Abstract

Renewal of the Wetboek van Koophandel (KUHD) is a Dutch colonial products a lot of problems. Although it has been stated in the National Legislation Program (Prolegnas) 2009 - 2014, but the number of regulations that have been removed from the KUHD, make arrangements of commercial law substance of overlapping, contradictory and theres a double substance. Therefore, to use renewal by the compilation method will be very ineffective, because when done harmonization, the many provisions that will be removed for united. When using the compilation method, will be in trouble to do the grouping of the material. Other methods are consolidated with Civil Code (KUHPerdata) Book III, to unify the principles and legal principles of legal trade into the agreements of law.

Abstract

Islamic jurisprudence see that sexual desire is a human base, a natural power that is in a human. So, islamic jurisprudence regulate a human biological sexual desire channel by a marriage, and they don't agree a sexual deviation, such as homosexual. Homosexual is a bad behaviour that is prohibited in islamic jurisprudence based on al-Quran and hadis. Scribes of islamic jurisprudence agree to forbid homosexual, although there are so many opinion about law sanction for them. Some of the scribes say that they have to be killed, have to be punished, such as a judgement for they commit an adultery, and even they say that homosexual will be punished in jail (ta'zir).

Abstract

Metode sufi yang berpijak pada kualifikasi dan pengetahuan hati, berkonsekuensi pada perhatian dan penekanan sufi pada aspek batiniah atau sisi spiritual dari sesuatu. Penerapan metode ini terhadap hukum merupakan kajian yang masih baru. Dalam hal ini, Ibn Arab adalah pemikir sufi komprehensif yang telah menerapkan metode spiritual dalam bidang hukum, begitu lengkap, sistematis, dan yang paling konsisten. Pada tataran praktik agama dalam bentuk fikih, metode spiritual Ibn Arab menawarkan tuntutan untuk merengkuh kesucian hati sebagai substansi dan makna hakiki ibadah dan hukum. Pada tataran kaidah hukum, metode dan pendekatan spiritual-batiniah Ibn Arab menghasilkan doktrin Kasih Sayang Tuhan dalam Hukum, yang mengimplementasikan diri dalam bentuk kaidah kemudahan dalam hukum. Sementara dalam teori hukum, pendekatan spiritualnya membentuk rumusan tentang kedudukan hati sebagai sumber hukum, yang intinya bermuara pada tuntutannya untuk menghasilkan hukum yang melibatkan hati nurani dan menjalankan hukum dengan pelibatan penghayatan terdalam pada makna hakiki hukum.

Abstract

Sebagai sebuah produk keilmuan hukum Islam, produk perbankan syari'ah, semestinya merupakan hasil dari interpretasi sebagaimana yang diharapkan dalam teori interpretasi yang, atau berangkat dari kenyataan dan kebutuhan pasar. Pada interpretasi tingkat kedua, yaitu tingkat aplikasi lembaga keuangan syariah interpretasi tertumpu pada dua metode, yaitu akomodatif dan asimilasi. Kedua metode ini, khususnya akomodatif, selama beberapa tahun terakhir tidak dapat memposisikan lembaga keuangan syariah sebagai lembaga keuangan yang berbasis theologies, akan tetapi sebaliknya justru dipersamakan dengan produk-produk konvensional. Sehingga metode yang ditawarkan dalam pengembangan produk perbankan syariah di masa-masa mendatang adalah dengan menggunakan metode tanpa batas (boundless). Di mana metode boundless berakat dari tuntutan dan kebutuhan masyarakat, kemudian dilakukan penelaahan untuk menetapkan kerangka akad yang dapat dipergunakan dalam memenuhi kebutuhan pasar tersebut.

Abstract

The shifts of Islam politics in Malaysia are very interesting to watch and observe, especially the political phenomenon done by UMNO and PAS. UMNO as the ruling party which is Malay-and-Islam-based is competing hard with PAS as the opposition which is also Malay-and-Islam-based. These two parties underwent political shifts as the political dynamics happened in society. UMNO was at first known as a secular party supported by the elite of the party having western education background. In its development, UMNO shifted into a party with many policies that somewhat benefited Malay ethnic and the Muslims. This shift, which benefited the Muslims and Malay ethnic, happened in the era of Mahathir Mohammad.

Abstract

Pada era pemilihan kepaladaerah langsung, Kiai sebagai elit lokal mempunyai nilai yang sangat berarti bagi calon pemimpin daerah. Dengan basis massa riil, Kiai dengan simbol-simbol agama merupakan modal yang signifikan dalam mendulang suara menuju kemenangan, terutama dalam rangka memobilisasi massa. Hal ini dikarenakan salah satu tugas pokok dalam rekruitmen politik adalah bagaimana elit yang ada dapat menyediakan kader-kader parpol berkualitas untuk duduk, terutama di kursi eksekutif maupun legislatif. Tarik-menarik kepentingan antara kandidat dan Kiai menjadi hal yang wajar. Kiai, dengan kharismanya mampu memobilisasi massa, sebaliknya kandidat pemimpin daerah mampu memberi berbagai fasilitas kepada Kiai.

Abstract

Hazairin is one of the pioneers who initiated the importance of  Islamic  law  with  Indonesian  pattern.  Even,  he  viewed  the importance  of  the  new  school  (mazhab)  in  Islamic  law,  namely  the Indonesian  mazhab. However, Hazairin’s thought on the methodology of ijtihad, as a basis for the establishment of a school of Islamic law, has not  been  widely  studied.  His  thought  which  was  more  studied  is  the idea  of  the  Indonesia  mazhab and  also  about  inheritance  law.  This article  specifically  explores  the  framework  of  Usul  Fiqh  proposed  by Hazairin. Epistemologically, the main topic of Usul Fiqh is about the sources of Islamic law and the method of how to formulate Islamic law from  the  source.  Therefore,  this  article  examines  Hazarin’s  thought about the two things, namely the sources of Islamic lawand its legal formulation method. From the study done, both on the  sources of law and Islamic law formulation method, Hazarin put the role of ulu al-amri (government, policy  makers)  in  a  strategic  position.  The  method  of legal formulation done by  ulu al-amrirequires  musyawarah(discussions), which  involves  jurists  and  other  relevant  scientific  experts  (collective ijtihad).  Results  of  ijtihad decided  by  ulu  al-amri will  automatically become binding formal rules of law, so that if the resultsof ijtihad is followed  and  practiced  by  the  public  widely,  it  will  become  a new school of Islamic law, namely the Indonesian mazhab.

Abstract

Through the Ministry of Religion, the government has drafted the legislation of law in the Religion Courts Subject about Marriage that discusses about unregistered marriages, polygamy, and marriage contract (mutah) as a complement of the Law No. 1/74 on Marriage. In the Article 143 of the draft mentioned the punishment for unregistered marriage, punished with a maximum fine of 6 million or imprisonment up to 6 months. The result of unregistered marriage inferential as follows: 1) there are legal and illegal unregistered marriage. It was to be plural or usual in society because a numbers of factor. 2) The assumption that seeing it as illegal and did not has a force of law looking for argumentation (istidlal) using qiyas method for equating record of ilan and wedding party, getting bennefit and li saddi az-zariah. 3) Criminalizing perpetrators of unregistered marriages through the provision of a prison sentence does not need to include Article 143 and Article 151, because marriage records violation is not a criminal act, only an administrative violation. 4) The actors of unregistered marriages can be punished a criminal fine in order to provide teaching and education. 5) Looking for argumentation using qiyas method on the ilan and wedding party are not relevan, because ilan and wedding party are sunnah. Even less the reason of consequence still an assumsion and does not muktabarak. On that account, would be not appropriate if the registration of marriages entered one of the pillars of marriage. 6) Sollution of the unregistered marriage case fine polygamy or monogamoy is marriage itsbat which there should be no provision prison sentence.

Abstract

Sharia economy has an economic system characteristics that it is own economic system, can be said to have differences with other economic systems. All facilities and infrastructure that is used to obtain the necessities of life in the world is not solely oriented to the life of the world alone but are closely related to the afterlife. While other economies; capitalist and socialist economies are solely oriented to the life of the world alone. Shariah economic rationality can be seen on the economic principles of Sharia and the basic principles of system used. Principle - the principle of Islamic Economics, are the justice and sociological value of wealth. The basic principle of Islamic banking system is profit-sharing system as an alternative. Capitalist economic system which gives freedom to every individual to exploit the earth. The capitalist system has several indicators; No uniform, no harmony, con-profit, materialistic, moral crisis, aside Welfare. Socialist Economic System are all forms of production and sources of revenue to the state-owned and regulated by the state then, used to all the people. There is no free will on economic system of society that it is contradiction to the human right it shelf.

Abstract

Hukum mahar dalam kajian fiqh munakahat adalah wajib. Persoalan kualitas dan kuantitas mahar itu sendiri dalam realitas masyarakat muslim sangat beraneka ragam. Pertanyaannya kemudian adalah kualitas dan kuantitas mahar itu dipahami. Pada masa Nabi Saw persoalan ini pernah muncul di tengah masyarakat ketika itu. Peristiwa tersebut diriwayatkan oleh Sahl bin Sad. Ulama yangmemahami hadis ini secara tekstual berkesimpulan bahwa batas minimal kuantitas mahar adalah cincin besi atau yang senilai dengannya, dengan kualitas sesuatu yang dapat diambil manfaatnya. Sedangkan ulama yang melihat hadis ini dalam kaitannya denganasbab al-Wurudnya kemudian melahirkan pendekatan kontekstual berkesimpulan bahwa batas minimal kuantitas sebuah maharadalah senilai dengan nisabpotong tangan, sedangkan cincin besi adalah batasan minimal untuk maharyang disegerakan. Sedangkan ulama lainnya yang memasukkan pengajaran al-Quran dapat dijadikan sebagai maharberkesimpulan bahwa batas minimal kuantitas maharadalah tidak terbatas, selama ada kerelaan, keridhaan dan kesepakatan antara kedua belah pihak yang yang melakukan akad.
