KARSA is a peer-reviewed national journal published by Institut Agama Islam Negeri Madura. It has been nationally accredited SINTA 2 since 2017 by Ministry of Research Technology and Higher Education of Republic Indonesia. It is published twice a year (June and December). It publishes articles of research results, applied theory studies, social issues, cultural studies, and Islamic culture issues. The aim of KARSA is to disseminate cutting-edge research that explores the interrelationship between social studies and (including) culture. The journal has scope and seeks to provide a forum for researchers interested in the interaction between social and cultural aspects across several disciplines. The journal publishes quality, original and state-of-the-art articles that may be theoretical or empirical in orientation and that advance our understanding of the intricate relationship between social science and culture. KARSA accepts manuscript with a different kind of languages are Indonesian, English, Arabic, or French.

Abstract

Abstrak: Artikel ini ingin menguji akar pemberlakuan hukum jinayah (hudud dan kisas) di Aceh pada masa Kerajaan Aceh Darussalam (1496-1903). Terjadi perdebatan, manakah yang diberlakukan di Aceh: syariat Islam (hudud dan kisas) atau hukum adat masyarakat Aceh. Pendapat pertama menyatakan bahwa hukum jinayah pernah diberlakukan pada beberapa masa Sultan Aceh dan pendapat kedua mengatakan bahwa hukum jinayah tidak diberlakukan di Aceh, melain-kan hukum adat yang diberlakukan. Titik singgung pemberlakuan syariat Islam dengan adat di Aceh justru memperlihatkan bahwa pemberlakuan syariat Islam di Aceh tidak murni sesuai dengan ketentuan syariah, melainkan terjadi dinamika sosial, yakni masuknya unsur adat ke dalam pemberlakuan syariah.     Abstract This article tends to examine the basis of  jinayah (crime) law implementation in Aceh during the Aceh Darussalam Kingdom period (1496-1903 AD). QanunJinayah is argued by the Acehness, it goes around that which must be implemented the shari’a, Islamic law (hudûd and qishâsh) or customary law (hukum adat) of Aceh society. First side states that jinayah law had ever been valid during the Sultan of Aceh period of time but the second side argues that it was the customary law that had been implemented. It indicates that in Aceh the enforcement of Islamic law does not genuinely match the shari’a provision, in contrast it has been influenced by customary law factor. In brief, there is a social dynamics in the implementation of shari’a.   Kata Kunci: Syariat Islam, Aceh, adat, hudud,dan kisas

Abstract

Indonesia Islamic philanthropy had been growing tremendously. Trends in institutions platforms in managing Islamic philanthropy brought the divergence of channel message distribution. Those institutions made convergence interdisciplinary innovation. Islamic philanthropy institutions obligate to distribute the message in an ethical manner. They employed prophetic communication values in engaging the public sphere with persuasive communication commonly. Prophetic communication design is a custom to promote transcendental dimension of contemporary communication praxis. The prophetic term uses the cognition proximity design refers to Prophet Muhammad as a role model. This research was conducted to get an overview of the prophetic communication representation in the Islamic philanthropic messages distribution. Analytical techniques use qualitative document analysis. The subject in this research is the display of text on the site of Islamic philanthropic foundations official website Rumah Zakat, Yayasan Dana Al-Falah, and Lembaga Manajemen Infaq. The theme categories enrich found with selective coding. The results of the analysis are discussed using the concepts of prophetic communication, message production theory, goal-plan-action theory, action-making theory, and cognitive dissonance theory. For further research could obtain from the communication management of more specific philanthropic objects.

Abstract

Abstrak: Penelitian ini dilatarbelakangi tidak diketahuinya secara jelas ‘illah doktrin idah baik dalam Al-Qur’an maupun hasil kajian para pakar, sehingga eksistensi doktrin idah berpotensi dipertanyakan kembali terlebih dikaitkan dengan teknologi modern. Oleh karena itu, masalah yang dikaji adalah bagaimana ‘illah idah dalam Al-Qur’an beserta kondisi sosial yang melatarbelakanginya dan bagaimana relevansi ‘illah tersebut dengan doktrin idah dikaitkan dengan zaman sekarang dalam perspektif ushûl al-fiqh. Penelitian ini menggunakan pendekatan ushûl al-fiqh kontekstual. Hasil yang ditemukan adalah Al-Qur’an ternyata tidak mengatur ‘illah doktrin idah. Interpretasi para pakar terhadap doktrin ini pun tidak dapat disebut ‘illah melainkan hikmah adanya doktrin idah. ‘Illah idah yang tepat berdasarkan proses al-sibr wa al-taqsîm adalah etika atau kesopanan. Etika atau kesopanan selalu relevan dengan zaman, tidak terbatas waktu, tidak terikat kondisi dan berlaku pada setiap orang. Berdasarkan ‘illah tersebut dan sesuai dengan kondisi sekarang serta melalui kajian maqâshid al-syarî‘ah dan qiyâs, idah tidak hanya masih wajib dijalani mantan istri, tetapi mantan suami pun wajib menjalaninya sebagaimana Nabi Muhammad pun menjalani idah sepeninggal Khadijah. Masa idah yang wajib ditempuh mantan suami adalah menyesuaikan dengan masa idah mantan istri. Abstract: The background of this research is found the ‘illah of idah doctrine which is not clear so far according to the Al-Qur’an and the result of experts research, so existence of idah doctrine become a question marks if related with modern technology. Therfore, the focus in this research that how ‘illah‘iddah according to the Al-Qur’an and social conditions underlying the ‘illah of ‘iddah, and also the relevance of ‘illah of idah with ushûl al-fiqh perspective. This research used ushul fiqh contextual approach. The result finding that the Al-Qur’an does not regulate the ‘illah of idah doctrine. The interpretation of experts about this doctrine does not as ‘illah but they just said the hikmah (benefit) of ‘illah. The exact of ‘iddah is related to the process of al-sibr wa al-taqsîm which is ethic or good manners. Ethic (good manners) is always relevant any period, any conditions, unlimited time and applies to any one. Based on ‘illah is relevant with right now condition and also study of maqâshid al-syarî‘ah and qiyâs, idah is not just for ex-wife but ex-husband also do this ‘iddah in same manner as the prophet Muhammad did ‘iddah after the death of Khadijah. The phase of idah for ex-husband is the same as the phase of idah for ex-wife. Kata Kunci: ‘Illah,hikmah, idah, ushûl al-fiqh.

Abstract

Abstrak: Pesantren merupakan sebuah komunitas yang memiliki subkultural tersendiri. Dalam perspektif Goffman, pondok pesantren dipandang sebagai asylum, yakni tempat yang memisahkan penghuninya, terutama santri, dari dunia luar dengan ‘pintu terkunci dan tembok tinggi’. Salah satu pondok pesantren yang dikenal sangat menjunjung tinggi disiplin sehingga membatasi perilaku para santrinya adalah TMI Pondok Pesantren (PP) Al-Amien Prenduan Sumenep. Karenanya, dalam kajian ini dibahas: Pertama, bagaimanakah kehidupan para santri dalam mematuhi berbagai peraturan yang berlaku di lingkungan TMI Pondok Pesantren al-Amien? Kedua, bagaimanakah cara yang dilakukan oleh pengurus TMI Pondok Pesantren al-Amien agar santri mematuhi peraturan yang ada? Dan ketiga, bagaimanakah para santri menyiasati peraturan yang ada untuk dilanggar? Penelitian yang menggunakan pendekatan kualitatif berjenis kajian fenomenologis ini menghasilkan temuan bahwa program pendidikan di TMI PP Al-Amien berlangsung selama 24 jam di bawah kontrol dan pengawasan ketat dari petugas penegak disiplin. Abstract: Pesantren is a community with its own subculture. In Goffman's perspective, pesantren is seen as an asylum, a place that separates the residents, especially students, from the outside world with a 'high walls and locked doors'. One of  well-known pesantren that upholds discipline and limits the behavior of the students is TMI Al-Amien Prenduan Sumenep. This study discusses: First, how is the life of the students in complying with various environmental regulations in TMI Amien? Second, what does the board of TMI Al-Amien officers do for students obey the rules? And third, how do the students get around the rules to be broken? The study applies a phenomenological approach. The finding is that the education program at TMI Al-Amien is carried out for 24 hours. under strict supervisors. Kata Kunci: Goffman, Total Institution, santri, TMI PP Al-Amien, disiplin

Abstract

The Madurese community in Situbondo is a group of people who are still 'unfamiliar' with the internet media (social media). Their lack of understanding in using social media often creates problems in society. This article is the result of ethnography of communication research which discusses criticism behavior of Madurese people in Situbondo in social media. It comprehensively analyzes aspects of use of language choice, motive of language choice and language formulation expressed by informants. Research findings show that: 1) Situbondo people express criticism in social media by using code of Madurese language and mixed Madurese-Indonesia and Madurese-English, and they are expressed through some patterns which are humor, figurative, threatening and affirmative, direct and indirect satire, Kiyai quote and lyrical/poetical pattern; 2) Some motives background of choice of language code in expressing criticism are influenced by aspects of hierarchy in a context of diglosia society, politic of identity; dimension of ethnic group and psychological and cultural motives. Formulation of these findings explain that most of criticism model of Madurese people in Situbondo through social media is manifestation of habit in expressing criticism in real world. Something avoided is criticism model using sarcasm sentence, containing hate speech, offending pride, social status, family and feeling of interlocutors. Expressive and outspoken criticism in social media are also considered to be dangerous and unacceptable by people because they create ‘floating’ (unclear) interpretation, and potential to be misinterpreted. While some acceptable criticism are criticism model expressed by fine language and expressed by humor, figurative, fine satire and lyrical/poetical patterns.

Abstract

Abstrak: Tulisan ini mendeskripsikan perkembangan peran dan fungsi pesantren sejak awal "kelahirannya" yang terjadi pada kehidupan masyarakat tradisional sampai pada perubahan model pesantren yang menyesuaikan dengan kemajuan teknologi informasi. Model pendidikan pesantren menjamur jauh sebelum lembaga pendidikan formal didirikan di Indonesia, sehingga kontribusinya sangat besar dalam pembangunan bangsa ini. Mempertahankan eksistensinya di tengah tren perkembangan masyarakat modern tentunya tidak mudah. Karena pesantren, di satu sisi, merupakan lembaga penguatan keagamaan dan moral, tetapi di sisi lain ia harus mampu beradaptasi dan bermetamorfosis sesuai dengan perkembangan masyarakat modern. Tantangan besar dalam masyarakat modern adalah dekadensi moral dan agama, lambatnya laju perkembangan ekonomi masyarakat, dan tingginya angka konsumerisme masyarakat. Berdasarkan tantangan ini, pesantren dapat melakukan revitalisasi peran dan fungsinya sebagai lembaga pendidikan dan pusat pemberdayaan masyarakat.     Abstract: This paper describes the development of the role and function of pesantren starting from the beginning of "its birth"  in traditional society to model of pesantren the advancement of information technology. Pesantren has flourished long before the formal educational institutions established in Indonesia. Thus, it has great contribution to the development of this nation. Maintaining its existency  in the middle of the development trend of modern society is certainly not easy for pesantren. In one side, it is an institution for strengthening of religious and moral issues but on the other hand it must be able to adapt and metamorphose in accordance with the development of modern society. The major challenges in modern society is the moral and religious decadence, the slow pace of economic development, and the high rate of consumerism. For these challenges, pesantren can revitalize its role and function as educational institutions and community empowerment center.     Kata kunci: Metamorfosis, Pesantren, Globalisasi

Abstract

This article studies the perceptions of Muslim scholars on the tradition of reading Burdah poetry by al-Bushiri. This research was conducted with intensive field work in Kapuas, Central Kalimantan. A visit to the area opened an opportunity to make involved observations, which helped to understand the daily social life among Muslim scholars and Muslim community in Kapuas. Purposive sampling technique has been used in the selection of informants and interviewed eight key informants. The results revealed that reading Burdah poetry is one of the representations of socio-cultural and traditional phenomena in Kapuas Muslim community. Most of these scholars do not practice it regularly but at certain times such as during dry season, epidemic of disease, because it is considered as tawassul repellent. The perception of Kapuas Muslim scholars on Burdah Poetry can be classified into two. First, Muslim scholars who declared Burdah poetry as a high literary work having very beautiful arrangement and meaning and there was praise to the Prophet, therefore it was in line with blessings to the Prophet. The second classification, some Muslim scholars did not align Burdah poetry with blessings to the Prophet.

Abstract

Abstrak:Kompolan merupakan bagian tradisi keagamaan yang diisi dengan aktivitas spiritualitas dan ritualitas keagamaan. Aktivitas kompolan ini menjadi media penting bagi transformasi nilai-nilai agama di masyarakat. Aktivitas ini berkembang pesat dan mengakar kuat pada masyarakat Madura, terutama di daerah pedesaan. Sebagai bagian dari realitas sosial keagamaan kompolan pada masyarakat Madura dapat menjadi bagian penting dari legitimasi, justifikasi dan ideologisasi eksistensi keberagamaan mereka. Tulisan ini merupakan ringkasan riset yang dilakukan awal tahun 2000-an di Desa Madu Songennep. Berdasarkan hasil penelitian menunjukkan secara historis kompolan tidak bisa dipisahkan dari konteks sosial yang terjadi pada tahun 1980-sampai awal 1990. Kompolan dalam konteks ini dijadikan agen yang mereproduksi sosial. Kompolan sebagai agen reproduksi sosial ini dimaknai sebagai hasil dari relasi keuasaan yang terjadi antar aktor yaitu relasi antara elite agama dengan peserta kompolan yang dalam prosesnya telah menimbulkan kekerasan simbolik dan kompolan mengambil peran dalam melestarikan bahkan menyebarluaskan dalam bentuk yang simbolik. Kata kunci:kompolan, nyai, dan klebunAbstract:Kompolan (gathering) becomes a part of religious tradition. It concerns the activity of religious spirituality and rituality. The activities in kompolan are the core media to transform the religious values of society. They are rapdily developed and stronly rooted into Madurese society, particularly in rural area. As a part of religious social reality , kompolan takes important role of legimitation, justification, and idiologization of Madurese people existance. This article higlights the study done at Madu village, Songennep (Sumenep) in 2000. The inertviewees are the member of kompolanand the leader (nyai). It results a finding that historically kompolan cannot be seperated from the social contact occured from 1980 to early 1990. In this contact, kompolan became an agent of social reproduction. It was a result of power relations between religion elites and kompolan members causing a symbolic violance. Hence, kompolan took control on conserving and disseminating in symbolic form. Abstract

Abstrak:Artikel ini dimaksudkan untuk menggambarkan tentang the Famale Geneital Mutulation (FGM) di Madura, Jawa Timur, Indonesia yang difokuskan pada tigapersoalan, yaitu tradisi lokal, norma keagamaan, dan hak asasi manusia. FGM telah berlangsung dari satu generasi ke generasi berikutnya di Madura sebagai tradisi lokal dan dorongan keagamaan. ia menjadi kewajiban yang harus dilakukan oleh setiap perempuan. Lebih dari itu, setelah perempuan Madura masuk agama Islam, kyai sebagai pemimpin keagamaan lokal memberikan kontribusi yang kuat bagi pelaksanaan FGM di Madura, yakni dengan memberikan pembenaran dari sisi keagamaan-keislaman. Di samping itu, dari sisi kesehatan menunjukkan bahwa FGM tidak memberikan efek penting terutama dalam reproduksi perempuan. Pelaksanaan FGM tanpa berkomunikasi terlebih dahulu dengan  anak perempuan sebagai korban. Karenanya, praktik FGM merupakan pelanggaran hak asasi manusia dalam perspektif  World Health Organization (WHO). Penelitian kualitatif digunakan dalam penelitian ini. Sedangkan wawancara dan dokumentasi digunakan sebagai teknik pengumpulan data.Kata Kunci:sunat perempuan, adat, agama dan HAMAbstract:This article aims to describe the Female Genital Mutilation (FGM) in Madura-east Java Indonesia which focused on three issues there are local tradition, religious norm, and human right. FGM have been doing from generation to generation in Maduresse as local traditions and religious urge. It is become some obligation as if and must be done every woman. More over, after entry of Islamic religion in Madura, kiai as local-religious leader gave strong contribution to do FGM in the Maduresse which Islamic-religious justified. Besides that, in the medical perspective shows FGM doesn’t give important effect particularly in the woman reproduction. Carrying out of FGM is without communication first with daughter as sacrifice. Therefore, practices of FGM are infringement of human right as World Health Organization (WHO) perspective. Qualitative research is used as method in the research and interview and documentation as the data collection. Key Words: famale geneital mutulation, tradition, religion, and human rights.
