Abstract

Further and deeper research into the validity of the Retroactive Principle is required in order to provide assertiveness about the arrangement of Retroactive Principles in the field of agreement law in the Indonesian legal system, especially the Building Rights Agreement in Agrarian Law and the existence of obscure legal norms in the case of the legal Notary / PPAT to the granting right of building use for a period of validity is reviewed according to the provisions of Article 28 of Regulation of Head of National Land Agency Number 2 Year 2013 concerning the Delegation of Authority of Land Rights and Land Registration Activity and by using case approach of PT. Pan Pacific Nirwana Resort. This research is a normative legal research that is derived from the existence of obscurity of legal principle and legal norm contained in the provisions of Law Number 5 Year 1960 on Basic Agrarian Law Basic (UUPA) in the provisions of Article 30 and Article 28 Regulation of Head of National Land Agency No. 2 of 2013 on the Delegation of Authority of Land Rights and Land Registration Activities. The conclusion of this research in Agrarian Law there is legal uncertainty in the concept of law building rights agreement with a period of time that is still running and the future is approved by a new regulation by the government which caused the previous agreement to occur normatively contradictory whether using retroactive or non-retroactive principle and the validity of deed Notary / PPAT in the granting of right to building to limited liability company which is still valid time is reviewed according to UUPA, Article 28 Regulation of Head of National Land Agency Number 2 Year 2013 regarding Delegation of Authority of Land Rights and Land Registration Activity and Article 1320 Privat Law and by using approach case PT. Pan Pacific Nirwana Resort is not valid. Penelitian lebih lanjut dan mendalam terhadap keberlakuan Asas Retroaktif diperlukan dalam rangka memberikan ketegasan tentang pengaturan Asas Retroaktif [1] di bidang hukum perjanjian dalam sistem hukum Indonesia khususnya perjanjian Hak Guna Bangunan dalam Hukum Agraria serta masih adanya kekaburan norma hukum dalam hal keabsahan akte Notaris/PPAT terhadap Perseroan Terbatas dalam pemberian Hak Guna Bangunan yang jangka waktunya masih berlaku dikaji menurut ketentuan Pasal 28 Peraturan Kepala Badan Pertanahan Nasional Nomor 2 Tahun 2013 tentang Pelimpahan Kewenangan Pemberian Hak Atas Tanah Dan Kegiatan Pendaftaran Tanah serta dengan menggunakan pendekatan kasus PT. Pan Pasific Nirwana Resort. Penelitian ini merupakan penelitian hukum normatif yakni beranjak dari adanya kekaburan asas hukum dan norma hukum yang terdapat di dalam ketentuan Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-pokok Agraria (UUPA) dalam ketentuan Pasal 30 dan Pasal 28 Peraturan Kepala Badan Pertanahan Nasional No. 2 Tahun 2013 tentang Pelimpahan Kewenangan Pemberian Hak Atas Tanah Dan Kegiatan Pendaftaran Tanah. Kesimpulan dari penelitian ini dalam Hukum Agraria terdapat ketidakpastian hukum dalam konsep hukum perjanjian Hak Guna Bangunan dengan jangka waktu yang masih berjalan dan ke depannya di sahkan suatu peraturan baru oleh pemerintah yang menyebabkan perjanjian sebelumnya terjadi pertentangan secara normatif apakah menggunakan asas retroaktif atau non retroaktif dan keabsahan Akta Notaris/PPAT dalam Pemberian Hak Guna Bangunan terhadap Perseroan Terbatas yang jangka waktunya masih berlaku dikaji menurut UUPA, Pasal 28 Peraturan Kepala Badan Pertanahan Nasional Nomor 2 Tahun 2013 tentang Pelimpahan Kewenangan Pemberian Hak Atas Tanah Dan Kegiatan Pendaftaran Tanah jo Pasal 1320 KUH Perdata serta dengan menggunakan pendekatan kasus PT. Pan Pasific Nirwana Resort adalah tidak sah.

Abstract

Corruption is a special crime that has a negative impact on the survival of the nation and the state. corruption can occur everywhere / all levels. From this description, this study aims to analyze the verdicts of the Makassar District Court judges in cases of corruption. The problems that arise in this study are: What is the judge's verdict against the occurrence of criminal acts of corruption. The method used in this study is a normative legal research method by analyzing data descriptively-quantitatively. The results showed, first, the verdict was a very significant influence on the rampant cases of criminal acts of corruption, corruption cases increased from year to year. secondly, the judge's verdict in the case of corruption is strongly influenced by the demands of the prosecutor. Prosecutors 'demands and judges' verdicts are very low, so they do not provide a deterrent effect for perpetrators of corruption. This illustrates that the judge has not fully applied the punishment to the perpetrators of corruption in order to give a deterrent effect, because there are still many judicial verdicts that are lower than the demands of the public prosecutor. Korupsi merupakan tindak pidana khusus yang berdampak buruk bagi kelangsungan hidup berbangsa dan bernegara. korupsi dapat terjadi dimana-mana/semua level. Dari uraian tersebut penelitian ini bertujuan untuk menganalisis tentang vonis hakim Pengadilan Negeri Makassar pada perkara tindak pidana korupsi. Permasalahan yang timbul dalam penelitian ini adalah: Bagaimanakah vonis hakim terhadap terjadinya tindak pidana korupsi. Adapun metode yang digunakan dalam penelitian ini adalah metode peneltian hukum normatif dengan menganalisis data secara deskriptif-kuantitatif. Hasil penelitian menunjukkan, pertama, vonis hakim sangat berpengaruh signifikan terhadap maraknya kasus tindak pidana korupsi, kasus tindak pidana korupsi semakin meningkat dari tahun ke tahun. kedua, vonis hakim pada perkara tindak pidana korupsi, sangat dipengaruhi oleh tuntutan jaksa. Tuntutan jaksa dan vonis hakim sangat rendah, sehingga tidak memberikan efek jera bagi pelaku tindak pidana korupsi. Hal ini menggambarkan bahwa hakim belum sepenuhnya dalam menerapkan penghukuman kepada pelaku tindak pidana korupsi untuk memberi efek jera, karena masih banyak terdapatnya vonis hakim yang lebih rendah dari tuntutan jaksa penuntut umum.

Abstract

TRIPs requires members to arrange to any intellectual property rights in accordance with the conditions of each country, so that each state set the Geographical Indication (GI) varies. The different settings are potential conflicts between TRIPs member countries. So the research problem of this thesis is: How IG arrangements relating to cessation of the use of the registered mark is associated with a state's territory IG TRIPs Agreement? and legal actions for users How IG to a dispute between members of the TRIPs? Research using normative legal research methods approach: Statue Approach, Conceptual Approach, Comparative Approach, and Analytical Approach. Analysis of legal materials is done by descriptive analysis. The results showed that each WTO member countries set different. For example, the United States set up through the Trademark Law, Regulation & Legal ATF habits, countries under the European Union set up the European Community Regulation (EEC No.2081/92), Vietnam: Intellectual Property Law (Law No.50-2005-QH11), and others. In general, countries that determine protection through a first to file system. Abstract

Diplomacy as a means of communication made by various parties, including the negotiations between representations who have been recognized or defined as well as the negotiations when it was not possible to see a bright spot, the one party or two countries who consider necessary, can choose the path of another in the settlement of disputes. Regarding the case Montara, Indonesia can choose the legal path is through ITLOS. When all lanes closed negotiations and diplomacy, international legal channels under the umbrella of ITLOS is open for the settlement of cases of oil spills in the Montara platform. If ITLOS considered too early to have as a line dispute resolution, since the country rarely choose ITLOS as a settlement of the dispute, as evidenced since it entry into force (between 1994 to 2006), only 13 cases were handled by ITLOS, and in UNCLOS itself is possible for more flexible judicial selection and Arbitration still in the high demand. Diplomasi sebagai suatu cara komunikasi yang dilakukan oleh berbagai pihak termasuk negosiasi antara wakil-wakil yang sudah diakui atau yang diartikan pula sebagai perundingan-perundingan ketika sudah tidak memungkinkan untuk menemui titik terang maka salah satu pihak maupun kedua negara yang mengganggap perlu, dapat memilih jalur lain dalam penyelesaian sengketa. Berkaitan dengan kasus Montara, Indonesia dapat memilih jalur hukum yaitu melalui ITLOS. Bila semua jalur negosiasi dan diplomasi tertutup, jalur hukum internasional dibawah payung ITLOS terbuka untuk penyelesaian kasus tumpahan minyak di sumur Montara. Apabila ITLOS dianggap terlalu dini untuk dipilih sebagai jalur penyelesaian sengketa, karena memang negara jarang sekali memilih ITLOS sebagai tempat penyelesaian sengketa, terbukti sejak entry into force (diantara tahun 1994 sampai dengan tahun 2006), hanya 13 kasus yang di tangani ITLOS di dalam UNCLOS masih memungkinkan adanya pilihan peradilan yang lebih fleksbel dan lebih diminati oleh negara-negara yaitu Arbitrase.

Abstract

Anak sebagai generasi penerus bangsa harus dilindungi oleh pemerintah. Sistem Peradilan Anak yang ada di Indonesia saat ini belum dapat mencapai Restorative Justice dengan baik. Oleh karenanya diperlukan suatu ide baru seperti Children Hearing System. Children Hearing System adalah sistem perawatan dan keadilan khas Skotlandia untuk anak-anak dan remaja. Dalam Children hearing System, anak yang berhadapan dengan hukum tidak langsung berhadapan dengan proses peradilan. Penulis menggunakan metode penelitian Yuridis Normatif. Hasil Penelitian menunjukkan bahwa Children Hearing System merupakan upaya preventif agar anak tidak terjerumus untuk melakukan hal-hal yang melanggar hukum. Children Hearing System dapat menjadi ide pembaharuan dalam sistem peradilan pidana anak di Indonesia. Kata Kunci : Restorative Justice, Children Hearing, Sistem Peradilan Pidana Anak.

Abstract

This study specifically aims to assess synchronization and differentiation between the judge's decision, both horizontally and vertically, especially with regard todomestic violence cases. In addition, this study also intends to study about rule  whichare  applied by the Judges on the cases, and  reveal whether the  decision  under reviewreflects the gender justice This research is a legal normative research using case approach which wasexamined by studying the Judge’s decision in concrete cases, especially with regard todomestic violence. The number of decisions that were examined are six decisions whichconsists of three decisions of the District Court (Pengadilan Negeri) and  threedecisions  of the High Court (Pengadilan Tinggi). The decisions are determined bypurposive sampling.  Based on the analysis of the six decisions mentioned above ,  can be concludedas following:1)  The rule applied by the judge in hanling the concrete cases  regarding domestic violence particularly violence against women is on the Domestic Violence Act ( ActNo. 23/2004 ) with the application of a kind of sanction of imprisonment rangingfrom 1-3 months, that varied there the defendant was arrested some are droppedwith conditional (pidana bersyarat) (not being held prisoner) 2)  Among the three decisions of the District Court and the three decitions of the HighCourt which have analysed,  in one hand show synchronization and the other hand show differentiation.  In this case, synchronization and differentiation  can be seen vertically (between the District Court and the High Court decision), andhorizontally (between the District Court to each other) or between the decision ofthe High Court to each other).  3)  That the decision of the District and the High Court,  either have reflected gendersensitively and gender equity.

Abstract

Governance and development efforts to implement national and local levels can run smoothly largely depends on the perfection of the State apparatus, which in its function must be professional and neutral character of the influence of all groups and political parties, and does not discriminate in providing services to the community in order to realize the welfare of society. To realize the neutrality of the State Apparatus, the central government is trying to give a neutral space of the apparatus of government both at central and local levels, however, the reality is often found to realize it is not easy. Various allegations of lack of neutrality of State Apparatus including regional secretary still often expressed by the public, especially during the General Election of Regional Head and Deputy Head of the candidates came from previously elected regional head (incumbent). It is not separated from the vagueness of the norm (vogue norm), associated with the filling of the post of secretary of the province are included in the Position Leader High as stipulated in Article 19 paragraph (3) of Law No. 5 of 2014 on the Reform of Civil State, stating for High leadership positions defined competency requirements, qualifications, rank, education and training, track record position and integrity, as well as other necessary requirements. The above provisions are not clear in stating the requirements that must be met by candidates for secretary of the province to ensure neutrality. This study is a normative law research that examines the ingredients literature that primary legal materials and secondary law. This study uses the approach of legislation and approach the concept. In the data collection is done by steps searches theories, concepts, principles, and an inventory of rule of law relating to the research problem. The conclusion relating to the cases in this study, namely charging Position Leader Higher done in an open and competitive among Civil Servants by taking into account the requirements of competence, qualifications, rank, education and training, track record positions, and intergitas and other requirements needed in accordance with the legislation reflects to realize the secretaries of provincial officials were neutral.

Abstract

The title of this research is: “The Equal Trearment of Parties in the Proceedings of the Business Competition Dupervisory Commission in the Perspective of Indonesia Procedural Law Courts. The Right to equal treatment also contains in the principle of hearing the opinions or arguments of other parties before the judge handed down the verdict; it must be carried out in the litigation. The unequal position of the parties in the hearing of the Business Competition Supervisory Commission will cause problems in seeking justice. What is the position of decision of the Business Competition Supervisory Commission in terms of the legal system of justice in Indonesia ?; and What is the legal protection against the reported party, when he/she is not getting the right to equality of treatment in the proceedings in the KPPU?. The research was a normative legal research that consisted of research on the systeamtics of law, the synchronization of law, legal history. Which resulted from the confict of law governing the legal status of the KPPU decision; and the void of law in the way of the litingants in the litigation procedure of KPPU. The results of this research showed that (1) The Legal position of Business Competition Supervisory Commission’s decision in the law of court procedure is that the decision of KPPU as a quasi judicial decision of which the law procedure is made on its own that is called Case Handing Procedures at the KPPU; in addition to the Law of Civil Procedure Code. (2) The from of legal protection for businesses as the reported party could be sacrificed because of the absence of clear rules regarding the from of the formulation of legal protection in the proceedings of the on the unequality of treatment of the reported party. Judul penelitian ini adalah: “Persamaan Perlakuan Para Pihak Dalam Beracara Di KPPU Dalam Perspektif Hukum Acara Peradilan Indonesia. Hak atas perlakuan yang sama  mengandung prinsip mendengarkan juga pendapat  atau argumentasi pihak yang lainnya sebelum hakim menjatuhkan putusan, wajib dilaksanakan dalam berpekara. Tidak seimbangnya posisi dari pihak-pihak yang berperkara dalam persidangan KPPU akan menimbulkan masalah dalam mencari keadilan. Bagaimana kedudukan Putusan Komisi Pengawas Persaingan Usaha ditinjau dari sistem hukum acara peradilan di Indonesia?; serta bagaimanakah bentuk perlindungan hukum terhadap terlapor, apabila terlapor tidak mendapatkan hak atas persamaan perlakuan dalam beracara di KPPU?. Jenis penelitian ini adalah penelitian hukum normatif mencakup penelitian terhadap sistematika hukum,  sinkronisasi hukum, sejarah hukum, yang beranjak dari konflik norma yang mengatur mengenai Kedudukan hukum putusan KPPU; dan norma kosong dalam tata cara berperkara di KPPU. Hasil penelitian ini menunjukkan bahwa (1) Kedudukan hukum putusan Komisi Pengawas Persaingan Usaha dalam hukum acara peradilan adalah putusan Komisi Pengawas Persaingan Usaha sebagai putusan quasi judicial dengan hukum acara yang dibuat sendiri yang disebut Tata Cara Penanganan Perkara di KPPU; disamping Kitab Undang - Undang Hukum Acara Perdata. (2) Bentuk  perlindungan hukum bagi pelaku usaha sebagai terlapor masih belum diatur secara tegas sehingga mengandung potensi bahwa pihak terlapor dapat dikorbankan karena ketiadaan aturan yang jelas mengenai bentuk formulasi perlindungan hukum dalam beracara di KPPU atas di korbankannya hak atas persamaan perlakuan dari terlapor.

Abstract

The threat to agrarian culture values which that why becomes investment object of itself tourism, marked practice of investment of tourism denying cosmology Tri Hita Karana. In other words, implementation of the development of investment of tourism through an institution of investment law in Province of Bali looks on inconsistent applying of law which ended at becoming disappears it itself culture tourism. The investment performance of Tourism in Province of Bali spelled out members hardly phenomenal, followed by the destruction of a norm, structural and source of economics as a result of arranging value liberalistic and individualistic sticking at investment law, with ideology Tri Hita Karana placing forward togetherness principles and balance, runs with the logic is himself. Tourism in Provinsi Bali, which is a manifestation of ideology value totality Tri Hita Karana, where culture is the main specification besides geographical uniqueness and life of its the rituality. Tri Hita Karana becomes a kind of commitment of value about understanding about life, how life must be experienced, and leading base consensus coexists. The arrangement of investment law is not accommodated to this Tri Hita Karana ideology, even in By Law and also development philosophy Province of Bali is affirmed Tri Hita Karana is development manual of Bali in general, and or especially expansion philosophy of cultural tourism. As a result, where ever is happened inconsistency law applying, is beginning from regulation of investment law which just making account of vertical synchronization with higher level regulation or which below his its, and harmonization with regulation on an equal. Objek investasi pariwisata di Bali yang sesungguhnya berakar dari nilai-nilai budaya agraris semakin terancam terlihat dari praktik investasi pariwisata yang semakin inkonsisten dengan fisolofi Tri Hita Karana. Tulisan ini bertujuan untuk mengkaji keberadaan hukum investasi dalam pembangunan investasi pariwisata di Bali dalam kaitannya dengan nilai-nilai dan prinsip Tri Hita Karana. Metode yang dipergunakan adalah metode penelitian hukum doktrinal, dengan pendekatan perundang-undangan serta pendekatan konsep, serta dianalisis secara kualitatif. Hasil studi menunjukkan bahwa pembangunan investasi pariwisata di Provinsi Bali inkonsisten dengan nilai filosofi Tri Hita Karana, yang ditandai kian menghilangnya pariwisata budaya itu sendiri. Capaian investasi pariwisata di Propinsi Bali yang sangat fenomenal, diikuti oleh keberantakan nilai, norma, struktur dan sumberdaya ekonomi akibat tata nilai liberalistik dan individualistik yang melekat pada hukum investasi. Filosofi Tri Hita Karana mengedepankan prinsip-prinsip kebersamaan dan keseimbangan, sudah seharusnya kepariwisataan di Bali dengan budaya sebagai kekhasan utama, keunikan geografis, dan kehidupan ritualitasnya konsisten dengan Tri Hita Karana. Tri Hita Karana menjadi semacam komitmen nilai tentang pemahaman mengenai hidup, bagaimana hidup harus dijalani, serta konsensus dasar yang menuntun hidup bersama. Pengaturan hukum investasi tidak akomodatif terhadap ideologi Tri Hita Karana., meskipun dalam Peraturan Daerah maupun falsafah pembangunan Provinsi Bali ditegaskan Tri Hita Karana merupakan penuntun pembangunan Bali. Akibatnya, terjadi inkonsistensi penerapan hukum, yang bermula dari regulasi hukum investasi yang hanya sekedar mementingkan sinkronisasi vertikal dengan peraturan yang lebih tinggi atau di bawahnya, dan harmonisasi dengan peraturan perundangan sederajat. Solusinya, penting adanya konstruksi hukum Peraturan Daerah semi-otonom.

Abstract

Transportation plays an important role in supporting, improving and enhancing the economic development both regionally and nationally. The need for services is increasing traffic, limiting the number of motor vehicles as much growing from year to year in Denpasar City causes unbalance between the number of vehicles available with the road infrastructure are available and also increase the traffic accident per year. Accidents in the road are usually caused by motor vehicles. In this case largely due to technical factors and not roadworthy. The issues examined are how is the implementation of the motor vehicle feasibility test in Denpasar City and whether is the implementation of vehicle testing already able to realize the safety of traffic in Denpasar City. The research was classified into empirical legal research of the descriptive analysis research using primary and secondary data. Transportasi memainkan peran penting dalam mendukung, memperbaiki dan meningkatkan pembangunan ekonomi baik di tingkat regional maupun nasional. Kebutuhan akan layanan lalu lintas semakin meningkat, jumlah kendaraan bermotor bertambah dari tahun ke tahun di Kota Denpasar sehingga menyebabkan ketidakseimbangan antara jumlah kendaraan yang dengan infrastruktur jalan dan juga meningkatkan kecelakaan lalu lintas per tahun. Kecelakaan yang terjadi di jalan biasanya disebabkan oleh kendaraan bermotor, dalam hal ini sebagian besar dikarenakan dari faktor teknis dan tidak layak jalan. Permasalahan yang diteliti adalah Bagaimana pelaksanaan uji kelayakan kendaraan bermotor di Kota Denpasar dan Apakah pelaksanaan pengujian kendaraan bermotor sudah dapat mewujudkan keselamatan berlalu lintas di Kota Denpasar. Penelitian ini diklasifikasikan ke dalam penelitian hukum empiris dari penelitian analisis deskriptif dengan menggunakan data primer dan data sekunder.
