Musawa : Jurnal Studi Gender dan Islam
Musãwa Journal of Gender and Islamic Studies was first published in March 2002 by PSW (Pusat Studi Wanita) Sunan Kalijaga Yogyakarta under contribution with the Royal Danish Embassy Jakarta. In 2008, published twice a year in collaboration with TAF (The Asia Foundation), namely January and July. Musãwa Journal is a study of gender and Islam especially on gender mainstreaming and child rights both in the study of texts in the Qur’an and Hadith, figures and thoughts, history and repertoire, classical and contemporary literature as well as socio-cultural studies. All concentrations are in the context of Indonesia and other countries in Southeast Asia within the framework of unified NKRI, based on Pancasila. Musãwa Journal has been published by PSW UIN Sunan Kalijaga Yogyakarta since 2002. Initiated by lecturers, gender activists and Islamic studies scholars of PTKI ( Higher Education of Islamic Religion) Musãwa has regularly published academic works and researches on gender and Islam for almost two decades. Now, the Journal extends its studies with Children and Human Rights (HAM). All studies are still in the context of gender and its mainstreaming. Through the studies hopefully, the Musawa journal can be part of the implementation of gender mainstreaming in the context of Indonesian society.

As we all know globalization is a consequence of the ease ofthe transportation of information and communication by technology that has far-reaching effects in economy, politics, social and culture, its presence cannot be avoided in this life. But, it becomes a problem when the development of science and technology that has given us a lot of positives can also give us a negative effect that is just as large that is felt by women without the notice of the government. Many criminal acts and even acts of utmost criminality often happen and women have become operational targets from the development of science and technology itself Why do women have to be the victims and why are 80% of the victims women? This has been the subject of debate for researchers and bystanders. With the existing problems, this article asks the readers to observe some of the technological crimes that are launched against women and also to see how far the government has acted as the policy holder.

In this paper Abul Qasim Gourji highlights several verses or hadith which become the theological base for the legitimacy of mut'sb marriage. As a follower of the Syi' ah School, the writer wishes to clarify the validity of tnut' ah marriage. In his opinion, there is not one verse in the al-Qur'an or the hadith that expresses, either directly or implicitly, a prohibition of mut'ah marriage. By quoting several stories found in the books of Tafsir and laws of the books of Hadith and Tarikh, which all originate from the Sunni school, the writer emphasises that the prohibition on mut' ah marriage was not made by the Prophet, but rather by Umar bin Khattab. And this prohibition, he feels, clearly contradicts the al-Qur'an and the hadith. Moreover, up til now still no agreement has been reached about this prohibition on mut'ahmarriage, which was even practiced by several of the Prophet's companions.

To live as a minority in a mainstream culture is far for easy, especially for a group viewed with such novelty and queerness by the society, like the transgender. Nevertheless, the transgender seem to be holding steady in the face of a barrage of negative assumptions and discrimination. Much of those came from the interpretations of certain religious entities, and imposing upon them massive social, spiritual and psychological burdens. The impression from such discrimination is that the transgender are rejected both in this world and the hereafter. One such problem has to do with the shalat, where they stand on unclear grounds upon the position in the lines of prayer and the defining of the limits of their aurat. This article thus tries to prove that Islam serves and accommodates all entities not excluding those of the transgender.

Gender as a subject itself has been around for quite some time in Indonesia, as has the fight for it by government and non-government organizations. Why is it then, that many victimized women still find themselves devoid of rights? Many contemporary views have cast the topic of gender equality as a virus to Indonesian women, especially Muslim women. So why does the fight for gender equality seem stagnant? It seems that for Indonesia, such a cause is mired in by many obstacles. The great wall of patriarchic culture and such defaming claims by 'Islamic' revivalist movements such as HTI, MMI or KPPSI have long lives indeed. Helped along by the comfortable armchair position of men, firmly entrenched in society and backed up by a headstrong dogmatic position on religious interpretation. Sadly, many women still nod to such a position, accepting it as one of the facts of life. Such phenomenon has driven the writer to realize that the struggle for gender equality is far from over. And that a mapping out and elaboration on the extent of challenges facing it would be most beneficial to those fighting for it. In hopes that it would help them in designing proper strategies to more effectively campaign for equality.

In principle, divorce is an unwanted decision for married couples. However, sometimes this is undeniable for many reasons. In Islam, divorce is perceived as an emergency exist for those who could not bare the marriage any longer. What is important to underline is the perceived opinion that it is only the husband who has the authority to divorce his wife. This article attempts at questioning this opinion. In addition, it debates different rights for husband and wife to get a divorce as stated in the fiqh text (known as talaq and kbulii').

Artikel ini mendeskripsikan penerimaan atau resepsi dunia Islam pada konsepsi kesetaraan gender. Kajian ini mengeksplorasi posisi audien dalam meresepsi pesan-pesan kesetaraan gender dalam Film Kartini karya Hanung Bramantyo. Data diambil dari wawancara audien Film. Mereka adalah perempuan yang aktif di Ormas Perempuan Islam. Penonton film relatif berkomentar tentang kesuksesan film sebagai media penyebaran gagasan dan nilai-nilai kesetaraan gender. Mereka menerima nilai-nilai equality secara terbuka dan bulat pada konsepsi kesetaraan gender secara dominan hegemonik. Hal ini mematahkan asumsi dominan tentang negara Islam anti konsep kesetaraan gender. Islam selalu dipandang sebagai barrier atau penghalang kesetaraan gender. Kultur negara Islam di nilai sangat patriarkal sehingga sulit mewujudkan kesadaran gender di kawasan tersebut. Paper ini menerangkan tentang Indonesia dengan mayoritas Islam sebagai promotor kesadaran kesetaraan gender. Hal tersebut memunculkan interpretasi tidak bias, genuine, dinamis, dan berkemajuan untuk menghapus ortodoksi, jumud, dan kental budaya patriarkhal. Film Kartini membawah masyarakat dunia bersikap optimis pada Indonesia dalam kesetaraan gender. Ini adalah harapan Kartini yang tertuang dalam “Habis gelap terbitlah terangâ€.[The article talks about the acceptance or reception of the Islamic world on the conception of gender equality. The study explores the position of the audience in perceiving messages of gender equality in Hanung Bramantyo's Kartini film. Data were taken from film audience interviews. They are women who are active in Islamic Women's Organizations. Film viewers relatively comment on the success of films as a medium for disseminating ideas and values of gender equality. They accept the importance of equality openly and unanimously in the dominant hegemonic conception of gender equality. It breaks the prevalent assumption of an Islamic territorial against the concept of gender equality. Islam has been seen as a barrier to gender equality. Islamic culture is considered patriarchal, making it challenging to create gender awareness in the region. This paper describes Indonesia with a Muslim majority as a promoter of gender equality awareness. It gives rise to an unbiased, genuine, dynamic, and progressive interpretation to erase orthodoxy, old age, and patriarchal. Kartini's film leads the world community to be optimistic about Indonesia on gender equality. This is Kartini's hope, which is stated in "After the dark comes light."]

Marriage gives material and immaterial rights to the wife in the household. But in social reality, many wives do not enjoy the rights of material and non-material, because the husband does not carry out his obligations responsibly. Therefore, forms of Islamic legal protection of the rights of the wife must be studied. The analysis focuses on advocacy for the rights of wives for dowry, living fulfillment, and a sense of security, in the perspective of Islamic law, to better protect the wife.

Problem of Pornography and pornoaksi progressively glow with the media appearance which lust. This problem then enter in public debate discourse, whether including art or porno. Then, this discourse enter in region of interefensi state, pass the invitor of RUU Anti Pornography and Pomoaksi (RUU APP). There is two citadel differ in answering to this RUU. Citadel supporting, what is supported by religion clan. and Citadel refusing, what is supported by actor faction. Artikel ini mencoba menggambarkan teologi feminis menurut perspektif Kristen Protestan yang melihat bahwa masalah ketidakadilan dan kekerasan adalah masalah teologi yang dikategorikan sebagai pelanggaran iman. Sehingga perlu adanya upaya untuk mereinterpretasi Alkitab dan membacanya dengan mata baru agar dapat menemukan wajah Yesus yang dalam pelayananNya. Berdasarkan penelitian didapatkan Kalangan Protestan memahami segala bentuk kekerasan fisik maupun nonfisik, makro maupun mikro, bukan lagi sekedar bentuk pelanggaran HAM tetapi juga sebagai pelanggaran iman. Namun, Gereja pun dapat menjadi lembaga yang paling diskriminatif terhadap perempuan.
