Abstract

Melalui pemberlakuan Undang-Undang Nomor 2 Tahun 2018, Dewan Perwakilan Daerah (DPD) diberikan wewenang dan tugas baru untuk melakukan pemantauan dan evaluasi atas rancangan peraturan daerah dan peraturan daerah. Hadirnya wewenang dan tugas baru ini pun memberikan tantangan tersendiri bagi DPD. Jika DPD tidak tepat dalam merumuskan lingkup tersebut, maka kekhawatiran terjadinya tumpang tindih wewenang dan tugas dengan Pemerintah Pusat akan terjadi. Selain itu, DPD juga harus mampu membedakan karakter antara pengawasan Perda yang dilakukan oleh lembaga legislatif dan lembaga eksekutif. Untuk menghindari adanya tumpang tindih wewenang, maka pemantauan dan evaluasi yang dilakukan DPD dapat lebih ditekankan pada upaya merumuskan permasalahan yang dihadapi oleh daerah dalam hal penyusunan rancangan Perda, perumusan materi rancangan Perda dan pelaksanaan Perda. Tindak lanjut atas hasil dari perumusan masalah yang didapatkan oleh DPD diarahkan dalam bentuk rekomendasi kebijakan sebagai pertimbangan terhadap penyusunan materi muatan peraturan perundang-undangan yang mengatur otonomi daerah.

Abstract

The press law is legal products that are responsive. It can be seen from the process of formation a press law with participatory manner. The material of press law also has been accomplished with the needs and desires of the people because it gives protection and guarantee against press freedom. In spite of the press law are responsive, but it was still not enforced effectively because it still occurs the practice of violence against practitioners of the press and press freedom abuse. This indicates that the guarantee and protection of press freedom through a press law is still not enough. In this context, the consolidation of democracy requires the existence of an increased public commitment fundamentally to use democratic procedures to organize public spaces that appear in the process of state. Therefore, it takes awareness and commitment together so press freedom can be realized. The Press law needs to be enforced consistently by all elements. The State should provide protection for practitioners by cracking down firmly the perpetrators of violence against practitionersof the press. In addition, the guarantee and protection of press freedom should be balanced with the professionalism of the practitioners of the press, by complying the code ethics of the profession and improve the ability of the press and journalism through education and training because press freedom without the limitations of law and ethics, produce an excessive press freedom.

Abstract

The government is authorized to carry out agricultural water management in the village. This agricultural water management aims to ensure that water needs are well fulfilled and sustainable for the welfare of village communities. In this case, the Yosowilangun Lor Village Government, Yosowilangun District, Lumajang Regency, seeks to maintain sustainable agricultural water governance through the authority of the Village Government by establishing Village Regulation Number 7 of 2021 concerning Sustainable Agricultural Water Governance. However, based on the analysis of the situation, there are still problems regarding the implementation of Village Regulation 7 of 2021 concerning Sustainable Agricultural Water Governance, especially regarding the institutional structure and culture of the community in carrying out agricultural water governance in the country. Therefore, in order to strengthen the institutional structure. Moreover, the culture of the community in carrying out agricultural water governance in the village, steps are needed to strengthen the institutional management of agricultural water in the village.

Abstract

Upon the enactment of Law No 2 in 2018, the Regional Representative Council has been given a new authority and task to monitor and evaluate the Local Regulations. The establishment of the new authority and task has provided a challenge for the Regional Representative Council in determining the scope of monitoring and evaluation. Overlap of functions might occur because the central government is also responsible for supervising the Local Regulations. Therefore, the Regional Representative Council should be able to spot the differences in the Local Regulations supervised by the legislative or executive councils. To avoid overlapping authorities, the monitoring and evaluation scope should be focused on formulating problems that are faced by the local government in planning, preparing, and implementing the Local Regulations. These results will, thus, be established in a form of a policy recommendation for preparing materials contained in a local autonomy law.

Abstract

This dissemination activity aims to instill and improve the religious-nationalist character of senior students and teachers at the Muhammadiyah Al-Munawaroh Islamic boarding school to maintain harmony between religious communities and with internal religious communities. Strengthening religious-nationalist values ​​provided training methods consisting of socialization, problem identification, socio-economic and cultural mapping of society to senior students and teachers. The techniques used include conducting surveys, focus group discussions, and designing training projects. The results of this dissemination activity show that it is working effectively to develop the capacity of students and teachers, as well as providing improvements in Islamic boarding school management, curriculum design and roles in society. Santri and teachers from various regions in Indonesia are given the knowledge and skills needed to become pioneering preaching cadres of religious-nationalist character in society.

Abstract

Based on the 2018 PISA report, the literacy and analytical abilities of Indonesian students are still very low. Poor literacy and analytical competence can be one of the factors that cause the low comprehension ability of Indonesian students in understanding and reading information. One method that has been proven to improve students' competence and skills, especially in analytical skills and increase students' curiosity is inquiry-based learning. Unfortunately, not all teachers have the pedagogical competencies needed to conduct inquiry learning. This problem is also seen in teachers in MTs. Nurul Huda Malang. Therefore, this community service activity is carried out to increase the capacity and pedagogical competence of teachers to improve the quality of learning that can trigger analytical attitudes in students. The implementation of service is carried out through several stages, namely: surveys and learning observations, training syllabus design, training implementation, and training evaluation. From the results of the implementation evaluation, it is known that the inquiry learning training is very useful and can be immediately applied by the teacher. In addition, there are other opportunities in the future to carry out training related to digital learning media needed by teachers in MTs. Nurul Huda Malang.

Abstract

This community service program in Ngroto Village, Pujon District, Malang Regency aims to increase community understanding and skills in formulating rules for participating villages. This activity was launched to follow up on the results of a previous study on the obstacles to village code formation. In principle, the formation of a village order in Ngroto Village follows the path specified in Permendagri No. 111 of 2014 from the Technical Guidelines for the Village Law, however, sometimes the process of forming the village order encounters obstacles. The obstacles that arise are: (1) the identification of opportunities and problems as outlined in the draft village regulations is not precise, detailed and complete; (2) lack of direct participation from some communities in drafting village regulations; (3) the process of drafting village regulations took longer during the Covid-19 pandemic; (4) lack of socialization and knowledge of village officials' projects; and (5) the lack of dissemination of village regulations which were transferred to the RT/RW level. This non-profit activity is carried out through advocacy and facilitation methods. Finally, an ideal village can be created through optimal community participation in the village development process, where the village government leadership responds to the wishes and aspirations of the village community.

Abstract

Community participation in budgeting is a crucial element in maintaining transparency and accountability in regional financial management. Based on Government Regulation of the Republic of Indonesia Number 45 of 2017 concerning Community Participation in Local Governance, regional governments are required to encourage public involvement in the process of formulating general budget policies for regional revenue and expenditure as well as temporary budget priorities and ceilings. This participatory process involves gathering input from the community through various methods such as surveys, community meetings, or online platforms. Despite the existing regulations, there are challenges in implementation, including a lack of public understanding of public budgets and bureaucratic resistance. Legal aspects also play a significant role in either encouraging or hindering community participation. This study aims to analyze the legal framework governing community participation in the budgeting process in Indonesia, identify the legal obstacles faced, and provide policy recommendations to enhance community participation. By implementing recommendations such as the use of e-Participatory Budgeting (e-PB) and participatory design, it is expected that community participation in the budgeting process will increase, resulting in public policies that are more responsive to the needs and aspirations of the community, and strengthening accountability and transparency in governance. Partisipasi masyarakat dalam penganggaran merupakan elemen krusial dalam menjaga transparansi dan akuntabilitas pengelolaan keuangan daerah. Berdasarkan Peraturan Pemerintah Republik Indonesia Nomor 45 Tahun 2017 tentang Partisipasi Masyarakat dalam Penyelenggaraan Pemerintahan Daerah, pemerintah daerah diwajibkan mendorong keterlibatan masyarakat dalam proses penyusunan kebijakan umum anggaran pendapatan dan belanja daerah serta prioritas dan plafon anggaran sementara. Proses partisipasi ini melibatkan pengumpulan masukan dari masyarakat melalui berbagai metode seperti survei, pertemuan komunitas, atau platform online. Meskipun regulasi telah ada, terdapat tantangan dalam implementasi, termasuk kurangnya pemahaman masyarakat tentang anggaran publik dan resistensi birokrasi. Aspek hukum juga berperan penting dalam mendorong atau menghambat partisipasi masyarakat. Kajian ini bertujuan untuk menganalisis kerangka hukum yang mengatur partisipasi masyarakat dalam proses penganggaran di Indonesia, mengidentifikasi kendala hukum yang dihadapi, dan memberikan rekomendasi kebijakan untuk meningkatkan partisipasi masyarakat. Melalui penerapan rekomendasi seperti penggunaan e-Participatory Budgeting (e-PB) dan desain perancangan partisipatif, diharapkan partisipasi masyarakat dalam proses penganggaran dapat meningkat, sehingga kebijakan publik yang dihasilkan lebih responsif terhadap kebutuhan dan aspirasi masyarakat, serta memperkuat akuntabilitas dan transparansi dalam pemerintahan.

Abstract

Partisipasi menjadi salah satu asas dalam penyelenggaraan pemerintahan desa. Undang-Undang Nomor 6 Tahun 2014 tentang Desa mengartikan bahwa partisipasi adalah turut berperan aktif dalam suatu kegiatan. Partisipasi masyarakat pada hakikatnya merupakan sarana untuk menghindari penyalahgunaan kekuasaan oleh pemimpin, menyalurkan aspirasi masyarakat, melibatkan masyarakat dalam pengambilan keputusan publik, dan menegakkan kedaulatan rakyat. Hal ini memberikan pemahaman bahwa dalam penyelenggaraan pemerintahan desa, diperlukan adanya ruang bagi masyarakat desa untuk ikut serta dalam kegiatan yang diselenggarakan oleh pemerintahan desa, termasuk dalam proses pembentukan peraturan desa. Namun, partisipasi masyarakat dalam pembentukan peraturan desa pada dasarnya masih perlu diselaraskan dengan konsep partisipasi yang bermakna sebagaimana diatur dalam ketentuan mengenai Pembentukan Peraturan Perundang-undangan. Sebab, peraturan desa merupakan salah satu jenis peraturan perundang-undangan, sehingga proses pembentukannya juga harus memenuhi kaidah-kaidah pembentukan peraturan perundang-undangan. Selain itu, dengan adanya perwujudan konsep partisipasi yang bermakna dalam pembentukan Peraturan desa maka partisipasi akan masuk dalam suatu kerangka pertukaran pikiran yang bersifat terbuka dan komunikatif (dialogis).
