Abstract

This article aims to address the ambiguity or phenomenon developing in society regarding the obligation to comply with the Marriage Law in Indonesia. This is because Indonesians possess dual identities: as Muslims who must follow the rules of our religion, and as citizens of Indonesia who are required to adhere to the laws in force in Indonesia (Positive Law). These dual identities among Indonesian Muslims can become a serious issue if we are not wise in making decisions, especially regarding marriage. As Indonesian citizens and Muslims, we are obliged to comply with the Marriage Law because, as citizens of Indonesia, we are certainly required to follow it. This article addresses this issue by stating that the obligation to comply with the Marriage Law, when aligned with the Qur'an, can be found in Surah al-Nisa' (4:59) as a legal argument. This position arises because, in addition to being commanded to obey Allah and the Prophet, we are also commanded to obey those in authority (Ulil Amri), who, in the context of Indonesia, refers to the government/leaders. The relevance of the Marriage Law to Ulil Amri is that the Marriage Law is a product of the government. Ulil Amri includes a combination of leaders, Umara, and society working together for the welfare of the community, which means that as Indonesians and Muslims, we are obliged to obey it.

Abstract

This study aims to address issues regarding the significance of a guardian (wali) in marriage. A marriage guardian is the person entitled to marry off a woman to a man of her choice. The wali acts on behalf of the bride in the marriage contract (akad nikah). Both the guardian and witnesses are responsible for ensuring the validity of a marriage contract. The purpose of this research is to educate the public about the importance of the wali's presence in marriage so that people do not easily disregard the role of the wali due to certain circumstances. The findings of this study reveal that the role of a wali is crucial in a marriage, as the wali is a fundamental pillar determining the validity of the marriage. Therefore, the position of the wali requires special attention, especially in conducting a marriage ceremony. The urgency of the wali's role is also emphasized in the Qur'an, Hadith, as well as in Indonesian laws, including the Compilation of Islamic Law and the Marriage Law.

Abstract

The writing of the Qur’anic manuscript has developed through two primary systems: Rasm Uthmani and Rasm Imla’i. In Indonesia, the dynamics between these two systems are evident in the processes of transmission, reception, and standardization of the Qur’anic script, influenced by historical developments and official policies, particularly from the Lajnah Pentashihan Mushaf al-Qur’an. This study aims to examine the transformation and adaptation of Qur’anic writing systems over time, as well as to analyze the impact of standardization policies on community practices. Using a historical-philosophical approach and a library research method, this study analyzes various manuscripts and printed mushafs. The findings indicate that Rasm Imla’i was more dominant during the early development of local mushafs due to limited access to the principles of Rasm Uthmani. However, since the implementation of standardization by religious authorities, Rasm Uthmani has become the official form in mushaf publication, although the Imla’i form continues to be used in educational contexts for pedagogical reasons. These findings reveal a tension between religious authority and local tradition and suggest the need for an epistemic re-evaluation of mushaf standardization policies within the context of contemporary Indonesia.

Abstract

Perkembangan teknologi digital telah mendorong perubahan signifikan dalam berbagai aspek kehidupan masyarakat, termasuk dalam cara bertransaksi. Penelitian ini bertujuan untuk mengkaji transformasi perilaku bertransaksi masyarakat Kabupaten Purworejo dari penggunaan dompet fisik ke dompet digital. Menggunakan pendekatan kuantitatif deskriptif, data dikumpulkan melalui metode survei mendalam terhadap orang responden yang dipilih secara purposive dengan kriteria berusia 16–30 tahun dan memiliki dompet digital. Hasil studi menunjukkan bahwa terdapat peningkatan penggunaan dompet digital, terutama di kalangan generasi muda. Namun, tantangan seperti rendahnya literasi digital, keterbatasan infrastruktur jaringan, dan kurangnya kepercayaan terhadap sistem digital masih menjadi hambatan utama dalam penyebaran teknologi ini secara merata. Temuan ini memberikan gambaran penting bagi pemangku kepentingan dalam merancang strategi edukasi dan pengembangan ekosistem pembayaran digital yang inklusif dan berkelanjutan di daerah.

Abstract

‘Iddah is one of the Islamic laws that must be carried out by Muslim women who lose their marital status for certain reasons. Problems arise when the women undergoing the ‘iddah period are women who are mustaḥaḍah mutaḥayyirah, namely women who are unable to differentiate between ḥaiḍ blood and istiḥāḍah blood. Departing from this problem, this study was conducted to examine and determine the ‘iddah period that must be carried out by women who are mustaḥaḍah mutaḥayyirah based on the perspectives of the Maliki and Shafi’i schools of thought, and to compare the opinions of the two schools of thought to find points of difference between them. According to the Imam Maliki Mażhab, the period of 'iddah for mustaḥaḍah mutaḥayyirah women is one year, with a breakdown of nine months to eliminate doubts and ensure the emptiness of the womb, as well as three months as a period of 'iddah equal to women in general, as a form of iḥtiyāṭ (prudence). Meanwhile, the Syafi'i Mażhab believes that the 'iddah period is sufficient for three months, because women essentially experience ḥaiḍ and become pure periodically, and extending the 'iddah period is considered to give rise to masyaqqah. The difference between these two schools of thought lies in determining the duration of the ‘iddah period and the method of istinbāṭ law. The Maliki school uses qawl ṣaḥābah and maṣlaḥah mursalah, while the Shafi’i school bases its opinion on the Qur’an, Hadith, and Qiyās.

Abstract

This article responds to the issue of the original legal ruling of divorce (ṭalāq) by examining the opinions of scholars from the four Sunni schools of law, which need to be explained comprehensively in order to understand the legal consequences that may arise. The purpose of this article is to provide knowledge by presenting various scholarly opinions from the different schools regarding divorce carried out under coercion. The basic legal ruling of divorce differs among the schools of law: some consider it permissible (mubāḥ), while others regard it as reprehensible (makrūh) if carried out without a valid sharʿī reason. This article also discusses the differences of opinion among scholars concerning divorce under conditions of coercion. The Ḥanafī school considers a divorce to remain valid even if it is pronounced under coercion, whereas the other three schools (Mālikī, Shāfiʿī, and Ḥanbalī) argue that a coerced divorce is invalid. This discussion aims to provide a comprehensive understanding of the concept of divorce in Islam and the dynamics of scholarly thought surrounding it.
