Abstract

Consumer financing disputes can be resolved by litigation and non-litigation. However, the choice of dispute resolution raises an competence dispute between dispute resolution institutions. Thus giving rise to legal uncertainty and losses for the parties to the dispute. The purpose of this study is to analyze the competence of consumer financing dispute resolution institutions in Indonesia. This research is a normative juridical approach with a legal, conceptual and case approach. The results of this study are that each dispute resolution institution has the attribute attributive in resolving consumer financing disputes. The competence to settle consumer financing disputes for each settlement institution must pay attention to two aspects, including the types of consumer financing disputes; and the choice of dispute resolution based on the agreement of the parties.

Abstract

Abstract

Penelitian ini difokuskan pada Pasal 65 Ayat (5) UU No.7 Tahun 2014, dalam penjelasan pasalnya menentukan bahwa mekanisme penyelesaian sengketa e-commerce lainnya adalah yang sesuai dengan ketentuan peraturan perundang-undangan. Namun, saat ini di Indonesia belum terdapat hukum yang mengatur mengenai arbitrase online. Hal serupa terjadi di Cina, yang belum terdapat aturan yang mengatur mengenai arbitrase online. Akan tetapi CIETAC, salah satu lembaga arbitrase Cina mampu menerapkan arbitrase online. Sedangkan di Indonesia, BANI belum sepenuhnya menerapkan arbitrase online. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan perbandingan. Hasil dari penelitian ini adalah arbitrase online dapat dijadikan alternatif penyelesaian sengketa e-commerce di Indonesia. BANI belum sepenuhnya menerapkan arbitrase online, belum tersedia peraturan prosedur arbitrase online, dan belum tersedia laman khusus arbitrase online. Sebaliknya, CIETAC dapat menerapkan sepenuhnya arbitrase online, tersedia peraturan prosedur arbitrase online dan tersedia laman khusus arbitrase online.Kata kunci: Alternatif Penyelesaian Sengketa, Arbitrase Online, E-commerce

Abstract

This article focuses on legal comparisons between Indonesian law and China law regarding arbitration and alternative dispute resolution, especially online arbitration. The author sees a similarity in terms of law, namely that there is no single law regulating the use of online arbitration. Even more, the conditions of the Covid-19 pandemic focused alternative dispute resolution to be carried out online as well. This paper is normative legal research with a comparative approach. The results of this paper are neither in Indonesia nor China regulates online arbitration in their legal system, but both provide opportunities for online arbitration to be held. There are differences in Indonesia and China. In Covid-19 pandemic situation force BANI Arbitration Center implemented online arbitration. But in China, China International Economic and Trade Arbitration Commission (CIETAC) fully implement online arbitration before covid-19 pandemic.

Abstract

The government is authorized to carry out agricultural water management in the village. This agricultural water management aims to ensure that water needs are well fulfilled and sustainable for the welfare of village communities. In this case, the Yosowilangun Lor Village Government, Yosowilangun District, Lumajang Regency, seeks to maintain sustainable agricultural water governance through the authority of the Village Government by establishing Village Regulation Number 7 of 2021 concerning Sustainable Agricultural Water Governance. However, based on the analysis of the situation, there are still problems regarding the implementation of Village Regulation 7 of 2021 concerning Sustainable Agricultural Water Governance, especially regarding the institutional structure and culture of the community in carrying out agricultural water governance in the country. Therefore, in order to strengthen the institutional structure. Moreover, the culture of the community in carrying out agricultural water governance in the village, steps are needed to strengthen the institutional management of agricultural water in the village.

Abstract

The Minyakita case in Indonesia highlights the vulnerable position of consumers vis-à-vis business actors, particularly concerning the accuracy and reliability of product labeling. This issue underscores the ongoing risks consumers face in accessing goods conforming to package labels’ quality and standards. This research aims to analyze legal violations in the Minyakita case, specifically those related to misleading or non-compliant labeling practices, and to examine systemic weaknesses in the regulatory oversight of cooking oil distribution in the Indonesian market. Furthermore, this study compares Indonesia’s regulatory framework with Japan’s, especially regarding product labeling standards and the oversight of essential goods. The research explores loopholes and law enforcement challenges within Indonesia’s existing consumer protection framework, particularly concerning using state-owned brands and distributing public goods. It also presents a comparative analysis of Japan’s consumer protection regime, highlighting Japan’s stronger institutional oversight, crisis response mechanisms, and market discipline. Findings indicate that although Indonesia has a comprehensive legal foundation for consumer protection, its regulatory enforcement and institutional coordination remain weak. This research concludes by offering five policy recommendations to enhance transparency, public accountability, and consumer empowerment, fostering a fairer and more resilient essential commodities distribution system.

Abstract

The rapid development of AI-generated art that mimics the signature styles of human artists, exemplified by the ghiblification phenomenon, poses a crucial problem for the copyright protection of artistic style, which is traditionally unprotected. This research aims to critically analyze this legal challenge, conduct a comparative study of the copyright regulatory frameworks in Indonesia, the United States, the European Union, and Japan concerning AI art and the issue of artistic style, and formulate policy recommendations for Indonesia. Using a normative juridical research method through statute, conceptual, and comparative approaches, this study examines the legislation, doctrine, and practices in these four jurisdictions. The results show that ghiblification confirms the vulnerability of artistic style; although style as an idea is not protected, the replication of specific expressions by AI can still potentially constitute copyright infringement. The comparative analysis reveals significant variations in approach: the United States strictly requires human authorship, Japan offers flexibility for using data for AI training with a proviso, and the European Union seeks a balance through a TDM exception, while Indonesia still faces a specific regulatory vacuum. Nevertheless, a global consensus exists on the importance of human creative contribution for the recognition of copyright. It is concluded that the existing copyright legal framework, particularly in Indonesia, is inadequate to respond to the disruption of AI-generated art, thus requiring urgent juridical adaptation. This study recommends legal reform in Indonesia, including the clarification of the status of AI-generated art, the consideration of licensing models, and the strengthening of moral rights aspects in order to balance technological innovation with fair artistic protection.
