Abstract

One of the purpose of the formulation and enactment of laws in Indonesian is to create of a peaceful, comfortable, orderly, and fair. Basically the purpose of the law can be approached from the essence of law . The essence of law or rules is to protect the rights of the community, and provide opportunities “more “ to the public . Thus the people who obey the law, their rights as citizens are protected and realized, as well as having the opportunity to be compared with other community members. Example, if the other party is not known, then the corruption, cheating can be done. If there is no police, the traffic violation can be done. As one consequence legal purposes not materialized in public life. Justice is still a very high value, well-being has not been felt by the majority of society , feeling comfortable, peaceful, and orderly atmosphere that is missed by the people. That there are signs of not implemented of rule or law. The signs of not implemented law, can be expressed as a sign of “ legal death “, in the sense that the law does not function in accordance with the function, role, and purpose . The application of the law in the reality of people’s lives , still formalistic, have not enactments expressly sanction yet, the judicial mafia. Abstract

Penyelesaian sengketa pertanahan yang dilakukan oleh Badan Pertanahan Nasional adalah merupakan terobosan baru dalam rangka untuk menghindari penumpukan perkaran di dunia peradilan khususnya Peradilan Tata Usaha Negara. Penelelitian ini bertujuan untuk mengkaji dan menganalis proses penyelesaian sengketa pertanahan yang dilakukan oleh Badan Pertanahan menurut Permen Nomor 11 Tahun 2016, dan untuk memahami dan menganalisis bentuk kewenangan BPN dalam penyelesaian sengketa pertanahan. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Metode pendekatan yang digunakan adalah: pendekatan Perundang-undangan, pendekatan konsep. Dari hasil penelitian dapat dikemukakan bahwa proses penyelesaian sengketa pertanahan dalam kaitannya dengan pembatalan sertifikat dapat dilakukan melalui Pengadilan Tata Usaha Negara dan di luar pengadilan. Penyelesaian sengketa di luar pengadilan dalam hal ini kewenangan pembatalan diberikan kepada BPN yang dapat di bagi menjadi dua yaitu melalui kewenangan kementerian dan di luar kewenangan kementerian. Sedangkan Bentuk kewenangan BPN dalam penyelesaian sengketa pertanahan bisa berupa kewenangan atribusi dan kewenangan pendelagasian.

Abstract

International humanitarian law recognized the classification of population during the war, namely: combatant; hors de combat; non-combatant; and civilians. Civilians is the parties who should be protected from enemy attacks and conversely this classification should not be attacked under any circumstances. In the other side of these classifications, the United States arrested around 200 Afghan children and teenagers on charges of being enemy combatant and detained them at the Detention Facility in Parwan. The act taken by the United States is not recognized in international humanitarian law since terms enemy combatant is not suitable with any other terms in international humanitarian law. The United States arrested children who did not took up arms and were not involved in the war but ‘allegedly’ involved with terrorist networks and were considered to treated state security. Phrase ‘allegedly’ refers to subjectivity and hard to describe. This research will discuss how international humanitarian law deal with the United States new terms namely enemy combatant. This study uses statutory approach which examining the laws and regulations concerned with the formulation of the problem discussed. It also uses conceptual approach which moves from the views and doctrines that develop in law to build a legal concept. This study is purpose to analyze legal basis and principles of international customary law related to the concept of enemy combatant as applied unilaterally by the United States to the armed conflict in Afghanistan.

Abstract

Implementation of the Hajj is regulated in Law No. 13 of 2008 concerning the organization of the pilgrimage. This law provide legal certainty for the citizens of the State of Indonesia (WNI) who wish to perform the pilgrimage in the holy land of Mecca with a system setup and management implementation. This monopoly is conducted by the Ministry of Religion is a form of monopoly by law. On  Presidential Decree number 70 of 2012 on the procurement of goods or services still relied upon by the religious ministry of the republic of Indonesia in Hajj transportation procurement by the government through a public tender process and the law, socio- legal approach empirical through legislation. There are many factors which become obstacle in the implementation of the transport Hajj like structure where the lack of specialized agencies authorized to manage funds Hajj , the substance is not harmony factor . The lack of knowledge about the pilgrims in the field of aviation technology that can interfere with the process of implementation transportation pilgrims. Notаris dаlаm prаktiknyа sering menerimа penitipаn sertipikаt Hаk Аtаs Tаnаh milik kliennyа, dimаnа penitipаn tersebut umumnyа dilаkukаn dаlаm hаl pаrа pihаk yаng аkаn melаkukаn Perjаnjiаn Pengikаtаn Juаl Beli (PPJB) yаng sifаtnyа belum lunаs sehinggа gunа melindungi kepentingаn mаsing-mаsing pihаk, mаkа sertipikаt tаnаh tersebut kemudiаn dititipkаn kepаdа Notаris pembuаt аktа PPJB. Kegiаtаn penitipаn tersebut menimbulkаn implikаsi hukum mengingаt tidаk аdа perаturаn perundаng-undаngаn yаng memberikаn kewenаngаn kepаdа Notаris untuk menerimа penitipаn tersebut, sehinggа berаkibаt Notаris yаng bersаngkutаn hаrus siаp menаnggung besаrnyа tаnggung jаwаb dаn risiko yаng dаpаt terjаdi terhаdаpnyа kedepаn kаrenа telаh menjаlаnkаn jаbаtаn diluаr kewenаngаn yаng diberikаn oleh undаng-undаng. Penelitiаn ini bertujuаn untuk mengаnаlisis terkаit bentuk pertаnggungjаwаbаn Notаris yаng berkedudukаn sebаgаi penerimа titipаn sertipikаt hаk аtаs tаnаh milik klien ditinjаu dаri perаturаn perundаng-undаngаn terkаit yаng berlаku. Metode penelitiаn yаng digunаkаn аdаlаh metode penelitiаn yuridis normаtif. Hаsil dаri penelitiаn ini menunjukkаn bаhwа Notаris yаng menerimа penitipаn sertipikаt Hаk Аtаs Tаnаh milik kliennyа аpаbilа terbukti telаh melаkukаn pelаnggаrаn yаng merugikаn pihаk lаinnyа dаpаt dimintаi pertаnggungjаwаbаnnyа secаrа perdаtа, pidаnа аtаu аdministrаtif sesuаi dengаn perаturаn perundаng-undаngаn yаng berlаku.

Abstract

The decentralization system impacts the change of the local tax regulation. Based on  the Law No 34 of 2000 on local tax and retribution, local government may determine new kind of taxes  besides what  has established in this Law, but they must refer to the available criteria. Tax  as one of the important local incomes to finance either the government operation or local development and to support the accountable, real, and extant decentralization . After the Law No 34 of 2000 has been replaced by the law No 28 of 2009 on local tax and retribution, local government is not allowed to pick up tax other than what the law has determined. The basis of the tax and the discretion is extended.  To improve the tax accountability; this law stipulates that some parts of tax income should be allocated to finance activities relevant to such tax.Keywords : Local Tax

Abstract

Penelitian ini bertujuan untuk mengkaji dan menganalisis mengenai akibat hukum terhadap sertifikat jaminan fidusia ketika pendaftarannya menggunakan akta jaminan fidusia yang tidak mengikuti ketentuan berdasarkan Undang-Undang Nomor 2 Tahun 2014 Jo Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris. Penelitian ini menggunakan jenis penelitian yuridis empiris. Untuk dapat menjawab permasalahan dilakukan penelitian lapangan dan kajian peraturan perundang-undangan untuk memperoleh jawaban dari permasalahan yang ada. Penelitian ini juga menelaah dan membedah suatu putusan pengadilan mengenai pembatalan akta notaris. Penelitian ini diharapkan dapat menjadi pedoman bagi notaris dalam menjalankan tugas dan jabatannya terkait pembuatan akta autentik terutama tata cara pembuatan akta jaminan fidusia. Pembuatan akta jaminan fidusia sering kali melanggar ketentuan Undang-Undang Nomor 2 Tahun 2014 Jo Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris, dengan alasan agar bisnis bank dan bisnis perusahaan finance tidak terhambat. Sertifikat jaminan fidusia yang didaftarkan menggunakan akta jaminan fidusia, yang dibuat tidak sesuai dengan Undang-Undang Nomor 2 Tahun 2014 Jo Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris menjadi batal demi hukum.

Abstract

Memasuki era digital, sistem pemasaran juga mengalami perubahan dari system pasar konvensional menuju sistem pasar digital. Pemasaran digital sudah berjalan secara aktif pada satu dekade terakhir. Proses transformasi ini tidak serta merta berjalan mulus. Terjadi gejolak dalam dunia pemasaran baik dari segi etika maupun regulasi. Marketplace, sebuah sistem pasar digital kemudian menjadi objek dari penelitian ini. Yang menarik adalah ketika sebuah transaksi pasar dilakukan di dunia maya. Potensi permasalahan yang muncul bukan hanya antara pembeli dengan penjual namun juga dengan pemilik Marketplace itu sendiri. Untuk menelusuri sistem dari Marketplace dari sisi regulasi akan dikaji lebih lanjut dalam penelitian ini melalui studi kasus dan peraturan perundang-undangan terkait. Sehingga diharapkan penelitian ini mampu memberikan gambaran secara umum terkait regulasi di dalam Marketplace.

Abstract

In case the concept of “right” is perceived in an opposite view by the Adat Law community and the country, then every regulation concerning right will be accepted in a different way too. Meanwhile “regulation” is in the field of the country authority where the Adat Law community forced to obey their regulations. In Law Number 41 concerning Forestry regulated that an Adat Law community has not entitled to manage forestry land as far as their existence has not recognized by the state although the Adat Law community has made a claim that management on forestry land was part of their congenital right and right on their ancestors root that they already have even before the declaration of Indonesia’s independence. Therefore, its implication caused conflict between the Adat Law community against the state / government keep on growing. The community continues managing the forest as their ancestor’s cultural basic while the state keep forcing their regulation on Adat Law community. In the end the number of violation against regulation of the management of forest resource keep on increasing, hence the forests are no longer a source of public welfare but oppositely has become a source of disaster for the Adat Law community. In this case the solution would be “the harmony” and “balance” of the state’s regulation on the Adat Law community. Keywords: Right, Forest Management, Law Enforcement.

Abstract

Law is impossible to die, even if we can strangle it until limp. This questions appeared the possibility of killing the law by tracing the ideas about the law and the state that appears in the passage of time. What emerges is that the order or disorder always presupposes the emergence of law. Although it does not indicate whether the law appear fair or not. The fact is that people need a law although not necessarily requiring the State. Problems faced by Indonesia is now possible to be considered not as a matter of law, but the inability of the State  to present itself as something that is needed by the community.Keywords : Community, Emergence of  Law, Fairness
