Abstract

This study aims to analyze disputes in Shariah Insuranceusing a case study of PT Asuransi Takaful. The focus of the study includes the forms and characteristics of disputes, the factors causing them, dispute resolution mechanisms, compliance with Islamic economic law principles, and the parties' perceptions of fairness. This study uses a qualitative approach with a case study method to explore the phenomenon in depth based on empirical data and a literature review. The research results show that disputes are generally related to claims, such as rejections, late payments, and differences in benefit values. Factors contributing to these disputes include a lack of transparency, low Islamic financial literacy, and weak communication between companies and participants. Dispute resolution mechanisms are mostly conducted through non-litigation channels such as deliberation, mediation, and Islamic arbitration, which align with the principle of reconciliation (islah). However, there remains a gap between the normative principles of Islamic economic law and its implementation in the field. The parties' perceptions of fairness are strongly influenced by the transparency of the process and the quality of communication. This research contributes to enriching the study of Sharia insurance disputes through a more contextual case study approach. Furthermore, it provides practical recommendations for companies, regulators, and academics to improve the effectiveness of fair and sharia-compliant dispute resolution.

Abstract

Artikel ini mengkaji bagaimana pendekatan sosiologi hukum dan antropologi hukum dapat digunakan sebagai pisau analisis dalam memahami proses pembentukan hukum pidana Islam (fiqh jinayah), tanpa memposisikan diri pada sikap mendukung atau menolak penerapan formal hukum pidana Islam dalam sistem hukum negara. Hukum pidana Islam, sebagaimana cabang hukum Islam lainnya, tidak terbentuk dalam ruang vakum sosial; ia lahir, berkembang, dan diterapkan dalam interaksi yang dinamis dengan struktur sosial, nilai budaya, dan kesadaran hukum masyarakat. Dengan menggunakan metode kualitatif berbasis studi kepustakaan (library research), artikel ini menelaah konsep living law dari Eugen Ehrlich, teori akulturasi hukum dan budaya, serta kajian-kajian empiris tentang relasi hukum Islam dengan adat di berbagai wilayah Indonesia. Temuan menunjukkan bahwa norma jinayah yang termuat dalam teks-teks fikih klasik mengalami proses kontekstualisasi yang berkelanjutan ketika diserap ke dalam realitas sosial-budaya lokal, sebagaimana tercermin dalam praktik qanun di Aceh, mekanisme penyelesaian sengketa berbasis adat, dan pergeseran persepsi masyarakat terhadap jenis-jenis perbuatan yang dianggap layak dipidana. Artikel ini berargumen bahwa pendekatan sosio-antropologis tidak menggantikan pendekatan normatif-tekstual dalam ushul fiqh, melainkan melengkapinya dengan memberi pemahaman tentang bagaimana hukum benar-benar berfungsi, diterima, ditolak, atau dimodifikasi di tingkat masyarakat

Abstract

This research examines the legal implications of Constitutional Court Decision No. 168/PUU-XXI/2023 on employment termination, analysed through the framework of Islamic political jurisprudence (siyasah dusturiyyah). The primary objective is to explore how the decision aligns with constitutional protections for workers while reflecting core Islamic governance principles. Using a qualitative normative-juridical approach, the study combines statutory interpretation, doctrinal analysis, and a comparative review of classical and contemporary Islamic legal thought. Data sources include Constitutional Court documents, national labour legislation, and scholarly works on Islamic political law. The findings reveal that the decision reinforces due process in employment termination, curtails arbitrary dismissals, and upholds constitutional guarantees of justice and equality. From the perspective of siyasah dusturiyyah, these outcomes correspond to foundational principles such as justice (al-‘adl), public interest (maslahah), and the prevention of harm (dar’ al-mafasid), thereby harmonising state authority with moral and religious imperatives. The study concludes that the Court’s reasoning, although grounded in constitutional law, implicitly supports Islamic political values that emphasise balanced protection for both employers and employees while safeguarding human dignity in the workplace. The academic contribution lies in offering a conceptual model for integrating constitutional adjudication with Islamic political jurisprudence in labour law reform. This integration provides a theoretical basis for policymakers and legal practitioners to develop regulatory frameworks that are both constitutionally compliant and consistent with Islamic governance ethics, thus advancing the discourse on the convergence of national and religious legal systems in the protection of workers’ rights.

Abstract

This study aims to analyze the responsibility of the Simalungun Regency Government in providing electricity for SD Negeri Sinar Baru based on the perspective of siyasah syar‘iyyah and Minister of Education Regulation (Permendikbud) Number 22 of 2023. Using an empirical research approach, data were obtained through interviews, observations, and document studies on the school's condition, local policies, and technical barriers in the field. The findings reveal that SD Negeri Sinar Baru still lacks adequate electricity access due to geographical constraints, budget limitations, and logistical challenges. This condition negatively affects the quality of teaching and learning and contradicts the principles of hifẓ al-din, hifẓ al-‘aql, and hifẓ al-nasl in Maqasid al-Syari‘ah, as well as the obligations stipulated in Article 9 paragraph (2) point g of Permendikbud Number 22 of 2023. The study recommends budget prioritization, cross-sector synergy, and the utilization of renewable energy to accelerate electricity provision for remote schools.

Abstract

Penelitian ini berjudul “Analisis Putusan PTUN Pekanbaru Nomor 42/G/2024/PTUN.PBR dalam Sengketa Penempatan Pegawai Pemerintah dengan Perjanjian Kerja (PPPK) Ditinjau dari Perspektif Siyasah Qadhaiyyah”. Latar belakang penelitian ini berangkat dari adanya sengketa kepegawaian antara seorang guru honorer bernama Roza Sriwalinda, S.Pd, dengan Gubernur Riau terkait penempatan PPPK yang tidak sesuai dengan ketentuan kebutuhan khusus sebagaimana diatur dalam Keputusan Menteri PAN-RB Nomor 649 Tahun 2023 dan Peraturan BKN Nomor 18 Tahun 2020. Sengketa ini diajukan ke Pengadilan Tata Usaha Negara (PTUN) Pekanbaru setelah upaya administratif tidak membuahkan hasil. Putusan PTUN Pekanbaru kemudian menolak gugatan penggugat secara keseluruhan, sehingga memunculkan persoalan penting mengenai pertimbangan hukum hakim dalam kasus tersebut. Tujuan penelitian ini adalah untuk mengetahui pertimbangan hukum hakim dalam Putusan PTUN Pekanbaru Nomor 42/G/2024/PTUN.PBR terkait sengketa penempatan PPPK serta menganalisisnya dalam perspektif siyasah qadhaiyyah. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan kualitatif deskriptif. Data diperoleh melalui studi kepustakaan, analisis peraturan perundang-undangan, literatur hukum administrasi, dan teori siyasah qadhaiyyah. Hasil penelitian menunjukkan bahwa hakim dalam putusan tersebut lebih menitikberatkan pada legalitas formal keputusan tata usaha negara, sehingga menolak gugatan penggugat. Akan tetapi, jika ditinjau dari perspektif siyasah qadhaiyyah, putusan tersebut belum sepenuhnya mencerminkan prinsip keadilan substantif, perlindungan hak-hak pegawai, dan upaya pencegahan kezaliman. Menurut prinsip yang diajarkan dalam Al-Qur’an dan dipertegas oleh pemikiran Imam al-Mawardi, seorang hakim seharusnya tidak hanya terpaku pada legalitas prosedural, tetapi juga wajib mempertimbangkan keadilan bagi pihak yang dizalimi. Oleh karena itu, penelitian ini menegaskan perlunya harmonisasi antara hukum positif dengan nilai- nilai keadilan Islam agar putusan pengadilan tidak hanya sah secara prosedural, tetapi juga adil secara substansial.

Abstract

This research is motivated by the increasing number of cases of violence against children in elementary schools, which indicates a gap between legal provisions and their implementation in the field. This study aims to analyze the state's responsibility in protecting the constitutional rights of elementary school children based on Article 54 of Law Number 35 of 2014 and examine its relevance from a jurisprudence perspective. This research uses a normative legal method by applying a statutory and conceptual approach. The results show that the implementation of child protection in elementary schools is still suboptimal, as indicated by the high rate of violence against children. This condition is influenced by weak supervision, ineffective coordination between institutions, and the less than optimal implementation requires further strengthening of siyasah dusturiyah aspects to ensure more substantive welfare (al-maslahah). Specific findings indicate a synchronization gap between child protection regulations and the fulfillment of fundamental rights within educational environments, where the principle of the state as a guardian (waliyul amri) has not been fully integrated into the technical and operational dimensions of field policy. This analysis asserts that reinforcing state responsibility must rely not only on the formal legality of positive law but also on the moral-political obligation to cultivate an educational ecosystem that is both secure and equitable, in alignment with the principles of himayah al-atfal. Therefore, it is necessary to strengthen the supervisory system, improve coordination between institutions, and develop more responsive and sustainable policies to ensure the effective protection of elementary school children.

Abstract

Environmental destruction is a frequently discussed theme in the Quran, one of which is found in Surah Ar-Rum verse 41. This verse attracted the attention of Tahir Ibn 'Ashur, a 20th-century exegete, in his commentary Tahrir wa Tanwir. This study aims to analyze Ibn 'Ashur's thoughts on this verse and its relation to environmental jurisprudence. This research is library research with an environmental jurisprudence approach. The primary source is Tafsir al-Tahrir wa al-Tanwir, while secondary sources include the commentaries of al-Qurthubi, Ibn Kathir, as well as lexicons and environmental jurisprudence books. The findings show that Ibn 'Ashur provides a more contextual interpretation of Ar-Rum 41, particularly regarding the meaning of the term fasād. He distinguishes fasād into two meanings: a general meaning (ideological, moral, and spiritual destruction) and a specific meaning (environmental pollution). Ibn 'Ashur also affirms the causality between human actions and environmental damage, explaining the impacts on land (loss of food, plagues) and sea (decline of fish, pearls, and storms). In conclusion, Ibn 'Ashur's thought is relevant to addressing the contemporary ecological crisis as it encompasses both spiritual and material dimensions
