Abstract

Pada era ini pengaruh globalisasi sangat kuat, terlebih lagi dalam bidang ilmu pengetahuan, teknologi, informasi, dan komunikasi mengalami perkembangan yang pesat. Dunia sedang bergerak ke arah baru dan menuntut untuk diikuti perkembangannya tidak terkecuali dengan Indonesia. Dalam bidang ekonomi transaksi penjualan dan pembelian menjadi aspek yang sangat penting dalam perekonomian, karena perkembangan yang pesat ini dalam hal transaksi penjualan dan pembelian tidak harus penjual dan pembeli bertemu secara langsung tetapi sekarang melalui media dunia maya atau internet, kita bisa melakukan transaksi jual beli kapan pun dan di mana pun kita berada tanpa harus bertemu secara langsung. Melihat trend perkembangan ini sebagian masyarakat tidak menggunakan uang konvensional seperti pada umumnya tetapi mulai beralih menggunakan digital currency yang dilindungi oleh kriptografi, diantara digital currency yang beredar yang paling terkenal adalah Bitcoin. Dalam perjalanan Bitcoin sendiri mengalami berbagai polemik dalam penggunaannya di dunia bahkan di Indonesia sendiri, karena di Indonesia sendiri Bitcoin belum diakui eksistensinya dan belum ada regulasi jelasnya. Bahkan dalam islam pun para ulama seputar Bitcoin ini masih menjadi perdebatan apakah Bitcoin ini dikatakan halal atau haram apabila di kaji dalam Al-Quran, hadits, ijma maupun sumber islami lainnya. Kata kunci: Bitcoin, digital currency, hukum islam  ABSTRACT In this era, the influence of globalization is very strong, even more so in the fields of science, technology, information, and communication experiencing rapid development. The world is moving in a new direction and demands to be followed by its development is no exception with Indonesia. In the field of economics, sales and purchase transactions are a very important aspect of the economy, because of this rapid development in terms of sales and purchase transactions, it is not necessary for the seller and buyer to meet directly, but now through cyberspace media or the internet, we can carry out buying and selling transactions anytime wherever and wherever we are without having to meet in person. Seeing this development trend some people do not use conventional money as in general but instead began to switch to using a digital currency that is protected by cryptography, among the most well-known digital currencies in circulation is Bitcoin. The course of Bitcoin itself experiences various polemics in its use in the world even in Indonesia itself because in Indonesia itself Bitcoin has not been recognized for its existence and there are no clear regulations. Even in Islam, the scholars around Bitcoin are still being debated whether Bitcoin is said to be halal or haram if it is examined in the Koran, hadith, ijma or other Islamic sources. Keyword: Bitcoin, digital currency, Islamic Law

Abstract

Perbankan syariah adalah suatu sistem perbankan yang dikembangkan berdasarkan syariah (hukum) Islam. Indonesia yang sebagian besar penduduknya adalah muslim memberikan ruang yang cukup lebar bagi perkembangan bank syariah. Perkembangan perbankan syariah di Indonesia telah menjadi tolak ukur keberhasilan eksistensi ekonomi syariah. Secara yuridis formal kedudukan hukum perbankan syari’ah adalah kuat dan sejajar dengan perbankan konvesional lainnya. Penelitian ini bertujuan untuk mendiskusikan pembiayaan dalam perbankan syariah dan dasar hukum pembiayaan tersebut.. Ada tiga macam pembiayaan dalam perbankan syariah yaitu pembiayaan modal kerja syariah, pembiayaan konsumtif syariah, dan pembiayaan investasi syariah. Sedangkan dasar hukum pelaksanaan perbankan syariah adalah undang-undang No. 10 tahun 1998.  Kata Kunci: Hukum; Perbankan Sariah; Pembiayaan

Abstract

Islam disyariatkan hanya untuk memberikan kemaslahatan kepada seluruh manusia dan menghindari dari kemudharatan. Salah satu petunjuk Allah dalam syariat islam adalah diperintahkannya menikah dan diharamkannya berzinah. Perintah kawin merupakan salah satu implementasi dari Al-Maqasyid Al-Khamsah yaitu hifzhul nasl. Tulisan ini untuk menggambarkan pemahaman tentang apa itu perkawinan,rukun dan syarat perkawinan, hukum  perkawinan serta bagaimana pencatatan perkawinan dan hak keperdataan istri dan anak. Melalui tema ini berusaha untuk diuraikan. Adapun kesimpulan yang dapat dirumuskan perkawinan adalah suatu perjanjian suci antara seorang pria dan perempuan untuk membangun rumah tangga yang bahagia. Dan sah apabila telah memenuhi rukun dan syarat. Dimana Hukum dalam perkawinan ada 5 yaitu wajib, sunnah, makruh, mubah, dan haram. Dan perkawinan yang baik itu dicatatkan disertai pembuktiannya dengan akta nikah sehingga akan mendatangkan maslahat untuk pihak istri dan keturunannya.

Abstract

ABSTRACTOne of the duties of a Notary is to read out the deed in the presence of the parties involved as mandated by the law. This research aims to determine the responsibility, legal consequences, and sanctions against a Notary for deeds not read out in the presence of the parties. The research method employed is a juridical-normative approach. The findings conclude that a Notary's responsibility for unread deeds may result in moral and legal accountability for the material accuracy of the deed. The legal consequence is that the deed may degrade into a private deed with imperfect probative force, thus providing inadequate legal protection. Sanctions for such actions may include oral warnings, written warnings, temporary dismissal, honorable dismissal, or dismissal without honorKeywords: Responsibility; Notary; Deed.ABSTRAKSalah satu kewajiban Notaris adalah membacakan akta dihadapan penghadap sesuai dengan perintah Undang-Undang. Penelitian ini bertujuan untuk mengetahui tanggung jawab, akibat hukum dan sanksi notaris terhadap akta yang tidak dibacakan dihadapan penghadap. Metode penelitian ini menggunakan pendekatan yuridis normatif. Hasil penelitian menyimpulkan bahwa tanggung jawab notaris terhadap akta yang tidak dibacakan, Notaris dapat dikenakan tanggung jawab secara moral dan perdata atas kebenaran materiil akta yang dibuatnya. Akibat hukum tersebut akta dapat terdegradasi menjadi akta di bawah tangan dan memiliki kekuatan pembuktian yang belum sempurna sehingga tidak dapat memberikan perlindungan hukum. Sanksi atas perbuatan Notaris tersebut berupa teguran lisan, teguran tertulis, pemberhentian sementara, pemberhentian dengan hormat, sampai pemberhentian dengan tidak hormat.Kata Kunci: Tanggung Jawab; Notaris; Akta.

Abstract

The Acquisition Duty of Right on Land and Building, commonly known as BPHTB, is a tax levied upon the acquisition of land and/or building rights. This study scrutinizes the circumstances under which BPHTB becomes payable in sale and purchase transactions regulated by the HKPD Law and investigates their misalignment with the practical realities of the property market. Employing the constructivism paradigm method and a qualitative approach, the research reveals that the criteria stipulated in the HKPD Law for paying BPHTB need to harmonize with the actual dynamics observed in property transactions. Notably, the study underscores that the timing outlined in the HKPD Law for BPHTB payment needs to align with the foundational philosophy of BPHTB as a tax designed to facilitate the transfer of asset ownership. The incongruities identified prompt critical reflections on the current regulatory framework. The study contends that the misalignment between the HKPD Law and the essence of BPHTB necessitates reevaluating the legislation to ensure its responsiveness to the real-time intricacies of property acquisitions. The findings advocate for a more coherent and aligned approach to the stipulations of BPHTB payment, emphasizing the need for adjustments that better encapsulate the intended purpose of this tax, which is the seamless transfer of asset ownership in property transactions.

Abstract

PPAIW has the main task of providing waqf administration and serving the needs of prospective wakif who will donate their assets by following per under the provisions of the legislation. The purpose of the PPAIW is so that the community gets authentic evidence that waqf has occurred. The existence of PPAIW makes waqf law change from a law that lives in the community to a written law that must be recorded by the state. However, that reality shows that PPAIW's performance in enforcing waqf law has not met the standards. The purpose of this study is to analyze the performance of PPAIW in enforcing the waqf law and formulate efforts that can be made in enforcing the waqf law. This research uses the empirical juridical method with qualitative analysis. PPAIW's performance in enforcing waqf law in Indonesia has not been by following per under good work indicators, because there are several legal problems in carrying out their obligations, so their performance is not up to standard. Efforts must be made to enforce waqf law, namely; increase PPAIW resources; realize a corruption-free government, and KKN; provide good service (good governance); guard nadzir in the land registration process; provide a decree for the appointment of nadzir; empowering nadzir and the community; mastering dispute resolution mechanisms and advocating for the community; comfortable office atmosphere and support PPAIW performance.

Abstract

A notarial deed must be signed by the parties involved. In some cases, the parties involved cannot put their signatures. The purpose of this study was to find out whether thumbprints can replace signatures in making notarial deeds and their legal consequences. This study uses normative legal research with secondary data and library research. The results of this study according to Article 1874 of the Civil Code and Article 44 paragraphs (1) and (2) of the UUJN regulates the affixing of a thumbprint as a substitute for a signature in making notarial deeds to people who are sick or disabled to read and write. These articles state that affixing a thumbprint as a substitute for a signature can be done on condition that the affixing must be done before an authorized official (Notary) and the Notary is required to include information or reasons regarding the person not being able to sign. The legal consequences of a deed not being signed are replaced by using a thumbprint, which is still valid and legally binding as an authentic deed as long as the provisions contained in Article 1874 of the Civil Code and Article 44 paragraphs (1) and (2) UUJN are fulfilled.

Abstract

The making of an authentic deed from a notary is not based solely on existing regulations but is the wish of each related party so that there is certainty regarding the rights and obligations they have. A notary who does not read out the deed that has been made may be subject to punishment in accordance with Article 16 paragraph 9 UUJN. In its implementation (Das Sein), there are Notaries who often do not read the notes they have made even though in the last sentence they say it is explained that what has been made has been read out by the Notary concerned. This raises new problems and makes the roof related to a deed under the hand and makes the party who wants it loses. The research to be carried out is a type of normative legal research through the study of literature and other legal materials, for example related to legal principles, positive law, legal principles and also the rule of law. The results of the study show that according to article 16 paragraph 1 letter (m) UUJN which explains that a notary is required to read every deed that has been made before the appearers and the legal consequences of a deed that are not in accordance with Article 16 paragraph 1 letter (1) UUJN are deed that made with a stamp or stamp that includes the symbol of the Unitary Republic of Indonesia and in a circular space the name, position and location of office of the relevant notary who makes the deed a private deed are stated in the circular space. This makes assets unable to be used according to the interests facing which of course makes the related parties lose money.

Abstract

To optimize the implementation of the national health insurance program (JKN), increase accessibility to quality medical services, and ensure the sustainability of the JKN program, President Joko Widodo issued Presidential Instruction (Inpres) no. One of 2022 concerning optimizing the implementation of the JKN program which was issued on January 6, 2022 The Minister of ATR/BPN was instructed by the president to guarantee that applicants for registration of transfer of land rights due to a sale and purchase are those who are active participants in the JKN program. The research method in this study is a type of normative legal research. Through the study of literature and other legal materials, the material is then analyzed through legal interpretation both functionally and teleologically and then conclusions will be drawn using the deductive method. The conclusion is that in selling land purchases without including the BPJS Health card, it is still valid based on PP no. 24 of 1997, but as an effort to make the JKN program optimally sustainable, the government also implies the BPJS Health card as a requirement in buying and selling land.
