Abstract

This article investigates the legal implications of necrophilia within the framework of Islamic law, specifically addressing whether such acts can be categorized as zinā ‘adultery’. The primary aim of this research is to analyze how Islamic teachings interpret and regulate sexual relations with deceased individuals, with a focus on the fundamental principles of human dignity and sanctity. Utilizing a qualitative method alongside a case study approach, this study involves a comprehensive review of Islamic texts, legal cases, and scholarly interpretations. The data sources encompass Islamic literature, the Qur'an, Hadith, and legal references, including scientific journals and academic books. The theoretical framework is anchored in the concepts of maqāşid syarī’ah, particularly the preservation of religion ‘ḥifẓ al-dīn’, intellect ‘ḥifẓ al-aql’, and life ‘ḥifẓ al-nafs’. The findings indicate that necrophilia is regarded as a serious violation under Islamic law, representing a breach of both moral and legal standards, which results in stringent penalties. In conclusion, this study underscores the importance of upholding the dignity of the human body after death, as mandated by Islamic law. This research contributes by clarifying how Islamic law addresses necrophilia and reinforcing societal norms related to the sanctity of life and death.

Abstract

Al-Ghazālī is recognized as a distinguished scholar who adeptly integrates the principles of fiqh ‘Islamic jurisprudence’ with tasawwuf ‘Islamic mysticism’, achieving a balance between naqlī ‘transmitted knowledge’ and 'aqlī ‘rational knowledge’, as articulated in his seminal work, Iḥyā' 'Ulūm al-Dīn. However, his perspectives on women's issues, particularly regarding the purpose of marriage, have been characterized as non-moderate, prompting some scholars to label him a misogynist. This study aims to elucidate and analyze Al-Ghazālī's views on the purpose of marriage and its hierarchical structure through the lens of Mubādalah ‘reciprocity’. This research employs qualitative literature review methodologies supported by a philosophical framework. Primary data are sourced from Al-Ghazālī's works, namely Iḥyā' 'Ulūm al-Dīn and Kasr al-Shahwatain. Secondary data encompass a range of academic books, journal articles, and additional references that substantiate the research findings. The collected data are subjected to descriptive-analytical techniques for thorough review and analysis. The research outcomes indicate the following: First, Al-Ghazālī highlights the hierarchy of marriage purposes grounded in the levels of maqāṣid al-syarī’ah, which consist of ḍarūriyāt ‘necessities’, ḥājiyāt ‘needs’, and taḥsīniyāt ‘desirables’. Second, from the perspective of Mubādalah, Al-Ghazālī's views on the purpose of marriage, as presented in Iḥyā' 'Ulūm al-Dīn, do not align with the principles of Mubādalah and exhibit gender bias. This misalignment is evident in several aspects: (1) At the pre-marriage stage, Al-Ghazālī positions men as the decision-makers in the selection of a spouse, while women are relegated to the status of the chosen objects. (2) There exists an incongruity between the hierarchy of marriage goals from Al-Ghazālī's perspective and the principles of Mubādalah. (3) Al-Ghazālī delineates the husband-wife relationship within a superior-inferior framework. (4) He emphasizes the roles of women primarily within domestic spheres. Al-Ghazālī's views are undoubtedly shaped by the socio-historical context of his era, as well as his identity as a şūfi. This research aspires to contribute to the discourse surrounding the evolution of Islamic family law legislation, advocating for the recognition and safeguarding of women’s rights and roles in a more equitable manner.

Abstract

Social media not only creates a new public sphere for the expression of religious activities but also serves as a contested arena for religious discourse. In Indonesia, one of the key discourses under contention is moderate Islamic discourse. This article addresses two primary questions: First, what forms does contested moderate Islamic discourse take on social media, and what strategies are employed in these contests?.  Second, what factors contribute to the emergence of these contestations surrounding moderate Islamic discourse on social media?. Using Fairclough’s critical discourse analysis as a theoretical framework, this research explores qualitative data gathered through the observation of YouTube videos. The findings indicate that the contestation of moderate Islamic discourse on YouTube occurs not only between traditional and new religious authorities, as is often assumed, but also among traditional religious authorities themselves. These groups compete to articulate the true and ideal meaning of moderate Islam. The contestation is driven by a combination of ideological, economic, political, and socio-cultural factors that influence the digital sphere in Indonesia.

Abstract

Despite its high Human Development Index (HDI), Yogyakarta paradoxically suffers from one of the highest poverty rates on the island of Java. This situation underscores the limitations of conventional human development metrics, particularly in regions with a predominantly Muslim population. To address this issue, this study introduces the Islamic Human Development Index (I-HDI) as an alternative framework that more effectively captures the relationship between human development and poverty in a Muslim-majority context. Utilizing secondary data from five districts in Yogyakarta spanning the years 2012 to 2023, and employing panel data regression alongside Granger causality analysis, the findings indicate that HDI has a limited and indirect effect on poverty. In contrast, I-HDI demonstrates a stronger and more direct negative correlation with poverty levels. Furthermore, Granger causality analysis reveals that changes in I-HDI significantly influence poverty levels, and vice versa, suggesting a dynamic and bidirectional interaction between these two variables. These results imply that I-HDI offers a more accurate reflection of human development in Muslim-majority regions, capturing dimensions often overlooked by traditional indices. Ultimately, the findings highlight the intricate interaction between human development and poverty, providing valuable insights for policymakers to create more effective poverty alleviation strategies grounded in Islamic principles and local cultural values.

Abstract

Zakat as a source of state income, representing zakat for Muslims to approve the spiritual ties of mankind. In this era, discussing zakat which is included in the duties of the authorities means he needs to improve continuity by helping muzzaki either by establishing institutions to facilitate the process of raising zakat funds, because this requires government assistance in improving the economy of the people. The establishment of institutions that represent government programs to overcome domestic economic and religious problems. Urgency about managing zakat, zakat fitrah with an administration system that is also good so that approval and management of zakat can be accounted for, taking into account the most important aspects of zakat management, goods and can also be in the form of money, zakat distribution media can be through mosques, social foundations, etc or directly distributed individually, the time of zakat payment and zakat payment channels. The essence of zakat fitrah over the significance of Eid al-Fitr is so important to human life. That it has meaning for humans who teach humans to share and give alms, gives happiness to those who are weak and unable, makes food for visitors of rice and other foods, ask for value one after one and another for one after another.

Abstract

Indonesia is a multicultural nation that has a variety of ethnic, racial, cultural, linguistic, and religious diversity. This diversity makes its challenges in creating a harmonious society. This is because it can bring some people trapped prejudice and discrimination, especially in religion. The prejudice that leads to discrimination and acts of violence will make social conflicts more acute in the multidimensional crises that occur in Indonesia.This article aims to describe prejudice and discrimination behavior from an individual psychological perspective, sociological, and cultural background. Besides that, it was also explained the idea of how to prevent and overcome prejudice and discrimination in religious beliefs that occurred. Efforts to prevent prejudice and discriminatory behavior in religion can be done by increasing the value of the group that is prejudiced, opening communication, conditioning the environment to internalize social norms. The hope is that all citizens can live side by side and respect each other in a peaceful and peaceful atmosphere.

Abstract

One of the Pandana Merdeka housing estates which has tried to instill harmony between communities with one another. One of the socializing activities of this housing is through mujahadah activities. This activity is very important to socialize in shaping the socio-religious aspects. The research method used is qualitative research using a sociological approach to religion. The results of this study indicate that Emile Durkheim's opinion regarding his observations about the religious phenomenon of Aboriginal groups in Australia is evident in the Pandana Merdeka housing community. This group phenomenon has the function of interacting with society in a moral order. As in the structure of the members of the Pandana Merdeka Housing community, each of them has a role in compiling the moral order through sacred ritual activities as collective action that reflects group solidarity.

Abstract

The study objective is to examine the excessive consumption of jilbab fashion trends by university students. This research is a descriptive study with qualitative methods and determined informants using purposive sampling. The researchers use primary and secondary both data all were collected through interviews, observation, and documentation. After the data were triangulated by sources and methods then we analyzed data using the simulakra theory of Jean P. Baudrillard to see the excessive consumption of jilbab fashion trends by students. The main results indicate that the growing jilbab fashion trends through social media have made student’s experience enjoy excessive consumeristic behavior for many years. Most female students imitate the public figures as their role models. They admire at female fashion models having full of signs and meanings hence they reproducing signs and meaning for their own interests. They become addicted to buying the latest hijab fashion products regardless of neither use it or sell it. They keep uploading their own photos wearing most current fashion in Instagram. . It seems that they create an uncertainty either the use of fashionable jilbab recommended by religion or promoting them as commercial products in social media.

Abstract

In facing life and life, the problem that mankind always feels is the two choices between happiness and misery. A person who always thinks acts, and behaves positively can certainly achieve positive results and get a sense of happiness. However, not a few people behave and behave negatively expecting positive results and wish to achieve a sense of happiness. Instantaneous motivational trends like these are evidence that between reality and hope is often not linear. This text aims to explore the happy ideas of Naquib al-Attas's perspective. By using the analytical descriptive method, this study found several important conclusions. First, al-Attas divides the happy aspect into two types, namely the aspect of physical and spiritual happiness. Second, for al-Attas, the highest level of happiness is the level of someone who knows himself or makrifatullah. Third, this highest happiness according to al-Attas cannot possibly be achieved by people who always emphasize the material aspects of their life, without knowing themselves, as is the case in modern-secular Western societies.

Abstract

Besides receiving education and teaching about the virtues of halal food according to the Melayu tradition, Riau community should also get an understanding of the virtues of halal food based on the Islamic law. This study aims to analyze the concept of the Riau Malay community in maintaining halal food, and what is the manners eat traditions of Melayu society closely related to eating etiquette in Islam. This research was a field study that collects data based on interviews, observation and documentation. The results showed that the food of the Melayu community has met the elements of halal and thoyyib as stipulated in culinary fiqh in Islamic law. The motive of the Melayu community to eat with halal and thoyyib criteria’s food is more due to habits and traditions that have been taught from generation to generation through the advice and teachings of the elders. This study also revealed that the type of food that is legalized is more than the type of food that is forbidden. Although the Malay community has been taught about the concept of halal food and thoyyib, but the teaching did not contain systematic content and had not yet reached a comprehensive level of understanding.
