Abstract

Keberadaan kepastian hukum merupakan sebuah bentuk perlindungan bagi pencari keadilan terhadap tindakan sewenang-wenang, yang berarti bahwa seseorang akan dan dapat memperoleh sesuatu yang diharapkan dalam keadaan tertentu secara pasti. pada wilayah Desa Benjor masih terdapat kekurangan pemahaman terhadap sejauh mana kepastian hukum hak atas tanah yang harus diterapkan, baik dilingkup aparatur desa itu sendiri maupun untuk masyarakat. Maka dengan itu diperlukan ekskalasi pemahaman terhadap kepastian hukum hak atas tanah agar tercipatanya tata kelola pemerintahan yang baik dan perwujudan cita-cita untuk keadilan bagi masyrakat melalui pendaftaran tanag yang sudah ditentukan oleh peraturan perundang-undangan. Permasalahan dalam penelitian ini diantaranya intensitas pengetahuan aparatur desa dan masyarakat desa terhadap kepastian hukum hak atas tanah di Desa Benjor serta hambatan aparatur desa dan masyarakat Desa Benjor untuk mendapatkan kepastian hukum terhadap hak atas tanah. Jenis Penelitian yang digunakan adalah penelitia yuridis empiris, dengan menggunakan pendekatan yuridis sosilogis.   Abstract Understanding of Legal Certainty of Land Rights in the Apparatus and Communities of Benjor Village, Malang Regency.The existence of legal certainty is a form of protection for justice seekers against arbitrary actions, which means that someone will and can get something that is expected under certain circumstances with certainty. in the Benjor Village area there is still a lack of understanding of the extent to which legal certainty of land rights must be applied, both within the village apparatus itself and for the community. So with that it is necessary to escalate understanding of legal certainty of land rights so that good governance is created and the realization of the ideals of justice for the community through land registration which has been determined by laws and regulations. The problems in this study include the intensity of knowledge of village officials and village communities regarding legal certainty of land rights in Benjor Village and obstacles to village apparatus and the people of Benjor Village in obtaining legal certainty regarding land rights. The type of research used is empirical juridical research, using a sociological juridical approach.

Abstract

Innovation in public administration reform plays a crucial role in realizing good governance. However, the main issue is resistance to change, which often stems from government employees who are comfortable with the old ways of working and are reluctant to adapt to new methodologies and resource limitations, both in terms of finances and human resources, which often become obstacles in the implementation of effective innovation. This study aims to find out Public Service Innovation in Realizing Challenges to Reform Good Governance in the future. This research is a type of policy research that is analyzed descriptively and qualitatively. The results of the study show that innovation in public services can be carried out with the achievement of changes in mindset and bureaucratic work culture, policy deregulation, organizational simplification, management improvements, arrangement of human resources of the apparatus, strengthening accountability and budget efficiency, strengthening supervision, and improving the quality of public services

Abstract

Insufficient consideration of inflation in pricing can result in insurance premiums being set too low, threatening the long-term viability of the insurance industry. This challenge became particularly evident during the notable challenges experienced by the Indonesian insurance industry between 2021 and 2022. Various issues, including poor management, product mis-selling, and the sale of unit-linked products with inaccurate information, led to insurance customers protesting against the Financial Services Authority (OJK) and the bancassurance sector, which is a partnership between banks and insurance companies that allows banks to sell insurance products through their distribution networks. This study analyzes the legal dimensions of insurance agent misconduct in mis-selling insurance products and propose targeted strategies for regulatory and industry reforms led by OJK to foster a healthier and more transparent Indonesian insurance sector. This study employed a normative legal research method with a statute- and concept-based approach. The results show improper sales violate Article 75 of Indonesias Insurance Law (Law No. 40 of 2014). The cumulative effect of these violations can damage the insurance sector's reputation, leading consumers to view it as unreliable and predatory, which may reduce market participation as potential policyholders opt-out, ultimately undermining the financial stability and growth of the insurance market in Indonesia. In response, the OJK has introduced SEOJK No. 5/SEOJK.05/2022, which provides guidelines for implementing risk-based supervision in the insurance sector. This regulation enhance transparency and accountability, address the identified issues, and restore consumer trust in the Indonesian insurance market.

Abstract

Tujuan penelitian ini adalah untuk mengkaji tentang perlindungan hukum bagi pengemudi transportasi akibat pembatalan sepihak oleh konsumen karena dalam praktiknya kegiatan pesan memesan makanan lewat ojek online ini masih sering mengalami banyak kendala. Salah satunya adalah adanya pembatalan pesanan yang dilakukan secara sepihak oleh konsumen. Metode penelitian yang digunakan adalah metode penelitian hukum normatif dengan menggunakan metode pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conseptual approach). Berdasarkan hasil penelitian bahwa Pembatalan pesanan secara sepihak oleh konsumen tentu tidak berdampak terhadap konsumen, namunberdampak bagi pengemudi ojek online tersebut. Kerugian dalam bentuk materiil tentu masih bisa diganti, tetapi kerugian immateriil tidak akan bisa diganti. Pembatalan sepihak oleh konsumen tersebut merupakan suatu perbuatan pelanggaran hukum yang harus di pertanggungjawabkan oleh konsumen, bentuk perlindungan yang didapatkan oleh pengemudi ojek online adalah memberikan biaya ganti kerugian sebagaimana yang terdapat dalam ketentuan pasal 1365 KUHPerdata. Dalam ketentuan yang diberikan oleh undang-undang untuk perlindungan hukum kepada pengemudi ojek online harus mempunyai itikad yang baik bagi konsumen untuk mengembalikan kerugian yang sudah dialami oleh pengemudi ojek online.

Abstract

Pada wilayah Desa Benjor masih terdapat kekurangan pemahaman terhadap sejauh mana kepastian hukum hak atas tanah yang harus diterapkan, baik dilingkup aparatur desa itu sendiri maupun untuk masyarakat. Melalui pengabdian ini, metode yang digunakan adalah pendampingan partisipatif. Dampak pada penyuluhan hukum adalah pemahaman pemerintah desa dan masyarakat desa dapat lebih memahami proses legal yang diperlukan untuk mengamankan hak-hak mereka, termasuk prosedur yang harus diikuti dalam pendaftaran tanah dan penyelesaian sengketa tanah. Manfaat utama dari penyuluhan ini adalah peningkatan kepastian hukum dalam masyarakat, yang pada gilirannya akan membantu mengurangi potensi konflik agraria dan memberikan rasa aman bagi pemilik tanah. Kesimpulan pada penyuluhan hukum ini yakni pemahaman Aparatur Desa dan Masyarakat Desa terhadap kepastian hukum hak atas tanah di Desa Benjor masih terbilang minim sehingga akan berdampak pada sengketa pertanahan dikemudian hari. Serta dilakukan penyuluhan hukum dengan memperkuat dasar ilmu hukum pertanahan kepada pemerintah desa dan masyarakat, yang dimana masyarakat yang belum mendaftarkan tanahnya maka dapat melakukan dengan dua cara, diantaranya secara sistematis dan sporadik.

Abstract

This study analyzes the urgency of regulating pets as a subject of legal protection in Indonesia. Although pets have the right to be treated humanely, regulations in Indonesia do not specifically recognize pets as legal subjects entitled to legal protection. This study uses a normative juridical approach with an analytical descriptive method to examine regulatory gaps related to pet protection. Data was obtained through literature studies on laws and regulations, legal doctrines, and cases of violence against pets. The results of the study show that existing regulations, such as Criminal Code Article 302 and Law No. 18 of 2009, still focus on the health aspect of livestock and have not accommodated the basic rights of pets. In addition, criminal sanctions for perpetrators of violence against pets are considered ineffective in providing a deterrent effect. This study recommends the establishment of a special law on the protection of pets, a revision of the Criminal Code Article 302, and public education programs to increase awareness about pet rights. The implementation of these regulations is expected to strengthen legal protection for pets and encourage a paradigm shift in society in treating pets as legal subjects who are entitled to protection.

Abstract

This article explores the urgency and conceptual framework for regulating pets as collateral objects within Indonesia’s legal system to establish legal certainty that aligns with animal welfare principles. Under the civil law framework, animals are still classified as movable objects without adequate legal protection for their fundamental rights as living beings. This situation creates a legal vacuum that leads to ethical, social, and legal issues in the practice of collateral. The issues examined include the legal status of pets as collateral in Indonesia, as well as the ideal regulatory concept and model that can ensure a balance between economic value and the protection of animals' fundamental rights. This research employs a normative juridical method with a statutory approach and a comparative study of the legal systems of Turkey and Australia. The findings show that although, in theory, pets can be used as collateral due to their classification as movable property, the absence of regulation gives rise to legal, ethical, and uncertainty-related issues. Comparisons with other countries emphasize the need for an ideal regulatory model that balances economic value with the protection of animals’ fundamental rights through clear legal definitions, independent valuation, mandatory care, and humane execution procedures. Thus, this article makes a vital contribution to the development of a more just and sustainable collateral law while also strengthening Indonesia’s position in responding to international legal developments concerning animal protection.

Abstract

This data article delves into the evolving landscape of criminal law enforcement through the lens of prosecutors' authority to terminate prosecutions using restorative justice principles. Utilizing a normative research approach, it scrutinizes Attorney General Regulation Number 15 of 2020 on Termination of Prosecution Based on Restorative Justice alongside statutory regulations Number 11 of 2021 and the concept of restorative justice itself. The study reveals that prosecutors indeed possess the power to end prosecutions when cases are resolved outside the courtroom, as evidenced by the issuance of the Decree on Termination of Prosecution (SKPP). This approach, rooted in article 35 paragraph (1) letters c and J of the Republic of Indonesia Prosecutor's Law, signifies a delegation of authority from the Attorney General to the Public Prosecutor. These findings emphasize the compatibility of restorative justice practices with the fundamental objectives of criminal law enforcement. Highlights: Prosecutor's Authority: Prosecutors have the authority to discontinue prosecution based on restorative justice principles. Out-of-Court Settlement: SKPP is issued after out-of-court settlement of criminal cases through restorative justice mechanisms. Legal Basis: The legal basis for such action is the Indonesian Prosecutor Law Article 35 paragraph (1) letter c and J, which confirms the delegation of authority from the Attorney General to the Public Prosecutor. Abstract

This study analyzes the effectiveness of customer fraud reporting services through a web-based fund transfer system at BRI Ponorogo Branch. Using qualitative methods, this study collects data through in-depth interviews, participatory observations, and document analysis to evaluate ease of use, speed of response, and customer satisfaction as well as challenges faced by bank officers. The findings show that the web-based system is effective in speeding up the handling of reports and increasing customer satisfaction, with responses generally received in less than 24 hours. Customers find this system easy to use and useful, despite technical obstacles and limited access to data faced by officers. Professional interaction between bank officers and customers also contributes to high satisfaction. Analysis of the documentation shows an increase in the number of fraud reports handled since the implementation of this system. Recommendations to improve effectiveness include increased training for bank officers, improvements to technological infrastructure, and the development of additional features on the system. This research provides important insights for the development of fraud reporting systems in the banking sector, with the hope of improving customer protection in the future.
