Abstract

The business development of the economy not only in the field of conventional, Shari'ah economic business now has started mushrooming everywhere. With a population of Indonesia is predominantly Muslim, the more it will attract market share to take part in business economics Shari'ah. Instead of that, the presence of a notary Shari'ah is urgently needed in Indonesia, because the focus of work in the field of economics Shari'ah, so it can ensure law and society in transacting Shari'ah. The research used normative juridical approach, using the theory of legal certainty. So we get Analisia, that the reality is that the people do not feel comfortable in transacting Shari'ah, because of the absence of provisions on rules of shari'a law notary. So the conclusion is obtained, the need for Shari'ah notary very important.

Abstract

This study with descriptive qualitative approach produces a fact that the context of education, the children of the Kalang community in general are also followed formal education, like other school children. They also received religious instruction as a compulsory subject. This of course has consequences for the possibility of cultural transformation through the instrument of education. Especially with religious education, the children of the Kalang community possible simultaneously and slowly will leave their teachings. Moreover, the nature of religious education itself is more of an orthodox religious values.

Abstract

This article explores educational opportunities in the early period of Islam until the 13th century, which shows the significant role of women in education. It can be argued that the role of women in education can be traced not only in certain areas of religious knowledge but also in the patronage of education and even in determining the political policy of the government. Unfortunately, compared to the next period until the 21st century, policy concerning education has recently turned to unfair treatment such as marginalization, exclusion, and even deprivation. What is surprising is that the reasons for the genitals, which deprive women of their right to participate in education, casually occurred. In other cases, socio-cultures are restricting their access to education. The factual errors on educational thoughts for women here are explicitly used as an empirical description in this study, while its purpose is to demonstrate the shift in the treatment of female education. The result expected in this study is to reach the historical footprint of Islamic education and ensure inappropriate reasons, such as genital terms, used and abused as arguments for not allowing women to get an education.

Abstract

Amidst the competitions among shariah bank demanding the shariah bank to have marketing strategies in order to keep a sustainable relation between bank and customers. It was revealed from this research that some variables: product attributes, the quality of service to the Islamic approach to marketing, reputation, satisfaction, affective commitment, continuous commitment and customer loyalty can be accepted as the decisive variables in deciding the good marketing relation­ship between shariah bank and customers.

Abstract

This article is a study of the harmonization of Islam, Christianity, and Buddhism in SD Negeri (State Elementary School) 46 Hulontalangi, Gorontalo City. The school plays important roles because it is the first state school in Gorontalo City that develops and implements the concepts of religious harmony and pluralism in a school environment. This research is a qualitative study which uses three data collection methods, namely: (1) observation, (2) in-depth interviews, (3) documentation. The findings show that the implementation of religious harmony is manifested in religious, social, and cultural cooperation. The cooperation has become a habit that affects the outlook and actions of all school members in their daily lives. The habit is inseparable from the role of teachers, parents, students, and all school residents who become teachers and learners from their environment. It results in harmony cooperation, namely cooperation that is not only in the form of ideas and words but also affects the social environment. Thus, what has been implemented at this institution can be an alternative solution for schools or other institutions on how religious pluralism can be facilitated and placed in the right position and needs.

Abstract

This article studied about the relationship between Partai Keadilan Sejahtera (PKS/the Prosperous Justice Party) and Pancasila as the state’s philosophy. PKS didn’t have the experience of the struggle of Indonesian independence and the difficult period of the Pancasila formulation. PKS was born after Pancasila convinced as the national agreement. The political attitude of PKS to Pancasila as the state’s philosophy is still indistinct. PKS viewed as political party that hide their truly intent: between receiving Pancasila and implementing islamic shari’ah. The aspiration of implementing islamic shari’ah has been concealing in vision and mission as well as in the heart of PKS’s cadres. The aspiration will be done by peaceful and constitutional ways.

Abstract

Religious radicalism is the trigger for the occurrence of terrorism which is an extraordinary crime and an enemy of all the countries that exist in the world. Since Indonesia as a country has a high vulnerability to religious radicalism, it is important to conduct studies on religious radicalism both nationally and regionally. Knowing the level and potential of religious radicalism is a step for the creation of a comprehensive mechanism of prevention and treatment of religious radicalism. The position of Banyumas as an inter-provincial gateway becomes very strategic for radical groups to spread their ideology and mindset. The ease of inter-regional access underpinned by good supporting facilities and infrastructure is an important point of consideration for radical groups to spread their ideas. Interviews were conducted to obtain data from stakeholders who handle radicalism. the findings were elaborated with supporting literature to provide a more comprehensive result. The results of this study indicate that Banyumas has great potential for the growth and development of religious radicalism, and Banyumas people have high vulnerability to get exposed and influenced by the idea of radicalism caused by factors of religious behavior, geography, culture, technology and information development, and demography. However, so far the level of religious radicalism in Banyumas is still low because there is good cooperation between the stakeholders and the community.

Abstract

Experience of meeting God constitutes an interresting phenomenon and become the focus of interrest of many disciplines. Psychology and tasawuf are two disciplines which focusedly study this phenomenon applying different approaches. Ghazali is the representative of the dicsipline of tasawwuf and William James is the representative of the dicsipline of psychology. The both experts applied the different approaches in studying the religious experiences. Epistemological base on which William James used , has the scientific accountability but less accurate in the source of knowledge. In other side, Ghazali has a deep source of knowledge but less of rationality. An effort to compromise the both approach in order to study about the experience of meeting God will result in a comprehensive, deep, and objective depiction.***Pengalaman bersua Tuhan merupakan fenomena yang menarik dan menjadi titik perhatian banyak disiplin ilmu. Psikologi dan tasawuf merupakan dua disiplin ilmu yang memfokuskan kajiannya pada fenomena ini dengan menerapkan pendekatan yang berbeda. Ghazali adalah representasi dari disiplin ilmu tasawuf dan William James adalah representasi disiplin ilmu psikologi. Kedua ahli tersebut menggunakan pendekatan yang berbeda dalam mengkaji pengalaman keagamaan. Basis epistimologi yang digunakan oleh James memiliki akuntabilitas ilmiah namun kurang akurat dalam sumber pengetahuannya. Di sisi lain Ghazali memiliki sumber pengetahuan yang dalam namun kurang dari sisi rasionalitas. Upaya untuk mengkompromikan kedua pendekatan dalam rangka untuk mengkaji pengalaman bersua Tuhan akan menghasilkan penggambaran yang dalam dan obyektif.

Abstract

Nowadays, Muslims are facing various contemporary problems related to the discourse of fiqh or Islamic law. In this case, the old tradition of Islamic jurisprudence is no longer sufficient to answer those problems due to the changes in the context of space, time, culture, and contemporary sciences. Any effort to renew the aspect of methodology must be done in the field of uṣul al-fiqh not only in Islamic jurisprudence. This is the reason that methodological reconstruction is needed in order to make it is able to accommodate the various problems that are disturbing Muslims today. One of Muslim scholars who tried to reconstruct at the level of the methodology of maqāṣid al-shariah is Jasser Auda. For the purpose of reconstructing maqāṣid al-shariah fundamentally, Auda uses a philosophical approach that is multidisciplinary as well as open with various other relevant disciplines as a methodological framework for reforming the study of uṣul al-fiqh and Islamic law. Applying philosophical and historical approach this study found that Auda reconstructs maqāṣid al-shariah by offering six features: cognitive nature, wholeness, openness, interrelated hierarchy, multidimensionality, and purposefulness. Furthermore, Auda gives contribution to the development of Islamic law and human rights. This paper will explore reconstruction as well as the contribution of maqāṣid al-shariah promoted by Auda through the approach of the philosophy of the system.

Abstract

This research aims to explore one of Islamic movements in Indonesia after reformation of 1998. By using qualitative method, it is clear that the demarcation betweeen Islamic tradisionalism and Islamic modernism fluided culturally. Although at the same time polarization both become more political, which is made Indonesian Islamic mainstream loosed elan vital as sosial and cultural movement. There is the contradictory trends in the dynamic of Islamic thought and movement introduced by Islamc minority groups. In one side the trends are multiculturalism, anti coruption movement and appreciation to the local cultures which is ignorenced before by Islamic movement in Indonesia. In other side, political oriented in many Islamic movement is stronger. The dominant of traditional constructions of Islamic polical thought of sunni (fiqh al-siyasah) influenced to the Islamic movement to state orientation at same time ignored the society with their problem and cultural expression. The cultural Islam proposed new understanding to Islamic traditions with hermeneutic and remove the locus of movement forum political Islam to civil Islam.
