Abstract

This study aims to analyze the arrangement of the green economy concept in the regulation of new renewable energy, the construction of the application of economic analysis of law in the regulation of the green economy in the regulation of new renewable energy, as well as the principle of green constitution in the transition to new renewable energy. This study used a normative juridical research method with a legislative approach and a conceptual approach. The results of the study indicate that the regulation of new renewable energy requires a special law that regulates comprehensively based on the principles of a green economy. The construction of new renewable energy law through the application of the concept of economic analysis of law is expected to be able to contain values, efficiency, and used that can provide benefits for the economy and environmental sustainability. Article 33 paragraph (4) of the 1945 Constitution of the Republic of Indonesia affirms the principle of just and environmentally friendly economic democracy as the basis of a green constitution for the application of new renewable energy

Abstract

This study aims to analyze the essence of professor and doctoral degrees in academia and the relationship of academic degrees as a capital commodity favored by politicians from Pierre Bourdieu’s perspective. The method in this study is a literature study carried out systematically through the stages of topic identification, collection of relevant literature, critical analysis of content, and compilation of results in a narrative framework. Data were collected from various sources such as journal articles, books, and relevant academic documents. Data analysis was carried out by deeply examining the arguments in the literature. The results of the study show that doctoral and professorial degrees are ethical achievements awarded by higher education institutions to individuals after meeting academic and pedagogical standards. Academic degrees have now become economic commodities for politicians to perpetuate domination. Academic degrees based on Pierre Bourdieu’s perspective can be understood as a form of symbolic capital that is often used to strengthen positions in social and political structures. The commodification of degrees not only reduces the intrinsic value of academic degrees, but also reduces public trust in the higher education system.

Abstract

The objective of this study is to analyze the formal requirements for filing a petition to annul the results of regional head elections and to examine the issues surrounding the application of the vote margin threshold in resolving disputes over regional head election results. This study employs a normative legal research method, using a statutory, conceptual, and case approach. The findings indicate that a petition for the annulment of regional head election results must satisfy two requirements, namely the existence of discrepancies in vote calculations between the election organizers and the petitioner, and the fulfillment of the vote margin threshold ranging from 0.5 percent to 2 percent as stipulated in Article 158 of Law Number 10 of 2016. The implementation of simultaneous regional head elections from 2015 to 2024 has generated a significant number of disputes totaling 743 registered cases. The Constitutional Court has demonstrated inconsistency in applying the vote margin threshold, as 24 out of 181 accepted cases did not meet the required percentage. The Constitutional Court's decision to accept cases that failed to meet the vote margin threshold is considered to deviate from the principle of legal certainty.

Abstract

This study aims to analyze the political preferences of voters with disabilities in general elections and the determinants of their political preferences. This study used qualitative methods with a descriptive approach. Data collection techniques include observation, interviews, and documentation. Data analysis used an interactive model that includes data reduction, data presentation, and drawing conclusions or verification. The results of the study indicate that political preferences are born from values as a basis, perceptions are formed through direct experience and interaction with the political environment, and tendencies are reflected in participation patterns and satisfaction with democratic mechanisms. Political preferences of voters with disabilities are influenced by ideological values formed from educational background, social class, and religious affiliation. While group identity plays a role in strengthening solidarity, forming a sense of attachment, and directing political choices according to the common interest. Political preferences of voters with disabilities are not simply personal choices, but rather the result of the interaction between values, perceptions, and tendencies influenced by ideological values and group identity to strengthen political orientation.

Abstract

This study aims to identify the urgency of implementing a Public Service Mall in the context of Indonesian bureaucracy and the challenges of implementing it in light of Presidential Regulation Number 89 of 2021. This study used a normative juridical method with a descriptive qualitative approach, focusing on the analysis of secondary legal materials such as laws and regulations, official documents, and other legal literature. Data collection techniques in this study were conducted through library research. Data analysis in this study uses qualitative normative techniques to interpret legal provisions and examine their legal implications. The Public Service Mall is a strategic innovation aimed at improving the effectiveness, efficiency, and quality of public services. The implementation of the Public Service Mall in practice still faces various challenges, such as inter-agency coordination, infrastructure readiness, and service system integration. The success of the Public Service Mall requires ongoing commitment and synergy from all stakeholders to realize modern, transparent, and adaptive public services.

Abstract

This study aims to describe the complete systematic land registration program, including its legal basis, procedures, and obstacles and solutions in its implementation. This study used an empirical legal study method that refers to secondary and primary data. The results of the study indicate that the complete systematic land registration program is based on Law Number 5 of 1960 concerning Basic Agrarian Principles and Regulation of the Minister of Agrarian Affairs and Spatial Planning or the Head of the National Land Agency Number 6 of 2018. The implementation of the complete systematic land registration program includes location and budget preparation, collection of physical and legal data, bookkeeping and certificate issuance, and certificate delivery. Obstacles in the implementation of complete systematic land registration in Cibinong District include a lack of public understanding, differences in land area, limited land history data, and the existence of absentee land. Solutions to overcome obstacles in the implementation of complete systematic land registration include strengthening governance through outreach and cross-agency coordination, structuring transparent financing mechanisms, and updating land data through re-measurement and integration of digital land plot maps.

Abstract

The purpose of this study is to analyze the concept of asymmetric decentralization and the implications of implementing asymmetric decentralization in the context of moving the national capital from Jakarta to Ibu Kota Nusantara. This study used a normative juridical method with a legislative approach and a conceptual approach. The results of the study show that asymmetric decentralization as applied in Indonesia can be seen in the efforts to relocate the national capital as regulated by Law Number 2 of 2024. The relocation of the national capital from Jakarta to Ibu Kota Nusantara leads to the concept of functional asymmetric decentralization, which emphasizes the division of power based on function and productivity rather than geographical boundaries. The relocation of the capital from Jakarta to Ibu Kota Nusantara has implications for governance, triggering various problems, including infrastructure and resource capacity imbalances, the emergence of social polarization and urban gentrification, and overlapping authorities and policies due to the absence of a legal framework that explicitly regulates coordination between Jakarta and Ibu Kota Nusantara.

Abstract

This article aims to analyze the political and governmental strategies implemented by traditional states in Nusa Tenggara in dealing with internal and external dynamics in the past. This study discusses the patterns of adaptation and political maneuvers carried out by local kingdoms such as Larantuka and Lombok in maintaining sovereignty, while managing relations with external powers, including European colonialism and regional trade networks. The approach used is historical-critical to identify the strategies applied in military power, diplomacy, strategic alliances, and traditional bureaucratic reforms to enhance the effectiveness of governance. The f indings reveal that cultural adaptability and the utilization of local resources are key factors in the success of traditional states in the archipelago. The contribution of this study is providing an understanding of regional political history and its relevance in the context of managing local autonomy today.

Abstract

The purpose of this study is to analyze the normative basis for fostering political literacy among Nahdliyin citizens and bahtsul masa’il as a framework for political education in the Nahdlatul Ulama tradition. This study employed a qualitative approach, utilizing a case study design. The results of the study indicate that the development of political literacy among Nahdliyin citizens is based on classical texts, the opinions of scholars, the decisions of the Nahdlatul Ulama Muktamar, and the outcomes of the Musyawarah Alim Ulama. The values instilled in the process of developing political literacy among Nahdliyin citizens can be categorized into four key areas, namely tasamuh, tawasuth, tawazun, and ta'adul. Political literacy development within Nahdlatul Ulama is centered on the lajnah bahtsul masa'il as a forum that examines various social, political, and religious issues in depth from the perspective of ahlussunnah wal jama'ah scholarship and theology. The lajnah bahtsul masa'il functions as a center for law enforcement and collective decision-making among scholars, Syuriah, Khatib, A'wan, and Tanfidziyah.

Abstract

This study aims to analyze the existence and legal protection of the position of neighborhood head in the regional governance of Buleleng Regency. This study used a sociological juridical approach conducted in three areas: Buleleng District, Sukasada District, and Seririt District. Data collection techniques in this study include documentation, interviews, and questionnaires. Data analysis used qualitative and quantitative techniques. The results of the study indicate that the existence of neighborhood heads in Buleleng Regency plays a role in assisting village heads in services and decision-making at the village level, even though their employment status is only as contract workers. The role of neighborhood heads is not listed in the official village structure based on Government Regulation Number 17 of 2018, but remains a strategic partner in the implementation of government and public services. Legal protection for the position of neighborhood heads in Buleleng Regency lacks legal certainty, due to the lack of clear regulations. The position of neighborhood heads has the potential to cause legal problems in the future, so a legal basis is needed through regional regulations to ensure legal certainty, protect officials, and support the implementation of authority legally and effectively.
