Abstract

Beginning of the emergence endowments can be seen from two assumptions. The first assumption states that the Kaaba was built by Adam, and the pillars established by the Prophet Ibrahim and Prophet Ismail, and then preserved by the Prophet Muhammad, it is thus the Kaaba is the first endowments known to man and used for religious purposes. While the second assumption states that the Prophet Abraham who built the Kaaba, it means endowments began in the time of Prophet Ibrahim, who has brought the teachings of monotheism. Endowments ordered by the Prophet comes from the prophetic vision and not follow the example of the implementation of the endowment implemented ancient Egyptians and Greeks and Romans. Later, the endowment was established in the community is carried out dynamically from a tradition that is to be amplified by the regulation, as practiced in Muslim countries. Regulation waqf positive impact for the wider benefit such as health care, education, social. Economic and others. Health services are provided through endowments-waqf hospital. Management of waqf with contextual regulation can also be used to develop the productive waqf property through commercial efforts and the results for social purposes.

Abstract

The existence of Islamic educational institutions of the Dutch colonial era to be the target because Islam has the spirit of colonialism visit, so that madrasas as a colonial threat. However, the Holy, Muslim leaders played a major role in realizing the existence of Islamic institutions with the aim of broadcasting Islam. Party contributing more important is muwakif (a pewakaf) land for Madrasah Diniyah Muawanatul Muslimin (madrasah Muawanah) so eksisnya sustainable educational institution since 1915 until now. One thing that should be examined administrators and organizers of educational institutions, namely evaluating soil perwakafan administration madrasas that later did not show up issues that do not make pleasant situation. It is necessary to involve the government, civil society and private citizens really materialized.

Abstract

Waqf property in principle are the property of the people, as suchbenefits must also be felt by the people and therefore at the level of the waqfproperty is ideally collective responsibility to maintain it’s exist.Indonesian state has a Muslim majority society. This conditioncertainly makes the problem of managing endowments, become a very urgentproblem and very vulnerable. In addition, problems sometimes arise seizureof waqf land ownership rights between the heirs wakif nadzir even there is aperson who has dared to be against the law to transfer or assign ownership toanother party. Those problems need to be addressed as well as law enforcementboth litigation and non-litigation order berkepastian law, justice and legalexpediency. Indonesia is a country of law as in Article 1 (3) of the Constitutionof the Republic of Indonesia (UUDNRI) 1945, so that all activities in ourcountry governed by law.Dispute resolution based on traditional endowment Indonesianpositive law is: Non-Litigation. (A). Peace and Alternative Dispute Resolution(ADR). The legal basis of dispute resolution outside of court can be deliveredas follows: Article 3, paragraph (1) of Law No. 14 of 1970, Article 1851 ofthe Civil Code, Article 1855 of the Civil Code, Article 1858 of the Civil Code,alternative dispute resolution is only regulated in one article, namely Article6 of Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution.(B). Procedures and dispute settlement procedures of Article 62 of Law No.perwakafan 41/2004 explains: perwakafan dispute settlement be reachedthrough negotiation to reach an agreement, if the dispute resolution referredto in subsection (1) does not succeed, the dispute can be resolved throughmediation, arbitration, or court. Article 62 of Law No. 41/2004 explains thatin solving the problems of the waqf property to first prioritize the attitude ofdeliberations to reach a consensus. Litigation: In the context of endowments,the Institute for Religious Courts through Article 49 of Law No. 7 of 1989as amended by Act Number 3 of 2006 on the Religious Courts. EndowmentsAct No. 41 of 2004, there are criminal provisions, which is still limited targetNazdhir and Officer Deed of Pledge Waqf. This is explained in Article 67paragraph (1) and paragraph (3).

Abstract

Zakat should be managed in a productive and professional. Domestic politics haveresulted in Zakat Act No 38/1999, which was then amended by Zakat Act No23/2011. This new Act mandated a stronger integration of zakat managementin the country. According to the Act, the zakat institution is divided in two:(i) government board of zakat and (ii) private zakat institutions. The formeris known as Badan Amil Zakat Nasional (abbreviated as BAZNAS), or theNational Board of Zakat, and the latter is known as Lembaga Amil Zakat(abbreviated as LAZ). BAZNAS was given a mandate to lead the integrationprocess and to coordinate all other zakat institutions comprising BAZNASat the Provincial and City/Regency levels and LAZ. This paper attemptsto discuss policy design and strategic steps that can fully support futuredevelopment of zakat in Indonesia. This study uses socio-economic approach. Theanalysis serves to simplify data into a form that is easier to read and interpret.The analysis used in this research is descriptive analysis.

Abstract

BAZNAS has now transformed into a large and influential zakah institution in the life of Indonesian society due to the power of the Law that shelter it. This is an institution awaited by Muslims in general. This institution is the Shariah institution authorized entitled to receive and distribution of zakat, infaq and alms. Therefore this institution should be established by each region throughout Indonesia both at provincial and district levels. Therefore, transparency becomes crucial because of the many parties who are interested in zakah institutions. Transparency can be done by presenting reasonable financial statements. The organizers of zakat institutions should be obliged to understand the preparation of financial statements. This is in some areas are still frequent inequality and lack of understanding of the basics in the preparation of zakah institutional financial statements.

Abstract

This article describes the role of zakat in poverty alleviation. Zakatthan as an obligation for Muslims, through zakat, the Quran makesa responsibility for Muslims to mutual help among others. Therefore, in ourobligations zakat is the element of moral, educational, social and economic(Rozalindah, 2014: 248): In the field of morality, charity scrape out the greedand avarice of the rich, purify the souls of those who perform the prayer of thenature miser, purify and develop property object. Education in the obligationof zakat can be gleaned from curiosity to give, berinfak and give up some ofits property as evidence of compassion for fellow human beings. In the socialfield, the charity, the poor group can play a role in his life, acted upon itsobligations to God, for helping zakat and sadaqah given by people who are able.With the zakat Similarly, people who are not able to feel that they are part ofthe community members, not the wasted and underestimated. In the economicfield, zakat can play a role in preventing the accumulation of wealth in a fewhands only, and obliges the rich to redistribute wealth to the group of thefamily fortune and destitute. So, zakat also serve as a potential source of fundsfor poverty reduction. Zakat can also serve as working capital for the poor tobe able to open up employment opportunities, so they can earn and be able tomeet their daily needs harinya.ipetik of curiosity giving, berinfak and give upsome of its property as evidence of compassion for fellow human beings. In thesocial field, the charity, the poor group can play a role in his life, acted upon itsobligations to God, for helping zakat and sadaqah given by people who are able.

Abstract

Poverty has many definitions, parameters, and standards. From the viewpoint of Islam, many theologians define and measure poverty by various terms and sizes. The difference among theologians’ opinion is caused by poverty terms contained in the Qur’an and Hadits. “Fakir” and “poor” have many meanings. It allows a wide interpretation of the verse and word from theologians. It is also seen from the regulation point in Indonesia, there are many definitions, standards and parameters of poverty. The difference of point of view on determination of poverty criteria and regulations according to Islam in Indonesia shows that the ways of ijtihad by theologians and the government elements is very open. The absence of standard stipulation held, encouraging the writer to conduct a comparative research in this paper; through literacy research. Syafi’i sect does not specify a quantitative standard for poverty. Poverty is only categorized on requirement. As long as people are not able to cover 50% of their basic needs, they are called as fakir. If people are only able to cover close to 70% of their basic needs then they are categorized as poor. Meanwhile, according to Hanafi sect, the qualitative standards turned to the Syafi’i sect. Poor conditions are more severe than the fakir. Besides,the quantitative standard of poverty is one nisab of zakat or the equivalent of 85 grams of gold. On the other hand, BPS and BKKBN formulate the concept and standard of poverty by economic concepts. Poverty is conceptualized as the inability of someone to meet basic consumption needs of the formulation adapted to local conditions respectively.

Abstract

The role of the Waqf is very strategic for the development of the muslim community throughout both concern education, health, and well-being. But the unfortunate developments that have been achieved so far are still struggling on the field of worship, education, and health alone, while the field of economics that are the pillars of modern life has not been touched wide. Many waqf property is “problematic”, as questioned by the heirs, even sued to court, there are deprived openly, no one asked back because of religious differences between expert wars with the Waqif., And some are sold expert inheritance for bankruptcy

Abstract

Cash waqf is not refers to money waqf only but also cover waqf of capital stock and obligation. This kind of waqf has been acknowledged by waqf institution in Indonesia and also has been regulated by the government. This article describes its regulation and how to do cash waqf in Indonesia.
