Abstract

This article analyzed concerning Green Protectionism against the Barriers of Indonesia’s Crude Palm Oil (CPO) Export in the European Union in accordance with GATT / WTO provisions. This writing is a normative legal research that used statutory, fact, and case approaches. In the analysis, it will explore the policy of green protectionism and look at various existing legal instruments, inter alia GATT/WTO Agreements, regulating the legal issue in concern.

Abstract

This paper is about the manifestation of the role of the community in the area ofdemocratic governance. The problems that occurred that embodiment of society's rolein the area of democratic governance is not entirely clear set in the rule of law inIndonesia, causing blurring the role of society in local governance to carry out aregional autonomy demokratis. This paper aims to understand and appreciate the roleof the public manifestation in the area of democratic governance. This paper, using themethod of the normative legal research with this kind of approach to the analysis oflegislation. This paper presented a study that in a democracy is a government of thepeople by giving authority to the community through participation embodiment.Democracy means rule system of government from the people. Democracy can foster afeeling of belonging to the community and is responsible for the development inaccordance with the meaning of democracy is government of, by and for the people. Theprocess of implementation of the program and the implementation of democraticdevelopment in the local government which is based on community participationinclude the planning and implementation of programs, dialogue with the public anddecision-making.

Abstract

In writing the journal entitled “The contribution of Restaurant Tax in Increasing the local revenue of Bangli Regency”, restaurant tax is one of the taxes taken by the regional government. In Bangli regency, restaurant tax is one of the local income that can later increase the local revenue of Bangli regency. the method which used is empirical law research method. There are some problems as How was the contribution of the restaurant tax in increasing the local revenue of Bangli regency and what factors that cause the differences between the target decided by the government with the realization of the income of Restaurant tax in Bangli regency. The contribution of restaurant tax toward the local revenue of Bangli regency from year to year is considered as very low. There are several factors that cause the small income of restaurant tax on Bangli regency, those factors are the law enforcement, materials and facility, society and culture factors. The local Bangli government has done some efforts to increase the revenue of the restaurant tax that is by giving administrative sanction to the restaurants which do not pay the tax and now has cooperation with Bangli prosecutor to take the tax.

Abstract

The paper entitled Permission System of Living Environment through Act Number 32 of 2009 on the Protection and Management of Living Environment. This paper uses analytical normative method and normative legislation approach. The quality of living environment which keep decreasing has been threatening the survival of human beings and other living things so the protection and management of living environment is needed. The permission of living environment plays an important role to protect and manage the environment. Furthermore, this paper will discuss the permission system of the living environment and the factors causing the revocation of living environment permission.

Abstract

Since the issuance of regulations regarding to regional autonomy Act No. 23 year of 2014 on Regional Government and Law No. 33 year of 2004 on Financial Balance between Central and Local Government, so the powers and responsibilities assigned to local governments to manage the region optimally be grater. It required a huge role of the legislators to control the financial related policy areas which is economical, efficient, effective, transparent, and accountable and factors that affect the value of the government’s financial reporting information. The method used in writting this paper is normative research. In terms of the role, the representative council shall supervise the implementation of the budget (APBD) as a form of governance and accountability of the organization of services oriented to the public interest. Factors that affect the value of the government’s financial reporting information, among others are, the quality of human resource, the use of technology, system of internal supervise and monitoring.

Abstract

This paper is titled, "Tax Collection At The Restaurant which is Has No Building Permit in Kintamani Bangli Region". The problems discussed in this paper is what the basis used by the Government in the Bangli Regency to collect tax to restaurant that does not have a permit in the area of Kintamani, Bangli and authority of the Government in the Bangli Regency to collect tax to restaurant that does not have a permit in the area of Kintamani, Bangli. The method used is normative juridical research. The basis used by the Government in the Bangli Regency tax purposes to restaurant that does not have a building permit is the principle of expediency. Based the authority that possessed, the Government shall collects tax to restaurant that does not have a permit in the area of Kintamani, Bangli. Conclusion of this paper is the basis used in the conduct of tax collection at the restaurant that does not have a building permit is the principle of expediency. Government in the Bangli Regency can do tax collection at a restaurant that does not have a permit in the area of Kintamani Bangli.

Abstract

This thesis entitled "Implementation of the Gianyar Regency Regulation No. 14 of 2012 on Building Permits Especially Against Means Tourism Building (Studies in Integrated Licensing Service Departement and Gianyar Regency), using empirical methods with legislation approach, fact approach , and analitical conceptional approach of law. The raised issue in this paper is how does the implementation of the Gianyar Regency Regulation No. 14 of 2012 by the Local Government in the Office of the Integrated Licensing Service Departement (BPPT) specialy in establshing the tourism facilities in the district if Gianyar and determine whether the factors that support and impede the implementation of the Regional Regulation No. 14 Year 2012. The conclusion is implementation of the local regulation can not be said operate effectively in view of the of the violations committed by the people/entrepreneurs about the activities of development without have permit and payment of the retribution in advance of Building Permit.

Abstract

The position of the individual as a citizen of a foreigner in a state is a subject of international law, which has the rights and obligations under the International law in a limited sense. Limited stay permit is valid residence permit granted to foreign nationals who meet immigration requirements. Each entry of foreigners into the territory of Indonesia, are entitled to the protection of both of the country of origin or destination country. However, each state has different procedures and processes in resolving acceptance influx of foreign nationals. This paper will discuss the limited stay permit of foreigners who stay in Indonesia.

Abstract

This writing aims to discuss the legality of the use of ‘Agent Orange’ weapon during the Vietnam War and the legal protection of children who are victims of the use of such weapon in Vietnam. This paper is a normative legal research that uses statute, case, and historical approaches. It describes and analyzes the chronology of events and legal protection that can be provided to victims of Agent Orange, especially children. This article concluded that the legal protection that can be given to children affected by Agent Orange weapon is not sufficiently provided.

Abstract

Forest Park (Tahura) is defined as forest conservation which its is to functionprevents abrasion caused by the waves on the coast . Mangroves are located in the cityof Denpasar area with 700 hectares . Because of the importance of mangrove forests asa function of spawning fish in the waters , land protection from erosion by waves , windprotector of the land , and sea water filter istrusi to the mainland , then this article willdiscuss the Denpasar Government authorities related to the control and management ofmangrove forests . The research is empirical juridical research . Denpasar GovernmentAuthority relating to the control and management of mangrove forests fall under Article40 paragraph ( 1 ) , ( 2 ) and ( 3 ) Regional Regulation No. 27 Denpasar 2011concerning Spatial Plan Year 2011-2031 Denpasar these provisions are based andcorresponds to the central government laws on Article 59 to Article 65 of Law No. 41 of1999 on Forestry and on Article 63 of Law 32 of 2009 on Protection and Managementof Environment and must remain coordinated between the central government ,provincial governments and government area in accordance with article 6 and 7 ofGovernment Regulation No. 38 Year 2007 About the Governmental Affairs between theGovernment , Provincial Government , and the Government of Regency / City.
