Abstract

Students face the rapid development of information technology to have such a huge impact in the social aspect of society. In the midst of the covid pandemic, the use of social media is increasing so that the frequency of students exposed to hoax information and potentially become hoax spreaders is getting bigger. This research is normative research with socio-legal science approaches, By looking at how the law regulates phenomena or events that occur in society. The Ministry of Communication and Information of the Republic of Indonesia has established a method of tracking hoaxers and has arranged sanctions for perpetrators of hoaxes in the Information and Technology Law.

Abstract

The dominance of systemic law in Indonesia which stems from Legal Positivism also affects the legal reasoning conducted by judges in court. Systemic law positions moral outside the law is failing to realize justice, this failure also affects the failure of legal reasoning by judge for cases in court. For this reason, it is necessary to change radically from systemic to non-systemic and also in legal reasoning by returning the law that is not value or moral free. This study aims to offer a change in systemic law to non-systemic law and how the value base in non-systemic legal reasoning. This study uses a philosophical approach that is by conducting an in-depth analysis of legal theories of Legal Positivism with theories of criticism of it in legal reasoning used by judges in court then for criticism in systemic legal reasoning the author tries to offer a non-systemic legal reasoning base with the ethical concept according to Imam Al-Ghazali.   Dominasi hukum sistemik di Indonesia yang berakar dari positivisme hukum mempengaruhi pula penalaran hukum yang dilakukan hakim di pengadilan. Hukum sistemik memposisikan moral di luar dari hukum  telah gagal mewujudkan keadilan, kegagalan ini berpengaruh pula pada kegagalan penalaran hukum terhadap kasus-kasus yang masuk ke pengadilan. Untuk itu perlu perubahan secara radikal dari hukum sistemik ke arah hukum non-sistemik termasuk pula dalam penalaran hukum dengan mengembalikan hukum itu tidak bebas nilai/moral basis nilai/moral. Penelitian ini bertujuan untuk memberikan penawaran perubahan hukum sistemik menjadi hukum non-sistemik dan bagaimana basis nilai dalam penalaran hukum non-sistemik. Penelitian ini menggunakan pendekatan filosofis yaitu dengan melakukan analisis secara mendalam terhadap teori-teori hukum Positivisme Hukum dengan teori-teori kritik terhadapnya di dalam penalaran hukum yang digunakan hakim di pengadilan kemudian atas kritik dalam penalaran hukum sistemik penulis mencoba menawarkan basis nilai penalaran hukum non-sistemik dengan konsep etika menurut Imam Al-Ghazali.

Abstract

Accessibility of education for people with disabilities has been guaranteed by Law no. 18 of 2016 concerning Persons with Disabilities. However, there is still a lot of data that shows that many children with disabilities do not have access to education, especially children with disabilities who are victims of violence, where in addition to having obstacles to their disabling condition, they also experience deep trauma but the trauma is not immediately known. This study will describe the barriers that occur for children with disabilities in getting access to education widely and what efforts can be made to fulfill the accessibility of education for them. This research methodology uses a qualitative and descriptive-analytical approach by taking the research location at the Aisyiyah Regional Leadership Council of Law and Human Rights, Central Java, which mainly assists children with disabilities who are victims of violence. In this study, it was found that there were obstacles experienced by children with disabilities in getting access to education, from the various obstacles that can be grouped into, barriers that come from parents, the community, government officials, educational institutions, and the children with disabilities themselves. and the efforts made to fulfill the accessibility of education for children with disabilities, namely consultation, investigation, profile assessment, physical healing, psychological healing, advocacy, home visits, psychological counseling, spiritual strengthening, and providing assistance.   Aksesibilitas pendidikan bagi difabel telah dijamin oleh UU No. 18 Tahun 2016 tentang Penyandang Disabilitas. Namun, masih banyak data yang menunjukkan banyak anak difabel tidak mendapatkan akses pendidikan apalagi anak difabel korban kekerasan, dimana selain mereka memiliki hambatan terhadap kondisi difabelnya itu sendiri juga mengalami traumatik yang mendalam tetapi tidak serta merta diketahui traumanya. Penelitian ini akan memaparkan hambatan-hambatan yang terjadi bagi anak difabel dalam mendapatkan aksesibilitas pendidikan secara luas dan upaya apa yang dapat dilakukan untuk pemenuhan asksesibilitas pendidikan bagi mereka. Metodologi penelitian ini menggunakan pendekatan kualitatif dan bersifat deskriptif analitis dengan  mengambil lokasi penelitian di Majelis Hukum dan HAM Pimpinan Wilayah ‘Aisyiyah Jawa Tengah yang banyak melakukan pendampingan terhadap anak difabel korban kekerasan. Dalam penelitian ini ditemukan adanya hambatan yang dialami anak difabel dalam mendapatkan akses pendidikan, dari berbagai hambatan tersebut dapat dikelompokkan menjadi, hambatan yang berasal dari orang tua, masyarakat, aparat pemerintah, lembaga pendidikan, dan dari diri anak difabel sendiri. dan upaya yang dilakukan untuk pemenuhan aksesibilitas pendidikan bagi anak difabel , yaitu konsultasi, investigasi, profile assesment, penyembuhan fisik, penyembuhan psikis, advokasi, home visit, konseling psikologi, penguatan spiritual, pemberian bantuan.

Abstract

This study examines how Jasser Auda’s maqāṣid asy-syarīʻah view sonchild protection as the basis for determining the age limit for marriage and how Jasser Auda’s maqāṣid asy- syarīʻah view son the philosophical and sociological foundations contained in the marriage age limit in Law No. 16 of 2019 This study uses a qualitative study with a descriptive analytical method with a philosophical and sociological approach. The results of this study indicatethat, First, Jasser Auda’s maqāṣid asy-syarīʻah view on child protection as the basis for determining the age limit for marriage, namely that Jasser Auda’s maqāṣid asy-syarīʻah theory shows that the goal of equalizing the marriage age limit contained in Law No. 16 The year 2019 refers to the concept of child protection as regulated in Law No. 23 of 2002 concerning Child Protection which includes the basic rights of children, the right to protection from violence and discrimination and full justice for children. Second, Jasser Auda’s maqāṣid asy-syarīʻah view of the philosophical and sociological foundations contained in the marriage age limit in Law No. 16 of 2019 using six features of the system theory that Jasser Auda optimized the results according to Cognitive, Openess, Wholeness, Interrelated Hierarchy, Multi Dimensionality and Porposefullnesis Law No. 16 of 2019 is in accordance with maqāṣid asysyarīʻah, realizing the goal of eliminating discrimination against women in accordance with the global era by reforming maqāṣid to wards Human Rights, creating equality between men and women, refers to the environment of society, nationandstate, such as upholding justice and tolerance, achieving a harmonious family.

Abstract

This research is focusing on its law and its consequences according to The Islamic Perspective. The aim of this study is to provide an overview of marital rape, why the phenomenon occurs, how the Islamic perspective on marital rape is, and what are the consequences based on the Islamic perspective are. This type of research is mixed between quantitative and qualitative by conducting library research. The results obtained from this study are that the cause of the phenomenon of marital rape is the COVID-19 pandemic, the absence of regulations governing marital rape, and the existence of assumptions or rules that require married women to obey their husbands. The Islamic perspective on one of the rapes in marriage is discussed in Q.S. An-Nisa '(4): 34. Furthermore, sanctions for the marital perpetrators according to The Islamic perspective, the perpetrator will be given ta'zir sanctions which have not been determined by syara'. So, the determination will be submitted to ulil amri or judges.

Abstract

This study aims to examine the strategy of the Islamic economic system in realizing the prosperity of the people in the modern era. This type of research uses a qualitative type with library research. While the research approach used is descriptive analysis. The data analysis used is using qualitative data analysis. The results show that the Islamic economic system in Indonesia has not shown good and significant results in realizing the prosperity of the people. So that it requires steps and strategies in developing sharia economics, namely first, strengthening in increasing public awareness regarding sharia economic literacy, increasing and empowering Human Resources both in quality and quantity, strengthening research and development (R&D) capacity. Second, Strengthening Fatwas, Regulations (Laws) and governance. Third, strengthening and expanding the halal network until the formation of halal in every region throughout Indonesia from upstream to downstream and the halal value chain. Fourth, strengthening the Islamic financial sector Strengthening the Islamic finance sector. Fifth, strengthening micro, medium and macroeconomic enterprises. Sixth, strengthening and developing a digital-based economy.

Abstract

This study aims to determine the practice of organizing tajdid marriages at the Taaruf Syar'i Bureau office, Sukoharjo district. In addition, the author also examines from the perspective of mas}lah}ah mursalah regarding what has been attempted by the Taaruf Syar'i Bureau Office in Sukoharjo Regency against interfaith couples in conducting tajdidun marriages. This research is a field research, which is a data collection technique carried out by means of field interviews by asking questions to married couples of different religions and collecting several other sources such as theses, theses, papers, journals, website articles, and news. To strengthen the research data, interviews were conducted with the head of the Ta'aruf Syar'i Bureau, Sukoharjo district, who gave a decision regarding the research title. The results of the researcher's analysis can be concluded that the Head of the Ta'aruf Bureau takes the Tajdid Nikah decision for married couples who initially marry in a Christian way and then want an Islamic marriage, in line with the mas}lah}ah mursalah principle, which is to continue their marriage and their marriage is legal in Islam. . With the Tajdid Marriage, the benefits taken are greater than the harm caused.

Abstract

The author's goal is to discuss the East Java Provincial Regulation Number 16 of 2012's review of maqasid asy-syariah  on sexual violence against women and children in order to provide an understanding of Islam in contemporary Islamic  discourse through maqasid asy-syariah, which includes humanitarian issues,  particularly for women and children. The community is obliged to comply with  regulations such as Regional Regulations (Perda) , despite the fact that there is no express instruction in the Qur’an or Hadith, even during the prophetic era. The need of comprehending maqasid asy-syariah in order to manage human life in order to maximize benefits and minimize harm. The data was analyzed using a descriptive-analytical method based on the maqasid asy-syariah theory. Data collection methods using library material and  previous study. The findings revealed that the Regional Regulation No. 16 of 2012, which  addressed the execution of the protection of women and children victims of  violence, gave attention to the maqasid asy-syariah issues that arose in the  community. This can be determined by referring to the regulation's "weighing" and "remembering" considerations. However, other aspects of the regional rule  are disregarded, such as Article 17's requirement to report sexual abuse against  women and children, for which they will face punishment as outlined in the  applicable laws and regulations.

Abstract

This articel discusses the theory of system and maqashid syari’ah which has been initiated improved by Jasser Audah in overcoming contemporary social problem. Accoding to Jasser, maqasyid syariah which emphezises porposefulness needs six fitures of way of thought those are cognition, holistic, openness, multidimensionality, interrelatedness and purposefulness. By those fitures, one can understand syariah proportionally and appropriately in solving recently problem.

Abstract

One of the methods to determine easily and accurately the qibla direction is by using the shadow of thing that leads to qibla direction. This method in Islamic astronomy is called as Raṣd al-Qiblat, and it has two kinds: that is, global and local Raṣd al-Qiblat. The focus in this study is the global Raṣd al-Qiblat. This method is chosen since it does not need the process of counting first, unlike the local Raṣd al-Qiblat. This global Raṣd al-Qiblat happens twice a year, on 28 May at 16:18 WIB and on 16 July at 16:27 WIB. The time taken in this study is on 16 July at 16:27 WIB. The problem raised in this study is how the accuracy of global Raṣd al-Qiblat as a method to determine the qibla direction, and how the limitation of time for the accuracy of this method applied in Indonesia. It can be concluded in this study that first, the global Raṣd al-Qiblat is an accurate method in determining the qibla direction. The Global Raṣd al-Qiblat on 16 July in 2022, 2023, and 2024 at 16:27 WIB with range ± 3 minutes is an accurate time for determining qibla direction. The most accurate time for global Raṣd al-Qiblat on 16 July 2022 for the western region of Indonesia or Java is at 16:25 WIB, on 16 July 2023 is at 16:26 WIB, and on 16 July 2024 is at 16:24 WIB.
