Abstract

Abdau represents a tradition of slaughtering Qurban practiced by the Muslim community of Tulehu during Eid al-Adha. This tradition commences with the meticulous preparation of three goats, which are bathed, dressed, and perfumed. They are then paraded through the village to the mosque for slaughter, accompanied by the chanting of salawat, dhikr, poems, and the pursuit of the tauhid flag along the route. This parade also showcases various cultural attractions, transforming it into a carnival that draws numerous tourists. Currently, Abdau faces significant criticism for allegedly breaching numerous fundamental principles of sharia. This research seeks to reveal the origins of this celebration and elucidate its connection to the practices derived from the Prophet's hadiths that persist within the community. This is a qualitative study, utilizing data gathered from written sources pertaining to the Abdau celebration, complemented by interviews with religious leaders, traditional authorities, and government officials in the Tulehu region who possess a deep understanding of the intricacies of the Abdau celebration. The data were subsequently examined utilizing the living hadith methodology. This study reveals that Abdau is an Islamic teaching rooted in the societal tradition, rather than a practice of a society that has undergone Islamization. The celebration of Abdau did not exist prior to the arrival of Islam; instead, it emerged concurrently with the establishment of the Tulehu region, which is home to a Muslim community. Examining the living hadith, the Abdau tradition in each of its ritual series reveals connections to the hadiths of the Prophet and its relevance to the Islamic law. Abdau is a tradition that involves the living hadith in Tulehu, particularly in the context of Qurban and its relation to the Islamic law.

Abstract

This study comprehensively explores the issue of poorly chosen names that contain negative connotations for culinary products and their impact on the halal status of food. The primary focus is on a food stall named "nasi bebek kuntilanak" (fried duck rice with the name kuntilanak, a ghost figure in Indonesian folklore). The approach used in this research is sociological-legal, involving the collection of primary information through interviews and direct observations, as well as the use of secondary data sourced from religious regulations, such as the fatwa issued by the Indonesian Ulema Council (MUI), and legislation. The main findings indicate that the business owner violated regulations by labeling their product "kuntilanak," which contradicts the legal stipulations outlined in the MUI Fatwa Number 44 of 2020 regarding the use of names, appearances, and packaging designs that cannot obtain halal certification. This regulation explicitly prohibits the labeling of halal on products that contain harmful elements such as disbelief, sinful actions, or connotations that do not align with Islamic values. The use of the term "kuntilanak," which is provocative and sensational, has the potential to influence public perception regarding the halal status of a food product. Although the composition of ingredients and food processing techniques meet halal requirements, the use of a name with negative implications becomes an obstacle in the halal certification process by the Halal Product Assurance Agency. This research is significant in understanding the cultural and social impacts of naming practices considered deviant. Therefore, this study emphasizes the importance of educating culinary business actors to use names that align with Sharia values, thereby strengthening consumer trust, maintaining a business reputation, and contributing to the enhancement of the national halal product ecosystem.

Abstract

Hukum kewarisan dalam Islam tentang pengangkatan anak tidak membawa pengaruh apapun terhadap status kewarisan anak tersebut karena tidak ada hubungan nasab antara keduanya. Namun dalam prakteknya, ditemukan penetapan di Mahkamah Syar’iyah Banda Aceh Nomor 0084/Pdt.P/2016/MS.Bna yang menetapkan anak angkat sebagai salah seorang ahli waris. Kajian ini ingin melihat bagaimana proses penetapan terhadap anak angkat sebagai ahli waris di Mahkamah Syar’iyah Banda Aceh, apa yang menjadi pertimbangan Hakim dalam menetapkan anak angkat sebagai ahli waris, dan bagaimana tinjauan hukum fiqih mawaris terhadap penetapan anak angkat sebagai ahli waris di Mahkamah Syar’iyah Banda Aceh. Untuk menjawab permasalahan tersebut dilakukan sebuah kajian melalui pendekatan yuridis empiris dan menggunakan metode pengumpulan data lapangan yang dipadukan dengan metode pengumpulan data kepustakaan melalui teknik wawancara dan dokumentasi. Hasilnya adalah proses penetapan anak angkat sebagai ahli waris dalam penetapan Nomor 0084/Pdt.P/2016/MS.Bna di Mahkamah Syar’iyah Banda Aceh diselesaikan dalam beberapa tahapan, yakni diawali dengan pendaftaran dan registrasi perkara, pembacaan surat permohonan oleh hakim, para pemohon memberikan keterangan di persidangan berkaitan dengan dalil-dalil permohonan, tahapan pembuktian, tahapan permusyawaratan majelis hakim, dan pembacaan penetapan. Adapun pertimbangan Hakim Mahkamah Syar’iyah Banda Aceh dalam menetapkan anak angkat sebagai ahli waris didasarkan kepada Pasal 171 huruf (c) Kompilasi Hukum Islam dan pemeriksaan silsilah keluarga para pemohon untuk menentukan hubungan status kewarisan para pemohon terhadap termohon yang membuktikan bahwa anak angkat tersebut sebenarnya merupakan anak dari saudari perempuan pewaris yang telah meninggal dunia lebih dahulu. Dalam tinjauan fikih mawaris penetapan anak angkat sebagai ahli waris di Mahkamah Syar’iyah Banda Aceh dipandang tidak melanggar ketentuan hukum kewarisan Islam dan digolongkan dalam kasus kalalah.

Abstract

The protection of children is a fundamental aspect of Islamic teachings, especially in terms of sexual violence that touches on issues of morality, dignity, and humanity. Islam strictly prohibits adultery and actions that lead to it, including sexual abuse of children. A severe issue that persists in Indonesia is sexual violence against minors, including in Banda Aceh City, with various forms ranging from harassment to rape. Children who should receive protection actually become victims in their immediate environment, such as family, neighbours, and even peers. Through a case study at DP3A Banda Aceh, this study seeks to examine how situations of sexual abuse against children are handled from the standpoint of Islamic law. Data were gathered through observations, interviews, and literature reviews from books, journals, rules and regulations, and Qur'anic verses using a legal sociological method and a normative-empirical juridical approach. The study was descriptive and qualitative in nature. According to the study's findings, DP3A Banda Aceh plays a significant role in providing social recovery, legal support, and psychological support to victims of sexual assault against minors. However, this effort still faces various challenges, such as minimal reporting of cases, social stigma against victims, and limited human resources and coordination between institutions. In the context of Islamic law in Aceh, handling this case requires a comprehensive approach, integrating religious values, local customs and the national legal system to give children, the country's future generation, the best possible protection.

Abstract

This research is motivated by the practice of altering the lineage of adopted children on the Family Card (Kartu Keluarga) in Marihat Butar Village without a court decree. This practice creates a problem in the form of a discrepancy between administrative facts and the provisions of positive law and Islamic law, which has not been extensively analyzed integratively from both legal perspectives. The objective of the research is to analyze the juridical consequences of this non-procedural lineage alteration, specifically its impact on population administration status and the civil rights of the child from the perspective of Islamic law. The method used is qualitative with a normative legal theory approach, collecting primary data through in-depth interviews with 5 adoptive couples, which were then analyzed descriptively-analytically. Results and discussion indicate that this practice creates legal dualism. In Islamic law, it results in the severance of legitimate lineage, inheritance rights, and mahram relations with the biological parents. Meanwhile, in positive law, this action creates inconsistency between population documents and biological facts, potentially causing issues regarding the child's civil legal status and public services. The implication of these findings reveals the urgency for socialization and strict law enforcement regarding legitimate child adoption procedures. There is also a need to integrate population administration databases with court rulings to prevent similar deviations in the future. [Penelitian ini dilatarbelakangi oleh praktik pengubahan nasab anak angkat dalam Kartu Keluarga (KK) di Desa Marihat Butar tanpa melalui penetapan pengadilan. Praktik ini menciptakan masalah berupa kesenjangan antara fakta administratif dengan ketentuan hukum positif dan hukum Islam, yang belum banyak dianalisis secara integratif dari kedua perspektif hukum tersebut. Tujuan penelitian adalah menganalisis konsekuensi yuridis dari pengubahan nasab secara tidak prosedural tersebut, khususnya dampaknya terhadap status administrasi kependudukan dan hak-hak keperdataan anak dalam perspektif hukum Islam. Metode yang digunakan adalah kualitatif dengan pendekatan teori hukum normatif, mengumpulkan data primer melalui wawancara mendalam terhadap 5 pasangan orang tua angkat, yang kemudian dianalisis secara deskriptif-analitis. Hasil dan pembahasan menunjukkan bahwa praktik ini menimbulkan dualisme hukum. Dalam hukum Islam, praktik ini mengakibatkan terputusnya hubungan nasab sah, hak waris, dan hubungan mahram dengan orang tua kandung. Sementara dalam hukum positif, tindakan ini menciptakan inkonsistensi antara dokumen kependudukan dan fakta biologis, berpotensi menimbulkan masalah dalam status keperdataan anak dan pelayanan publik. Implikasi dari temuan ini mengungkap urgensi sosialisasi dan penegakan hukum yang tegas mengenai prosedur pengangkatan anak yang sah. Diperlukan juga integrasi database administrasi kependudukan dengan putusan pengadilan agar dapat mencegah penyimpangan serupa di masa depan.]

Abstract

Although human rights are considered basic rights that are not determined by social views or state legitimacy and are given to every individual from birth, in the context of Indonesia, even though Komnas HAM was established through Presidential Decree No. 50 of 1993 to protect human rights, its implementation still faces various challenges. One of the main problems is the lack of optimisation in the enforcement of human rights. This raises questions about the extent of the state's commitment to protecting human rights and its efforts to strengthen law enforcement mechanisms. The results of the study show that although Indonesia has adequate legal instruments to guarantee human rights, their implementation in the field still leaves gaps. In this study, the author uses qualitative methods with a field research and document analysis approach. The results of this study show that the manifestation of human rights in the Indonesian legal system is realised through the strengthening of regulations, the optimisation of mechanisms for affirming the role and authority of Komnas HAM, and improved coordination between law enforcement agencies.

Abstract

Restorative justice is an approach to resolving legal cases that involves the offender and the victim in order to achieve a fair settlement by emphasizing the fulfillment of the rights and obligations of the parties based on humanitarian aspects and more dignified and just legal protection. The implementation of restorative justice in this study is carried out in cases of assault committed by children as perpetrators of street crime at the Banda Aceh Police Resort (Polresta Banda Aceh), focusing on the resolution process of several cases between 2023 to 2025. This study aims to examine how restorative justice is implemented in handling cases of child-perpetrated assault as street crime at Polresta Banda Aceh and to identify the obstacles faced in its effectiveness. This study employs a juridical empirical method with statute approach and conceptual approach. Data are collected through interviews with responsible parties at Polresta Banda Aceh and are analyzed descriptively to provide a detailed overview of the implementation of regulations in practice.The findings indicate that Polresta Banda Aceh has attempted to implement restorative justice through penal mediation involving the offender, the victim, and other related parties. However, not all cases are successfully resolved as expected. Out of 9 cases handled, only 3 cases are successfully resolved through restorative justice, while 6 cases are referred to formal judicial proceedings. The implementation still faces several obstacles, including limited family support, the failure to reach an agreement between the offender and the victim, and the lack of optimal support from customary institutions for children. Although the procedures have been carried out in accordance with existing regulations, this condition indicates a gap between legal norms that require diversion and their implementation in practice. Therefore, it is necessary to enhance the capacity of law enforcement officers through specialized training, accompanied by public education, as well as integrating customary law values, in order to ensure that restorative justice is implemented more effectively.

Abstract

Child protection for victims of criminal acts remains a pressing global concern, particularly in jurisdictions where legal frameworks coexist with complex socio-cultural structures. While existing scholarship has largely focused on normative legal analysis or institutional responses, insufficient attention has been given to the interplay between family dysfunction and institutional intervention in shaping the effectiveness of child protection systems. This article addresses this gap by examining the implementation of child protection mechanisms at the Regional Technical Implementation Unit for Women and Children Protection (UPTD PPA Aceh) through an integrative analytical framework combining family law, victim-centered justice, and maqāṣid al-sharīʿah. Employing a socio-legal approach with qualitative methods, this study integrates doctrinal legal analysis with empirical data derived from in-depth interviews, field observations, and case documentation. The findings demonstrate that UPTD PPA Aceh has developed an integrated protection model encompassing legal assistance, psychological recovery, and social reintegration. However, the effectiveness of this model is significantly constrained by structural limitations, weak family support systems, and persistent socio-cultural stigma. This article contributes to the literature by advancing a conceptual framework that situates child protection at the intersection of family responsibility and institutional governance. It further argues that sustainable protection mechanisms require a systemic integration of legal norms, institutional capacity, and family-based resilience, which is normatively consistent with the objectives of maqāṣid al-sharīʿah, particularly the preservation of life (ḥifẓ al-nafs) and lineage (ḥifẓ al-nasl).

Abstract

This article analyzes the position of artificial intelligence (AI) in the practice of Islamic fatwa using the hadith and Maqasid Sharia approaches. The study focuses on four main aspects: studying the concept and characteristics of artificial intelligence, understanding the implications of Islamic ethics for AI regulation, analyzing the hadith of the Prophet Muhammad (PBUH) regarding AI Fatwa, and evaluating the use of AI in fatwas based on Maqasid Sharia. This study uses a qualitative method based on library research by examining the books of mu'tabarah hadith, classical works of usul fiqh, and contemporary literature related to technology and Islamic law. The results show that AI is an instrumental computing system that works based on data and algorithms, which lacks intention, moral awareness, and sharia responsibility. The analysis of the hadith confirms that the authority of fatwa in sharia is only valid for scholars who meet the requirements of knowledge and moral integrity. From the perspective of Maqasid Syari'ah, AI can be justified as a supporting instrument (wasilah), such as in researching evidence, processing data, and mapping scholarly opinions, as long as the final decision remains with the mufti. Thus, AI does not function as an independent fatwa issuer, but rather as a tool that must be guided by the principle of prudence, Islamic ethics, and the objectives of sharia.

Abstract

The increasing participation of women as migrant workers has created complex socio-legal consequences within family structures, particularly concerning the fulfillment of children's rights. While economic remittances from female migrant workers contribute to improving household welfare, the prolonged physical absence of mothers raises critical concerns regarding parenting, emotional attachment, and moral development of children. Existing studies largely focus on the economic benefits of labor migration, while limited attention has been given to the holistic fulfillment of children's rights from an Islamic legal perspective. This study aims to examine the fulfillment of children's rights in families of female migrant workers in Bukit Tusam District, Southeast Aceh Regency, and to analyze the issue through the framework of Islamic law. The research employs an empirical qualitative approach through field research, with data collected via in-depth interviews, observation, and documentation involving female migrant worker families, substitute caregivers, and community stakeholders. The findings indicate that children's economic and formal educational rights are relatively fulfilled through remittances and continued access to schooling. However, the rights related to parental care, emotional support, and moral-religious guidance are often inadequately addressed due to the absence of maternal caregiving. From the perspective of Islamic law, the fulfillment of children's rights requires a holistic approach grounded in the principles of maqāṣid al-sharīʿah, particularly the protection of lineage, intellect, and welfare. This study contributes to the discourse on Islamic family law by emphasizing the need for integrative policies and community-based support systems to ensure the comprehensive protection of children's rights in migrant worker families.
