Abstract

This study raises the issue of how effective the Regional Regulations are Obligatory to Wear Markers for the Jami Mosque Congregation in Gowa Regency Saddu Zari'ah's Perspective. From this main problem, it is limited to sub-problems, namely how the effectiveness of the local regulation on the obligation to wear masks for jami mosque congregations in Gowa Regency, as well as how saddu zari'ah's perspective on the mandatory wearing of masks. This study aims to find out the effectiveness of the local regulation on the mandatory wearing of masks for jami mosque congregations in Gowa Regency, and to find out the saddu zari'ah perspective on the mandatory wearing of masks. This descriptive-qualitative field research uses a juridical-syar'iy approach, by collecting data through questionnaires and in-depth interviews for religious leaders, administrators and jami mosque congregations, the data is processed, analyzed to produce conclusions. The results of this study indicate that the local regulations that require wearing masks are effective for jami mosque congregations in Gowa Regency. As many as 74.4% of jami mosque congregations in Gowa Regency always wear masks outside the home, including at the mosque. The effectiveness of the use of masks is based on several reasons: 1) the congregation knows that wearing masks has been required by the government through local regulations, 2) similarly that with the saddu zari'ah method, the regional regulations that require wearing masks are in accordance with Islamic law

Abstract

This study aims to analyze the reduction of the meaning of the principle of strict liability in the Omnibuslaw Act which will have a significant impact on environmental law enforcement in Indonesia. Environmental law enforcement will revert back to law enforcement in the past. The research used is normative legal research, with a statute approach. The results of the study indicate that the Omnibus Law abolishes the element "without the need to prove the element of error". The blurring of norms in this regulation actually distances the meaning of the principle of strict liability. Basically, strict liability is a concept that allows corporations to be charged with criminal responsibility as a consequence of the developments that occur. The impact of the abolition of the principle, namely, the system of proving faults will be increasingly difficult in enforcing environmental law, the more environmental damage that occurs, the government and society must spend more in proving errors that result in environmental damage, the court will be very rigid in giving decisions if they have to be bound by the new norm in the omnibus law

Abstract

This comprehensive study examines the dynamics of business licensing policies and the adoption of the Online Single Submission (OSS) system as a risk-based solution in public services. The research assesses the legal aspects of business licensing policies, particularly focusing on the OSS system, and evaluates its impact on the efficiency and effectiveness of public services. Employing a juridical approach, the study conducts thorough legal analysis of relevant legislation, regulations, and judicial precedents. Empirical data from case studies and stakeholder interviews in OSS system implementation are collected and analyzed. The findings emphasize the OSS system's importance in streamlining licensing procedures and reducing administrative burdens. Through a risk-based approach, the OSS system promotes transparency, accountability, and fairness while enhancing legal certainty and minimizing corruption risks. The study also identifies challenges, such as data privacy and cybersecurity concerns, and potential conflicts in decision-making processes. Addressing these challenges will improve the effectiveness and sustainability of the OSS system. The research contributes to public administration and legal studies, providing valuable insights for policymakers and legislators in designing and refining business licensing policies and implementing the OSS system. Ultimately, the study aims to promote good governance, facilitate economic growth, and enhance the quality of public services.

Abstract

This study aimed to analyze the existence of a party tribunal in resolving internal political party disputes under the provisions of law number 2 of 2011 concerning Amandements to Law Number 2 of 2008 regarding Political Parties. Its existence is designed as an internal tribunal to quickly examine and decide cases of internal party disputes with certainty and justice. However, party tribunals and the decisions made have yet to be able to assist political parties in resolving disputes efficiently and effectively. This study used normative legal research metods with a statutory, case, and conseptual approaches. The results of this study indicate that the internal dispute resolution mechanisms of political parties are carried out through the political party tribunal. Suppose a settlement through the political party tribunal has yet to be reached. In that case, the settlement of political party disputes is carried out through the District Tribunal, and it can be followed by filing an appeal to the Supreme Court. Arrangements related to internal conflicts must be regulated more clearly in the law to create democratic regulations and uphold the principle of legal certainty.

Abstract

This research describes the fertilizer problem in Indonesia and the existence of the Fertilizer and Pesticide Monitoring Commission, this institution was formed which in reality does not solve problems in the agricultural sector. This research is legal research that analyzes the authority of the Fertilizer and Pesticide Monitoring Commission from the perspective of State Administrative Law with a conceptual and statutory approach. The results of this research are: first, the ideal function of KP3 is preventive and repressive supervision. secondly, the supervision carried out by KP3 is only preventive supervision, and even then in the executive area there is overlap between state government organizations.

Abstract

This paper examines the effectiveness of resolving physical violence against wives at the investigation stage carried out by investigators from the Women and Children Protection Unit (UPPA) of the Maluku Regional Police (Polda) through a restorative justice approach. This research is a sociological juridical (empirical) research. Efforts to resolve physical violence against wives at the investigation stage are carried out by UPPA investigators of the Maluku Regional Police (Polda) through restorative justce in the form of; (1) Involve all parties interested in the problem of crime (violence) to participate in solving collectively or together; (2) The perpetrator does not refuse and is willing to commit and is voluntarily responsible for compensating for the violence committed; and (3) Provide opportunities to the perpetrator in terms of reaching a resolution to the violence committed against his wife. The resolution of physical violence against wives at the investigation stage carried out by investigators from the Women and Children Protection Unit of the Maluku Regional Police based on the resolution efforts described above through a restorative justice approach has been effective, this is because the victim does not want to continue the case to the court stage which will lead to divorce.

Abstract

Cases of child neglect are considered an indicator of the minimal quality of child protection in Indonesia. The law that is needed is criminal law because it is considered effective. Sanctions for perpetrators of criminal acts of child neglect are explained in Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection. Criminal Provisions, Article 77B "Any person who violates the provisions as intended in Article 76B ("Every person is prohibited from placing, allowing, involving, ordering to involve a child in a situation of abuse and neglect"), shall be punished with a maximum imprisonment of 5 (five) years and/or a maximum fine of IDR 100,000,000.00 (one hundred million rupiah)”, however the fact is that sanctions against parents who do not support their children as per the court decision regarding the obligation to pay child support, especially for a father, are almost never implemented because of the umbrella There is no specific law that provides sanctions for fathers who do not support their children. Therefore, in order to increase the effectiveness of implementing child protection, it is necessary to provide criminal sanctions for child neglect committed by parents, especially for fathers who do not carry out their obligations, namely by revising the Elucidation to Article 76 B of Law Number 35 of 2014 concerning Child Protection, with the addition of an editorial explaining the article, "what is meant by Neglect, includes the Parent's (Father's) Denial of Payment of Child Support based on a Religious Court Decision which has permanent legal force.

Abstract

This study aims to find reasons why pretrial institutions are no longer relevant and must be immediately renew in Indonesian criminal procedural law. This article was compiled using the normative legal method. The study was conducted by examining the legislation, legal literature and doctrines related to pretrial. This study also uses three approaches, namely the statutory approach, the historical approach, and the conceptual approach. The results of the study show that pretrial reform in Indonesian criminal procedural law is important to be carried out immediately, Considering the many shortcomings that pre-trial institutions currently have, such as limited authority in the scope of the pre-adjudication stage which makes pre-trial far behind the models of similar institutions in various countries, and the absence of control or supervision over other crucial matters, such as determining whether evidence is obtained. in a legal way or not. Therefore, through the formation of a new criminal procedural law with pre-trial institutions changing their form to Commissioner Judges or Preliminary Examining Judges with a more active nature, it is hoped that human rights and citizen rights can be realized in the judicial process, as well as to achieve due process of law such as that is aspired to. The pros and cons of legal certainty and the principle of legality related to the decision of the constitutional court that expands the authority and broadly interprets several matters related to pretrial and criminal procedural law will be answered through the establishment or ratification of a new KUHAP with a pretrial institution that changes its form as a Commissioner Judge or Preliminary Examining Judge with more active nature.

Abstract

Tujuan dari penelitian ini adalah untuk mengetahui lebih jauh mengenai teori dan gagasan di balik akad ijarah pembiayaan multijasa serta bagaimana pemanfaatannya untuk memberikan hak kepastian hukum kepada penerima manfaat. Sumber data yang berasal dari peraturan perundang-undangan, fatwa, dan sumber pustaka lainnya digunakan dalam metode analisis deskriptif normatif, yaitu pendekatan komparatif dan konseptual. Sudah menjadi rahasia umum bahwa terdapat beberapa penafsiran mengenai bagaimana seharusnya akad ijarah pembiayaan multijasa diterapkan, baik dalam peraturan perundang-undangan maupun fatwa. Setiap lembaga fatwa mendapatkan tingkat kepastian hukum yang berbeda-beda sebagai hasil penelitian ini. Kesimpulan yang dapat diambil dari perbedaan pandangan tersebut adalah bahwa mutijasa harus menjamin keabsahan obyek, hubungan hukum, dan status pemilik manfaat agar dapat memberikan mekanisme pengalihan manfaat yang jelas sehingga akan memberikan kepastian hukum hak atas manfaat dalam suatu akad pembiayaan ijarah. Proses transfer manfaat tersebut kemudian dapat diringkas sebagai berikut: 1) Lembaga keuangan yang berperan sebagai mu’jir wajib menjamin bahwa hak kepemilikan atas manfaat jasa telah dikelola dan dapat digunakan atau dinikmati oleh nasabah yang bertindak sebagai musta' jir ; 2) Lembaga keuangan yang bertindak sebagai lessor harus terlebih dahulu mengadakan perjanjian atau akad ijarah dengan penyedia jasa dalam rangka pengelolaan kepemilikan hak atas manfaat; dan 3) Lembaga keuangan yang bertindak sebagai lessor dapat secara mandiri mengadakan akad ijarah multijasa secara langsung dengan nasabah, dengan ketentuan lembaga keuangan tersebut membayar atau bertransaksi dengan pihak ketiga atau penyedia jasa tersebut.

Abstract

This research stems from the many cases of disputes that have been legally binding but the rights have not been fulfilled due to constraints in real execution. A number of cases also require an in-depth understanding of the authority possessed by the Chairman of the District Court. The research method used combines normative and empirical approaches. The research focused on the High Court in the South Sulawesi region. The research subjects included all judges, including the Chief Justice, Registrar, and Substitute Registrar. The results of the study indicate that the implementation of internal supervision of the Chief Justice of the District Court is still ineffective in the implementation of civil case decisions that have permanent legal force. It is necessary to increase effective supervision over the implementation of decisions by the Chief of the District Court and a firm attitude is needed from the High Court and the Supreme Court as higher institutions in stages. In addition, opening up space for justice seekers to consider making extraordinary legal efforts, a better understanding of the types of decisions that can be executed, and solutions to legal obstacles that may arise in the execution process such as the establishment of regulations that can be used as legal instruments for resolving certain relatively complicated decisions, for the sake of justice, expediency and legal certainty in accordance with the value of justice for humanity.
