Abstract

The law of the sea, which is a branch of international law, has developed a long time ago and has undergone very significant changes in its regulations. Moreover, the law of the sea plays a very important role in limiting the areas of the sea, land, and waters of a country. Which here the sea is a road that is very often used to connect one country to another for trade purposes and even for other interests. On the other hand, there is international maritime law to protect natural resources from being misused. The International Court of Justice is to resolve disputes between member countries. This institution also provides opinions or advice to official bodies and specialized agencies established by the United Nations. In carrying out its duties, the International Court of Justice refers to international conventions to determine cases recognized by countries in dispute. The ICJ is also guided by international customs which are evidence of common practice.

Abstract

Film Ice Cold : Murder, Coffee, and Jessica Wongso akhir-akhir ini menjadi isu yang kontroversial di tengah masyrakat. Satu sisi menilai terdapat kejanggalan yang luar biasa yang harus di ungkap dalam kasus pembunuhan Wayang Mirna Salihin dengan kopi sianida hingga fil ini daat dijadikan petunjuk. Pada sisi lain, sebagaian masyrakat menilai film ini berpihak, menggiring opini publik, dan sebagai alat komersialisasi oleh pihak Netfflix. Penelitian ini bertujuan untuk menganalisis dua perspektif yang kontroversial di atas. Penelitian merupakan penelitian kualitiatf dengan pendekata deskriptif. Data yang digunakan dalam penelitian ini merupakan data sekunder yang didapatkan dari kutipan fil, sinopsis, buku, jurnal ilmiah, dan website yang kredibel. Data-data yang diukumpulkan dinalaissi dengan tahapan pengumpulan data, seleksi data, reduksi data, dan penarikan kesimpulan. Hasil penelitian menujukkan 1.) The film Ice Cold: Murder, Coffee, and Jessica Wongso can indirectly strengthen Jessica Wongso's side in filing for extraordinary legal action/judicial review which will then be constructed by constructing an argument as if the application for reconsideration this time is based on public unrest and complaints. 2.) The film Ice Cold: Murder, Coffee, and Jessica Wongso has the potential to become a commercialization tool because the film is paid, viral, and has cheap production costs compared to action films, horror films, and so on. 3.) Researchers agree with singer and actor Brissia Jodie that Netflix should make a part two film with a more balanced storyline on both sides.

Abstract

Hukum Internasional di dunia melibatkan sebagian besar perjanjian Internasional sebagai suatu langkah untuk membatasi pelanggaran yang terjadi. Dimana baru-baru ini muncul senjata baru yang bersifat otonom. Dimana senjata ini bisa memilih dan membidik sasaran tanpa campur tangan manusia. Senjata tersebut adalah Lethal Autonomous Weapon System yang sekalinya diaktifkan tidak dapat mentoliler apapun itu yang akan diserang, baik itu kombatan ataupun non kombatan bahkan akan menyerang diamanapun tempatnya tanpa melihat situasi. Penelitian ini merupakan penelitian hukum yang bertujuan untuk mengkaji bagaimana legalitas Lethal Autonomous Weapon System dilihat dari Humaniter Internasional. Tulisan ini menggunakan metode penelitian hukum normatif dengan pendekatan kualitatif analisis data deskriptif. Mekanisme dari senjata yaitu untuk pertahanan ketika perang bukan untuk menjadi ajang kehancuran yang tidak perlu dan bahkan menimbulkan korban penduduk sipil. Dapat ditarik kesimpulan bahwa perlu adanya aturan hukum yang membatasi ataupun untuk melarang senjata ini beroperasi. Dapat dipahami bahwa Lethal Autonomous Weapon System masih sangat jauh untuk memenuhi prinsip-prinsip Hukum Humaniter Internasional, dan tidak mungkin senjata ini akan legal jika dalam pengoperasian nya saja tidak ada campur tangan manusia.

Abstract

The background of this research is that interfaith marriages are not explicitly regulated in Law no. 16 of 2019 concerning Amendments to Law no. 1 of 1974 concerning Marriage, so there is a legal vacuum to strictly regulate interfaith marriages in Indonesia. This is because more and more people in Indonesia are doing interfaith marriages. With the Law no. 23 of 2006 concerning Population Administration (UU Adminduk) can accommodate interfaith marriages being disabled, but in practice it is best not to do so. Article 35 letter a of the Adminduk Law relating to interfaith marriages is a special rule that overrides more general regulations and does not erase old provisions, so that Law no. 16 of 2019 concerning Amendments to Law no. 1 of 1974 concerning Marriage is still valid in the national regulatory system in the field of marriage. With the existence of rules that prohibit interfaith marriages as a solution to overcome the legal vacuum by not giving rights to interfaith marriage actors to register their marriages through a court order. As for the legality of marriage materially, it still returns to the laws of their respective religions, while with regard to formal, civil law relations arising from marriage, if the marriage has received legal recognition, then everything is protected by law. The rejection of interfaith marriages in Indonesia is basically a discriminatory act that is not in accordance with the principles of Human Rights (HAM) itself. However, humans are obliged to prioritize their basic human obligation to comply with their religious laws and the state as law enforcer needs to regulate prohibitions on interfaith marriages so that violations do not occur in society.

Abstract

Akselerasi digitalisasi berdampak pada meningkatnya pengguna internet yang sejalan dengan meningkatnya pengguna media sosial, termasuk anak-anak. Siswa SDN 3 Paras 85% telah memiliki dan menggunakan media sosial. Namun, siswa-siswi ini belum memahami dampak dari penggunaan media sosial. Salah satu cara untuk mencegah kecanduan adalah dengan memberikan edukasi tentang pengaruh negatif penggunaan gadget pada anak SD. Kegiatan ini dilakukan melalui Sosialisasi Penggunaan Media Sosial dalam Upaya Mencegah Social Media Addiction Pada Siswa SDN 3 Paras. Dalam kegiatan ini, Tim KKN Kelompok 1 UBY membagi dalam (4) sesi. Pertama, pemateri memaparkan materi tentang media sosial dan dampaknya mulai dari pengertian media sosial, apa saja media sosial itu, pengaruh penggunaan media sosial, serta upaya pencegahan kecanduan dari penggunaan media sosial. Kedua, pengadaan sesi tanya jawab untuk mengetahui pemahaman siswa terkait media sosial untuk menguji tingkat pemahaman siswa. Ketiga, pengadaan games untuk menghibur siswa. Keempat, evaluasi kegiatan dilakukan untuk mengetahui sejauh mana siswa-siswi SDN 3 Paras memahami dampak negatif dari penggunaan media sosial. Kegiatan ini memperoleh tanggapan yang baik dari siswa-siswa serta guru di SDN 3 Paras. Hasil dari kegiatan ini adalah siswa-siswa dapat menyebutkan jenis-jenis media sosial, dampak yang dialami jika terlalu sering menggunakan gadget dan bermain media sosial sehingga dari kegiatan ini diharapkan siswa-siswi lebih bijak dan lebih selektif dalam mengakses media sosial

Abstract

Cyber ??operations began to attract attention in international law in the late 1990s, in 1999 the United States Naval War College held the first major legal conference on this issue. In the aftermath of the attacks of September 11, 2001, transnational terrorism and subsequent armed conflict shifted attention from topics to large-scale cyber attacks. Operations occurred in Estonia in 2007 and against Georgia during its war with the Russian Federation in 2008, as well as cyber incidents such as the targeting of Iran's nuclear facilities with the Stuxnet Worm in 2010. Cyber ??warfare is included in organized crime and terrorism as one of the level one threats. The United States National Security Strategy itself calls cyberwarfare one of the most serious national security, public safety and economic challenges that we face as a nation and state. There is a need for clear and concrete international and national legal regulations so that cyber warfare can be prevented and does not cause unnecessary casualties in accordance with the principles of international humanitarian law. Apart from clear regulations, support is needed in the defense sector to form human resources and at the military defense level.

Abstract

The phenomenon of Trafficking in Persons (TIP) targeting Indonesian citizens (WNI) in Cambodia in recent years highlights the vulnerability within the cross-border legal protection system for victims. These cases are predominantly orchestrated by international criminal syndicates utilizing online job scamming schemes, ensnaring hundreds of WNI into economic and psychological exploitation. This study aims to analyze the urgency of the Indonesian government's preventive and corrective measures in combating TIP against WNI in Cambodia, employing a national and international legal approach. The methodology used is normative legal research, incorporating statutory, conceptual, and case study approaches. The research findings indicate that the government's preventive efforts are still reactive and lack comprehensive integration. Conversely, corrective measures, particularly victim handling, have not been adequately balanced with sufficient recovery support (including psychological and legal rehabilitation). This study emphasizes the critical need for synergy between the Governments of Indonesia and Cambodia. Furthermore, harmonization of national laws with the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children (Palermo Protocol), is essential to strengthen the protection mechanism for WNI victims of TIP abroad.

Abstract

This study aims to analyze how principles of international law are integrated into Indonesia's national legal system—including the status of international principles, integration mechanisms (ratification, incorporation, transformation), as well as the challenges and implications. The method used is normative juridical with statute, conceptual, and historical approaches. The research results indicate that Indonesia has normatively accommodated the integration of international law principles; however, there are obstacles such as a status that is not yet fully automatic (dualistic), low regulatory harmonization, and resistance to external influence. It is recommended that the harmonization of national regulations with international obligations be strengthened, and that international law literacy within national institutions be improved.

Abstract

The persistent problem of long waiting times in Indonesia’s National Health Insurance (JKN) services has raised concerns about the fulfillment of the right to health guaranteed under Article 12 of the International Covenant on Economic, Social and Cultural Rights (ICESCR). Although the AAAQ framework Availability, Accessibility, Acceptability, and Quality does not explicitly mention timeliness, delays in medical services directly affect accessibility and quality. This study aims to examine whether service delays within JKN indicate potential non-compliance with Indonesia’s international human rights obligations. Using a normative legal method supported by targeted case illustrations, this research analyzes the alignment between ICESCR standards and the implementation of JKN policies, particularly regarding disparities in service delivery and prolonged waiting times. The findings show that unequal distribution of health facilities, inconsistent service quality between insured and non-insured patients, and extended queues at primary and referral facilities undermine the substantive elements of accessibility and quality. These conditions may constitute a potential breach of the core obligations outlined in ICESCR, despite the absence of a binding enforcement mechanism. Strengthening facility capacity, improving digital service systems, and ensuring equitable distribution of health personnel are identified as essential measures to ensure timely, non-discriminatory, and rights-based health services.

Abstract

The research is aimed to figure out whether the International Law is a genuine law. This concerns with why the international community is willing to obey the international law though it lacks of formal institutions that are in charge of empowering the law. This is a normative legal research. The data used in this research are the secondary data along with the secondary law material that is in the form of research result. Through this research, it can be concluded that the nature of coordinative relationship among international community - not having a supranational institution that has an authority in making and forcing the validity of certain international regulation at once to the citizens of nations that are breaking the international law – will not decrease the existence and the essence of the international law as a legal norm. The most major factor emerging the acceptance and the obedience of the international community towards its regulation is the awareness and the needs of all people towards which regulation that can offer the law and order, justice, and law enforcement that can be done and of which can not be done in the practice of the international law. The internally emerged obedience will offer a better result that the one emerged by the punishment.
