Abstract

Based on the Preamble to the 1945 Constitution of the Republic of Indonesia, the fourth paragraph refers to the ideals to be implemented within a single composition of the Republic of Indonesia. Article 28 C paragraph (1) of the 1945 Constitution of the Republic of Indonesia mandates that every person has the right to develop himself through meeting his basic needs, has the right to receive education and to benefit from science and technology, arts and culture, to improve for the quality of his life and for the welfare of humanity. This research aims to analyze legal politics in implementing the fulfillment of Minimum Service Standards (SPM) in Early Childhood Education (PAUD) in Indonesia. This research is normative legal research with a normative juridical approach. The research results show that the implementation of SPM in the PAUD sector is very important to ensure that every young child receives quality educational services. Article 11 of Government Regulation Number 2 of 2018 concerning Minimum Service Standards explains that local governments are obliged to implement SPM to fulfill the types of basic services and quality of basic services that every citizen has the right to receive. The implication is that the implementation of Minimum Service Standards (SPM) in Early Childhood Education (PAUD) is very important to ensure that every young child in Indonesia receives quality educational services, which ultimately contributes to improving the quality of life and human welfare.

Abstract

Industri kelapa sawit merupakan industri strategis nasional karena selain sebagai penyumbang devisa terbesar juga memiliki dampak besar terhadap perekonomian di Indonesia. Tidak dapat dikesampingkan fakta bahwa industri kelapa sawit juga menimbulkan sejumlah dampak negatif bagi lingkungan. Perdebatan dari kalangan konservasitisme dan developmentalis terkait kelanjutan pengelolaan sumber daya alam tidak akan menyelesaikan akar masalah sebenarnya. Pemerintah perlu mengatur kelanjutan pengembangan industri strategis kelapa sawit. Persaoalan dalam penulisan ini adalah pemerintah dalam sepuluh tahun terakhir berkali-kali membatalkan aturan tentang sertifikasi industri kelapa sawit yang lestari (sertifikasi ISPO) akibatnya pendekatan green growth economic belum dapat terwujud pada industri kelapa sawit. Metode Penulisan dalam penelitian ini yuridis normatif dengan fokus melakukan kajian yuridis terhadap implementasi konsep hukum lingkungan green growth economic terhadap kebijakan sertifikasi pada industri kelapa sawit. Hasil kajian penelitian ini menunjukkan aturan yang tidak jelas dan mengikat terkait sertifikasi ISPO (hanya bersifat voluntary). Selain itu sertifikasi ISPO hanya memberi kewajiban tanpa memberi insentif apapun bagi industri kelapa sawit. Hal ini berbeda jika dibandingkan dengan sertifikasi internasional yakni RSPO, selain memberi kewajiban tetapi juga mampu memberikan insentif berupa harga yang premium menyebabkan sertifikasi ISPO tidak dapat diterapkan secara efektif guna menunjang green growth economic.

Abstract

Industri kelapa sawit merupakan industri strategis nasional yang menghasilkan sumber devisa terbesar bagi Indonesia. Persoalan industri kelapa sawit adalah sifat investasi jangka panjang, mengingat panen baru dapat dilakukan setelah 3-4 tahun setelah penanaman, investor harus mengurus perizinan teknis dalam jumlah yang banyak serta melalui prosedur yang birokratis, mengingat hingga saat ini banyak perizinan teknis belum dapat diurus melalui online single submission (OSS). Potensi tindakan koruptif terjadi mengingat pengurusan perizinan teknis yang panjang dan birokratis sedangkan investor perlu segera melakukan penanaman dan mendapatkan sertipikat atas tanah guna keperluan pembiayaan. Permasalahan dalam penulisan ini adalah bagaimana mengantisipasi sifat koruptif dan penerbitan perizinan teknis kelapa sawit. Metode dalam penulisan ini adalah yuridis normatif dengan pengambilan data secara kepustakaan dengan cara berpikir deduktif dalam melakukan verifikasi data.

Abstract

In 2018, the Indonesian government issued Presidential Instruction No. 8 of 2018 re. suspension and evaluation of palm oil plantation permits and boosting of its productivity (Moratorium policy).  This article is written as a critique, using a legal-dogmatic approach, directed towards this policy. It is noted that there exists uncertainty about which license, from the web of existing and relevant permits-licenses, are going to be suspended and evaluated. This legal uncertainty in the final analysis hampers the effort to make Indonesia prosperous as aspired by the 1945 Constitution (Art. 33).

Abstract

The development of aviation market in Southeast Asia after the Covid-19 pandemic is promising. More aircraft are delivered to the Asia-Pacific region, including the Association of South East Asian Nations (ASEAN) Member States. The introduction of ASEAN Open Skies (also known as ASEAN Single Aviation Market) a decade earlier together with ASEAN Economic Community Blueprint 2025 goals for an integrated and cohesive regional economy highlight the importance of a seamless air connectivity. Liberalisation of the airline industry in ASEAN Member States is crucial to restart the airline industry pre-pandemic and to grasp the so-called Asian century momentum. However, ASEAN Member States are reluctant towards liberalisation efforts, maintaining protectionism on both freedoms of the air (traffic rights) as well as foreign direct investment (ownership and control). Existing legal framework at regional level, namely ASEAN Framework Agreement on Services (AFAS) and ASEAN Trade in Services Agreement (ATISA), only received lukewarm attention from ASEAN Member States. This article discusses the urgency to recall the commitment of a gradual liberalisation based on AFAS and ATISA among the ASEAN Member States, the implementation of which will lead to the establishment of a regional community carrier which benefits ASEAN citizens.

Abstract

As a business practice, banks play an important role in collecting money from the public in the form of deposits, and channeling it into the form of credit or other forms, so that, banks aim to improve the standard of living of the people or the economy of a country. . Automated Teller Machines (ATMs) are one of the items that have emerged from technology in the banking sector that can facilitate transaction activities without the need to visit bank tellers due to advances in the times and technology. The development of a technology can have a positive impact and a detrimental impact, one of which is the emergence of cybercrime (Cyber Crime) in the banking world which is commonly referred to as skimmingcrimes. The type of normative legal research is used as research on the rule of law, the level of norms, principles, philosophies, theories and the rule of law itself, with an approach to legislation (Statute Approach). Then the purpose of this study is to find out how to protect the law for customers who own automated teller machines (ATMs) who experience skimming crimes and how to apply sanctions against perpetrators for skimming crimes on automated teller machines (ATMs), so that it can be concluded that every criminal act in skimming crimes may be sentenced to criminal sanctions and administrative sanctions for those who are proven to have done so.therefore the application of criminal sanctions used in the crime of skimming is contained in article 30 paragraph (2) jo 46 paragraph (2) of Law Number 11 of 2008 which has been amended into Law No. 19 of 2016 jo article 55 paragraph (1) 1 of the Criminal Code jo article 363 of the Criminal Code Keywords: Skimming, Legal Protection, Application of Criminal Sanctions
