Abstract

The treason or treason act is closer to the act of betrayal. In a constitutional law perspective, this treason is defined as the act of a person or group of people towards leadership in a country because of its incompatibility with the rules that apply in the country, so that he or they take actions that tend to "deviate" so that it can break down the leadership of a state leader. In the corner of the desert of Islam, treason or treason act can be done by a person or group of people preceded by a political conspiracy, evil consensus, and intrigue to achieve its political goals. In the Qur'an several verses are mentioned about this treason. Where all contain the notion that treason is an act or an attempt to oppose and undermine the power of someone who is not favored or considered an enemy who has conflicting indications. Both in terms of religion and worldliness by means of deception, deception, or other acts that are contrary to the religion of Islam. Starting from this context, the author wants to review specifications and indications of treason from the perspective of Islamic state governance law by taking the constellation of thoughts of classical scholars.

Abstract

Zoning, a limitation system that is so widely discussed today, focuses initially on the education system in Indonesia, namely on the problem of admission of new students which began in 2017. One of these policy settings is for children to be educated in areas close to residence. This system is often connected by the public with the search for a partner to get married. Based on normative Islamic law research, marriage in Islam does not provide specific restrictions regarding this zoning in finding a partner. However, this zoning can be implicit in the recommendations of marriage in Islam. Bringing up conflict that has become a topic of discussion in many media and communities, which in the end, can create a solution for couples who find it difficult to find a life partner as well as presenting internal conflicts that pertain to the realm of privacy, intersect with the right of humans to freely choose from and where their partners. Regardless of a marriage that leads to the coercion of one partner or coincidence of finding the right partner according to the zoning where the couple lives.

Abstract

Religious pluralism is a constructive attitude, not only theological normative awareness but also social awareness, where we live in a pluralistic society in terms of religion, culture, ethnicity, and various other social diversity. In addition, religious pluralism must also be understood as a true affinity for diversity. Religious pluralism is a concept that has a broad meaning, is related to the acceptance of various religions, and is used in different ways. Pluralism aims to deconstruct absolutism, asserting relativism and underlying tolerance for differences, heterogeneity, and pluralism not only as facts that must be recognized but pluralism is seen and treated as a form of positivism, not negativism. Besides religious pluralism is also used as a unifying tool and glue for a country, both from the lower, middle and upper classes. In addition, a pluralist who promotes pluralism through pluralism must acknowledge and defend these differences, pluralism, and heterogeneity to be used as useful things. But in fact until now in the midst of society, there are still different perceptions in interpreting plurality and the term pluralism, understanding multicultural meaning based on sharia, not just mere personal perception.

Abstract

Narcotics abuse cases in Indonesia have been at an alarming level, which causes all levels of society to become targets of victims of narcotics abuse. Efforts to overcome this use two approaches in the narcotics law that regulate it, namely the penal approach and the non-penal approach, which are commonly referred to as the double-track system. As a form of transnational organized crime, narcotics crimes need special efforts to overcome them. Among the many substances of criminal legislation, one of the special measures that can be used is applying the benefits of the existence of the principle of strict liability. The discussion regarding the existence of the principle of strict liability will be the object of study in this paper, namely by using the normative legal research method which prioritizes the study of positive legal provisions and general legal principles. So, it can be found what the strict liability principle is in the teachings of criminal law and the use of the strict liability principle in enforcing criminal law in the field of narcotics in Indonesia. The principle of strict liability can be an option for a new breakthrough in the effectiveness and efficiency of combating narcotics crimes in Indonesia. Although the existence of the principle of strict liability in its implementation provides convenience and practicality for law enforcement officials in carrying out their duties, it also provides an opportunity for injustice. So that the focus of the application of the principle of strict liability is not only used as a means of making it easier but is more used to overcome injustice for the victim or the perpetrator in cases of narcotics abuse so that it will no longer cause an injustice that can injure the basic human rights contained in the paragraph 1 Article 28D of the Indonesia Constitution.Keywords: Narcotics, strict liability, transnational organized crime. Abstrak:Kasus penyalahgunaan narkotika di Indonesia sudah berada pada level yang mengkhawatirkan, yang menyebabkan semua lapisan masyarakat menjadi sasaran korban penyalahgunaan narkotika. Upaya penanggulangannya menggunakan dua pendekatan dalam undang-undang narkotika yang mengaturnya, yaitu pendekatan penal dan pendekatan non penal yang biasa disebut dengan sistem jalur ganda. Sebagai salah satu bentuk kejahatan transnasional terorganisir, kejahatan narkotika memerlukan upaya khusus untuk menanggulanginya. Di antara sekian banyak substansi peraturan perundang-undangan pidana, salah satu upaya khusus yang dapat digunakan adalah dengan menerapkan manfaat dari adanya prinsip pertanggungjawaban yang tegas. Pembahasan mengenai adanya asas strict liability akan menjadi objek kajian dalam tulisan ini, yaitu dengan menggunakan metode penelitian hukum normatif yang mengutamakan kajian ketentuan hukum positif dan asas hukum umum. Sehingga dapat diketahui apa prinsip strict liability dalam ajaran hukum pidana dan penggunaan prinsip strict liability dalam penegakan hukum pidana di bidang narkotika di Indonesia. Prinsip strict liability dapat menjadi pilihan terobosan baru dalam efektivitas dan efisiensi pemberantasan tindak pidana narkotika di Indonesia. Meskipun adanya prinsip strict liability dalam pelaksanaannya memberikan kemudahan dan kepraktisan bagi aparat penegak hukum dalam menjalankan tugasnya, namun juga memberikan peluang terjadinya ketidakadilan. Sehingga fokus penerapan prinsip strict liability tidak hanya digunakan sebagai sarana untuk mempermudah tetapi lebih banyak digunakan untuk mengatasi ketidakadilan bagi korban atau pelaku dalam kasus penyalahgunaan narkotika sehingga tidak lagi menimbulkan kerugian. ketidakadilan yang dapat mencederai hak asasi manusia yang terkandung dalam ayat 1 Pasal 28D Undang-Undang Dasar Negara Republik Indonesia.Kata Kunci: Narkotika; Strict Liability; Kejahatan Terorganisir Transnasional.

Abstract

The current job transformation is one of the challenges for the state of Indonesia. Crimes over time have been carried out systematically, including corruption. The interesting thing about the development of efforts to combat corruption is the development of the concept of returning state finances. Legal entities in Indonesia have long experienced legal pluralism, as can be seen from the configuration of the community that carries out Islamic criminal law and customary law as local wisdom. This study uses a normative approach with secondary data support with the specification that the confiscation of corruptor's property in Islamic criminal law is divided into: Reproaches and reprimands/warnings, dismissing from his position (al-azl min al-wadzifah), by beating (whipping), punishment in the form of property (fines) and physical punishment, exile, crucifixion, death penalty. The relevance between these concepts is a form of legitimacy for the legal significance that comes from the beliefs and needs of the community. This article raises the concept of positive law with concepts in Islamic criminal law to find the relevance of the two which will later become part of the effort to function Islamic criminal law into Indonesian positive law in order to achieve the goal of a fair law and reduce corruption.

Abstract

Hak teman tuli yang masih sulit didapatkan adalah hidup mandiri serta terlibat dalam masyarakat,maka diperlukan kesadaran juga kemampuan masyarakat untuk berkomunikasi dengan menggunakan bahasa isyarat. Dengan pekembangan teknologi terutama aplikasi mobile pembelajaran bahasa isyarat dapat dilakukan dimana saja dan kapan saja juga oleh siapa saja.Faktor penting dari aplikasi mobile adalah user interface,karena aplikasi mobile harus memiliki unsur kenyaman dan kemudahan pada saat dioperasikan oleh pengguna. Metode design thinking digunakan dalam penelitian ini, metode ini diketahui sebagai satu cara berpikir mendalam untuk mewujudkan pemecahan masalah, diawali oleh tahap empati pada suatu permasalahan yang berfokus pada manusia (human centered) menghasilkan terobosan yang berkesinambungan dan didasari oleh permasalahan pengguna, dalam metode ini terdapat lima tahap yaitu Empathize,Define,Ideate,Prototype dan Test.Untuk melakukan pengujian atau test peneliti melakukan pengujian dengan metode system usability scale. Penelitian ini menghasilkan suatu prototype aplikasi mobile pengenalan bahasa isyarat indonesia (BISINDO) bernama "i can hear you" . Berdasarkan pengujian Prototype menggunakan metode System Usability Scale (SUS) . Rata-rata nilai sus yang didapatkan sebesar 80,045, maka dapat disimpulkan bahwa aplikasi pengenalan bahasa isyarat Indonesia (BISINDO) “I can hear you” memenuhi kategori acceptable.
