Musawa : Jurnal Studi Gender dan Islam
Musãwa Journal of Gender and Islamic Studies was first published in March 2002 by PSW (Pusat Studi Wanita) Sunan Kalijaga Yogyakarta under contribution with the Royal Danish Embassy Jakarta. In 2008, published twice a year in collaboration with TAF (The Asia Foundation), namely January and July. Musãwa Journal is a study of gender and Islam especially on gender mainstreaming and child rights both in the study of texts in the Qur’an and Hadith, figures and thoughts, history and repertoire, classical and contemporary literature as well as socio-cultural studies. All concentrations are in the context of Indonesia and other countries in Southeast Asia within the framework of unified NKRI, based on Pancasila. Musãwa Journal has been published by PSW UIN Sunan Kalijaga Yogyakarta since 2002. Initiated by lecturers, gender activists and Islamic studies scholars of PTKI ( Higher Education of Islamic Religion) Musãwa has regularly published academic works and researches on gender and Islam for almost two decades. Now, the Journal extends its studies with Children and Human Rights (HAM). All studies are still in the context of gender and its mainstreaming. Through the studies hopefully, the Musawa journal can be part of the implementation of gender mainstreaming in the context of Indonesian society.

Marital Itsbat is still necessary as a policy, even for marriages conducted prior to the entry to force of Law No. 1 of 1974 on Marriage. Changes regarding the provision of Itsbat are necessary to ensure that the law could still act as the guardian of legal certainty to achieve justice for citizens. In reality, a policy of legitimizing marital. Itsbat is necessary in Indonesia’s legal politics, which is not only based on past marital laws (iusconstituendum), current laws but must also encompass the need to regulate future marriages (iusconstitutum. Considering thse needs, the policy in question must not only fulfill the needs of Muslims, but also those who are deprived of the chance to legitimize their marriages’ documentation; whether due to poverty, ignorance or other factors (such as the religious validity of the couple), migration or other issues. This material change of Itsbat should still be based on the principle of protection and non-discrimination towards women so that it can still give a sense of justice to women. In other words, it should not only stem from the fulfillment of the requirements in Law No. 1 of 1974, which in reality has been proven to be discriminatory to women.

This paper asserts that education is an important instrument in life. Specifically, this article describes the rationale for Muslim’s obligation to participate actively in education, and the roles they play in the implementation of a quality education. All will be assessed from the perspective of Islamic teachings, particularly the Qur’an and Hadith. In addition, to strengthen and complement this paper, the perspective of the International Covenant on Economic, Social and Cultural Rights (ICESCR), which confirms that the Islamic community is a unified living entity when it comes to fulfilling education (kiyan hayy wahid). Therefore, the cooperation of various parties in the administration of education in accordance with the principles of maqasid shariah and the ICESCR is part of the Qur’anic command to do good deeds and piety (ta’awun ‘ala al-birr wa at -taqwa). Cooperation should embodied in an effort to develop a culture of reading and writing, preparing facilities and infrastructure, to increase educational human resources and create an environment conducive to education. Contribution of the Muslim community in educational issues should be the expectation of all parties.

Women still have to make hard effort to strive for liberating themselves. As most of them persistently fight for gender equality to gain their equal rights before men, and when men's sympathy hugely grows to take women as their equal contenders, many other women at the same time enjay being involved in pornography and porno-action. They harm people by committing sex exploitation in various actions. The question then comes up, how the acts govern the pornography and porno action and what impact it will make for women's struggle. This article describes the constitutions regulating porno. graphy and porno-action and elaborates the impact of pornography-porno action towards the entire women's liberation struggle. The term of porno. graphy-porno action, scope, and the object used in criminal laws vary in many countries. They use it both explicitly or implicitly in which the judge's reasoning plays a large role within it. Terminologically, the word of porno. graphy-pomo-action is not found in Indonesian Criminal Law. Nevertheless, it is substantially stated by: Crime against Norms. we can read that in chapters 281, 282, 283, 532 and533 Â of Criminal Law.

Setiap peradaban memiliki pandangan yang berbeda terhadap sosok perempuan. begitu juga dengan setiap agama berbeda memposisikan perempuan dalam ajarannya. Sebab itu artikel ini akan mengulas respon Islam, terutama hadis, dalam merespon kearifan lokal yang terdapat dalam budaya Arab. Tema itu difokuskan pada masalah respon hadis (Islam) tentang perempuan menstruasi. Perempuan menstruasi mendapatkan stigma melalui mitos-mitos yang sudah menlekat dalam setiap tradisi. Penelitian ini menghasilkan bahwa Islam merespon dan memfilter budaya yang bias gender dengan pendekatan kultural. Hadis yang menjelaskan perempuan menstruasi menciptakan tatanan wacana baru dalam setiap matannya.

This paper tries to explore the use of hadith regarding with polygamy in interpreting surah An-Nisa 03 on polygamy. One of the prominent moslem scholar, Ibnu Katsir interpret this verse with hadiths. By using historical method, this paper concludes that Al-Nisa: 3 related to socio-cultural context of Arab society in revelation period. To understand this verse will be insufficient if we analyze it in linguistical-literal aspect, without concerning on the historical context of asbabun nuzul, both micro and macro context.[Artikel ini mencoba mengeksplorasi penggunaan hadis-hadis mengenai poligami dalam menafsiri QS. An-Nisa: 03. Salah satu tokoh tafsir kenamaan, Ibnu Katsir, mencoba menginterpretasikan ayat tersebut dengan hadis. Dengan mempergunakan pendekatan historis tulisan ini berkesimpulan bahwa QS. An-Nisa’ 3 terkait dengan konteks sosio-kultural masyarakat Arab pada masa pewahyuan. Memahami ayat ini tidak cukup hanya dengan menggunakan pendekatan literal-linguistiknya semata, namun harus memahami bagaimana konteks historis dari asbabun nuzul, baik konteks mikro maupun makronya.]

Dalam dunia sastra Indonesia, khususnya novel-novel pop saat ini tengah menjadikan perempuan dan seks sebagai isu-isu yang sangat penting. Para penulis pria maupun wanita sering menggunakan tema seks dalam karya-karya mereka yang diyakini sedang menjadi tren. Seperti halnya Indah Hanaco dalam novelnya, the Curse of Beauty, Wenda Koiman dalam novelnya Curahan Hati Sang SPG juga bercerita tentang penindasan seksual perempuan melalui profesi mereka sebagai Sales Promotion Girl (SPG). Hal ini tentu saja berlainan dengan pandangan Islam yang telah memberikan perhatian lebih kepada perempuan karena telah dijelaskan dalam beberapa ayat dan hadits. Melalui fenomena SPG dalam perpektif yang sama baik oleh pengarang perempuan ataupun laki-laki, yang menjadi subjek yang terpinggirkan baik dalam dunia nyata maupun yang digambarkan dalam novel pop makamakalah ini mencoba untuk mengungkapkan (1) bagaimana bentuk penindasan seksual tubuh SPG dalam kedua novel pop ini? (2) Bagaimana pandangan penulis tentang seksualitas perempuan yang diangkat melalui cerita SPG yang tercermin dalam kedua novel pop ini (3) bagaimanacara Islam melihat wacana seksualitas yang dihadapi oleh SPG dalam kedua novel pop ini?.Makalah ini menggunakan deskriptif kualitatif. Data diambil dari semua deskriptif mengenai penampilan tubuh SPG untuk memahami makna naratif dari tubuh. Tulisan ini menunjukkan bagaimana fenomena penindasan seksual perempuan melalui profesinya sebagai SPG telah menenggelamkan mereka dalam keterpurukan yang dalam yang berakibat pada seksploitasi yang tidak sesuai dengan norma agama terutama dalam Islam. Di sini, perempuan sama halnya dengan perangka elektronik yang dengan cepat mengalami pasang surut model mereka dan perlahan menghilang dalam sirkulasi.[In Indonesian pop novels, women and sex are two particular important issues. Many male and female writers use sexual issues as a trendy theme of their works. This issue can be seen in Indah Hanaco’s novel the Curse of Beauty and Wenda Koiman’s Curhan Hati Sang SPG. Both works also talk about women sexual oppression from their profession as Sales Promotion Girl (SPG), which in some cases, are contradictory with Islamic teaching. The phenomenon of SPG’s marginalization is depicted in the pop novel from the same perspective between men and women authors. Therefore, this article tries to explore (1) how are the forms of sexual oppression of SPG’s body in this pop novels; (2) how are the authors’ perspective on female sexuality through the SPG’s story reflected in this pop novels; (3) how does Islam see the sexuality discourse faced by SPG in this pop novels. This research uses descriptive qualitative. The data is taken from all descriptives concerning SPG body appearance to understand the narrative meaning of the body. This article shows how the phenomenon of women sexual oppression through their profession as SPG has drowned them to the deep immersed that affect to sexploitation and it is not suitable with the norm of religion especially in Islam. Here, women are assumed like electronic devices that appear and disappear quickly as new models come to new circulation]

The Draft Law on Gender Equality is an early draft at the socialization stage, still to receive inputs from the society. However, there have been many negative responses and many Islamic groups reject it wholesale. Their argument interalia, is that the draft law is secular in nature and is thus contradictory to fundamentalist Islamic teachings and law. This article will attempt to discuss and position the draft law within the ambit of Islamic law. The general conclusion is that while most of the ideas contained within the draft law is much in line with the principles of Islamic law, several articles which conflict with Islamic law need to be revised and changed. The shortcomings and errors within the draft law are indeed in need of criticism, but it should not be a reason to reject the entire draft law

It is the time for Indonesian women to become autonomous women. This contention has a substantial reason. In fact, many husbands or fathers, who are considered the breadwinners of family, cannot provide an adequate income to fulfill their family needs. Many women have also become single parents because of getting divorce or their husbands or fathers died. How should women struggle with these mentioned conditions? How could they fulfill their individual and family needs if they do not know how to deal with the problems? How could women sustain their own and family life if they are physically and intellectually weak, poor and do not know what to do? The phenomena indicate the urgency of giving women an entrepreneurship education that will assist them to live independently and be capable of maintaining their life and family survival.
