Abstract

This study was intended to explain the phenomenon of identity politics and political dynasties in the holding of simultaneous elections in 2020. The focus of this study was looking at the issue of identity politics and political dynasties in several regions, including Solo, Medan, South Tangerang, and Central Kalimantan, which were case studies of identity politics and political dynasties issue in the 2020 elections. This research used a type of qualitative research with a descriptive approach. Data was obtained through literature studies by looking at previous research based on the same topic and news in the mass media about the issue of identity politics and political dynasties. The study found that identity politics and political dynasties still occurred in some regions, i.e., in Solo, Medan, South Tangerang, and Central Kalimantan. In addition, hate speech, black campaigns, and hoax issues had sprung up with different models through social media and billboards.

Abstract

This study aimed to produce appropriate, attractive, and effective learning media for Pancasila and Citizenship Education to improve students' critical thinking skills. The development procedure was carried out according to the Thiagarajan 4-D Model. The test subjects in this study were VIII grade students of the Laboratorium Malang Junior High School. Media validity was known from the results of media expert validation by 97.5 percent and material expert validation by 92.5 percent, and the attractiveness of media based on a questionnaire obtained by 90 percent.  The civic ladder snake learning media was able to improve students’ critical thinking skills because the post-test results were higher than the pretest results. The critical thinking ability average of students on the large-scale test increased from 38.7 percent to 87 percent. So, there had been a significant change in students’ critical thinking skills after the implementation of the civic ladder snake learning media. The civic ladder snake learning media were valid, attractive, and able to improve students’ critical thinking skills.

Abstract

This study aimed to analyze the liability of land deed officials in Decision Number 179/Pid.B/2015/PN.Sungguminasa and legal protection for land deed officials for criminal acts of embezzlement committed by employees. The method used in this study was normative juridical with a case approach and a statutory approach. The accountability of the land deed official in Decision Number 179/Pid.B/2015/PN.Sungguminasa related to the criminal act of embezzlement by his employees was completed in an authentic deed belonging to the aggrieved appeared by bearing all the administrative costs. Legal protection for land deed officials for criminal acts of embezzlement committed by their employees was categorized in preventive and repressive legal protections. Preventive legal protection was guided by Article 55 paragraph (1) of the Criminal Code, which stated that a crime could be given to a party who commits, orders, and participates in committing a crime. Repressive legal protection was guided by Article 50 paragraph (1) of the Regulation of the Minister of Agrarian Affairs and Spatial Planning Number 2 of 2018, which stated that ministries, assemblies, or organizations of the Association of Land Deed Makers might provide legal assistance to land deed officials whom investigators summon.

Abstract

This study aimed to analyze the fundamental values of peace education and the implementation of the fundamental values of peace in Pancasila and Citizenship Education learning and its obstacles. This study used a descriptive qualitative approach to find out and describe the meaning behind implementing the basic values of peace. The fundamental concept of peace education consisted of twelve values, namely: (a) self-acceptance, (b) prejudice, (c) ethnic differences, (d) religious differences, (e) gender differences, (f) differences in economic status, (g) group differences, (h) diversity, (i) conflict, (j) reject violence, (k) admit mistakes, (l) forgive. Implementing the fundamental values of peace in learning was done by modifying the Learning Implementation Plan, models, media, and teaching materials according to reality or factual nature. Barriers to the implementation of the basic values of peace in learning were related to the ability of teachers to understand the fundamental values of peace, the low interest in student learning, and the lack of facilities and infrastructure to support the learning process.

Abstract

This study aimed to describe the application of Pancasila Education, Citizenship Education, and Pancasila ideology attitudes among students and analyze the effect of Pancasila Education and Citizenship Education courses on students' Pancasila ideological attitudes. This study used quantitative methods to test specific theories by examining the effect of one variable on another. Implementation of Pancasila Education among students was included in the effective category because it had an average frequency distribution of 3.77. The implementation of Citizenship Education among students was included in the effective category because it had an average frequency distribution of 4.01. The Pancasila ideology attitude among students was included in the effective category because it had an average frequency distribution of 3.70. The subjects of Pancasila Education and Citizenship Education significantly influence the attitudes of students' Pancasila ideology. The Pancasila Education course had a non-dominant influence on students' Pancasila ideological attitudes with a relationship of 61.9 percent, while Citizenship Education had a dominant influence on students' Pancasila ideological attitudes with a relationship of 71.8 percent.

Abstract

The purpose of this study was to analyze the philosophical basis and implications of the Decision of the Main Assembly of Bali Pakraman Village Number 01/Kep/Psm-3/MDP Bali/X/2010 on the position of Balinese women in the family and inheritance. This study used a normative juridical method with a philosophical and conceptual approach, which discussed legal rules or regulations as a system associated with legal events. The study results showed that the philosophical basis for the Decision of the Main Assembly of the Bali Pakraman Village Number 01/Kep/Psm-3/MDP Bali/X/2010 was a patrilineal system Balinese society which did not provide opportunities for Balinese women to become heirs. The implication of the decision of the Main Assembly of the Bali Pakraman Village Number 01/Kep/Psm-3/MDP Bali/X/2010 was the realization of gender equality between Balinese men and women in obtaining rights, although with different amounts of inheritance.

Abstract

This study aimed to analyze the legal principles in executing material guarantees and legal protection for fiduciary creditors to repay their receivables after issuing Constitutional Court Number 18/PUU-XVII/2019. This study used a statutory, conceptual, and case approach with a normative juridical type of research. The results of this study indicated that the legal principles in executing material guarantees after the decision of the Constitutional Court Number 18/PUU-XVII/2019 had changed regarding the executorial title, which was initially in the Grosse deed, into a guarantee certificate. According to the Constitutional Court, norms change did not provide justice, so the executorial title on the fiduciary guarantee certificate did not apply. Legal protection for fiduciary creditors to obtain repayment of their receivables after the decision of the Constitutional Court did not have legal certainty for interested parties.

Abstract

This study aimed to describe the Pancasila and Citizenship Education study students' knowledge about the position of Pancasila as the state's basis and the true theory, students' views regarding the truth of Pancasila as the basis of the state, and efforts to improve the quality of the truth of Pancasila as the state's basis from the perspective of students. This study used a qualitative approach with a descriptive type of research. The technique of collecting data was through interviews conducted in discussions. Data analysis used data reduction techniques, data classification, data triangulation, data confirmation, and conclusions. The study results showed that students knew Pancasila as the basis of the state and the theory of truth of coherence, correspondence, pragmatism, and performative. Students' views on the five values of Pancasila were not implemented by Indonesian society and have not been fully beneficial in all areas of state and social life. Efforts to improve the quality of the truth of Pancasila as the state's basis could be made by increasing understanding of the five precepts of Pancasila, improving the curriculum, approaching all scientific fields, and forming a community of civilizing Pancasila values.

Abstract

This study aimed to analyze the limits of the meaning of the technical error phrase in Article 57 paragraph (2) of Government Regulation Number 80 of 2019 on the validity of electronic contracts and analyze legal protection for business actors, system makers, and recipients of goods/services related to the phrase technical error in Article 57 paragraph (2) Government Regulation Number 80 of 2019. This study used a normative juridical method with a statutory and analytical approach. The results showed that the technical error phrase in Article 57 paragraph (2) of Government Regulation Number 80 of 2019 contained the meaning of default, resulting in the electronic contract being null and void. Legal protection for business actors was included in Article 6 of Law Number 8 of 1999, in the form of guarantees for self-defense when a dispute occurred due to consumers who had bad intentions. Article 12 of Law Number 19 of 2002 explicitly explained that computer programs were one of the protected copyrighted works. It was legal protection for system makers. Legal protection for recipients of goods/services was contained in Article 46 of Law Number 8 of 1999, in the form of guarantees of justice related to the quality of the product received.

Abstract

One of the problems encountered during the learning process was the low ability to speak in front of the class. This study aimed to improve speaking skills using the storytelling learning model in Pancasila and civic education subjects. This study was a second-cycle class action research consisting of four phases: planning, implementation, observation, and reflection. Data analysis in this study was carried out through three stages, namely data reduction, data presentation, and conclusions. The analysis results found an increase in students' speaking ability at each meeting. It had proved that students' speaking ability in Pancasila and Citizenship Education subjects increased with the application of the storytelling learning model.
