Abstract

The Covid-19 pandemic situation that has occurred this year has forced the government to issue all policies to regulate the public to avoid or reduce the risk of contracting the Covid-19 virus. The Bali Governor Regulation 46 of 2020 aims as stipulated in Article 3, namely to prevent and control the spread of the Covid-19 virus in various sectors in the Province of Bali. It is also seen in Law 23 of 2014 concerning Regional Government, in particular Article 238 paragraph (4) where administrative sanctions can only be regulated in Regional Regulations. Specifically, regarding administrative sanctions such as what was previously regulated in the Bali Governor Regulation No. 46 of 2020, it is a sanction given to people who violate health protocols which during the Covid-19 pandemic are getting serious handling from the authorities. The administrative sanctions in the Bali Governor Regulation No. 46 of 2020 are regulated in Article 11 paragraph (2). Based on the Presidential Instruction of the Republic of Indonesia Number 6 of 2020 concerning Improvement of Discipline and Law Enforcement of Health Protocols in the Prevention and Control of Corona Virus Disease 2019, Bali Governor Regulation No. 46 of 2020. The inclusion of administrative sanctions on the people in Bali is Rp. 100.000,- for people who are in the wild in the room/house not wearing a mask, it is an instruction previously issued by the President which instructs regional heads to impose sanctions, one of which is administrative fines for the community, and for the amount of the sanctions which are determined by the Governor.

Abstract

In writing the journal entitled “The contribution of Restaurant Tax in Increasing the local revenue of Bangli Regency”, restaurant tax is one of the taxes taken by the regional government. In Bangli regency, restaurant tax is one of the local income that can later increase the local revenue of Bangli regency. the method which used is empirical law research method. There are some problems as How was the contribution of the restaurant tax in increasing the local revenue of Bangli regency and what factors that cause the differences between the target decided by the government with the realization of the income of Restaurant tax in Bangli regency. The contribution of restaurant tax toward the local revenue of Bangli regency from year to year is considered as very low. There are several factors that cause the small income of restaurant tax on Bangli regency, those factors are the law enforcement, materials and facility, society and culture factors. The local Bangli government has done some efforts to increase the revenue of the restaurant tax that is by giving administrative sanction to the restaurants which do not pay the tax and now has cooperation with Bangli prosecutor to take the tax.

Abstract

Broadcasts broadcast via television broadcasts have developed rapidly by presenting internet-based broadcasts or broadcasts. Looking at what currently exists in Indonesia, one of them is Vidio.com. Indonesia itself strongly adheres to the norms of politeness in social life, where internet-based broadcasting often displays scenes or words that are not in accordance with the norms of politeness that Indonesia currently adheres to. Article 13 paragraph (2) of Law No. 32 of 2022 regulates broadcasting services in Indonesia consisting of radio broadcasting services and television broadcasting services. Here it can be seen that the KPI does not have the authority to carry out supervision regarding internet-based broadcasting services. The authority possessed by KPI is attribution authority which originates from the law in carrying out broadcasting supervision in Indonesia. provisions of Bill C-11 and Law no. 32 of 2002 both regulate Broadcasting, but there are differences between these two provisions, Indonesia is limited to Radio and Television Broadcasting Services, while Bill C-11 Broadcast which has been revised, supervision covers Radio Broadcasting Services, Television, Providers Telecommunications and Internet Services. The internet in this case in Bill C-11 includes online streaming services. The supervision carried out by the CRTC is actually similar to that carried out by the KPI.

Studi0ini menerapkan metode penelitian0hukum0empiris, khususnya pendekatan penelitian0deskriptif. Sumber daya hukum0primer, bahan hukum0sekunder, dan bahan hukum tersier adalah sumber data dan data yang digunakan, yang masing-masing terdiri dari data primer0dan sekunder. Analisis dokumen, teknik observasi, dan teknik wawancara adalah beberapa0teknik pengumpulan0data yang digunakan. Untuk pengambilan sampel, teknik pengambilan sampel nonprobabilitas digunakan, sementara pengambilan sampel purposive dan snowball digunakan untuk memilih subjek. Data juga dikumpulkan, diproses, dan dievaluasi secara kualitatif. Temuan menunjukan sanksi terhadap pelaku usaha rokok tanpa pita cukai 0Undang-Undang0No. 8 Tahun 19990tentang perlindungan konsumen,di Kabupaten Buleleng tidak0efektif karena masih ada warung yang menjual rokok tanpa pita cukai di Kabupaten Buleleng dan belum diberi sanksi. dan hambatan-hambatan yang dialami instansi terhadap peredaran rokok tanpa pita cukai di Kabupaten Buleleng, ada kendala dari dalam dan dari luar instansi terkait.

Abstract

Penelitian ini bertujuan untuk mengetahui, memahami, dan mengkaji mekanisme dan prosedur penetapan hak atas tanah terlantar dan implikasinya sebagai kepastian hukum bagi masyarakat. Peraturan Pemerintah Nomor 20 Tahun 2021 tentang Penertiban Kawasan dan Tanah Terlantar telah mencakup beragam aspek mengenai penetapan hak atas tanah terlantar di Indonesia, namun terdapat kekosongan norma dikarenakan tidak memuat prosedur perlindungan hukum bagi pemegang hak atas tanah. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian normatif dengan penggunaan pendekatan perundang-undangan, dan pendekatan konseptual. Sumber data yang digunakan dalam penelitian ini berasal dari sumber data primer berupa peraturan perundang-undangan dan sumber data sekunder berupa literatur, penelitian, jurnal, dan skripsi yang terkait dengan mekanisme hak atas tanah terlantar. Penentuan narasumber dalam penelitian ini menggunakan teknik purposive sampling yang dilakukan melalui penentuan narasumber berdasar tujuan tertentu. Data penelitian dikumpulkan melalui studi dokumen terhadap segala sumber yang relevan yang kemudian dianalisis melalui analisis deskriptif kualitatif. Sebagai bentuk produk hukum yang menjamin kepastian hukum Peraturan Pemerintah Nomor 20 Tahun 2021 bertujuan untuk melindungi masyarakat dalam konteks penguasaan dan pemanfaatan tanah.

Abstract

Terdapat dua tujuan dilakukanya penelitian ini, yaitu: 1) untuk mengkaji penerapan asas kehati-hatian dalam pembuatan akta Notaris di Kantor Notaris/PPAT Rina Harindyah S. H.; dan 2) memperjelas status hukum akta notaris sehubungan dengan Pasal 15 ayat (1) UUJN, serta akta PPAT pada kantor yang sama. Metode penelitian hukum empiris diterapkan dalam penelitian ini, yang berfokus pada observasi dan analisis fakta-fakta sosial untuk memahami penerapan hukum dalam praktik. Pengumpulan data dilakukan melalui tiga teknik utama: dokumentasi, wawancara, dan observasi langsung. Data dan informasi tersebut bersumber dari gabungan bahan hukum primer, sekunder, dan tersier. Temuan penelitian ini menunjukkan bahwa Notaris harus berhati-hati dan teliti sebelum menyelesaikan atau menandatangani suatu akta. Hal ini mencakup pemeriksaan menyeluruh terhadap semua fakta terkait dan pertimbangan yang adil dan obyektif terhadap kepentingan para pihak. Notaris wajib menerapkan keahlian hukumnya dalam segala pelayanannya, khususnya dalam pembuatan akta Notaris dan PPAT, dengan memastikan bahwa dokumen-dokumen tersebut sesuai dengan peraturan perundang-undangan yang ada. Lebih lanjut, peran PPAT sebagai pejabat publik menjawab tuntutan masyarakat akan kepastian hukum terhadap berbagai perbuatan hukum terkait pertanahan. Menurut Peraturan Jabatan PPAT, PPAT merupakan satu-satunya pejabat yang berwenang membuat akta untuk perbuatan hukum tertentu yang berkaitan dengan pertanahan, sehingga memperkuat signifikansinya dalam kerangka hukum.

Abstract

The protection of foreign legal subjects in the context of international contracts has become an increasingly important issue in international relations. In the era of globalization and economic integration, international contracts serve as a primary instrument in facilitating cross-border transactions. However, foreign legal subjects face different challenges and risks compared to domestic legal subjects. This journal examines the legal protection of foreign legal subjects in international contracts from the perspective of international private law. International private law plays a crucial role in governing legal relationships between nations and resolving disputes involving foreign legal subjects. Foreign legal subjects, such as individuals, companies, or legal entities from other countries, require effective legal protection in contractual rights, enforcement of intellectual property rights, dispute resolution, and prevention of discrimination. Challenges include differences in laws between nations, variations in the understanding of principles of international private law, and disparities in jurisdictional systems. To provide fair and equal legal protection for foreign legal subjects, it is important to understand the perspective of international private law. This journal analyzes various aspects of legal protection for foreign legal subjects in international contracts through a doctrinal approach and analysis of international court practices. The analysis and findings of this journal are expected to contribute to the understanding of the legal protection of foreign legal subjects in the context of international contracts and promote the development of more effective and inclusive legal frameworks.

Abstract

This article examines the implementation of Article 33 letter b of Presidential Regulation Number 62 of 2023 concerning the Acceleration of Agrarian Reform in Sumberklampok Village, Gerokgak District, Buleleng Regency. The focus is on the land certification program for transmigrant residents and the obstacles faced by the National Land Agency. The research method used is empirical legal research with a descriptive qualitative approach. The results show that the implementation was carried out through the Agrarian Reform Task Force (GTRA), with 94 land title certificates successfully issued, while 14 plots of land still face barriers due to beneficiary conflicts and unclear land status. This article recommends strengthening interagency coordination and expediting the legal status determination of land as a solution.
