Abstract

The purpose of this research is to know about how to manage and develop land waqf in Cokromenggalan Ponorogo Village, and about the potential for developing waqf productivity in Cokromenggalan Ponorogo Village. The research method used in this study is a qualitative method using an inductive approach, the data collection techniques used are observation, interview and documentations. The results of this study are the management and development of waqf in Cokromenggalan Village managed by nadzir with the assistance of the local mosque administrator (ta'mir). In the distribution of waqf assets, the majority are in the form of mosques, prayer rooms, and educational institutions. As for the potential development of waqf productivity, it is still not maximized, due to limited human resources, costs, and public awareness to manage waqf is still lacking.

Abstract

This study aims to describe the concept of Sharia Fintech Lending and its regulatory readiness in Indonesia. Along with the development of technology and online lending issues that are troubling the public, sharia fintech lending grows and develops. However, the challenges of online lending make this industry little known to the public, so its development tends to be slow. In quantitative terms, this industry is not as much as conventional fintech. Therefore the government (OJK) initiated regulations for this industry supported by the DSN MUI Fatwa. However, after it was implemented, it turned out that there were many obstacles that hindered the growth of sharia fintech lending. Based on the research findings, OJK needs to review this regulation to make it more flexible and support the development of Islamic banking fintech more rapidly

Abstract

Growth and development is a process that occurs continuously from conception and continues into adulthood. In the process of child development, early detection is needed to identify early problems from the normality of child development. The purpose of this study is to find out the description of the growth and development of early childhood aged 4-6 years. The research method used was descriptive qualitative which was conducted on 40 children aged 4-6 years, to determine growth using body mass index (BMI) measurements and to determine development using a developmental pre-screening questionnaire (KPSP). Based on BMI measurements, the highest results were found in the normal category of 25 people with a percentage of 62.5%. Meanwhile, based on KPSP, according to the age of 28 people with a percentage of 70%. The most based on age, namely 28 people aged 5 years with a percentage of 70%, and the most based on gender, namely 21 men with a percentage of 52.5%.

Abstract

The advocate profession is a respectable profession (officium nobile) in carrying out its profession under the protection of laws, laws and codes of ethics. Are free to be independent and not tied to a biocratic hierarchy. With this reality, sometimes an advocate deviates from his professional function, resulting in a violation of the advocate's code of ethics. Ethics itself is the foundation of a profession so that there are symptoms of abuse of the profession and ignoring moral values, then a discourse of thought about the code of ethics of the advocate profession according to the perspective of Islamic law with the aim of advocates carrying out their duties according to the established code of ethics and not far of Islamic ethics. The method used in this writing is the type of normative writing with the nature of analytic descriptive research. Research library data collection techniques (libraries) that emphasize sources of information from legal books, journals, papers and opinions that have a relevant relationship to the problem under study. The result of this paper is a description that the professional code of ethics for advocates contains moral values ​​which form the basis of an advocate's personality professionally and must not violate moral principles, and may not harm the interests of others. Profesi advokat merupakan profesi yang terhormat (officium nobile) dalam menjalankan profesinya berada dibawah perlindungan hukum, Undang-undang dan kode etik. Bersifat bebas mandiri serta tidak terikat pada hirarki biokratis. Dengan realitas demikian terkadang seorang advokat menyelewengkan fungsi profesinya, sehingga terjadi pelanggaran kode etik advokat. Etika sendiri merupakan landasan suatu profesi sehingga terjadi gejala-gejala penyalahgunaan terhadap profesi dan mengabaikan nilai-nilai moralitas, maka muncullah wacana pemikiran tentang kode etik profesi advokad menurut kaca mata hukum islam dengan tujuan para advokad melaksanakan tugasnya sesuai kode etik yang ditetapkan dan juga tidak jauh dari etika islam. Metode yang digunakan dalam penulisan ini adalah Jenis penulisan normative dengan sifat penelitian deskriptif analitik. Teknik pengumpulan data library research (pustaka) yang menekankan sumber informasi dari buku-buku hukum jurnal, makalah dan pendapat yang mempunyai hubungan relevan dengan permasalahan yang diteliti. Hasil dari tulisan ini adalah sebuah uraian bahwa kode etik profesi advokat mengandung nilai moral yang menjadi landasan kepribadian seorang advokat secara professional dan tidak boleh melanggarprinsip moral, serta tidak boleh merugikan kepentingan orang lain.

Abstract

The background to this research is that the Roudlotul Huda Magetan Islamic Boarding School contains Islamic Boarding School-Owned Enterprises (BUMP) which play an important role in the Islamic boarding school's economy. The presence of Covid-19 caused the economy to decline, and this thesis contains the problem formulation, (1) How is the application of maqashid syari'ah in the economic recovery of BUMP Basmallah at the Roudlotul Huda Islamic Boarding School, Magetan?, (2) How is the application of maqashid syari'ah to BUMP Basmallah's financial role in post-pandemic economic recovery at the Roudlotul Huda Islamic Boarding School, Magetan? This research was conducted using a qualitative research approach with data collection procedures and through interview, observation and documentation techniques. The conclusions are (1) Implementation of maqashid syari'ah at BUMP Basmallah in economic recovery at the Roudlotul Huda Magetan Islamic Boarding School by fulfilling the objectives of maqashid syari'ah in accordance with the level of need, namely the dharuriyyah (primary needs), (2) Application of maqashid syari'ah in post-pandemic economic recovery at the Roudlotul Huda Islamic Boarding School by fulfilling aspects of the maqashid shari'ah elements, namely maintaining religion, soul, reason and protecting property. So that it can achieve its goals according to the provisions prescribed by Islam

Abstract

Perkembangan teknologi yang mudah dan terbuka tidak menutup kemungkinan bahwa berbagai macam transaksi dapat menyebabkan konsumen berbelanja secara impulsif atau bahkan menjadi boros. Banyak faktor yang mendorong konsumen untuk membeli barang yang mereka butuhkan atau inginkan, seperti media sosial facebook yang digunakan sebagai media promosi oleh produsen maupun pengguna untuk menawarkan jasa. Pada e-commerce terdapat kemudahan untuk pengguna melakukan transaksi walaupun mereka belum memiliki dana berbagai kemudahan itu memunculkan transaksi baru yaitu gestun atau gesek tunai. Metode penelitian ini menggunakan penelitian kualitatif dengan teknik pengumpulan data melalui observasi, wawancara, dan dokumentasi. Teknik analisis data menggunakan analisis deskriptif kualitatif, berupa kata-kata dan lisan dari hasil observasi maupun wawancara yang diolah dan dianalisis agar dapat menarik sebuah kesimpulan. Berdasarkan hasil dari penelitian ini dapat di simpulkan bahwa 1. Praktik gestun di grup gestun all limit facebook dilakukan dengan metode checkout dan scan code QRIS yang disediakan oleh penyedia jasa gestun dengan metode pembayaran paylater dengan tenor waktu pelunasan pembayaran sesuai pada aplikasi yang disediakan (1,3,6, hingga 9 bulan) serta penyedia jasa gestun mematok fee diluar biaya-biaya yang dikeluarkan pada metode pembayaran paylater, 2. Islam memperbolehkan semua transaksi muamalah yang baik, jika ada transaksi yang batil dan dilarang dalam dalil syara’ maka tidak sah transaksi tersebut. Pada praktik gestun ada unsur-unsur kegiatan yang tidak dibenarkan oleh syara’, yakni adanya aktifitas kebohongan pada transaksi jual beli antara pengguna (pembeli) dan penyedia jasa gestun (penjual).
