Abstract

The Venezuela crisis is an intersection between political turmoil, economic crisis, mismanagement of natural resources, poverty, and health issues. The root causes of the crisis can be examined by using a peace psychology analysis, chiefly the concept of moral disengagement. This perspective is useful for looking at the Venezuelan crisis in a different approach and, at the same time, addressing peace efforts. One of the things that need to be pursued by domestic actors and humanitarian intervention is reconciliation. This reconciliation must meet the pre-conditions for the dialogue and peace agenda.

Abstract

Penelitian ini bertujuan untuk menganalisis dan merumuskan parameter konstitusional politik kriminal dalam pengaturan tindak pidana administrasi berdasarkan putusan-putusan Mahkamah Konstitusi mengenai pengujian ketentuan pidana dalam undang-undang. Pasalnya, diperlukan ukuran tertentu agar sanksi pidana dapat digunakan secara selektif dan terukur. Penulisan hukum ini merupakan penelitian yuridis normatif. Dengan data sekunder berupa sumber hukum primer yakni putusan-putusan Mahkamah Konstitusi, peraturan perundang-undangan, serta sumber hukum sekunder berupa buku, jurnal, dan artikel ilmiah. Kemudian data yang didapat dianalisis secara deskriptif (analitik)-kualitatif. Dari penulisan hukum ini diperoleh kesimpulan bahwa, politik kriminal dalam pengaturan tindak pidana administrasi menurut Mahkamah meliputi aspek penentuan perbuatan pidana (kriminalisasi) dan ancaman pidana (penalisasi). Adapun argumentasi-argumentasi Mahkamah sebagai parameter yang berkaitan antara lain mengenai (i) kepastian hukum dan perlindungan hukum, (ii) perlindungan masyarakat, (iii) overcriminalization, (iv) hukum pidana sebagai ultimum remedium dan memperhatikan eksistensi hukum lainnya, (v) ketentuan konstitusional adresat, (vi) teknis perumusan norma, dan (vii) disparitas sanksi pidana dalam tindak pidana administrasi

Abstract

AbstractThe conflicts between Minister of Maritime and Natural Resources Rizal Ramli and vice president Jusuf Kalla in electricity projects, Minister of State-Owned Companies and Minister of Transportation regarding fast-train development, Minister of Energy and Mineral Resources and Minister of State-Owned Companies regarding management policy of Masela Block, are conflicts inside the circle of the President’s assistants. These conflicts are implications from the obscurity of positions and authorities of said assistants. The author then researched with juridical empiric method. Through this research, it is hoped that the effective formulation of relation between the President’s assistants can be found.IntisariPerselisihan antara Menko bidang Kemaritiman dan SDA Rizal Ramli terhadap Wapres Jusuf Kalla dalam proyek listrik, Menteri BUMN dan Menteri Perhubungan dalam pembangunan kereta cepat, Menteri ESDM dan Menteri BUMN dalam kebijakan pengelolaan Blok Masela merupakan perseteruan di lingkaran pembantu presiden. Perseteruan tersebut merupakan implikasi dari ketidakjelasan kedudukan dan wewenang para pembantu presiden. Penulis kemudian meneliti permasalahan ini dengan metode yuridis empiris. Melalui penelitian ini, diharapkan dapat ditemukan formulasi pengaturan dan upaya untuk mewujudkan relasi pembantu presiden dalam Kabinet Jokowi-JK yang efektif dan efisien.

Abstract

Abstract

This article endeavors to seamlessly incorporate the teaching of Alternative Dispute Resolution (ADR) directly into the framework of Clinical Legal Education (CLE), utilizing collaboration with esteemed dispute settlement institutions, notably the Indonesian Arbitration Center (BANI) and the Indonesian National Mediation Center (PMN). The imperative for such integration is underscored by the heightened demand for skilled arbitrators and mediators, given the ubiquitous inclusion of ADR clauses in nearly every contractual arrangement. In the contemporary legal landscape where ADR clauses have become standard practice for resolving disputes arising from contractual relationships, the professional roles of arbitrators and mediators are indispensable. The significance of this initiative lies in recognizing that the success of CLE in ADR in Indonesia necessitates a fundamental shift in the mindset of the legal community. It is asserted that the conventional teaching methods, traditionally confined to the classroom, are insufficient for the cultivation of skills pertinent to amicable dispute resolution. Thus, the article advocates for the active involvement of professional arbitrators and mediators, calling for their comprehensive integration and support not only within law school curricula but also in the broader community. This transformative approach aims to bridge the practical gap between theoretical instruction and real-world application, envisioning a legal education system that produces professionals adept at ethical and effective dispute resolution in Indonesia.

Abstract

This research primarily aims to investigate the opportunities for the internalized implementation of Online Dispute Resolution (ODR) within the judicial system for the settlement of small claims in Indonesia. Several positive features of ODR, such as its ease, speed, and cost-effectiveness, can serve as catalysts for the settlement of small claims. Currently, Article 6A of the Supreme Court Regulations No. 4 of 2019 concerning the Settlement Procedure of Small Claims (the Small Claims Regulation) also allows for the use of electronic case administration in accordance with relevant legislation. This study employs a normative juridical research approach with a qualitative descriptive analysis method. The data used consist of secondary data, including primary legal sources from various legislative regulations. Additionally, data from journal articles, reports, and other literature related to ODR and small claims are utilized. A comparative study with the United States is employed to gain insights into best practices for implementing ODR in small claims settlement. Subsequently, this research proposes several steps for the ODR process in resolving simple lawsuits, including case initiation, negotiation, mediation, and adjudication. Furthermore, it emphasizes the principles of ODR that need to be upheld, such as voluntariness, accountability, and impartiality. Ultimately, integrating technology into civil justice systems through ODR will enhance the effectiveness and accessibility of justice in resolving small claims.

Abstract

Indonesia’s Constitutional Court introduced the concept of meaningful participation in the lawmaking process, emphasizing the right to be heard, considered, and explained. This concept was institutionalized through amendments to the Law on Lawmaking Procedures (Law Number 13 of 2022). However, meaningful participation remains poorly implemented, as demonstrated by the lack of public involvement in the issuance of the Government Regulation in Lieu of Law legalizing the Omnibus Law on Job Creation and the Constitutional Court's ruling on Law Number 6 of 2023 (Job Creation Law 2.0), which deemed public participation irrelevant for emergency laws. These developments highlight inconsistencies in applying the principle of meaningful participation in Indonesia’s legislative practices. This research evaluates the institutionalization of meaningful participation in Law Number 13 of 2022 and its practical application in Indonesia’s lawmaking process. This research uses doctrinal legal research methods by examining library materials and secondary data to analyze the legal framework and its implementation. The findings reveal a significant gap between the theoretical framework of meaningful participation and its application in practice, particularly in emergency lawmaking. In conclusion, while the institutionalization of meaningful participation reflects a positive step, inconsistent application undermines its potential to enhance democratic governance in Indonesia.

Abstract

Penelitian ini berfokus untuk menganalisis sepuluh putusan yang mengargumentasikan mengenai sengketa pra yudisial yang diputus pada tahun 2021. Putusan-putusan a quo kemudian dianotasi dan dianalisis untuk melihat pola-pola terkait pokok perkara yang disengketakan, pola amar putusan, pola petitum, dan pertimbangan hukum hakim. Hasil analisis tersebut kemudian digunakan untuk menyusun kerangka pengaturan ius constituendum penyelesaian sengketa pra yudisial di Indonesia. Penelitian ini merupakan penelitian yuridis normatif dengan berfokus pada data sekunder berupa putusan-putusan hakim. Data sekunder tersebut kemudian dipadukan dengan beberapa peraturan perundang-undangan yang berkaitan dengan sengketa pra yudisial. Hasil penelitian ini antara lain adalah pokok perkara yang muncul adalah mengenai penipuan, penggelapan, pencurian, dan tindak pidana lingkungan hidup. Selanjutnya, dasar hukum mengenai penyelesaian sengketa pra yudisial telah mengalami perkembangan dalam praktiknya sehingga perlu mendapat revisi. Perbaikan tersebut antara lain meliputi aspek formiil, materii, serta prosedur yang fungsional.
