demikian menunda upaya-upaya preventif. Kurangnya kesadaran akan permasalahan e-waste dari perhatian publik menimbulkan ancaman pada dimensi keamanan manusia. Artikel ini berargumen bahwa mencegah limbah elektronik menjadi isu keamanan utama dapat memberikan keuntungan dengan melakukan sekuritisasi masalah ini sebagai ancaman terhadap keamanan manusia. Tulisan ini akan dimulai dengan mengidentifikasi isu global tentang limbah elektronik dan bagaimana hal itu dapat membahayakan kesehatan dan keamanan manusia pada umumnya. Kerangka sekuritisasi kemudian akan diimplementasikan dengan menggunakan konsep komprehensif keamanan manusia dalam menjelaskan fenomena e-waste, karena dapat mengeksplorasi ranah normatif politik dan di sisi lain juga melakukan pendekatan dari berbagai sudut pandang, yang memungkinkan pemahaman dan solusi multidimensional. The issue of electronic waste (e-waste), as an effect of the rapid development of electronic technology and often view products from the commercial side regardless of its end-cycle, evolved its existence as a global problem because of the implemented disposal and reuse practices are often not heeding the dangers that may be resulted. This is especially a concern in the global south due to general perspective that pollution and waste is seen as the price of development, which also linked to the view that the management of electronic waste is a costly, difficult, and impractical practice as well as assumption that the environment and society can be maintained in the future. The omission of e-waste issue from public concern raises an impending threat to human security dimension. This paper argues that preventing e-waste from becoming a major security issue may benefit from securitizing the issue as a threat to human security. This paper will start by identifying the global issue of e-waste and how it can harm human’s health and security in general. Securitization framework will then be implemented using the comprehensive concept of human security in explaining the e-waste phenomenon since it explores the normative realm of politics while also a multi-faceted approach, enabling multidimensional understanding and solutions.

Abstract

The fight against terrorism must depart from the settlement of the core of problems. One of the most important roots of terrorism today is the injustice and imbalance in the system of international relations which in turn fosters an attitude of double standards to the holders of international domination and hegemony, the US and its Western allies. Only with the creation of a new international order which is fair, then terrorism can be reduced, thus creating world peace.

Abstract

Border problems are often originated from a very complex issue. Problems that arise are because of there is no uncertainty about the border, and disparity of boundary zone development between the country and neighboring countries. The latter problem often encourages the orientation and mobility of border communities who tend to prefer to more rapid development area. Problems can arise from the differences perception and outlook between the government and society about the meaning of border, as well.This paper proposed the concept of shared space as a strategic move to overcome that perceptual difference on the border. A space that is managed together both in planning and implementation, will be able to minimize the number of conflicts and tensions that often arise in the border region.
