Musawa : Jurnal Studi Gender dan Islam
Musãwa Journal of Gender and Islamic Studies was first published in March 2002 by PSW (Pusat Studi Wanita) Sunan Kalijaga Yogyakarta under contribution with the Royal Danish Embassy Jakarta. In 2008, published twice a year in collaboration with TAF (The Asia Foundation), namely January and July. Musãwa Journal is a study of gender and Islam especially on gender mainstreaming and child rights both in the study of texts in the Qur’an and Hadith, figures and thoughts, history and repertoire, classical and contemporary literature as well as socio-cultural studies. All concentrations are in the context of Indonesia and other countries in Southeast Asia within the framework of unified NKRI, based on Pancasila. Musãwa Journal has been published by PSW UIN Sunan Kalijaga Yogyakarta since 2002. Initiated by lecturers, gender activists and Islamic studies scholars of PTKI ( Higher Education of Islamic Religion) Musãwa has regularly published academic works and researches on gender and Islam for almost two decades. Now, the Journal extends its studies with Children and Human Rights (HAM). All studies are still in the context of gender and its mainstreaming. Through the studies hopefully, the Musawa journal can be part of the implementation of gender mainstreaming in the context of Indonesian society.

Abstract

Islam is a religion which has attempted to elevate the status of women so that there should be no discrimination between women and men from the Islamic perspective. However, in some fiqh texts, which are based on selected Qur'an and hadith, there is discrimination against women. On the other side, gender discourse now becomes an important issue and is used to improve the status of women. This article attempts to explore both the jiqh texts and gender discourse on the models of leadership in a family, especially on the role of women and men in the family and on the sexual relations, from the Islamic perspective.

Abstract

Tujuan ditulisnya naskah ini untuk mendeskripsikan keteguhan warga Samin mempertahankan model perkawinannya sebagai wujud ketaatan melaksanakan ajaran leluhurnya, Ki Samin Surosentiko. Kekhasan perkawinannya berhadapan dengan perundangan karena perkawinan tidak dicatatkan, sehingga pasangan tidak memiliki akta kawin. Bagi sebagian warga Samin di Kudus, melestarikan tradisi model perkawinan ini lebih diutamakan daripada mentaati UU Perkawinan dan Administrasi Kependudukan. Perkawinan yang tidak dicatatkan tentu saja, memiliki dampak yang signifikan, khususnya pada perempuan jika terjadi perceraian. Namun demikian, sekarang sudah ada upaya sebagian warga Samin menambah tatacara perkawinannya yang semula tidak dicatatkan di Kantor Dukcapil menjadi dicatatkan dengan tujuan mendapat akta kawin, status anak dalam akta lahirnya tercatat sebagai anak yang sah.[This article is based on research carried out among Samin community’s in Kudus and their consistency to keep marriage tradition based on their ancestor’s teaching, Ki Samin Surosentiko. According to this tradition, it is not necessary for a spouse to register their marriage because it is not mentioned in their teachings. Consequently they don’t have marriage certificate. For most of Samin society in Kudus, preserving the tradition is more important than following Marriage Law or the state’s regulation. Though there are now efforts of some residents to register their marriage in order to get married certificate or marriage law status and legitimated status of their children, most of marriages of Samin society in Kudus remain unregistered because it adheres to Ki Samin’s teaching. Abstract

Sirri marriage does not seem to be a problem in Maduran society, even when the  women are often harmed during or after the marriage. This apparent indifference can be explained by analyzing the cultural logic of Maduran society, among them through the patriarchal relations where women are ignorant of public administration issues, the view that women must be protected, herded and made into an asset of men’s pride. The paradigms regarding virginity (parabhan) and spinsters, and the fiqh-based religious reasoning apparent in Maduran society exacerbates the problem.  There are several explanations for the patterns of sirri marriages in Madura:  poverty, ignorance or lack of information on behalf of the women, the practice of arranged marriages (ajuduagi) and polygamy. Sirri marriages in Madura leads to child laborers supporting families, underage widows due to incapacity of handling domestic conflicts and hindrances for women from accessing their rights in many aspects due to their dependence on men.

Abstract

There is a tradition of forced marriage (kawin/nikah paksa) in Madurese society in which young  females are paired up with and married off to young males of their parents choosing. Young women may be promised in marriage when they are still in their mothers’ wombs or in childhood, and the marriage age for girls is generally under the age of 18 years, though there are those who marry between 12-15 years. Regeneration of the ancestral lineage can be seen in several areas in Madura including Bangkalan, Sampang, Pamekasan and Sumenep. Instead of the following the prescriptions of Muhammad, girl children have become ‘victims’ of a culture that discriminates  against them. If seen from a human rights perspective, the tradition of kawin paksa breaches the ethics related to humanity, justice and equality.

Abstract

There are two main arguments advanced in this article. Firstly, regarding the image of women perpetuated lry mass media, and secondly why media is not showing gender sensitivity when developing women images. In general mass media portray women in one amongst these five images: women image as a frame, as a column, as an available 'bed', as a saucer and an image of friendship. These images are developed and became popular within a patriarchal culture because men define women as such, and women have no power to disagree. The author proposes that today's women readers must apply more critical view in reading and analyzing the content of mass media, especially with regard to women's images.

Abstract

This article discusses the debates regarding the interpretation of al-Nisa (4) 34 [Holy Quran] that was advocated by many ulama. There exists a significant difference that indicate a greater role for women. Based on the assumption that the leadership of men over women can be absolute, given (wahby)or by effort (kasby), the final views of leadership entails the consequence that not all men can become leaders for women, even in domestic matters. Nevertheless, these two views are still strongly indicative that men are equals to women in all forms of leadership and does no differentiate between domestic or public matters of leadership.

Abstract

Thus far the views of experts of Islamic jurisprudence regarding homosexuality have been very clear in forbidding it. The Alqur'an, Hadith and Ijma' are the bases of the prohibition on marriages of this kind, although jurists differ in their views on the punishment for homosexual behaviour. Malik, ash-Shafi'i and Ahmad equate the punishment for homosexual acts with that for adultery, whereas Abu Hanifah views it as a ta'zir punishment (one determined by the government). Meanwhile, the· view of some that homosexuality is a natural and predetermined phenomenon presents its own challenges: how will Islamic law respond to the claim that homosexuality is a part of our basic human rights that must be protected?

Abstract

Meski praktek jilbab sudah dikenal di Indonesia sejak abad 17, sejarah mencatat jilbab mulai dikenal lebih  luas sejak awal abad 20 bersamaan dengan masuknya modernisasi dan Islamisasi di Nusantara. Modernisasi yang dikenalkan bersamaan dengan kebijakan politik Etis kolonial Belanda memberi peluang lebih luas bagi perempuan untuk mendapatkan akses pendidikan di sekolah. Pada saat yang sama, revivalisme Islam yang dimotori oleh Muhammadiyah juga turut mendorong perempuan untuk terlibat aktif mengenyam pendidikan. Namun, dorongan bagi perempuan untuk terlibat dalam aktifitas publik melalui pendidikan juga dibarengi dengan seruan untuk menutup aurat mereka di ruang publik sebagaimana ajaran Islam dan diikuti dengan segregasi di beberapa aktifitas perempuan. Artikel ini berusaha melihat kompleksitas praktek jilbab di masa akhir kolonialisme Belanda sebagai bentuk negosiasi perempuan muslim dimana wacana modernisasi, revivalisme Islam dan nasionalisme berjalin kelindan turut mempengaruhi praktek tersebut.
