Abstract Digital transformation in government organization provides opportunity to improve the effectiveness of public service delivery. However it’s also raises constitutional problem related the protection of citizens’ right, legal certainty and the limitation of state power. This research aims to analyze the constitutionality of digital transformation policies within the Indonesian constitutional legal system and to formulate a constitutional evaluation model for digital policies. The research employs a normative legal method using statutory, conceptual, and case approaches. The objects of analysis include Presidential Regulation Number 95 of 2018 on the Electronic-Based Government System, the Electronic Information and Transactions Law, the Personal Data Protection Law, and the Constitutional Court Decision Number 20/PUU-XIV/2016. The research’s results show that these regulations have established a normative foundation for organizing digital transformation. Nevertheless, their implementation continues to face several challenges, including regulatory harmonization, personal data protection, accountability of electronic system providers, and constitutional oversight. The Constitutional Court Decision Number 20/PUU-XIV/2016 affirms that the utilization of digital technology must adhere to the principles of legality, due process of law, proportionality, and the protection of the right to privacy. The novelty of this study lies in the development of a Constitutionality Evaluation Framework for Digital Transformation Policies, which consists of six indicators: (1) legal basis, (2) constitutional legitimacy, (3) protection of constitutional rights, (4) proportionality assessment (5) accountability and transparency, and (6) judicial oversight. This framework serves as an evaluation instrument for digital policies that is oriented toward upholding constitutional supremacy and protecting the constitutional rights of citizens. Abstrak Transformasi digital dalam penyelenggaraan pemerintahan memberikan peluang peningkatan efektivitas layanan publik, tetapi juga menimbulkan persoalan konstitusional terkait perlindungan hak warga negara, kepastian hukum, dan pembatasan kekuasaan negara. Penelitian inibertujuan menganalisis konstitusionalitas kebijakan transformasi digital dalam sistem hukum tata negara Indonesia serta merumuskan model evaluasi konstitusionalitas kebijakan digital. Penelitian menggunakan metode hukum normatif dengan pendekatan peraturan perundang-undangan, konseptual, dan kasus. Objek analisis meliputi Peraturan Presiden Nomor 95 Tahun 2018 tentang Sistem Pemerintahan Berbasis Elektronik, Undang-Undang Informasi dan Transaksi Elektronik, Undang-Undang Pelindungan Data Pribadi, serta Putusan Mahkamah Konstitusi Nomor 20/PUU-XIV/2016. Hasil penelitian menunjukkan bahwa regulasi tersebut telah membentuk dasar normatif penyelenggaraan transformasi digital, namun implementasinya masih menghadapi tantangan berupa harmonisasi regulasi, perlindungan data pribadi, akuntabilitas penyelenggara sistem elektronik, dan pengawasan konstitusional. Putusan Mahkamah Konstitusi Nomor 20/PUU-XIV/2016 menegaskan bahwa pemanfaatan teknologi digital harus berlandaskan prinsip legalitas, due process of law, proporsionalitas, dan perlindungan hak atas privasi. Kebaruan penelitian initerletak pada pengembangan Model Kerangka Evaluasi Konstitusionalitas Kebijakan Transformasi Digital yang mencakup enam indikator, yaitu legal basis, constitutional legitimacy, protection of constitutional rights, proportionality test, accountability and transparency, serta judicial oversight, sebagai instrumen evaluasi kebijakan digital yang berorientasi pada supremasi konstitusi dan perlindungan hak konstitusional warga negara.
