Jurnal Hukum Novelty (ISSN 1412-6834 [print]; 2550-0090 [online]) is the Journal of Legal Studies developed by the Faculty of Law, Universitas Ahmad Dahlan. This journal published biannually (February and August). The scopes of Jurnal Hukum Novelty are: Constitutional Law, Criminal Law, Civil Law, Islamic Law, Environmental Law, Human Rights, International Law, and also interconnection study with Legal Studies in accordance with the principle of novelty.

This theoretical-normative study aims to determine the problematic use of legal theory and its impact on the construction of the law itself. This is very important because the construction of today's law has not created a social awareness of the law so that law enforcement becomes difficult. The discussion in this study raises several issues to be studied, such as; what is the dependencies pattern between law and social awareness? Then how to reconstruct them in the current of the Theory of Law? And the last is; what is the proper direction of legal creation? The results of this study conclude: First, the problem of alienation and distortion between law and society is just like an iceberg phenomenon because the main problem lies within the understanding theoritical of the law itself. Second, the relationship between law and social awareness is the dependence relationship, where the legal product must reflect social awareness so that the actualization of the law is accepted by society as its need. Third, discussing the correlation between law and society is not enough with normative thought (prescriptive), but also empirical (descriptive), so the theory of law plays a very important role to bring this multidisciplinary understanding back to normative thought that prescriptive. Fourth, the legal product which is not based on normative thought is very dangerous because it will be very liberal and far from social morality based on social values, thus there will be alienation and distortion between law and society, or in other words law does not reflect the social awareness.

Introduction to The Problem: Resettlement/Shelter is one of the basic human needs and plays a strategic role as the formation of character as well as national personality. However, there is still a problem concerning the availability of public housing in Indonesia. The root of this problem is because people are free to transfer their ownership over their public housing, which leads to the escalation of public housing price. One of the situations where an escalation of public housing price occurred and inaccurate-ownership is in Kalibata City. Kalibata City was supposed to be public housing, but in the present, it 3is occupied by upper-middle-income families as well as an investor.Purpose/Objective Study: The purpose of this research article is to observe, analyze, and criticize the transfer of public housing ownership in Indonesia and provide a comparison with the Community Land Trust in the United States of America.Design/Methodology/Approach: The research method employed in this research article is normative research method, whereas the types of data utilized are literature studies. The literature studies comprise of various sources in the form of laws, books, and journals related to public housing. The data is analyzed by employing a qualitative method and presented descriptively.Findings: The result of this research article indicates that the Government Regulation which is a follow-up to Article 55 paragraph (5) Law Number 1 of 2011 regarding Housing and Resettlement Area which mandates to regulate further related to the appointment and establishment of the institution has not been formed yet. Furthermore, to realize intergenerational justice, the transfer institution must be burdened with specific duties.

ABSTRACTThis study aimed to evaluate the mechanism for settling disputes in the Constitutional Court containing elements of constitutional complaint. In particular, this study focused on two things: first assessing the urgency/ importance of the idea of setting constitutional complaint in the Constitutional Court's authority. Secondly, to formulate recommendations on setting constitutional complaint in the Constitutional Court's authority.The method used in this research is descriptive qualitative. This type of research is a doctrinal law. This research studied the concept and implementation of the judicial settlement of cases that contain elements of constitutional complaint (complaint constitution) by the Constitutional Court.The conclusion of this study is an important constitutional complaint mechanism is contained within the competence of the Constitutional Court to solve problems of injustice experienced by citizens as a result of public policies undertaken by the government in a broad sense, namely the executive, legislature and judiciary. Setting constitutional complaint within the competence of the Constitutional Court does not have to be explicitly stipulated in the constitution, but enough in the explanation of the Constitutional Court Act. That is not to add direct authority of the Court, but expand the meaning of the authority of the Court in testing the law.

Nasib TKI di tengah keberadaan Undang-Undang Nomor 39 Tahun 2004 tentang Penempatan dan Perlindungan TKI di Luar Negeri nampaknya masih menyisakan tanda tanya akan kapabilitasnya apabila melihat kenyataan bahwa masih maraknya TKI yang mendapatkan perlakuan buruk atau penyiksaan di negeri orang. Faktor-faktor penyebab terjadinya penyiksaan ini dilatarbelakangi oleh sempitnya lapangan pekerjaan yang ada di Indonesia yang menyebabkan ledakan minat masyarakat untuk menjadi TKI dan menjadi parah ketika sebagian besar dari mereka memilih untuk menjadi TKI melalui jalur illegal. Faktor pemicu lainnya ialah rendahnya kualitas SDM dan rendahnya pendidikan TKI kita. Untuk menjamin perlindungan hukum dalam penempatan TKIÂ (tenaga kerja Indonesia) di luar negeri, maka pemerintah telah mengakomodir Undang-Undang Nomor 39 Tahun 2004 tentang Penempatan dan Perlindungan Tenaga Kerja Indonesia di Luar Negeri. Akan tetapi kenyataannya, nasib TKIÂ (Tenaga Kerja Indonesia) di negeri orang berbanding terbalik dengan apa yang telah dijamin oleh keberadaan Undang-Undang Nomor 39 Tahun 2004 tentang Penempatan dan Perlindungan Tenaga Kerja Indonesia di Luar Negeri. Peranan Undang-Undang Nomor 39 Tahun 2004 tentang Penempatan dan Perlindungan TKI di Luar Negeri dalam memberikan jaminan perlindungan bagi TKI dirasa masih kurang mampu dalam mengakomodir perlindungan hukum bagi TKI. Oleh sebab itulah sangat dibutuhkan tidak hanya peranan dari pemerintah saja tetapi juga peranan dari TKI itu sendiri dalam membekali diirinya dalam hal pengetahuan dan skill agar terhindar dari berbagai bentuk perlakuan buruk di negeri orang.

Nowadays, outsourcing becomes a common system which is used in many business entities. For some reasons, as a system, outsourcing has emerged pro and contra opinions. Some people thought that outsourcing could make business run more effectively and efficiently, while the other thought that outsourcing could make labor placed in unfavorable condition. However, Indonesian law system still allows or accommodates business entities to use outsourcing in their business. In fact, through its practice, Indonesian labor law which rules outsourcing has not been implemented effectively, so the labor would become the weak party when they are in work relation with the bosses. This article will be focused on how outsourcing was implemented, and in the same situation, how the labor respond to it. This article was based on field study, in which researchers gave attention to the implementation of outsourcing system in 2 (two) different work units within the same institution, a private university in Jakarta. This study shows, because of some reasons, the labor still accepts when they were working under the outsourcing system.

The development of technology is needed and cannot be separated from patent protection between WIPO’s (World Intellectual Property Organization) member like Indonesia and Japan. This study discusses Indonesian patent protection law and its comparison toward invention between Indonesia and Japan. The study done through normative research methodology and analysed it comparatively. Indonesia has regulated the patent protection in Act Number 13 of 2016. The scopes are patent, simple patent, and also the period of patent protection for 20 years, while regular patent protected for only 10 years. Japan has arranged the patent protection in Japan Patent Act 21/1959 and it covers the patent and utility model. The time period for the patent protection is 20 years and for utility models is 6 years. The two countries have used common principle that is ‘first to file’. Both nations have also required the same requirements which are the novelty of the invention, the beneficial of the product, and the invention steps. Litigation and non-litigation are the doors to resolve patent dispute.

Introduction to The Problem: The Sustainable Development Goals or SDGs are development goals in 2030 to carry out environmentally sound development, which explicitly aims to carry out development that is to meet environmental sustainability and is based on human rights. It is also an adaptation of the principles of the Stockholm Declaration 1972.Purpose/Objective Study: This research is to find the principles of environmentally sound development, both within the principles of international law and the SDGs principles, that are expected in future development policies to be carried out in the perspective of the right to the environment, both the central and regional governments.Design/Methodology/Approach: In this doctrinal law research, it is examined using the conceptual approach contained in the principles of development and environmental principles contained in the substance of international law.Findings: In the principles of international law, there are seven principles of sustainable development goals agreed by the international community in the Rio Conference as a guideline in implementing equitable development based on human rights, which also must be guided by the targets of sustainable development within the SDGs.Paper Type: Research Article

Eksistensi masyarakat hukum adat di Bali sangat mempengaruhi eksistensi penguasaan tanah prabumian berdasarkan konsep komunalistik religius. Konsepsi komunalistik religius adalah konsepsi utama dalam pembangunan tanah nasional untuk mencapai unifikasi hukum tanah nasional. Konsepsi komunalistik religius juga tercermin dalam penguasaan tanah prabumian, desa pakraman di Bali oleh krama desa. Unsur komunalistik terwujud dalam penguasaan tanah tersebut sebagai tempat bermukim dan untuk digarap sehingga memberikan suatu hasil yang dapat dipergunakan untuk menunjang kehidupan sebagai sumber nafkah. Sebagai unsur kebersamaan maka bagian tertentu dari hasil penggarapan tanah yang harus diserahkan kepada desa pakraman untuk kepentingan bersama dalam upacara yadnya dan adanya larangan pengalihan tanah tersebut tanpa ada persetujuan bersama dalam paruman desa pakraman. Mengenai unsur religius tercermin dari adanya suatu kepercayaan bahwa pemerajan dan Pura Kahyangan Tiga di desa yang didirikan di atas tanah prabumian harus tetap dijaga dan dirawat karena dipercayai terdapat kekuatan Ida Sang Hyang Widhi Wasa beserta segala manifestasi-Nya termasuk juga roh para leluhur.

A company that carries out its business activities in the field and/or related to natural resources is obliged to carry out its Corporate Social Responsibility (CSR). This research was conducted at PT Riau Crumb Rubber Factory which is located in Sri Meranti Village. Raw rubber production activities into semi-finished rubbers have been routinely generating pollution for the environment and society, such as air pollution and water pollution. The problem is how the implementation of CSR PT Riau Crumb Rubber Factory to the community of Sri Meranti Village in Pekanbaru City? What are the obstacles and the legal effort based on Riau Province Regional Regulation Number 6 Year 2012? This research is a sociological law research. Source of data used in this research is primary data and secondary data. Data collection techniques used in this study are observation, interview, and literature study. Data analysis technique used in this research is qualitative analysis. The result of this research is PT Riau Crumb Rubber Factory has implemented CSR, but has not fulfilled the expectation the community of Sri Meranti Village because it is not comparable with the pollution and environmental damage caused by the company's operational activities. The obstacle from the company side is the limited budget of CSR funds owned by PT Riau Crumb Rubber Factory to be able to meet all the needs of the community, while from the community side is the lack of legal knowledge of the community of Sri Meranti Village about CSR. The legal effort is that if PT Riau Crumb Rubber Factory does not implement CSR, the community of Sri Meranti Village can convey their aspirations to the DPRD of Riau Province for the company to be recommended to get administrative sanction from the government, such as the suspension of operational license of the company.

Today, some Indonesian still adhere to the customs that come from their respective regions. It also includes habits that are carried out repeatedly which becomes a rule or commonly referred to customary law. Based on the philosophical aspect of customary law that lives, grows and develops in the soul of the Indonesian people in accordance with the values of the Pancasila as stated in the opening of the 1945 Constitution, the existence of customary law is very influential on customary crimes that occur in certain regions. Customary violations are still commonly found in the community, especially adultery. The implementation of customary criminal sanctions is felt to provide satisfaction and a sense of justice for some people so that the people’s lifes can be balanced.
