Abstract

The development of interpretation method and its approach have given place for academician to discuss about soul through scientific approach. It raises debate which has not been finished yet. In one side, there is a claim that this approach results inappropriate interpretation of Al-Qur’an. However, in other side, this approach can result contextual meaning of Al-Qur’an. Soul, the mysterious thing in life, can be used to be an object of research in science. Therefore, the research on the interpretation of Al-Qur’an through scientific approach results the definition of soul and the detection of its place which can be explained through scientific research. Keywords: Soul, interpretation of knowledge, scientific perspective

Abstract

The labour and wage problems is one of central issues in the contemporary industrial economy. Wagework is the leading provider of tax-advantage consumer directed health, commuter and other employee benefi t. In order to compromise between employee and employer interest, the government set a minimum regional wage. Minimum wage policy in Indonesia is set based an a survey of decent living needs. Hizbut Tahrir is one of Islamic movement that calls to return to the practise of Islam in the all of life sides. Then, Hizbut Tahrir concerns to study of Islamic economy, especially the economy of Islamic state and public fi nance. Hizbut Tahrir has different opinion with other moslem economic about standard wage rates. Standard wage rates – refers Hizbut Tahrir opinions- is only based the work utility of labor. The basic living needs cannot be the standard of wage. The wage rate is prerogative right of employee and employer, described a agreement based the utility of work. This opinion different with mainstream moslem economic. According to maintreams moslem economic, standard of wage not only based work utility of labor, but also based decent living needs.Keyword: Standard, wage, living needs, Islamic economy

Abstract

This article discusses the phenomenon of ambruk tradition in Ngesong, Tiron village, Banyakan-Kediri. Ngesong community has a tradition in which candidate of bridegroom and bride which have not been legal based on Islamic law and State law stay in one house. Through sociology approach, this article tries to investigate this socio-culture context. Ambruk tradition is a tradition done after engagement session and the decision of the marriage day by transferring the candidate of bridegroom to the family of the candidate of the bride. Ambruk tradition has two aspects namely helping works of the candidate of the parent in-law and staying in the parent in-law’s house.  In Islamic law perspective, ambruk tradition is prohibited; though helping the candidate of the parent in-law is permitted. Staying in the candidate of parent in law’s house although for helping them is ‘urf fasid since it is harmful and makes sin of khalwah and zina. Meanwhile, the afraid of making damage or sins must be prohibited. Therefore, based on sadd al-dhari’ah concept, ambruk tradition cannot be permitted.Keywords; Tradisi ambruk,pinangan, sadd al-dhari’ah,‘urf fāsid

Abstract

In the last decade, our conscience has been disturbed by widespread violence that occurred in the society. A various form of vandalism and cruelty became a tragic phenomenon that is very easily seen in our country. Wisdom and magnanimity that had ever been exalted and glorified as the character and identity of our nation has been today fossilized into niche of civilization. Therefore, there is a need for fundamental change in education of all levels, from kindergarten to high schools, for which curriculum restructuring is one option. In this sense, the application of curriculum 2013 has to be tailored to the needs of students and society.  Curriculum 2013, which is a further development of competence based curriculum initiated in curriculum 2004 and 2006 (KTSP), includes also attitudes competence, knowledge, and skills simultaneously. Abstract

A worriness about the mix of ilm al-kalam with ilm al-Mantiq of Aristoteles, which is considered inconsistent, have prompted several Muslim thinkers like Ibn Taimiyah and Ibn Qayyim Al-Jauziah to ban the available ilm al-kalam at that time. They both believed that, in ilm al-Mantiq of Aristoteles, there is no qiyas aula or an effort of humanizing God and, therefore, it will result in not recognizing God as creator of universe (because universe exists by himself). Thus, the tradition of  ilm al-Mantiq have made someone to be kufr. Meanwhile, the ulama of kalam have tended to also used Aristoteles’ framework of thinking in building their arguments. Abstract

Strip Stories adalah salah satu teknik yang efektif dalam pembelajaran speaking/berbicara. Menyediakan Strip Stories dapat meningkatkan minat siswa dan merangsang partisipasi siswa didalam kelas speaking/ berbicara. Berdasarkan asumsi diatas rumusan masalah penelitian dapat diformulasikan sebagai berikut: 1) Bagaimana kemampuan siswa dalam berbicara sebelum diajar menggunakan teknik Strip Stories? 2) Bagaimana kemampuan siswa dalam berbicara setelah diajar menggunakan teknik Strip Stories? 3) Adakah perbedaan yang signifikan antara sebelum diajar menggunakan Strip Stories dan sesudah diajar menggunakan Strip Stories?Metodologi dari penelitian ini mengunakan penelitian pre-eksperimental sebagai desain penelitian, populasi dalam penelitian ini adalah semua siswa kelas sebelas MAN Tulungagung 1 sebanyak 9 kelas, sampel penelitian ini adalah kelas sebelas IPA 4 (kelas excellent) yang siswanya berjumlah 30 siswa, alat penelitian ini menggunakan tes. Teknik analisis datanya menggunakan teknik statistik untuk mengetahui perbedaan antara kedua variable. T-test digunakan untuk mengetahui apakah Ha diterima atau ditolak. Jika nilai T-test lebih kecil daripada tabel T, maka Ho ditolak. Jika nilai T-test lebih besar daripada nilai tabel T, maka Ha dapat diterima.Hasil dari penelitian ini menunjukkan bahwa nilai siswa sebelum diajar menggunakan teknik Strip Stories masih jelek sedangkan nilai siswa setelah diajar menggunakan Strip Stories meningkat. Nilai rata-rata siswa sebelum diajar menggunakan Strip Stories adalah 11.77. Sedangkan nilai rata-rata siswa setelah diajar menggunakan teknik Strip Stories adalah 14.17. hasil hitung dari T adalah 10.304 sedangkan tabel 0.05% dengan tingkat signifikan 1.699. Jadi T count lebih tinggi dibandingkan dengan T table. Ini berarti bahwa Ha yang menyatakan bahwa ada perbedaan skor antara capaian berbicara siswa sebelum menggunakan Strip Stories dan setelah menggunakan Strip Stories terhadap siswa Sebelas IPA 4 di MAN Tulungagung 1. Ha diterima sedangkan Ho ditolak. Dengan kata lain, teknik Strip Stories (Potongan Cerita) dapat digunakan untuk mengajar berbicara siswa tingkat SMA dan MA.Keywords: Keefektifan, Teknik Strip Stories, Pencapaian Speaking (Berbicara)

Abstract

Nowadays, the development of transactions in finacial institution very rapidly, both in the new contracts, development of contracts that already exist, or a combination of the two contracts that have been established. This is a response of financial institutions to the need of modern society, as well as an effort to give alternative business transactions to its customers.Derivatifs transactions is hybrid investment, grafts from the original, or new transactions arising as a form of deviation or development or specificity of the transactions that have been established. These transactions usually have patterns similiar to original transactions, but there are different things that are influenced by certain considerations such as tradition, mashlahah, etc. As for the models of derivatif transactions in islamic financial institution are : the merging model (include : mudarabah mushtarakah, bai’ ‘inah, bai’ tawarruq, bai’ wafa and beli gadai emas), improvement ( include : mudarabah and musharakah with jaminan, mudarabah and musharakah parrarel, and rahn tasjily), and qiyas model (include :  paroan, pro telon, pro papat, etc).Ulama have argued that derivatif transactions based on the principle “al-ashlu fi al-mu'amalah al-ibahah, hatta yadullu al-dalil 'ala tahrimihi. Departing from this principle, then the Ulama allow, ikhtilaf, and forbid the derivatif transaction. Keywords; transaksi derivatif, lembaga keuangan syariah.

Abstract

For some time, Islam in Southeast Asia, especially in Indonesia, is considered a periphery Islam (peripheralism religion) due to the syncretism practice and accommodationists against local beliefs. Indonesian Islam is only a little tradition (small tradition) of great tradition Islam who was in the Middle East region. Great tradition is Islamic tradition that grows and develops in the center of culture, namely in the Middle East or more specifically in Mecca and Medina, while little tradition is Islamic tradition that developed outside the Middle East region, including Indonesia, and those are considered to deviate from the pure Islamic. The thesis thrive on the paradigm of modernism that spawned Islamologist like K.P. Landon, Winstedt, Van Leur and also Clifford Geertz with his Trichotomy approach which is famous for the Java community, the belief or confidence is also shared by some Muslim scholars. This paper shows some bias in the paradigm of Modernism and Postmodernism as elaborate approaches in Islamic studies. Postmodernism did de-centering to dismantle the discourse about the center and the periphery, little tradition and great tradition. Abstract

This paper attempts to discuss Najmuddin al-Tufi’s thought on maslahah, as well as see the extent of his liberal idea. In order to unravel this problem, the author conducted a literature review to examine al-Tufi’s work, Risalah fi Ri’ayah al-Maslahah. This study resulted in two conclusions. First, al-Tufi’s thought on maslahah is quite controversial because it is delivered with provocative words. Al-Tufi states that in case of conflict between nas and masalahah, the precedence is maslahah using Takhsis and Tabyin mechanisms. Second, al-Tufi’s thought can’t be put into the category of liberal thought. Since, although al-Tufi states the permissibility displacing the position of nas with maslahah, the process must be carried out with the Takhsis and Tabyin mechanisms which are already popular practiced in Islamic Legal thoughts.Keywords: Al-Tufi, Maslahah, Ri’ayah al-Maslahah

Abstract

Kaidah dan dhabith fiqih keduanya sama-sama merupakan rumusan hukum yang di dalamnya mencakup banyak masalah. Perbedaan keduanya terletak pada cakupannya; kalau kaidah mencakup permasalahan dari banyak bab sedangkan dhabith hanya mencakup permasalahan dari satu bab fiqih saja. Ulama mutaqaddimin – misalnya al-Subky (w. 771 H) dalam kitabnya al-Asybah wa al-Nadhair – sering menggunakan kata al-Qawaid al-Khashshah (kaidah-kaidah khusus) untuk menunjukkan makna al-Dhawabith al-Fiqhiyyah. Istilah al-Dhabith baru banyak digunakan oleh ulama mutaakhkhirin dan para akademisi (lihat misalnya Ali an-Nadwiy dalam bukunya al-Qawaid al-Fiqhiyyah).Penelitian ini adalah library research (studi kepustakaan). Datanya dihimpun melalui pembacaan dan kajian teks (text reading) dan selanjutnya dianalisis dengan deskriptif analytic yang betujuan untuk mengetahui fokus penelitian dengan cermat dan benar.Hasil penelitian menyimpulkan : ada 30 (tiga puluh) dhabith fiqih di dalam kitab Al-Umm. Tujuh dhabith berkaitan dengan masalah thaharah (bersuci), tiga dhabith tentang berbagai permasalahan dalam shalat, dua dhabith tentang masalah zakat, dua dhabith tentang haji, dua dhabith tentang makanan, dua dhabith tentang transaksi jual beli, tiga dhabith berkaitan dengan rahn (gadai), satu dhabith tentang washiat, empat dhabith mengikat berbagai permasalahan nikah, satu dhabith tentang had (hukuman), dan dua dhabith berkaitan dengan masalah ikrar (pengakuan).Kata kunci: dhabith fiqih, Al-Umm, Qaidah fiqhiyyah.
